SPLOŠNE DOLOČBE I. The definitions used in these Rules shall have the same meaning as those used in the Act governing PPPs. II. ZAHTEVE GLEDE OSEBJA, PROSTOROV IN OPREME II. (2) The advisor for PPPs shall be present in a specialised shop for a minimum of six hours per week on days and at hours announced in advance, and customers shall be informed of this by a written note hanging in a visible place in the shop. (4) Notwithstanding the second paragraph of this Article the advisor for PPPs may be present in the specialised shop for a shorter period of time during reduced demand for PPPs; and customers shall be informed of this by a written note hanging in a visible place in the shop. The local phytosanitary inspector shall be informed of the shorter presence of the advisor for PPPs by written note or email. (1) Premises for selling or storage of PPPs in wholesale stores and specialised shops shall be held in buildings built of chemically and physically resistant and inert materials that do not absorb PPPs; the inner surfaces of these premises shall be finished in a way that allows safe work and quick and easy cleaning. (4) In the premises where PPPs are sold or stored the ventilation shall be arranged to ensure that the concentration of gases, vapour and aerosols in the working environment does not exceed the values defined by the regulations on health and safety at work. (5) The employer shall provide for workers who handle PPPs or spilt PPPs appropriate personal protective equipment in accordance with the regulations on health and safety at work. (7) V prostorih, kjer se FFS prodajajo oziroma skladiščijo, morajo temperatura, vlaga in svetloba ustrezati pogojem, ki so navedeni v navodilu proizvajalca FFS. V teh prostorih mora biti zagotovljena tudi umetna osvetlitev. In these premises artificial light shall also be provided. 6. člen Article 6 (posebni pogoji glede prostorov in opreme) (Special conditions regarding premises and equipment) (1) Prostori, ki so namenjeni prometu s FFS na debelo, morajo imeti prostor za skladiščenje FFS in prostor za začasno skladiščenje odpadkov FFS, ki mora biti urejen v skladu s predpisi, ki urejajo skladiščenje odpadkov FFS, odpadnih nevarnih snovi in odpadne embalaže. (1) Premises intended for wholesale distribution shall contain a room for storage of PPPs and a room for temporary storage of PPP waste, constructed in accordance with the regulations on storage of PPP waste, hazardous waste substances and waste packaging. The room for temporary PPP waste storage shall contain two covered containers, one holding the appropriate absorbent, the other (empty) intended for temporary keeping of spilt and waste PPPs. (4) The storage and sales premises referred to in this Article shall be safeguarded in such a way that the access of unauthorised persons to PPPs for professional use is prevented. (5) If PPP distributors also sell seeds and propagating material of agricultural plants, plants or plant products or store them in the shop, they shall store PPPs in a special physically separated part of the shop or sales place in such a way that any contact or impact of PPPs on agricultural plant propagating material, plants or plant products is prevented. (6) Distributors who sell PPPs for professional use shall also keep in their product range personal protective equipment defined by the regulations regulating health and safety at work 7. člen Article 7 (skladiščenje oziroma shranjevanje FFS) (Keeping or storage of PPPs) (1) FFS morajo biti skladiščena v skladu s pogoji, ki jih določijo njihovi proizvajalci. FFS morajo biti zapakirana v njihovi originalni embalaži, varno in pregledno zložena in urejena po skupinah nevarnosti oziroma strupenosti in vrstah uporabe tako, da je v vsakem trenutku mogoč dostop do njih. (1) PPPs shall be stored in accordance with the conditions defined by their manufacturers. PPPs shall be packed in the original packaging, safely and clearly arranged by hazard or toxicity classification and type of use in such a way that access to them is possible at any moment. The plan of the arranged PPPs shall be placed in a visible location in the storage space. Regular supervision of the condition of PPPs and their packaging shall be ensured. (1) Distributors shall manage data on the trade name and quantity of PPPs sold, divided into retail sale in specialised shops and wholesale; and separately for each individual location. (3) Distributerji morajo podatke iz tega člena najpozneje do 31. marca za preteklo leto posredovati Upravi v elektronski obliki v skladu z navodili Uprave. IV. KRITERIJI ZA DOLOČITEV FFS ZA POKLICNO OZIROMA NEPOKLICNO RABO V PROMETU NA DROBNO IV. CRITERIA FOR DEFINING PPPs FOR PROFESSIONAL