Circular No. 02/1999/TT-BM guiding the re-exportation of log timber with a lawful import origin from Cambodia

No. 8 (28-2-1999) OFFICIAL GAZETTE 35 CIRCULAR No.02/1999/TT-BTM OF JANUARY 12, 1999 GUIDING THE RE EXPORT OF LOG TIMBER WITH LAWFUL IMPORT ORIGIN FROM CAMBODIA Pursuant to the Government's Document No.02/ CP-KTTH of January 13, 1998 on the import of Cambodian timber and Document No.1455/CP-KTTH of December IO, 1998 on the re-export of log timber with lawful import origin from Cambodia; The Ministry of Trade ,guides the re-export of log timber with lawful import origin from Cambodia as follows: I. GENERAL PROVISIONS: l. All enterprises that hold business registration certificates with appropriate goods lines, have already registered export/import enterprises· code numbers and have log timber lawfully imported from Cambodia shall be entitled to file applications for re-export thereof according to this Circular's provisions. 2. Log timber mentioned in this Circular includes all kinds of log timber exploited from natural and planted forests with lawful import origin from Cambodia. II. DOSSIERS OF APPLICATION FOR RE-EXPORT: 1. For cases where the enterprise applying for re export is also the one that has imported log timber: The enterprise's written request, which states the quantity and category of timber to be re-exported, the present timber rallying place and the intended border-gate for re-export. The copy of the import customs declaration already liquidated ( enclosed with the original for comparison and back subtraction. Such original shall be returned to the enterprise). The copy of the business registration certificate and the certificate of registration of export/import enterprise's code number. The document of the ranger sub-department of the locality where the enterprise rallies timber, certi(ving the quantity and category of the timber with la\vful import origin from Cambodia (with Cambodia's hammer stamp). The re-export contract. 2. For cases where the re-exporting enterprise is not the one that has imported log timber: In addition to the dossiers prescribed in Point l above, the concerned enterprise shall have to produce the original of the sale/purchase contract signed with the importing enterprise. III. IMPLEMENTATION PROVISIONS: The export of sawn timber and wood products made from timber with la,.,,fuJ import origin from Cambodia shall comply with Decision No.65/1998/ QD-TTg of March 24, 1998 of the Prime Minister on the export ofv.:ood and forest products and import of wood materials and forest products and Decision No.136/l 998/QD-TTg of July 3 L 1998 of the Prime Minister on the amendments to a number of regulations on the procedures for export of wood and forest products.
