National Water Act: Establishment of Limpopo-North West Catchment Management Agency (GN. R. 409 of 2014)

ESTABLISHMENT OF THE LIMPOPO-NORTH WEST CATCHMENT MANAGEMENT AGENCY IN TERMS OF SECTION 78(3) OF THE NATIONAL WATER ACT, 1998 (ACT NO. 36 OF 1998) a) I, Bomo Edna Edith Molewa, Minister of Water and Environmental Affairs, hereby, in terms of section 78(3) of the National Water Act, 1998 (Act No 36 of 1998), declare that b) the Limpopo-North West catchment management agency is established; c) that the catchment management agency name is the Limpopo-North West; d) the area of operation of the Limpopo-North West catchment management agency includes the previous Limpopo and Crocodile-West water management areas (WMAs) together Luvuvhu catchment from the previous Luvuvhu-Letaba WMA. The Limpopo-North West CMA is situated in Limpopo and North-West provinces and in Limpopo WMA and includes all properties in respect of which and person is entitled to use water by virtue of entitlements in terms of section 22(1) of the Act from (i) the Limpopo-North West Water Management Area is number 1 as described in the National Water Resource Strategy2 as published on the 16 August 2013 in Government gazette No 36736 Notice no 845 (ii) any other water resources situated outside the area described in paragraph (c)(i) above, which water resources and accompanying area , the Department of Water Affairs or the responsible authority may require the Limpopo Catchment Management Agency to control, e) the business case of the Limpopo-North West Catchment Management Agency has been approved; f) all initial and inherit and delegated functions will be performed in the Limpopo North West CMA. g) water resource management charge will be billed by the Limpopo-North West CMA in accordance with Section 57(2) of the National Water Act. h) Section 90(1)(c) of the National Water Act empowers the Minister of Water and Environmental Affairs to make regulations determining the basis and extent of remuneration and payment of expenses of members of the governing Board of STAATSKOERANT, 23 MEI 2014 No. 37674 3 This gazette is also available free online at www.gpwonline.co.za GOVERNMENT NOTICE DEPARTMENT OF WATER AFFAIRS No. 409 23 May 2014 Catchment Management Agencies.
