Notification of Department of Agriculture Re : Criteria, procedures and conditions for the importation or bringing in transit of prohibited, restricted and unprohibited articles B.E. 2551 By virtue of the provisions of Section 5 hecta, Section 8, Section 9, Section 10 and Section 11 of the Plant Quarantine Act B.E. 2007, amended by the Plant Quarantine Act (No. 2) B.E. 2542 and the Plant Quarantine Act (No. 3) B.E. 2551 with particular provisions that may restrict the right and freedom of any person in which Section 29 together with Section 32, Section 33, Section 41 and Section 43 of the Constitution of the Kingdom of Thailand permits by virtue of the law. The Director-General of the Department of Agriculture through the recommendation of the Plant Quarantine Committee, hereby announces as follows. Item 1 Applications for permit, permits, declarations for import or bringing in transit, tags affixed on package containing prohibited, restricted and unprohibited articles as described in Part 1 to 5 shall be in accordance with format forms attached to this notification. Part 1 Importation of prohibited articles for research purpose Item 2 Any person who would like to import prohibited articles for research purpose shall submit an application for permit to import those prohibited articles to the Director General at Office of Agricultural Regulation or Plant Quarantine Sation or submit it through mail to Office of Agricultural Regulation, Department of Agriculture, 50 Paholyothin Road, Lardyao Sub-district, Chatuchak District, Bangkok 10900. Item 3 The importation of prohibited articles must be subjected to the following rules: (1) The importation must be made only through a designated plant quarantine station and must be accompanied with a permit to import prohibited articles as well as a phytosanitary certificate or a certificate from the authorized agency of the exporting country in case where prohibited articles imported are plant pests or carriers which are not plants. The said phytosanitary certificate or certificate must indicate the following information. 2 (a) In case of the importation of prohibited articles which are plants or carriers, the phytosanitary certification must indicate pest-free status, disinfestation/disinfection or percentage of allowable tolerance level of plant pests to fulfill all requirements stipulated by the Director General. (b) In case of the importation of prohibited articles which are plant pests, the certificate must indicate that the pests are the same identity as those indicate in the import permit. (2) The container of prohibited articles must be strong and must be able to prevent the prohibited articles from contaminating during transportation. (3) The container must be affixed with tag and must be addressed to the Director-General or Chief of Plant Quarantine Station where the prohibited articles are entered and other information is not allowed to write on the container of prohibited articles. (4) The prohibited articles must be imported through only the following plant quarantine stations. (a) Bangkok Seaport Plant Quarantine Station, (b) Suvarnabhumi International Airport Plant Quarantine Station, (c) Bangkok Post Office Plant Quarantine Station. (5) Upon arrival of prohibited articles at the designated plant quarantine station in (4), the person who holds import permit or authorized representative must declare and hand over prohibited articles to the plant quarantine official no matter how the permit holder brings prohibited articles by himself or other means. (6) After the plant quarantine official receives prohibited articles and verify whether or not the importation of prohibited articles is completely conformed to the rules specified in (1) to (5), the plant quarantine official at port of entry must send prohibited articles to be held at post-entry quarantine station for detailed diagnosis of plant pests. The importer must be responsible for all expenses incurred from such diagnosis. The importation of prohibited article which is genetically modified plant must comply with criteria, procedures, and conditions stipulated by the Director-General. Item 4 The Director-General shall consider revoking import permit or specify additional conditions in case where any person who has already been granted a permit to import prohibited articles, however, if it appears that serious plant pests are severely outbreak or there is a reasonable ground to believe that there is severely outbreak of serious plant pests in country of origin of prohibited articles to be brought or in case where it appears that the person who holds import permit does not comply with specified conditions during conducting the research. 