Regulation on quantities of agricultural seed and propagating material and form of application for the authorization of marketing or for the issue of the special import permit

Na podlagi 4.a člena, tretjega odstavka 14.a člena, četrtega odstavka 18. člena, drugega odstavka 32. člena in šestega odstavka 33. člena Zakona o semenskem materialu kmetijskih rastlin (Uradni list RS, št. 25/05 – uradno prečiščeno besedilo) izdaja ministrica za kmetijstvo, gozdarstvo in prehrano Pursuant to Article 4a, paragraph three of Article 14a, paragraph four of Article 18, paragraph two of Article 32 and paragraph six of Article 33 of the Agricultural Seeds and Propagating Material Act (Official Gazette of the Republic of Slovenia [Uradni list RS], No. 25/05 – Official Consolidated Text), the Minister of Agriculture, Forestry and Food issues the following P R A V I L N I K R U L E S o količinah semenskega materiala kmetijskih rastlin in obrazcu zahteve za dovolitev trženja oziroma za izdajo posebnega uvoznega dovoljenja on the quantities of agricultural seeds and propagating material and the application forms for permission for marketing and for special import permits 1. člen Article 1 Ta pravilnik določa največjo letno količino semenskega materiala kmetijskih rastlin z namenom trženja končnemu potrošniku; največjo dovoljeno količino semenskega materiala, ki se šteje za vzorec za uradna preizkušanja in inšpekcijske namene; največjo dovoljeno količino semenskega materiala, ki se sme tržiti za znanstvene namene, za poskuse in testiranja, za selekcijo oziroma za ohranjanje genske raznolikosti; največjo količino semenskega materiala kmetijskih rastlin, ki se lahko uvozi za osebno uporabo; obrazec zahteve za dovolitev trženja semenskega materiala sorte, ki je v postopku vpisa v sortno listo in obrazec zahteve za izdajo posebnega uvoznega dovoljenja. These Rules lay down the maximum annual quantity of agricultural seeds and propagating material intended for marketing to the final consumer; the maximum permitted quantity of seeds and propagating material that is considered a sample for official examination and inspection purposes; the maximum permitted quantity of seeds and propagating material that is permitted to be marketed for scientific purposes, for experiments and tests, selection or preservation of genetic diversity; the maximum quantity of seeds and propagating material that may be imported for personal use; the application form for authorising the marketing of seeds and propagating material of varieties that are subject to the procedure for entry in the national variety list; and the application form for a special import permit. 2. člen Article 2 (1) Z namenom trženja končnemu potrošniku se lahko trži semenski material sort kmetijskih rastlin, razen krompirja, ki ne izpolnjuje vseh predpisanih zahtev glede homogenosti partije, pakiranja, zapiranja in označevanja, do največje letne količine, navedene v stolpcu 3 iz priloge 1, ki je sestavni del tega pravilnika. (1) For the purpose of marketing to the final consumer, seeds and propagating material of varieties of agricultural plants, other than potatoes, that do not meet all the prescribed requirements as to the homogeneity of the lot, packaging, sealing and labelling, may be marketed up to the maximum annual quantity indicated in column 3 of Annex 1, which is an integral part of these Rules. (2) Pakiranja semenskega materiala sort kmetijskih rastlin iz prejšnjega odstavka morajo biti zaprta tako, da je onemogočeno njihovo odpiranje brez poškodbe sistema zapiranja ali poškodbe na etiketi ali na pakiranju. (2) Packages of seeds and propagating material of varieties of agricultural plants referred to in the preceding paragraph shall be sealed in such a manner that they cannot be opened without damaging the sealing system or leaving evidence of tampering on the label or packaging. (3) Na pakiranju oziroma etiketi semenskega materiala sort kmetijskih rastlin iz prvega odstavka tega člena morajo bit navedeni vsaj naslednji podatki: o dobavitelju, vrsti rastline, sorti, kategoriji, številki partije, letu zapiranja, masi pakiranja in tretiranju semena. Navedeno mora biti tudi, da je trženje dovoljeno samo na območju Republike Slovenije. (3) Packaging or labels of the seeds and propagating material of varieties of agricultural plants referred to in paragraph one of this Article shall provide at least the following information: on the supplier; plant species; variety; category; lot number; year of sealing; packaging weight; and treatment of the seed. It must also be indicated that marketing is permitted only within the territory of the Republic of Slovenia. 