Ministerial Regulation Prescribing Qualifications of a Land Excavation Supervisor under the Act on Land Excavation and Fill, B.E. 2546 (2003). By virtue of provisions of Section 10 and Section 17 (6) of the Land Excavation and Fill Act B.E. 2543 (2000), which is an Act containing certain provisions in relation to the restriction of rights and liberties of a person, in respect of which Section 29 in conjunction with Section 35, Section 48 and Section 50 of the Constitution of the Kingdom of Thailand so permit by virtue of provisions of law, the Minister of Interior, by the advice of the Land Excavation and Fill Committee, hereby issues the Ministerial Regulation as follows. A person with a regulated engineering professional license in the field of civil engineering under the law on engineers shall be a supervisor of land excavation with the depth exceeding 3 meters from the ground level, or with the area at the top of the soil pit exceeding 10,000 square meters, or with the depth or area as prescribed by notification of the local officer. Given on the 26th Day of February B.E. 2546 Pramuan Ruchanaseree Deputy Minister, for Minister of Interior Remark: The grounds for promulgation of this Ministerial Regulation are: Whereas section 17 (6) of the Land Excavation and Fill B.E. 2543 (2000) prescribes that any person intending to carry out land excavation with the depth exceeding three meters from the ground level, or with the area at the top of the soil pit exceeding ten thousand square meters, or with the depth or area as prescribed by notification of the local officer, shall notify the local officer in the form prescribed by the local officer, with respect to which the name of the supervisor with the qualifications prescribed by Ministerial Regulation shall be notified, it is thus expedient to prescribe qualifications of such land excavation supervisor.
