Ingingo ya 2: Ibisobanuro by’amagambo Muri iri teka, amagambo akurikira afite ibisobanuro bikurikira: modalities of aquaculture and fisheries products, equipment and materials; After consideration and approval by the Cabinet, in its meeting of 11/11/2020; ORDERS CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order regulates activities related to aquaculture, fishing, processing, transportation, conservation and commercialisation of aquaculture and fishery products, equipments and inputs. Article 2: Definitions In this Order, the following terms have the following meanings: distribution des produits, engins et matériels d’aquaculture et de pêche; Après examen et adoption par le Conseil des Ministres, en sa séance du 11/11/2020; ARRÊTE: CHAPITRE PREMIER: DISPOSITIONS GÉNÉRALES Article premier: Objet du présent arrêté Le présent arrêté réglemente les activités relatives à l’aquaculture, la pêche, la transformation, le transport, la conservation et la commercialisation des produits de l’aquaculture et de la pêche, des équipements et intrants. Article 2: Définitions Dans le présent arrêté, les termes repris ci après ont les significations suivantes: Official Gazette n° 40 of 14/12/2020 62 1º Minisitiri: Minisitiri ufite ubworozi bwo mu mazi n’uburobyi mu nshingano; 2º umudandaza: umucuruzi w’umusaruro w’ubworozi bwo mu mazi n’uw’uburobyi, ufite mu bubiko bwe ibiro by’amafi bitageze kuri magana atanu (500 Kg) by’umusaruro w’ubworozi bwo mu mazi n’uw’uburobyi kandi akagurisha ingano nke y’umusaruro cyangwa ifi imwe (1) imwe (1); 3º umuntu: umuntu ku giti cye, isosiyete y’ubucuruzi, umuryango utegamiye kuri Leta cyangwa koperative. 4º umuranguzi: umucuruzi w’umusaruro w’ubworozi bwo mu mazi n’uw’uburobyi, ufite mu bubiko bwe ibiro magana atanu (500 Kg) cyangwa birenzeho by’umusaruro w’ubworozi bwo mu mazi n’uw’uburobyi, kandi akagurisha nibura ibiro mirongo itanu (50 Kg) by’umusaruro. 1º Minister: Minister in charge of aquaculture and fishing; 2º retailer: a seller of aquaculture and fishing products having in his or her stock less than five hundred kilograms (Kg 500) of aquaculture and fishing products and sells them in small quantities or one (1) by one (1); 3º person: an individual, a company, a non-governmental organisation or a cooperative. 4º wholesaler: a seller of aquaculture and fisheries products having in his or her stock five hundred kilograms (Kg 500) or more of aquaculture and fisheries products and who sells at least fifty (50) kilograms of these products. 1º Minisitre: Ministre ayant l’aquaculture et la pêche dans ses attributions; 2º détaillant: un vendeur des produits d’aquaculture et de pêche ayant dans son stock moins de cinq cents kilogrammes (500 Kg) de produits d’aquaculture et de pêche et les vend en petite quantité ou un (1) à un (1); 3º personne: une personne privée, une société commerciale, une organisation non gouvernementale ou une coopérative. 4º grossiste: un vendeur des produits d’aquaculture et de pêche ayant dans son stock cinq cents kilogrammes (500 Kg) ou plus des produits d’aquaculture et de pêche et qui vend au moins cinquante (50) kilogrammes de ces produits. Ingingo ya 4: Ibisabwa ushaka gukora ubworozi bwo mu mazi Umuntu wifuza gukora ubworozi bwo mu mazi agomba kugaragariza Urwego rufite iterambere ry’ubworozi bwo mu mazi n’uburobyi mu nshingano ibi bikurikira: 1º uburenganzira bwo gukoresha aho yifuza gukorera ubworozi bwo mu mazi; 2º inkomoko y’amazi azakoresha; 3º uburyo bw’ubworozi bwo mu mazi azakoresha n’ibikoresho azakenera; 4º ko azorora ibinyabuzima bisanzwe mu mazi yo mu Rwanda cyangwa ibivuye ahandi byakorewe CHAPTER II: AQUACULTURE Article 3: Possible areas to practice aquaculture The aquaculture can be practiced on uplands, marshlands, lakes, rivers, pond or dams. Article 4: Requirements for a person who intends to practice aquaculture A person who intends to practice aquaculture must indicate the following to the authority in charge of aquaculture and fisheries development: 1º the right to use the place where the aquaculture will be carried out; 2º the source of water to be used; 3º the aquaculture system to be practiced and all required inputs; 4º that he or she will practice the farming of native aquatic organisms or those whose adaptation to the CHAPITRE II: AQUACULTURE Article 3: Endroits envisageables à l’aquaculture L’aquaculture peut être pratiquée sur les collines, dans les marais, dans les lacs, dans les rivières, dans les étangs piscicoles ou dans les réservoirs. Article 4: Exigences pour une personne