Issue nos 01-03/October 2014 OFFICIAL GAZETTE 19 THE PRIME MINISTER THE SOCIALIST REPUBLIC OF VIETNAM Independence - Freedom - Happiness No.1696/QD-TTg Hanoi, September 23, 2014 DECISION On a number of measures to treat ashes, slag and gypsum from thermal power plants and chemical and fertilizer factories for use as raw materials for production of construction materials(*) THE PRIME MINISTER Pursuant to the December 25, 2001 Law on Organization of the Government,· Pursuant to the Government's Decree No. 124/2007/ND-CP of July 31, 2007, on management of construction materials; At the proposal of the Minister of Construction, DECIDES: Article 1. To provide a number of measures to treat ashes, slag and gypsum from the1mal power plants and chemical and fe1tilizer factories for use as raw materials for production of constm ction materials, with the following principal contents: 1. Targets To treat ashes, slag and gypsum from the1mal power plants and chemical and fe1t ilizer factories up to standards and technical regulations for use as raw materials for production of constm ction materials, aiming to mitigate environmental pollution and reduce land areas used as waste landfills, contributing to saving natural resources used for production of construction materials and ensuring sustainable development; To dete1mine a roadmap for the1mal power plants and chemical and fe1t ilizer factories to complete the installment of equipment for treatment of ashes, slag and gypsum up to standards and technical regulations for use as raw materials for production of construction materials; To increase the volume of domestically available gypsum for use as raw materials for production of construction materials so as to gradually reduce and eventually limit gypsum impo1t. To f01m a market of treated ashes, slag and gypsum for use as raw materials for production of construction materials. 2. Implementation roadmap The1mal power plants and chemical and fe1t ilizer factories that are operating or have f*J Cong Bao Nos 895-896 (04/10/2014) ©Vietnam Law and Legal Fomm 20 OFFICIAL GAZETTE Issue nos 01-03/October 2014 obtained investment decisions must have plans on investment ( or investment cooperation) in technological lines and equipment for treatment of ashes, slag and gypsum up to standards and technical regulations for use as raw materials for production of constrnction materials, which must be completed for operation commencement before 2020; fu order to get project approval, a newly established, expanded or renovated thennal power plant or chemical and fe1tilizer facto1y must have a design of complete technological line and equipment for treatment of ashes, slag and gypsum treatment up to standards and technical regulations for production of construction materials; By 2020, the1mal power plants and chemical and fe1tilizer factories will be allocated land for use as waste landfills with the maximum capacity of two years' production based on their projects' scale and capacity; 3. Implementation solutions To add the provision that basic designs of investment projects to construct the1mal power plants and chemical and fe1tilizer factories must have the process of ash, slag and gypsum treatment and plans on ash, slag and gypsum recove1y; to add the criterion of ash, slag and gypsum ti·eatment for the1mal power plants and chemical and fe1tilizer factories in the contents of project appraisal; to review and add the provision on size and use duration of landfills for ashes, slag and gypsum; To dete1mine redundant landfill areas after investment in technological lines and equipment for ash, slag and gypsum treatment for conversion of land use purposes; Domestically manufactured mechanical products for technological lines and equipment for ash, slag and gypsum ti·eatment may be considered for addition to the list of key mechanical products under the Prime Minister 's Decision No. 10/2009/QD-TTg of Janua1y 16, 2009, and the pilot mechanism for domestic design and manufacture of equipment of the1mal power plants during 2012-2025 under the Prime Minister's Decision No. 1791/QD-TTg of November 29, 2012; The treatment of ashes, slag and gypsum and use of :finished products for production of construction materials are entitled to suppo1ts and incentives provided for the ti·eatment of solid wastes (recycling, reuse) under cmTent regulations on management of solid wastes; The1mal power plant and chemical and feitilizer facto1y project owners shall pay expenses for ash, slag and gypsum treatment if failing to invest in technological lines and equipment for treatment thereof for use as raw materials for production of construction materials; To promote research for renewal of science and technology for ash, slag and gypsum treatment at the1mal power plants and chemical and fe1tilizer factories; To encourage other industrial establishments which generate ashes, slag and gypsum to ti·eat these wastes under this Decision. Article 2. Organization of implementation 1. The Ministiy of Construction shall: © Vietnam Law and Legal F ornm Issue nos 01-03/October 2014 OFFICIAL GAZETTE 21 Disseminate this Decision for implementation and annually