3. člen Article 3 (1) Največja količina semenskega materiala sort kmetijskih rastlin, ki se šteje za vzorec za uradno preizkušanje sorte ali za inšpekcijski nadzor (v nadaljnjem besedilu: vzorec semenskega materiala) je navedena v stolpcu 4 iz priloge 1. Dobava vzorca semenskega materiala se ne šteje za trženje in pri uvozu ni potreben inšpekcijski pregled. (1) The maximum quantity of seeds and propagating material of varieties of agricultural plants that is considered a sample for official examination of varieties or inspection control (hereinafter referred to as: sample of seeds and propagating material) is indicated in column 4 of Annex 1. Supply of a sample of seeds and propagating material shall not be considered marketing, and there is no need for inspection control upon import. (2) Vzorec semenskega materiala iz prejšnjega odstavka mora biti označen z navedbo, da gre za vzorec za uradno preizkušanje sort ali za inšpekcijski nadzor. Navedene morajo biti tudi vrsta rastline, sorta in količina semenskega materiala kmetijskih rastlin. (2) A sample of seeds and propagating material referred to in the preceding paragraph shall be indicated as a sample intended for official examination of varieties or inspection control. The following shall also be indicated: plant species, variety and the quantity of seeds and propagating material of agricultural plants. 4. člen Article 4 (1) Največja količina semenskega materiala sort kmetijskih rastlin, ki niso vpisane v sortno listo in se lahko trži za znanstvene namene, za poskuse in testiranja, za selekcijo oziroma za ohranjanje genske raznolikosti, je navedena v stolpcu 5 iz priloge 1. (1) The maximum quantity of seeds and propagating material of varieties of agricultural plants that have not been entered in the national variety list and may be put on the market for scientific purposes, for experiments and tests, selection or preservation of genetic diversity, is indicated in column 5 of Annex 1. (2) Semenski material sort kmetijskih rastlin, ki niso vpisane v sortno listo, se za namene iz prejšnjega odstavka lahko trži tudi, če ne izpolnjuje vseh zahtev glede kakovosti, če dobavitelj nima dovoljenja Uprave za izdajo etiket in potrdil, oziroma ga trži fizična ali pravna oseba, ki ni vpisana v register dobaviteljev. (2) For the purposes referred to in the preceding paragraph, the seeds and propagating material of varieties of agricultural plants that have not been entered in the national variety list may also be placed on the market if they do not comply with all quality requirements; if the supplier has not been authorised by the Administration for the Issue of Labels and Certificates; or if it is marketed by a natural or legal person that has not been entered in the register of suppliers. (3) Pakiranje semenskega materiala sort kmetijskih rastlin iz prvega odstavka tega člena mora biti označeno vsaj z navedbo vrste rastline, sorte, količine semenskega materiala, tretiranja semenskega materiala in namena trženja. (3) Packaging of seeds and propagating material of varieties of agricultural plants referred to in paragraph one of this Article shall be marked by indicating at least the plant species; variety; quantity of seeds and propagating material; treatment of seeds and propagating material; and the purpose of marketing. 5. člen Article 5 Semenski material sort kmetijskih rastlin iz 2., 3. in 4. člena tega pravilnika mora izpolnjevati zahteve v skladu s predpisi o zdravstvenem varstvu rastlin. Seeds and propagating material of varieties of agricultural plants referred to in Articles 2, 3 and 4 of these Rules shall meet the requirements in accordance with the regulations governing plant health. 6. člen Article 6 (1) Največja količina semenskega materiala posamezne vrste kmetijskih rastlin, ki se lahko uvozi ob vsakokratnem prestopu meje brez inšpekcijskega pregleda za osebno uporabo, pod pogojem, da je v izvirnem pakiranju, je navedena v stolpcu 5 iz priloge 1. (1) The maximum quantity of seeds and propagating material of an individual species of agricultural plants that may be imported upon each crossing of the border without inspection for personal use, on the condition of being in its original packaging, is indicated in column 5 of Annex 1. (2) Skupna dovoljena količina semenskega materiala kmetijskih (2) The total permitted quantity of agricultural seeds and rastlin iz prejšnjega odstavka ne sme presegati pri poljščinah 10 kg oziroma pri zelenjadnicah 0,5 kg na osebo. propagating material referred to in the preceding paragraph shall not exceed 10 kg per person for arable crops or 0.5 kg for vegetables. 