Ingingo ya 2: Imirimo ikorwa mu buvumvu Imirimo y’ingenzi ikorwa mu buvumvu ni iyi ikurikira: Rwanda Bureau of Standards (RBS); Pursuant to Law n° 38/2010 of 25/11/2010 establishing Rwanda Agriculture Board (RAB) and determining its responsibilities, organization and functioning; Pursuant to Law n° 39/2010 of 25/11/2010 establishing National Agricutural Export Development Board (NAEB) and determining its responsibilities, organization and functioning; Pursuant to Law nº 54/2008 of 10/09/2008 determining the prevention and fight against contagious diseases of domestic animals in Rwanda; Pursuant to Law n° 30/2012 of 01/08/2012 Governing on agrochemicals; ADOPTS : CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Law This Law shall determine the organization and functioning of the beekeeping in Rwanda. Article 2: Beekeeping activities The beekeeping main activities shall be the following: l’Office Rwandais de Normalisation (RBS); Vu la Loi n° 38/2010 du 25/11/2010 portant création de l’Office Rwandais de Développement Agricole (RAB) et déterminant ses attributions, organisation et fonctionnement; Vu la Loi n° 39/2010 du 25/11/2010 portant création de l’Office National de Développement des Exportations Agricoles (NAEB) et déterminant ses attributions, son organisation et son fonctionnement; Vu la Loi nº 54/2008 du 10/09/2008 portant règlement de la police sanitaire des animaux domestiques au Rwanda; Vu la Loi n° 30/2012 du 01/08/2012 portant utilisation des produits agrochimiques ; ADOPTE: CHAPITRE PREMIER : DISPOSITIONS GENERALES Article premier: Objet de la présente loi La présente loi détermine l’organisation et le fonctionnement de l’apiculture au Rwanda. Article 2 : Activités apicoles Les principales activités apicoles sont les suivantes : Official Gazette n° 27 bis of 08/07/2013 7 1° kwagika; 2° guhakura; 3° gutunganya no gucuruza ibikomoka ku nzuki. Ingingo ya 3 : Ibisobanuro by’amagambo Muri iri tegeko amagambo akurikira asobanurwa ku buryo bukurikira: 1° igishashara: imvubura inzuki zifashisha mu gukora udukono tw’ubuki n’ibyari byazo; 2° insinda: igice cy’intanga ngabo y’ibihingwa iba mu ndabo inzuki zitara ituma habaho kubangurirwa kw’indabo inzuki zikayikoresha nk’ibiribwa nyubakamubiri; 3° irumbo ry’inzuki : inzuki nyinshi ziri hamwe mu muzinga cyangwa hanze yawo; 4° kwagika: igikorwa cyo gushyira imizinga ahantu hateguwe kugira ngo inzuki zororokeremo; 5° ubuvumvu: umwuga w’ubworozi bw’inzuki bugamije kuzibyaza umusaruro; 6° umuvumvu : umuntu worora inzuki agamije umusaruro ; 1° beehiving; 2° honey harvesting; 3° processing and marketing of other beekeeping products. Article 3: Definitions of terms Under this Law, the following terms shall have the meanings: 1° wax: substances secreted from bee glands by means of which bees make honeycombs and their nests; 2° pollen: male reproductive element of plants found in flower stamens collected by bees that allows fertilization of ovum in flowers and used by bees as growth food; 3° colony of bees: family of bees inside or outside of a hive; 4° beehiving: placing hives in a maintained location for bees to reproduce; 5° beekeeping: raising of bees for their rational exploitation; 6° beekeeper: person who engages in bee breeding for a production; 1° la pose des ruches ; 2° la récolte du miel ; 3° le traitement et la commercialisation des produits apicoles. Article 3 : Définitions des termes Aux fins de la présente loi, les termes repris ci-après ont les significations suivantes : 1° cire : substances secrétées par les abeilles à l’aide desquelles les abeilles fabriquent les rayons à miel et leurs nids; 2° pollen: élément reproducteur mâle des plantes contenu sur les étamines des fleurs récolté par les abeilles permettant la fécondation de l’ovule dans une fleur et utilisé par les abeilles comme aliment de croissance; 3° colonie d’abeilles: famille d’abeilles à l’intérieur ou à l’extérieur d’une ruche ; 4° pose des ruches : fait de placer les ruches dans un endroit aménagé pour que les abeilles puissent s’y reproduire; 5° apiculture: élevage des abeilles en vue de leur exploitation rationnelle ; 6° apiculteur: personne qui pratique l’élevage des abeilles en vue de réaliser une production; Official Gazette n° 27 bis of 08/07/2013 8 7° umuzinga : igikoresho umuvumvu yororeramo inzuki ; 