These regulations may be cited as the Business Licenses Regulations 2006. 2. In these regulations, unless the context otherwise requires "Act" means the Business Licences Act 2002; and "Application" means an application for a Business Licence made under section 7 of the Act and "applicant" shall have a corresponding meaning. 3. (1) An application for a business licence shall be (a) made in the form prescribed in Form 1; and (b) accompanied with the correct application fee prescribed in Schedule 1. (2) The application shall be provided to the Business Licensing Officer, either in person or by post. (3) Where an application is considered by the Business Licensing Officer to be incomplete, he shall advise the applicant in writing to provide the necessary information. (4) Where an application is considered by the Business Licensing Officer to be complete, the applicant shall be issued with a receipt indicating the date of receipt. 4. (1) An application shall be made for each business activity listed in Schedule 2. (2) Where a person engages in more than one business activity, a business licence shall be obtained for each business activity. (3) The Business Licensing Officer may (a) accept an application containing more than one related business activity; 4 Short title Interpretations Application for Business Licence Application per business activity TONGA GOVERNMENT GAZETTE SUPPLEMENT EXTRAORDINARY No. 2 Tuesday 27th March 2007 (2) Where the Business Licensing Officer receives a notice under sub regulation (1) that the Business Licence Register contains information that is no longer correct, the Business Licensing Officer shall amend the Business Licence Register within 7 working days of receiving the notice. (3) Where the Business Licensing Officer receives a notice under sub regulation (1) that the Business Licence issued contains information that is no longer correct, the Business Licensing Officer shall issue the licensee with an amended Business Licence upon application and payment of the fee prescribed in Schedule 1. (4) Where the Business Licensing Officer amends the Business Licence Register, he shall within 7 working days of the amendment give notice in writing to the licensee. 14. (1) Where a licensee fails to inform the Business Licensing Officer when required under regulation 13(1), the Business Licensing Officer may impose a penalty of $100. (2) Where the Business Licensing Officer imposes a penalty under sub regulation (1), the Business Licensing Officer shall advise the licensee in writing. Made at Nuku‘alofa this 23 March, 2007. Hon. Penalties 7 (b) issue one licence that covers more than one related business activity; (c) impose conditions on a licence issued for a business activity specified in Schedule 2; and (d) waive any requirement for an application in respect of an activity that is not carried out by a business person in the course of trade, industry or commerc e 5. (1) Where an application is received pursuant to section 8 of the Act, the Business Licensing Officer shall within 7 working d ays either issue the applicant with a Business Licence or advise the applicant in writing of the grounds for refusing the application. (2) A business licence issued shall be in the form prescribed in Form 2. (3) Where an application is refused on grounds set out in section 5 of the Business Licences Act 2002, the application fee shall not be refundable. 6. (1) The application may be withdrawn by written application to the Business Licensing Officer and signed by the application. (2) The application fee shall not be refunded where the application is withdrawn. 7. A business licence for importing may be issued according to section 9 of the Act subject to conditions prescribed in Schedule 3 of these Regulations. 8. (1) A business licence renewal application shall be – (a) made in the form prescribed in Form 3; and (b) accompanied with the correct business licence renewal application fee as prescribed in Schedule 1. (2) The requirements of regulation 3(2) and regulation 3(3) shall apply to a renewal application. (3) Where a renewal application satisfies the requirements of sub regulation (1) and sub-regulation (2), the Business Licensing Officer shall within 7 working days of receiving the application issue the applicant with a renewed Business Licence. (4) Where conditions are endorsed on the Business Licence, the Business Licensing Officer shall issue a renewed Business Licence upon being satisfied that the conditions are being complied with. 9. (1) The Business Licensing Officer shall establish and maintain a Business Licence Register in a form approved by the Business Licensing Officer. (2) The Business Licence Register shall contain the following information – Withdrawal of Application Licence Conditions Renewal of Business Licence Business Licence Register 5 Issue or refusal of Business Licence (a) business name; (b) licence number; (c) business activity; (d) address of place of business; (e) taxpayer identification number; (f) date of issue; (g) expiry date; and (h) any conditions endorsed on the Business Licence. (3) The Business Licence Register shall be available for inspection or copying of entries by the public during normal business hours upon payment of the fees prescribed in Schedule 1. (4) Where a Business Licence is cancelled, the Business Licence Register shall contain details of the cancellation. 10. Where the Business Licensing Officer cancels a Business Licence he shall – (a) notify the licensee in writing of the reason for the cancellation; and (b) inform the licensee of his right of appeal. 11. (1) An appeal shall, be made in writing to the Minister within 14 working days from the date the licensee is given notice of the cancellation. (2) The appeal shall set out the grounds of appeal. (3) The Minister shall, within 28 working days of receiving the appeal, consider all relevant information made by the licensee and decide the appeal. (4) The Minister shall within 3 working days of the date of deciding the appeal, advise the licensee in writing of his decision. 12. Where the Business Licensing Officer cancels a Business Licence, the cancellation shall not come into effect until in the case of the holder a license who – (a) does not exercise a right of appeal within 14 working days as specified under regulation 11(1); or (b) exercises a right of appeal within the time prescribed under regulation 11(3), from the date when the decision was made. 13.