qui a l’intention d’exercer l’aquaculture Une personne qui a l’intention d’exercer l’aquaculture doit indiquer ce qui suit à l’autorité ayant le développement de l’aquaculture et de la pêche dans ses attributions: 1º le droit d’utiliser l’endroit où l’aquaculture sera réalisée; 2º la source d’eau à utiliser; 3º le système d’aquaculture à pratiquer ainsi que tous les intrants requis; 4º qu’elle élèvera des organismes aquatiques indigènes ou ceux dont leur adaptation aux eaux du Official Gazette n° 40 of 14/12/2020 64 ubushakashatsi bukemeza ko byayororerwamo; 5º ibigize ibiryo bizakoreshwa mu bworozi n’inkomoko yabyo; 6º ko afite ubumenyi mu by’ubworozi bwo mu mazi cyangwa kuba yiteguye guha akazi abakozi bafite ubumenyi bukenewe; 7º uburyo bwo gusukura no gutunganya amazi yakoreshejwe mbere yo kuyarekura; 8º ko afite ibikoresho byo gusuzuma no gukurikirana ingano n’imihindagurikire y’amazi akoresha, harimo gupima ubushyuhe, umwuka, ubusharire, ubujyakuzimu, fosifori, amoniya, nitirite, kubonerana no korohera; 9º ubuso bw’amazi yifuza kororeramo n’aho yifuza kororera; 10º ibikoresho azakoresha mu bworozi bwo mu mazi. Rwandan water bodies has been approved by research; 5º the composition of feed and their origin; 6º the knowledge in aquaculture or to be ready to hire personnel with the required knowledge; 7º the water treatment system before discharging; 8º that he or she has tools for measuring physico-chemical water parameters including temperature, oxygen, pH, depth, phosphorous, amonia, nitrite, turbidity and conductivity; 9º water body and the surface area to be used; 10º equipments to use in aquaculture. Rwanda a été approuvée par la recherche; 5º la composition des aliments et leur origine; 6º la connaissance en aquaculture ou être prêt à recruter un personnel ayant une qualification requise; 7º le système de traitement des eaux usées avant le déchargement; 8º qu’elle possède les appareils de mesure des paramètres physico chimiques de l’eau, notamment la température, l’oxygène, pH, la profondeur, phosphore, amonia, nitrite, la turbidité et la conductivité; 9º la masse d’eaux et la superficie á occuper; 10º les équipements à utiliser dans l’aquaculture. Ingingo ya 6: Uruhushya rwo gukora ubworozi bwo mu mazi Umuntu wifuza gukora ubworozi bwo mu mazi agomba kuba afite uruhushya rwatanzwe n’umuyobozi w’urwego rufite iterambere ry’ubworozi bwo mu mazi n’uburobyi mu nshingano. Dosiye y’ubusabe bw’uruhushya rw’ubworozi bwo mu mazi igizwe n’ibi bikurikira: 1º ibaruwa isaba uruhushya yandikiwe urwego rufite iterambere ry’ubworozi bwo mu mazi n’uburobyi mu nshingano, inyujijwe ku buyobozi bw’Akarere usaba yifuza gukoreramo, akamenyesha Minisiteri ifite ubworozi bwo mu mazi n’uburobyi mu nshingano; Article 5: Aquaculture applied on dam Dam for water collected in an infrastructure for different purposes can be used in aquaculture activities in compliance with instructions established by beneficiaries of the dam. Article 6: License to practice aquaculture A person who wishes to establish an aquaculture farm must have a license from the authority in charge of aquaculture and fisheries development. The application file for an aquaculture license consists of the following: 1º an application letter for a licence addressed to the authority in charge of aquaculture and fisheries development endorsed by the District authority where the applicant wishes to establish an aquaculture farm, with a copy to the Ministry in charge of aquaculture and fishery; Article 5: Aquaculture pratiquée dans un réservoir Un réservoir d’eaux collectées dans une infrastructure pour différents usages peut être utilisé dans des activités d’aquaculture conformément aux instructions établies par les bénéficiaires du réservoir. Article 6: Licence d’exercer l’aquaculture Une personne qui désire créer une ferme d’aquaculture doit avoir une licence délivrée par l’autorité ayant le développement de l’aquaculture et de la pêche dans ses attributions. Le dossier de demande d’une licence d’aquaculture comprend ce qui suit 1º une lettre de demande de licence adressée à l’autorité ayant le développement de l’aquaculture et de la pêche dans ses attributions avec sous couvert de l’autorité du District dans lequel le demandeur veut installer sa ferme et réserver une copie au Ministère ayant l’aquaculture et la pêche dans ses attributions; Official Gazette n° 40 of 14/12/2020 66 2º umushinga w’ubworozi bwo mu mazi ugaragaza ingengo y’imari izakoreshwa, ubwoko bw’ibinyabuzima byo mu mazi yifuza korora n’inkomoko yabyo; 