3 Item 5 The person who holds import permit must report research results to the Director- General after the research is complete. Item 6 Prohibited articles or produces derived from those prohibited articles must be subjected to the following conditions; (1) They must be destroyed under the supervision of the plant quarantine official. or (2) They must be appropriately managed according to the procedures approved by the Director-General. Item 7 All expenses of the plant quarantine official incurred during supervision of research must be borne by person who holds import permit. Part 2 Importation of prohibited articles for commercial purpose Item 8 Prohibited articles imported for commercial purpose must be subjected to pest risk analysis according to criteria, procedures and conditions stipulated by the Director General. Item 9 Any person who would like to import prohibited articles for commercial purpose shall submit an application for import permit to the Director-General at Office of Agricultural Regulation or Plant Quarantine Station or submit it through mail to Office of Agricultural Regulation, Department of Agriculture, 50 Paholyothin Road, Lardyao Sub district, Chatuchak District, Bangkok 10900. Item 10 The importation of prohibited articles for commercial purpose must be subjected to the following rules. (1) The consignment of prohibited articles must be imported only through a plant quarantine station and must also be accompanied with an import permit as well as a phytosanitary certificate issued by the authorized agency of the exporting country. The phytosanitary certification must indicate detailed information according to the requirements for permitting importation of those prohibited articles for commercial purpose. (2) Upon an arrival of the consignment at plant quarantine station, the person who holds import permit or authorized representative must declare the import to the plant quarantine official. In case where the person who holds import permit would like to re-export consignment of prohibited articles to other countries, he must inform to the plant quarantine official about re-export of this consignment. 4 (3) After the plant quarantine official is declared according to (1) and (2), the plant quarantine official at port of entry shall verify all documents and prohibited articles in accordance with requirements specified in the import permit. (4) After the plant quarantine official finishes all verification in (3), the consignment of prohibited articles shall be granted clearance to import. (5) While the plant quarantine official carries out plant pest diagnosis for import clearance, the plant quarantine official has the authority to seize or hold prohibited articles at plant quarantine station or post-entry quarantine station or other places determined by the plant quarantine official. If plant pests are detected, the plant quarantine official shall order the owner of consignment to carry out pest disinfestation/disinfection. In case where there is no available effective treatment, the consignment of prohibited articles must be destroyed or sent out of the Kingdom. Part 3 Importation of prohibited articles for other purposes Item 11 Prohibited articles imported for other purposes must be subjected to pest risk analysis in accordance with criteria, procedures and conditions stipulated by the Director General. Item 12 Any person who would like to import prohibited articles for other purposes such as analysis of quality or characteristic in laboratory shall submit an application for import permit to the Director-General at Office of Agricultural Regulation or Plant Quarantine Station or submit it through mail to Office of Agricultural Regulation, Department of Agriculture, 50 Paholyothin Road, Lardyao Sub-district, Chatuchak District, Bangkok 10900. Item 13 The importation of prohibited articles for other purposes must be made only through a plant quarantine station and must be accompanied with a permit to import prohibited articles as well as a phytosanitary certificate. Provisions of Items 10 (2), (3), (4) and (5) shall be applied mutatis mutandis for consideration in granting import clearance of prohibited articles for other purposes. Part 4 Bringing in transit of prohibited articles Item 14 Any person who would like to bring in transit of prohibited articles shall submit an application for permit to bring in transit of prohibited articles to the Director-General at Office of Agricultural Regulation or Plant Quarantine Station or submit it through mail to 5 Office of Agricultural Regulation, Department of Agriculture, 50 Paholyothin Road, Lardyao Sub-district, Chatuchak District, Bangkok 10900. Item 15 Bringing in transit of prohibited articles must be subjected to the following rules. (1) They must be subjected to pest risk analysis in accordance with criteria, procedures and conditions stipulated by the Director-General. (2) They must be transited through the plant quarantine station and must be accompanied with the permit to bring in transit of prohibited articles as well as the phytosanitary certificate. (3) The container of prohibited articles must be affixed with tag. (4) Bringing in transit of prohibited articles, no matter it is plant, carrier or plant pest, must be completely complied with all the conditions stipulated by the Director General. (5) Upon arrival of