report the use of ashes, slag and gypsum as raw materials for production of constmction materials to the Prime Minister; Assume the prime responsibility for, and coordinate with the Ministiy of Science and Technology and related agencies in, promulgating in 2015 national standards and technical regulations on use of ashes, slag and gypsum from thennal power plants and chemical and fe1tilizer factories as raw materials for production of consfluction materials; Organize scientific researches on production of materials using ashes, slag and gypsum from the1mal power plants and cheinical and fe1tilizer factories; identify potential ash, slag and gypsum sources for treaflnent at different times to plan reasonable and effective use. 2. The Ministry of Industry and Trade shall: Assume the prime responsibility for, and coordinate with the Ministry of Construction and related agencies in, organizing, supervising and inspecting the implementation of this Decision, and periodically or extraordinarily repo1t it to the Prime Minister; Study, amend and supplement the provision that basic designs of invesflnent projects to construct the1mal power plants and chemical and fe1tilizer factories must have the process of ash, slag and gypsum treaflnent and plans on ash, slag and gypsum recove1y; add the criterion on freatment of ashes, slag and gypsum at the1mal power plants and chemical and fe1tilizer factories in the contents of project appraisal; and review and add provisions on size and use duration ofland areas as landfills for ashes, slag and gypsum in 2015; Direct the1mal power plant and cheinical and fe1tilizer facto1y project owners in implementing this Decision; Consider and subinit to the Prime Minister domestically manufactured mechanical products for technological lines and equipment for ash, slag and gypsum tr·eatment for addition to the list of key mechanical products under the Prime Minister's Decision No. 10/2009/QD TTg of Janua1y 16, 2009, and the pilot mechanism for domestic design and manufacture of equipment of the1mal power plants during 2012-2015 under the Prime Minister 's Decision No. 1791/QD-TTg of November 29, 2012. 3. The Ministry of Natural Resources and Environment shall: Assume the prime responsibility for, and coordinate with the Ministry of Industry and Trade and the Ministiy of Construction in, studying and approving, or subinitting to competent authorities for approval, the roadmap to gradually reduce and eventually limit the impo1t of gypsum and stop the impo1t of ashes and slag for use as raw materials for production of construction materials; Assume the prime responsibility for, and coordinate with the Ministry of Industry and Trade in, reviewing and adding regulations on management of wastes from the1mal power plants and cheinical and fe1tilizer factories. 4. The Ministry of Science and Technology shall: Organize the appraisal of standards and technical regulations on use of ashes, slag and ©Vietnam Law and Legal Fomm 22 OFFICIAL GAZETTE Issue nos 01-03/October 2014 gypsmn for production of construction materials and announce national standards according to regulations; Assist national-level scientific and technological research tasks on treatment and use of ashes, slag and gypsmn from the1mal power plants and chemical and fertilizer factories for use as raw materials for production of constrnction materials. 5. The Ministry of Planning and Investment shall: Assume the prime responsibility for, and coordinate with related ministries and sectors in, studying policies to encourage the use of domestically manufactured products in technological lines and equipment for ash, slag and gypsmn treatment. 6. The Ministry of Finance shall: Guide the implementation of policies on suppoits and incentives for treatment of ashes, slag and gypsmn from the1mal power plants and chemical and fe1i ilizer factories and use of :finished products for production of construction materials. 7. The Ministry of Transpo1i and Ministry of Agriculture and Rural Development shall: Coordinate with the Ministry of Construction in fo1mulating plans on use of ashes, slag and gypsmn in construction of transpo1i works, dikes, dams, hydropower plants, inigation works and other works. 8. Provincial-level People Committees shall: Coordinate with related ministr·ies and sectors in implementing this Decision in their localities; Guide the conversion of use pmposes of land areas used as landfills in excess of the prescribed standards; Intensify the communication among and encourage establishments producing constrnction materials in their localities to use ashes, slag and gypsum as constrnction materials; Annually repo1i to the Ministry of Construction, Ministry of Industry and Trade and Ministry of Natural Resources and Environment on the implementation of this Decision in their localities. Article 3. This Decision takes effect on the date of its signing. Ministers, heads of ministerial-level agencies , heads of government-attached agencies, chairpersons of provincial-level People Committees, chairpersons of Members' Councils and general directors of state economic groups and c01porations shall implement this Decision.