3º urutonde rw’ibikoresho n’inyongeramusaruro azakoresha; 4º igihe umushinga uzamara; 5º inyandiko y’ikigo cy’imari cyemewe yemeza ko afite ubushobozi mu buryo bw’amafaranga. UMUTWE WA III: INYONGERAMUSARURO ZIKORESHWA MU BWOROZI BWO MU MAZI Ingingo ya 7: Gutera cyangwa kongera ibinyabuzima mu mazi Umuntu ushaka gutera cyangwa kongera ibinyabuzima byo mu mazi byaba ibikomoka imbere mu Gihugu cyangwa 2º a detailed project plan indicating the budget, type of aquatic organisms intended to produce and their origin; 3º a list of equipments and inputs to use; 4º duration of the project; 5º proof of financial capacity from a recognised financial institution. However, the application for aquaculture in marshlands or in public water is done in accordance with relevant laws. Article 10: Manufacture, importation or commercialisation of feeds for aquatic organisms A person who intends to do manufacturing, importation or commercialisation of feeds for aquatic organisms applies for an authorisation from the competent authority. Article 11: Setting up a hatchery, importation and commercialisation of seed or aquaculture equipments A person who intends to setup a hatchery, to make importation and commercialisation of seed or aquaculture equipments applies for a license from the authority in charge for aquaculture and fisheries development. pêche dans ses attributions ou en son partenariat. The authority in charge for aquaculture and fisheries development determines the requirements to get a license. The license referred to in this Article cannot be transferred to another person. When a person granted the license no longer using it, he or she returns it to the authority that issued it. CHAPTER IV: FISHERIES Article 12: Types of fishing The types of fishing are as follows: 1º sport fishing; 2º professional fishing; 3º research or scientific fishing. A person who intends to practice the fishing referred to in this Article applies for a license from the authority in charge for aquaculture and fisheries development. CHAPITRE IV: PÊCHE Article 12: Sortes de pêche Les types de pêche sont les suivants: 1º la pêche sportive; 2º la pêche professionnelle; 3º la pêche de recherche ou scientifique. Une personne qui désire pratiquer la pêche citée dans le présent article demande une licence à l’autorité ayant le développement de l’aquaculture et de la pêche dans ses attributions. Icyiciro cy’uruhushya rw’uburobyi bw’umwidagaduro kirimo ubwoko bw’impushya bukurikira: 1º icyiciro cya A1: uruhushya rw’uburobyi bw’umwidagaduro bukorwa n’Umunyarwanda; 2º icyiciro cya A2: uruhushya rw’uburobyi bw’umwidagaduro Article 13: Sport fishing Sport fishing is the fishing which is practiced for recreation purpose in public water using not more than five (5) hooks. A person who needs to do sport fishing must have a license. That licence is issued to hotels, guest houses or individuals. Article 14: Category of sport fishing license and modalities of its use The category of a sport fishing license is A. The category of sport fishing license comprises of the following types of licenses: 1º category A1: a license of a sport fishing done by a Rwandan; 2º category A2: a license of a sport fishing done by a foreign resident or non-resident in Rwanda; Article 13: Pêche sportive La pêche sportive est la pêche qui est pratiquée à des fins de loisir dans les eaux publiques en utilisant pas plus de cinq (5) hameçons. Une personne qui veut pratiquer la pêche sportive doit avoir une licence. Cette licence est octroyée à des hôtels, des motels ou aux individus. Article 14: Catégories de licence de la pêche sportive et modalités de son utilisation La catégorie d’une licence de la pêche sportive est A. Ingingo ya 16: Icyiciro cy’uruhushya rw’uburobyi bw’umwuga n’ibiruranga Icyiciro cy’uruhushya rw’uburobyi bw’umwuga ni B. An individual who practices sport fishing uses one (1) hook. A person who practices sport fishing may be accompanied by his or her spouse and not more than two (2) of his or her children who attained the age of at least eleven (11) years. If the holder of license referred to in Paragraph One of this Article is a hotel or guest house, it must not exceed twenty (20) hooks and it complies with the provision of Paragraph 3 of this Article. Article 15: Professional fishing The professional fishing is the fishing which is practised for profit purpose and commercialisation of fishery products. Article 16: Category of a professional fishing license and its characteristics The category of a professional fishing license