7. člen Article 7 (1) Semenski material tistih vrst kmetijskih rastlin, ki niso navedene v prilogi 1, so pa navedene v predpisih o trženju semena kmetijskih rastlin, se lahko uvozi oziroma trži za znanstvene namene, za poskuse in testiranja, za selekcijo oziroma za ohranjanje genske raznolikosti in za osebno porabo, največ do količine, ki so za sorodne vrste oziroma vrste s podobno absolutno maso semena navedene v stolpcu 5 iz priloge 1. (1) Seeds and propagating material of species of agricultural plants that are not included in Annex 1 but are indicated in the regulations on the marketing of seeds of agricultural plants, may be imported or put on the market for scientific purposes, for experiments and tests, selection or preservation of genetic diversity and for personal use, up to the quantity that is indicated in column 5 of Annex 1 in respect of related species or species with similar absolute mass. (2) Semenski material vrst kmetijskih rastlin iz prejšnjega odstavka mora glede uvoza, trženja in pakiranja izpolnjevati vse zahteve, določene v 4., 5. in 6. členu tega pravilnika. (2) Concerning import, marketing and packing, seeds and propagating material of agricultural plant species referred to in the preceding paragraph shall comply with all the requirements laid down in Articles 4, 5 and 6 of these Rules. 8. člen Article 8 (1) Zahtevo za izdajo dovoljenja za trženje semenskega materiala sorte, ki je v postopku vpisa v sortno listo, se vloži na Fitosanitarno upravo Republike Slovenije (v nadaljnjem besedilu: Uprava) na obrazcu iz priloge 2, ki je sestavni del tega pravilnika. (1) Applications for authorisation for the marketing of agricultural seeds and propagating material of a variety that is subject to the procedure for entry in the national variety list shall be lodged with the Phytosanitary Administration of the Republic of Slovenia (hereinafter referred to as: the Administration) on the form provided in Annex 2, which is an integral part of these Rules. (2) Zahtevo iz prejšnjega odstavka vloži dobavitelj, ki je prijavitelj sorte za vpis v sortno listo, ali dobavitelj, ki ga je za to pooblastil prijavitelj. (2) Applications referred to in the preceding paragraph shall be lodged by suppliers that have applied for the variety to be entered in the national variety list, or suppliers that have been authorised for this purpose by the applicant. (3) Uprava o zahtevi iz prejšnjega odstavka odloči v skladu z Odločbo Komisije 2004/842/ES z dne 1. decembra 2004 o pravilih za izvajanje, po katerih lahko države članice dovolijo dajanje v promet semen tistih sort, za katere je bila vložena prošnja za vpis v nacionalni katalog sort poljščin ali zelenjadnic (UL L št. 362 z dne 9. 12. 2004, str. 21). (3) The Administration shall decide on applications referred to in the preceding paragraph in accordance with Commission Decision No. 2004/842/EC of 1 December 2004 concerning implementing rules whereby Member States may authorise the placing on the market of seed belonging to varieties for which an application for entry in the national catalogue of varieties of agricultural plant species or vegetable species has been submitted (OJ L 362, 9.12.2004, p. 21). (4) Uprava največjo dovoljeno količino semena pri posameznih vrstah poljščin objavi v uradnem glasilu in na spletnih straneh Uprave. (4) The Administration shall publish the maximum permitted quantity of seeds for individual species of arable crops in the official journal of the Administration and on its website. 9. člen Article 9 (1) Zahtevo za izdajo posebnega uvoznega dovoljenja za uvoz semenskega materiala sort kmetijskih rastlin, ki niso vpisane v sortno listo, vloži na Upravo uvoznik. (1) Applications for a special import permit for the import of seeds and propagating material of varieties of agricultural plants that have not been entered in the national list of varieties shall be lodged with the Administration by the importer. (2) Obrazec zahteve iz prejšnjega odstavka je v prilogi 3, ki je sestavni del tega pravilnika. (2) The form for applications referred to in the preceding paragraph is provided in Annex 3, which is an integral part of these Rules. 10. člen Article 10 Z dnem uveljavitve tega pravilnika preneha veljati Pravilnik o vrstah kmetijskih rastlin, količinah semenskega materiala kmetijskih rastlin ter obrazcu zahteve za dovolitev trženja oziroma za izdajo posebnega uvoznega dovoljenja (Uradni list RS, št. 92/02). On the day these Rules enter into force, the Rules concerning agricultural plant species, propagating material quantities and application form for the issue of trading permits and/or of special import licences (Official Gazette of the Republic of Slovenia [Uradni list RS], No. 92/02) shall cease to be in force. 11. člen Article 11 Ta pravilnik začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije. These Rules shall enter into force on the day following their publication in the Official Gazette of the Republic of Slovenia.
