[30rd July 2007] Supplement to Official Gazette S.1. 17 of 2007 35 PLANT PROTECTION ACT (Cap 171A) Plant Protection (Aleurotrochelus atratus) Regulations, 2007 In exercise of the powers conferred by section 16 of the Plant Protection Act, the Minister of Environment, Natural Resources and Transport hereby makes the following Regulations-e 1. This Regulations may be cited as the Plant Protection Citation (Aleurotrochelus atratus) Regulations, 2007. 2. In these Regulations "Authorised Officer" means a person authorised by the Chief Agricultural Officer or by the officer in charge ofthe Timber Control Unit, Forestry Division of the Ministry of Environment. Interpretation 3. (1) No person shall transport any coconut or other palms or parts of such palms from one island to another island without the written permission ofanAuthorised Officer. (2) An Authorised Officer or a police officer may seize and detain any palm or part thereof that is being or has been transported in contravention ofsubregulation (1). 4. (1) An Authorised Officer may, where the Officer has reasonable grounds to believe that any palm tree on any land is affected by the pest Aleurotrochelus atratus, enter upon the land and take such measures as may be necessary for Prohibition on transportof certainplants Powerof entry 36 Supplement to Official Gazette [30rd July 2007] preventing the spread of the pest and may for that purpose exercise the powers conferred on the ChiefAgricultural Officer under section 10ofthe Act. (2) An Authorised Officer shall, if so requested by any person affected, produce the authority to act under these Regulations. 5. Any person who contravenes regulation 3(1) or obstructs anAuthorised Officer in the discharge ofhis functions under regulation 4 is guilty of an offence and liable on conviction to a fine of SR25,OOO and to imprisonment for a period ofthree years.