is B. étranger résidant ou non au Rwanda. Article 15: Pêche professionnelle La pêche professionnelle est la pêche qui est pratiquée à des fins lucratives et pour la commercialisation des produits de pêche. Article 16: Catégorie d’une licence de pêche professionnelle et ses caractéristiques La catégorie d’une licence de pêche professionnelle est B. The category of professional fishing license comprises of the following types of licenses: 1º license B1: a license for a fishing unit using a long line fishing nets not exceeding a length of five hundred meters (m 500) or a long line of more than five (5) hooks; 2º license B2: a license for a fishing unit using fishing nets exceeding five hundred meters (m 500) but not exceeding one thousand five hundred meters (m 1500); 3º license B3: a license for a fishing unit using a lift net of unit of six (6) rolls of one hundred meters (m 100) by ten meters (m 10); 4º license B4: a license for a fishing unit using the purse seine or the lift net whose size exceeds one hundred meters (m 100) by ten meters (m 10). The professional fishing license is valid for one year (1). Article 17: Requirements for research or scientific fishing A research or scientific fisher is an individual or an institution involved in any activity aimed at conducting research on aquatic environment or on aquatic organisms, with authorisation of the authority in charge of aquaculture and fishing. The research or scientific activities is conducted based on the research plan, if possible, they can be prepared in collaboration with the institution in charge of aquaculture and fishing. One or more experts appointed by the institution in charge of aquaculture and fishing based on research to be conducted are involved in the research or scientific activities and the license holder bears all the expenses. Les activités de recherche ou scientifique sont menées sur base du plan de recherche et, si possible, peuvent être préparées en collaboration avec l’institution ayant l’aquaculture et la pêche dans ses attributions. Un ou plusieurs experts désignés par l’institution ayant l’aquaculture et la pêche dans ses attributions sur base des recherches à mener sont impliqués dans les activités de recherche ou scientifique et le titulaire de la licence supporte toutes les dépenses. Article 18: Legal fishing gears The following gears are authorised for fishing: 1º for limnothrissa miodon: lift nets of at least six millimetres (mm 6) mesh size fixed on trimaran boats and lamps. Monofilament nets are prohibited. 2º for rastrineobola argentea: lift nets of at least five millimetres (mm 5) mesh size fixed on trimaran boats and lamps. Monofilament nets are prohibited. 3º for haplochromis: gill nets of more than one point five inch (1.5) or three point eight one centimetre (cm 3.81). monofilament nets are prohibited. Les filets monofilaments sont interdits. 2º pour rastrineobola argentea: filet soulevé de maille étirée d’au moins cinq millimètre (5 mm) fixé sur bateaux de pêche trimarans avec des lampes. Les filets monofilaments sont interdits. 3º pour haplochromis: filet maillant de la taille de un virgule cinq pouces (1.5) ou trois virgule quatre-vingt un centimètre (3.81 cm). Monofilament nets are prohibited. 5º clarias and protopterus: gill nets of at least six centimetres (cm 6) or long line hooks. Monofilament nets are prohibited. Article 19: Other fishing equipments Other fishing equipments are as follows: 1º the fishing boat which is well constructed into wooden timbers and other stainless materials as to minimize any accident and contamination of fishery products, which is designed for its easy cleaning and efficient handling of fishery products, and which is 4º tilapia et carpe: filet maillant dormant d’au moins quatre pouces (4) ou dix virgule seize centimètre (10.16 cm) et plus. Article 19: Autres équipements de pêche Les autres équipements de pêche sont les suivants: 1º le bateau qui est construit en planches ou autres matériels inoxydables de manière à minimiser les accidents et la contamination des produits de la pêche; et qui est conçu de façon à faciliter leur nettoyage et la manipulation des produits de la Official Gazette n° 40 of 14/12/2020 76 rya koperative na numero y’ubwato. Article 22: Prohibited acts in fishing The following acts are prohibited in fishing: 1º using poisonous substances aimed at stunning, weakening or killing aquatic organisms; 2º applying explosives; 3º using electromagnetic procedures or electrocution; 4º beating water with an aim of