8° uruco : igice cy’irumbo ryimutse mu muzinga bitewe n’uko havutse urundi rwiru; 9° urucumbu: amarirangenge y’ibiti inzuki zifashisha mu gusana no kurinda umuzinga; 10° uruvumvu : imizinga myinshi yagitse hamwe hagamijwe ubworozi bw’inzuki; 11° uruyuki : agakoko gato kaguruka gakora ubuki; 12° urwiru : uruyuki rumwe rukumbi mu muzinga rubyara izindi ; IMUTWE WA II : GUCUNGA NO GUTEZA IMBERE UBUVUMVU Ingingo ya 4 : Imicungire n’imigenzurire by’ubuvumvu Ubuvumvu bucungwa kandi bukagenzurwa na Minisiteri ifite ubworozi bw’inzuki mu nshingano zayo. Ingingo ya 5 : Ihuriro ry’abavumvu Iteka rya Minisitiri w’Intebe rigena uburyo ihuriro ry’abavumvu rijyaho. 7° hive: artificial structure in which the beekeeper raises bees; 8° swarm: part of the population of a colony leaving the hive when a new queen is born in the existing hive; 9° propolis: resinous substance derived from trees and used by bees to restore and protect the hive; 10° apiary: several hives placed in the same location as part of beekeeping activity; 11° bee: small flying insect that makes honey; 12° queen: the only reproductive female bee in a hive; CHAPTER II: MANAGEMENT AND DEVELOPMENT OF BEEKEEPING Article 4: Management and supervision of the beekeeping The beekeeping shall be managed and supervised by the Ministry in charge of beekeeping. Article 5: Union of beekeepers A Prime Minister’s Order shall determine modalities for establishment of the Union of Beekeepers. 7° ruche: structure artificielle dans laquelle l’apiculteur pratique l’élevage des abeilles; 8° essaim: une partie de la population d’un essaim quittant la ruche avec la naissance d’une nouvelle reine; 9° propolis : substance résineuse tirée des arbres dont les abeilles se servent pour réhabiliter et protéger la ruche ; 10° rucher : plusieurs ruches placées au même endroit dans le cadre d’une exploitation apicole; 11° abeille : petit insecte volant qui fabrique du miel ; 12° reine: l’unique abeille femelle reproductrice dans une ruche; CHAPITRE II : GESTION ET DEVELOPPEMENT DE L’APICULTURE Article 4 : Gestion et supervision de l’apiculture L’apiculture est gérée et supervisée par le Ministère ayant l’apiculture dans ses attributions. Article 5 : Union des apiculteurs Un Arrêté du Premier Ministre définit les modalités de création de l’Union des apiculteurs. Official Gazette n° 27 bis of 08/07/2013 9 UMUTWE WA III: KUBUNGABUNGA UMUTUNGO UKOMOKA KU BUVUMVU Ingingo ya 6: Aho umuvumvu yagika imizinga Umuvumvu yorora inzuki hakurikijwe amabwiriza abigenga ashyirwaho na Minisitiri ufite ubworozi bw’inzuki mu nshingano ze. Ingingo ya 7: Kwimura uruvumvu n’imizinga Iyo serivisi y’ubworozi bw’inzuki ishinzwe igenzura isanze hari imizinga yagitswe mu buryo bunyuranyije n’amabwiriza ateganywa mu ngingo ya 6 y’iri tegeko, isaba ko nyir’imizinga ayimura akayagika hakurikijwe amategeko. Ingingo ya 8 : Gufata irumbo ry’inzuki Iyo hari irumbo ry’inzuki riri ahantu hatari mu muzinga, inzego zibishinzwe zirarifata zikariwushyiramo. Ku mpamvu z’umutekano w’abantu n’ibintu, iyo serivisi y’ubworozi bw’inzuki isanze hari irumbo ry’inzuki riri ahantu hatari mu muzinga, irarifata ikaryimurira mu muzinga wabugenewe. Ingingo ya 9: Uburenganzira ku mutungo Umuzinga, irumbo ry’inzuki, uruco kimwe n’ibikomoka ku nzuki ni umutungo bwite w’umuvumvu. CHAPTER III : CONSERVATION OF BEEKEEPING RESOURCES Article 6 : Place where a beekeeper places hives The beekeeper shall raise bees according to relevant standards that are determined by instructions of the Minister in charge of beekeeping. Article 7 : Relocation of an apiary and hives Where beekeeping service in charge of inspection finds that hives are placed contrary to the provisions of Article 6 of this Law, it shall require the owner thereof to place them in accordance with the Law. Article 8: Capturing a colony Where a colony of bees settled in a place other than a hive shall be captured by the relevant authorities and be placed in a hive. Where, for the purposes of ensuring the safety of persons and property, the service in charge of beekeeping finds that a colony of bees is settled in a place other than a hive, it shall capture it and place it in an appropriate hive. Article 9: Right of ownership Hives, colonies, swarms and beekeeping products shall be the beekeeper’s private property. CHAPITRE III : CONSERVATION DES RESSOURCES APICOLES Article 6 : Lieu de pose des ruches par l’apiculteur L’apiculteur pratique l’élevage des abeilles conformément aux normes en la matière définies par les instructions du Ministre ayant l’apiculture dans ses attributions. Article 7: Déménagement d’un rucher et des ruches Lorsque le service d’inspection apicole constate qu’il y a des ruches posées contrairement aux dispositions de l’article 6 de la présente loi, il demande au propriétaire de ces ruches de les poser conformément à la loi. Article 8 : Capture d’une colonie Une colonie d’abeilles installée dans un endroit autre qu’une ruche est capturée par les instances concernées qui la placer dans une ruche. Lorsque, aux fins d’assurer la sécurité des personnes et des biens, le service chargé de l’apiculture constate qu’il y a une colonie d’abeilles installée dans un endroit autre qu’une ruche, il le capture et le place dans une ruche appropriée. Article 9 : Droit de propriété Les ruches, les colonies, les essaims ainsi que les produits apicoles constituent la propriété privée de l’apiculteur. Uruco rw’inzuki rudafite urukurikiranye mu gihe cy’iminsi mirongo itatu (30) ruba urw’uwarufashe bwa mbere. Ingingo ya 11: Gutakaza uburenganzira ku mutungo bwite Nyir’irumbo ry’inzuki atakaza uburenganzira kuri iryo rumbo iyo ryimukiye mu rundi ruvumvu rurimo inzuki z’undi muvumvu. Icyakora, iyo umuvumvu wakiriye iryo rumbo yagize uruhare mu iyimuka ryaryo, ibivugwa mu gika cya mbere cy’iyi ngingo ntibyubahirizwa. UMUTWE WA IV: ISUKU N’IBIBUJIJWE MU BUVUMVU Ingingo ya 12: Isuku Umuvumvu agomba kwita ku isuku y’imizinga, iy’ibikoresho, iy’umusaruro w’ubuki n’iy’umubiri we mu gihe cyose ari mu mirimo y’ubuvumvu. Iteka rya Minisitiri ufite ubworozi bw’inzuki mu nshingano ze rigena ishyirwa mu bikorwa ry’ibikubiye muri iyi ngingo. Article 10: Right to a swarm When a colony of bees leaves a hive and lands at the neighbor’s, the owner reserves the right to chase and capture it. After thirty (30) days, a colony of bees that is not chased by anyone shall belong to the person who captured it first. Article 11: Loss of the right of ownership An owner of a colony of bees shall lose ownership of a swarm that migrates to another occupied apiary belonging to another beekeeper. However, if the new owner of the swarm has contributed to the migration, the provisions of Paragraph One of this Article shall not apply. CHAPTER IV: HYGIENE AND PROHIBITIONS IN BEEKEEPING Article 12: Hygiene A beekeeper must ensure the hygiene of hives, equipment, honey production and personal hygiene whenever engaged in beekeeping activities. An Order of the Minister in charge of beekeeping shall determine modalities for the enforcement of the provisions of this Article. Article 10 : Droit sur un essaim Lorsqu’une colonie d’abeilles sort d’une ruche et se pose chez le voisin, le propriétaire a le droit de le poursuivre et le capturer. Après trente (30) jours, une colonie d’abeilles qui n’est poursuivie par personne appartient à celui qui la capturé le premier. Article 11 : Perte du droit de propriété Le propriétaire d’une colonie d’abeille perd son droit de propriété sur cet essaim lorsque celui-ci migre vers un autre rucher habité appartenant à un autre apiculteur. Toutefois, si le nouvel acquéreur de l’essaim a joué un rôle dans cette migration, il n’est pas fait application des dispositions de l’alinéa premier du présent article. CHAPITRE IV : HYGIENE ET INTERDICTIONS EN APICULTURE Article 12: Hygiène L’apiculteur doit veiller à l’hygiène de ses ruches, de son équipement, de la production de miel et à son hygiène corporelle chaque fois qu’il est engagé dans les activités apicoles. Un arrêté du Ministre ayant l’apiculture dans ses attributions détermine les modalités d’application des dispositions du présent article. Ingingo ya 15 : Isenywa ry’irumbo ry’inzuki Serivisi y’ubworozi ifata icyemezo cyo gusenya irumbo ry’inzuki cyangwa uruco ry’inzuki mu gihe no mu buryo igena iyo: 1° irumbo ry’inzuki ririmo udukoko tugoye kurwanywa; 2° irumbo cyangwa uruco rw’inzuki bishobora kugira ingaruka ndakumirwa ku baturage; 3° irumbo cyangwa ahantu hari inzuki hatitaweho cyangwa hatagikoreshwa; 4° irumbo rirwaye cyangwa inzuki zapfuye. Article 13: Modalities for the use of toxic substances in beekeeping An Order of