the consignment for transit at the first entry point of plant quarantine station, the person who holds permit or authorized representative must declare in transit consignment to the plant quarantine official at the said plant quarantine station. Subsequently, after completion of all verifications, the plant quarantine official shall make a statement of import clearance on the bottom part of declaration form for bringing in transit so that the permit holder or representative can present the document to the plant quarantine official at the last plant quarantine station to transit the consignment out of the Kingdom. Item 16 Permits to import prohibited articles for research, commercial and other purposes and a permit to bring in transit of prohibited articles can be used for one species of plant from one origin. Part 5 Importation and bringing in transit of restricted and unprohibited articles Item 17 The importation or bringing in transit of restricted articles must be subjected to the following rules. (1) The consignment of restricted articles must be imported or brought in transit through a plant quarantine station and must be accompanied with a phytosanitary certificate issued by the authorized agency of the exporting country. The phytosanitary certificate must indicate pest-free status, disinfestation/disinfection or percentage of allowable tolerance level of plant pests to fulfill all requirements stipulated by the Director General. (2) Upon arrival of the consignment at plant quarantine station, the importer or owner must declare it to plant quarantine official no matter how the importer or owner brings it by himself or other means. 6 In case where the importer would like to re-export the consignment of restricted articles to other countries, he must inform to the plant quarantine official about re export of this consignment. (3) After the plant quarantine official is declared according to (1) and (2), the plant quarantine official at port of entry shall verify all documents and restricted articles in accordance with specified requirements. (4) After the plant quarantine official finishes all verifications in (3), the consignment of restricted articles shall be granted clearance to import. (5) While the plant quarantine official carries out plant pest diagnosis for import clearance, the plant quarantine official has the authority to seize or hold restricted and unprohibited articles at plant quarantine station or post-entry quarantine station or other places determined by the plant quarantine official. If plant pest is detected, the plant quarantine official shall order the owner of consignment to carry out pest disinfestation/disinfection. In case where there is no available effective treatment, the consignments of restricted and unprohibited articles must be destroyed or sent out of the Kingdom. Item 18 Bringing in transit of restricted articles: Upon arrival of the consignment for transit at the first entry point of plant quarantine station, the owner or authorized representative must declare in transit consignment to the plant quarantine official at the said plant quarantine station. Subsequently, after completion of all verifications, the plant quarantine official shall make a statement of import clearance on the bottom part of declaration form for bringing in transit so that the owner or representative can present the document to the plant quarantine official at the last plant quarantine station to transit the consignment out of the Kingdom. Item 19 Any person who imports or brings in transit of unprohibited articles must provide a phytosanitary certificate and declare the import or bringing in transit to the plant quarantine official. Provisions of Item 17 shall be applied mutatis mutandis for import or bring in transit of unprohibited articles. Transitory provisions Item 20 Permits, tags permitting the import or bringing in transit, permits to move plant from plant quarantine station, post-entry quarantine station or conveyance or actions that have already been issued or administered in accordance with the Ministerial Regulation No. 2 (B.E. 2507) which was issued under provisions in the Plant Quarantine Act B.E. 2507, prior to or on the effective date of this notification, shall remain valid and shall be the permits, tags 7 accompany with the import or bringing in transit, permit to move plant from plant quarantine station, post-entry quarantine station or conveyance or actions issued or administered in accordance with this notification. Item 21 Applications for permit or declaration which have already be submitted or undertaken in accordance with the Ministerial Regulation No. 2 (B.E. 2507) which was issued under provisions in the Plant Quarantine Act B.E. 2507, prior to or on the effective date of this notification, shall be the applications for permit or declaration submitted or undertaken under this notification. This notification shall enter into force a days after the date of its proclamation in the Royal Gazette, and shall remain valid henforce.
