DECIDES: Article I.- To prornulg;1te together \Yith this Decision the Regulation on ,,orking relationship bet,,een the Ranger Department and the national parks under the Ministf\ of Agriculture and Rural Dc\·elopment. Article 2.- This Decision takes effect 15 da,s after its signing. Article 3.- The Director of the Ministf\ ·s OITicc. the Director of the Organization and Personnel Department. the Director of the Ranger Department. the heads of the units attached to the Ministf\ and the directors of the national parks under the Ministr> shall hmc to implement this Decision. For the Minister o/Agriculture and Rural Dei•elopment Vice ~1inister NGUYEN VAN DANG THE REGULATION ON WORKING RELATIONSHIP BETWEEN THE RANGER DEPARTMENT AND THE NATIONAL PARKS UNDER THE MI.\fISTRY OF AGRICULTURE AND RURAL DEVELOPMENT (Issued together with Decision No.3-111 YYYIQD BNN/TCCB o/Fehruary 12, JYYY) Chapter I GENERAL PROVISIONS Article 1.- The Director of the Ranger Department is assigned by the Ministry of Agriculture and Rural De\elopmcnt (hereafter referred to as the Ministn) to manage and direct the professional operations of the national parks under the Ministry Article 2.- The professional operations of the national parks under the Ministf\ shall comp!:, \\ith the Regulation on management of special-use forests in Vietnam. the State·s legal documents as \\ell as the in\'estmcnt programs. plans and/or projects alrcad, apprmed b, the competent authorit\(ics) Article 3.- All master plans. plan and projects dram1 up b:, the national parks must. before being submitted to the Ministn ·s leadership for apprm al. be commented b\ functional departments and the Ranger Department in strict accordance,, ith the State management regulations and the Ministn ·s ,rnrking regulation. and not affect the nature presef\ at ion. the prcscn at ion and de, clopmcnt of the countn s biodi\'crsit\. Chapter fl THE TASKS OF THE RANGER DEPARTMENT Article -I.- The Ranger Department shall be ,lllS\\ ernble to the Minister for managing and dirccti ng the professional ope rat ions or the national parks under the Ministn (according to Decision No.2%8/NN TCCB/QD orNmcmbcr 15. 1997) Article 5.- The forest management and protection: I- Monitoring and directing the prc,cntion and combat against the forest fires and the prc\'ention and elimination of forest pests and plagues in the national parks: 2- Monitoring changes in the forest resources. the use of forest land and the settlement or disputes mer forest land according to l;m: ~- Guiding and directing the propaganda. education and mobili1ation of the people to participate in the protection and de, clopmcnt of forest resources. and building the people ·s forces for the protect ion of forests in the national parks: 1-- Compiling forest management and protection documents for guiding and fostering the ranger force as \\Cll as the mass to participate in the forest protection. Article 6.- The legal enforcement and inspection: 1- Coordinating ,, i th the concerned agencies in elaborating. amending and/or supplementing legal 12 OFFICIAL GAZETTE No. 15 (22--1--1999) documents on forest management and protection related to the national parks. and submitting them to the Ministry for decision or further submission to the Government: 2- Directing the enforcement of the legislation on forest management and protection and nature prcserYation in the national parks: 3- Coordinating with the Ministry·s Inspectorate and the l;m enforcement bodies in settling complaints and denunciations about the forest management and protection by the national parks as prescribed by law: 1-- Guiding the ranger stations of the national parks in imposing administrati,c sanctions and conducting penal inYestigations against acts of ,iolating the legislation on forest management and protection within the national parks. Article 7.- The nature presen·ation and c11Yironmental protection: 1- Monitoring. guiding, reyiewing and directing the acti,itics of nature and biodiversity prcscf\"ation. as \\'ell as ecological tourism. the management and rational use of natural resources (including wild plants and animals) according to the economic-technical studies or i1l\'cstmcnt projects already apprm·cd by the competent authority(ics) (including foreign invested projects): 2- Coordinating with the relc,ant departments and sections of the Ministry in arranging and organi,.-:ing the training and fostering of officials and employees Chapter III THE TASKS OF THE.NATIONAL PARKS Article H.- The directors of the national parks shall be answerable to the Director of the Ranger Department for all professional operations of the national parks. Article 9.- The directors of the national parks shall coordinate with the local administrations ( especially in buffer zones) in stabilizing the population·s settlement. and intensifying the sedcntarization in order to impro,c the living conditions of the local people. mobilize and encourage them to participate in the protection of natural resources of the national parks. Article JO.- When working out annual working programs and plans and concluding projects. the directors of the national parks shall ha\'c to consult with the Ranger Department before submitting them to the Ministry for approval. Article 11.- The directors of the national parks shall direct the national parks· ranger stations in well performing the forest management and protection tasks. and at the same time closely coordinate "ith the ranger authorities in the localities in order to ,\ell perform the management and protection of the national parks· forests. Article 12.- Reporting regime: I- Monthly. the ranger stations of the national parks shall ha,e to submit to the Ranger Department reports made according to the prescribed contents and form as for the ranger sub-departments: 2- Once c,cry six months. the directors of the national parks shall submit reports to the Ranger Department on professional operations of the national parks, so that the latter can make a sum-up and dnm directing experience therefrom. then report them to the Ministry: 3- Computer networks linking the national parks with the Ranger Department and the Ministry of Agriculture and Rural De\'elopmcnt shall be set up in order to promptly send reports on extraordinary matters concerning the domain of forest management and protection as well as incidents affecting the national parks. so that the Ranger Department can support the handling of such matters or incidents. or report them to the Ministry for handling. and at the same time through such computer networks. the Ranger Department can provide documents on State management and professional operations, and exchange information related to the national parks. Chapter IV A NUMBER OF PROVISIONS CONCERNING THE DEPARTMENTS AND SECTIONS OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT Article 13.- Annually. the Ranger Department shall coordinate with the national parks in organizing a conference on professional operations and help the Ministry organize conferences on the national parks· operations with the participation of the rclc\'ant departments and sections to revie,v works and discuss the orientation and tasks for the years to come. Article 1-1.- The Ranger Department shall No. 15 (22--t-1999) OFFICIAL GAZETTE coordinate v,ith the relevant departments and sections in organizing seminars to exchange experiences and discuss measures to effectively carry out the acti,ities related to the domain of nature preseryation and important international projects of the national parks. Chapter V FINAL PROVISIONS Article 15.- Annually. the Director of the Ranger Department and the directors of the national parks shall organize the review of implementation of the Regulation. and when necessary. propose the Ministry to amend and/or supplement the Regulation to make it suitable to the requirements and tasks of the State management and sustainable development of the special-use forests and national parks.