the Minister in charge of beekeeping shall determine modalities for the use of toxic substances employed in agriculture and for the prevention of contamination in beekeeping activities. Article 14: Honey harvesting equipment The beekeeper, when harvesting honey, shall be bound to use appropriate equipment that are determined by instructions of the Minister in charge of beekeeping. Article 15: Destruction of a colony of bees The beekeeping service shall order the destruction of a colony or a swarm of bees at such times and in such manner determined by it if: 1° the colony of bees is infected with pathogens difficult to treat; 2° the colony or swarm of bees may cause inevitable damage to the population; 3° the colony of bees or the place where bees are raised is neglected or abandoned; 4° the colony consists of sick or dead bees. Article 13: Modalités d’utilisation des substances toxiques dans l’apiculture Un arrêté du Ministre ayant l’apiculture dans ses attributions détermine les modalités d’utilisation des substances toxiques utilisées dans l’agriculture ainsi que les modalités de prévention de la contamination dans les activités apicoles. Article 14 : Matériel pour la récolte du miel L’apiculteur est, lors de la récolte du miel, tenu d’utiliser le matériel approprié défini par les instructions du Ministre ayant l’apiculture dans ses attributions. Article 15: Destruction d’une colonie d’abeilles Le service d’apiculture décide de la destruction d’une colonie ou d’un essaim d’abeilles selon les délais et modalités qu’il fixe lorsque: 1° la colonie d’abeilles est infectée par des agents pathogènes difficiles à soigner ; 2° la colonie ou l’essaim d’abeilles peut causer des dommages inévitables à la population ; 3° la colonie d’abeilles ou le lieu où les abeilles sont élevés est négligé ou abandonné ; 4° la colonie d’abeilles comprend les abeilles mortes ou malades. Ingingo ya 17 : Kuregera icyemezo utishimiye Iyo umuvumvu atishimiye kimwe cyangwa byinshi mu byemezo bivugwa mu ngingo ya 15 n’iya 16 z’iri tegeko, ashobora kuregera urwego rwisumbuye mu gihe kitarenze iminsi icumi (10) uhereye igihe igihe yamenyesherejwe icyemezo. UMUTWE WA V : INGINGO ZISOZA Ingingo ya 18 : Itegurwa, isuzumwa n’itorwa ry’iri tegeko Iri tegeko ryateguwe, risuzumwa kandi ritorwa mu rurimi rw’Ikinyarwanda. Ingingo ya 19 : Ivanwaho ry’ingingo z’amategeko zinyuranyije n’iri tegeko Ingingo zose z’amategeko abanziriza iri kandi zinyuranyije na ryo zivanyweho. Article 16: Granting, withdrawal of beekeeper’s certificate and loss of the right to practice the beekeeping profession Granting certificate, its withdrawal from any beekeeper who contravenes the provisions of this Law as well as the loss of the right to practice this profession, shall be determined by instructions of the Minister in responsible for beekeeping. Article 17: Appeal against a decision When a beekeeper is not satisfied with one or more decisions provided under Articles 15 and 16 of this Law may appeal to the higher-level organ within ten (10) days from the time he/she has been notified on. CHAPTER V: FINAL PROVISIONS Article 18: Drafting, consideration and adoption of this Law This Law was drafted, considered and adopted in Kinyarwanda. Article 19: Repealing provision All prior legal provisions inconsistent with this law are hereby repealed. Article 16: Octroi, retrait du certificat d’apiculteur et perte du droit d’exercer la profession d’apiculture L’octroi du certificat d’apiculteur, son retrait à tout apiculteur qui viole les dispositions de la présente loi ainsi que la perte du droit d’exercice de cette profession, sont définis par les instructions du Ministre ayant l’apiculture dans ses attributions. Article 17: Recours contre une décision Lorsqu’un apiculteur n’est pas satisfait de l’une ou plusieurs des décisions visées aux articles 15 et 16 de la présente loi, elle peut faire recours devant l’organe d’échelon supérieur dans un délai ne dépassant pas dix (10) jours à partir du moment ou il a été notifié. CHAPITRE V : DISPOSITIONS FINALES Article 18 : Initiation, examen et adoption de la présente loi La présente loi a été initiée, examinée et adoptée en Kinyarwanda. Article 19 : Disposition abrogatoire Toutes dispositions antérieures contraires aux dispositions de la présente loi sont abrogées.