OR NON PROFESSIONAL USE IN RETAIL SALE 10. člen Article 10 (kriteriji in ocena tveganja) (Criteria and risk assessment) (1) FFS, ki so dovoljena za nepoklicno rabo, se določijo na podlagi izpolnjevanja vseh kriterijev glede na vrsto nevarnosti iz 11. člena tega pravilnika, rezultatov ocene vpliva FFS na okolje iz 12. člena tega pravilnika in velikosti pakiranj iz 13. člena tega pravilnika. (1) PPPs allowed for non-professional use shall be defined on the basis of compliance with all criteria related to the hazard classification referred to in Article 11 of these Rules, the outcome of the impact assessment of PPPs on the environment referred to in Article 12 of these Rules and the size of packaging referred to in Article 13 of these Rules. (2) Ne glede na določbo prejšnjega odstavka lahko Uprava določi, da se FFS, ki ne izpolnjuje vseh pogojev iz 11., 12. in 13. člena tega pravilnika, uporablja kot FFS za nepoklicno rabo, če je zaradi posebnih načinov predlagane uporabe ali pakiranja in iz ocene tveganja za zdravje ljudi ali okolje v postopku registracije FFS razvidno, da je tveganje za zdravje in okolje majhno. (2) The labelling of PPPs regarding the hazard classification referred to in the previous paragraph is specified in Annex 2, which is an integral part of these Rules. 12. člen Article 12 (rezultat ocene vpliva FFS na okolje) (Result of environmental impact assessment for PPPs) FFS je dovoljeno za nepoklicno rabo, če iz njegove ocene vpliva na okolje v postopku registracije FFS izhaja, da ob upoštevanju naslednjih kriterijev njegova uporaba ne vpliva negativno na okolje: A PPP shall be permitted for non-professional use if the environmental impact assessment within the authorisation procedure for PPPs shows that in observing the following criteria its use does not have a negative impact on the environment: je določen varnostni pas do površinskih voda enak ali manjši od 15 m, the defined buffer zone to surface water is equal to or shorter than 15 m, je HQ koeficient za čebele manjši od 50, - the HQ coefficient for honey bees is less than 50, je bioakumulacijski faktor BCF manjši od 100, - the bioaccumulation factor BCF is less than 100, je degradacijski čas DT50 v tleh pri laboratorijskih študijah manjši od 100, the soil degradation timeframe DT50 in laboratory studies is less than 100, je koeficient adsorpcije Koc večji od 15 in - the soil adsorption coefficient Koc is greater than 15 and se na osnovi razpoložljivih podatkov oceni, da uporaba FFS ne bo škodovala organizmom v komunalnih čistilnih napravah. the available data indicate that the use of this PPP would not harm the organisms in municipal treatment facilities. 13. člen Article 13 (velikost pakiranja FFS) (Size of packaging of PPPs) FFS je dovoljeno za nepoklicno rabo, če glede velikosti pakiranja izpolnjuje naslednje pogoje: A PPP shall be permitted for non-professional use if the size of packaging fulfils the following conditions: je pakirano v embalaži, katere velikost ustreza koncentratu za pripravo mešanice za enkratno uporabo, ki zadostuje za površino tretiranja največ do 500 m2, ali it is packed as a concentrate in a volume corresponding to the preparation of one single-use mixture sufficient for applying to a surface not exceeding 500 m2, or je pakirano kot gotovi pripravek za neposredno uporabo, ki zadostuje za površino tretiranja največ do 500 m2. it is packed as a ready-for-use product in a volume sufficient for applying to a surface not exceeding 500 m2 . V. SPLOŠNE INFORMACIJE O FFS V. GENERAL INFORMATION ON PPPs 14. člen Article 14 (splošne informacije o FFS) (General information on PPPs) (1) Splošne informacije o tveganju za zdravje ljudi in okolje pri uporabi FFS, ki jih distributerji v drugih prodajalnah z izključno neživilskim blagom zagotavljajo kupcem ob prodaji FFS, zagotovi Uprava. (1) General information on the risk to human health and to the environment arising from the use of PPPs which are sold by distributers in other sales outlets with solely non-food products shall be provided by the Administration. (2) Informacije iz prejšnjega odstavka so na voljo kupcem v obliki letakov ali zloženk. (2) The information referred to in the previous paragraph shall be available to customers in the form of flyers or leaflets. VI. PREHODNE IN KONČNE DOLOČBE VI. TRANSITIONAL AND FINAL PROVISIONS 15. člen Article 15 (prehodno obdobje glede označevanja FFS) (Transitional period regarding the labelling of PPPs) V skladu z Uredbo 1272/2008/ES so FFS, ki so dana v promet pred 1. junijem 2015, glede upoštevanja pravil o nezdružljivosti pri skladiščenju in glede na vrsto nevarnosti za FFS, ki niso dovoljena za nepoklicno rabo, lahko označena v skladu s Prilogama 1 in 2.