capturing aquatic organisms; 1º Lac Kivu et Lacs Burera et Ruhondo: entre dix-sept heures du soir (17 heures) et sept heures du matin (7:00); Lacs de l’Est: entre seize heures du soir (16:00) et huit heures du matin (8:00). This starts immediately after their arrival at the landing site. The aquaculture and fishery products with signs of deterioration are rejected. The transporter of aquatic organism meant for production, wether eggs, fingerlings or broodstocks, must possess a certificate of origin and a movement permit issued by the authority in charge of aquaculture and fishery development. The transporter of frozen, chilled, dried, smoked or salted aquatic organisms, whether produced within the country or imported, must possess a certificate of origin, movement permit, import, export and re-export license, issued by the institution in charge of inspection. It is prohibited to carry aquaculture and fishery products in public transport vehicles when they are not in appropriate isothermic containers. Article 27: Transport des produits de l’aquaculture et de la pêche Le transporteur des produits de l’aquaculture et de la pêche dans le pays doit être en possession de la facture qui indique l’origine des produits et leur destination. Le transportateur des organismes aquatiques congelés, réfrigérés, séchés, fumés ou salés, soit capturés localement ou importés, doit posséder un certificat d’origine, un laissez - passer, une licence d’importation, d’exportation ou de réexportation, délivré par une institution ayant l’inspection dans ses attributions. The authority determines the content and validity of the authorisation. The wholesaler or retailer conducts his or her business on a site approved by the competent authority and must always have invoices for products locally produced and a certificate of origin for imported products. The wholesaler or retailer must fulfil the requirements of foodstuff hygiene. Especially, he or she must have a refrigerator, isothermal container for fresh products, well ventilated, and protected from moisture for smoked, salted and dried products. Article 32: Autorisation de vente en gros et au détail des produits de l’aquaculture et de la pêche Sans préjudice des autres dispositions légales régissant le commerce intérieur au Rwanda, le grossiste ou le détaillant des produits de l’aquaculture et de la pêche doit posséder une autorisation délivrée par l’autorité ayant le développement des produits de l’aquaculture et de la pêche dans ses attributions. L’autorité détermine le contenu et la validité de l’autorisation. Le grossiste ou le détaillant exerce son métier dans un lieu approuvé par l’autorité compétente et doit disposer toujours des factures pour les produits locaux ou un certificat d’origine pour les produits importés. Le grossiste ou le détaillant doit remplir les conditions relatives à l’hygiène des denrées alimentaires. Plus particulièrement, il doit avoir les réfrigérateurs, les caisses isothermes pour les produits frais et des récipients bien clos, aérés et protégés contre l’humidité pour les produits fumés, salés et séchés. Article 33: Commercialisation of aquaculture and fishing gears, materials and other inputs Without prejudice to provisions governing the domestic trade in Rwanda, the commercialisation of aquaculture and fishing gears, materials and other inputs requires a license issued by the authority in charge of aquaculture and fisheries development. The authority determines the content and validity of the authorisation. Import and export license of aquaculture and fishing gears, materials and other inputs is issued by the authority in charge of aquaculture and fisheries development. The authority determines the content of the license, entry and exit border post. Article 33: Commercialisation des engins, matériels et autres intrants d’aquaculture et de la pêche Sans préjudice des autres dispositions légales régissant le commerce intérieur au Rwanda, la commercialisation des engins, matériels et autres intrants d’aquaculture et de la pêche nécessite une licence de l’autorité ayant le développement de l’aquaculture et de la pêche dans ses attributions. L’autorité détermine le contenu et la validité de l’autorisation. La licence d’importation et d’exportation des engins, matériels et autres intrants d’aquaculture et de la pêche est délivré par l’autorité ayant le développement de l’aquaculture et de la pêche dans ses attributions. L’autorité détermine le contenu de cette licence et les postes frontières d’entrée et de sortie.
