No. 09 (06-7-2004) OFFICIAL GAZEl TE TtfE GOVERNMENT DECREE No. 139/2004/NO-CfJ <:>f June 25, 2004 ofi sanctioning of administrative violations in the domain of forest management, forest protection and forest~ product management This Decree prescribes sanctions against individualsa~?Qrganizations, Vietnamese and foreign. as well, that commit administrative v;,.:,',,,tiolis i;· the Vietnarn<}Se territory by breach,iri9:•the•State's regulations on forest man·age n-il;}:nt) forest protection and torest p rodu9tjn~rir1gem~ nt. ·und~r•the.· Decree, the violators shall be • .: <• • •, ,''v • • subjE:!pt ;to priti¢1pal s£tnCtioning forms (caution and fine otup lo· VN[) 30;000,000) and a number of a.ddiU6hal sanctioning forms such as deprivation of the right to use assorted permit.$; 'ConfiscatiQn of violation material evideric'e$ arid '.means, withdraw~r of business ' ' ' registra tioh 1;:~rlific::ateS .. ' The Decree also specifies violation ac1s, sanctioning· forms and levels, the sanctioning competence, the sanctioning procedures, the application of preventive measures, the sanctioned persons' right to lodge complaints and denunciations and the setltementthereof.. It takes effect 15 da.ys after its publication in the Official Gazette and replaces the Government's Decree No. 77/CP of November 29, 1996 on sanctioning of administrative violations in forest managornent and protection as well as forest-product management and Decree Na.
