Pursuant to Law n° 08/2006 of 24/02/2006 determining the organization and functioning of the District ; ADOPTS: CHAPTER ONE: GENERAL PROVISIONS Article One: Establishment of the Centre This Law shall establish the National Land Centre abbreviated as “NLC” and determine its organization, functioning and competence. NLC shall fall within the category of public institutions which are entrusted with regulatory responsibilities and promotion of economic and social activities as well as other activities of general interest. NLC shall have legal personality, administrative and financial autonomy and shall be governed in accordance with Laws governing organs of public service. Vu la Loi n° 08/2006 du 24/02/2006 portant organisation et fonctionnement du District; ADOPTE: CHAPITRE PREMIER: DISPOSITIONS GENERALES Article Premier : Création du Centre La présente loi porte création du Centre National de Gestion Foncière dénommé NLC en sigle anglais et détermine son organisation, son fonctionnement et sa compétence. NLC est classé dans la catégorie des établissements publics de régulation, de promotion d’activités économiques, sociales et d’autres activités d’intérêt général. NLC est doté de la personnalité juridique et de l’autonomie administrative et financière. Il est régi par les dispositions régissant la fonction publique. Ingingo ya 3: Ibisobanuro by’amagambo Muri iri tegeko, amagambo akurikira asobanurwa kuri ubu buryo: 1° Amagambo ahinnye y’icyongereza “GIS” (Geographic Information System) asobanura ikoranabuhanga rifasha kugaragaza no gusesengura imiterere y’ibiri ku Isi; 2° Amagambo ahinnye y’icyongereza “GPS” (Global Positioning System) asobanura uburyo bugaragaza aho ibintu biherereye ukoresheje ibyogajuru; Article 2: Head office of NLC The head office of NLC shall be located in the City of Kigali, capital city of the Republic of Rwanda. It may be transferred elsewhere on the Rwandan territory where deemed necessary. NLC shall have branches responsible for land management. A Presidential Order shall determine the place of location of head offices of such branches. Article 3: Definitions of terms For the purposes of this Law, the terms below shall have the following meanings: 1° Geographic Information System (GIS) : a system for displaying and analyzing data which are spatially referenced to the Earth; 2° Global Positioning System (GPS): a satellite-based navigational system allowing the determination of the position of objects on the earth's surface; Article 2: Siège de NLC Le siège de NLC est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Article 3: Définition des termes Au sens de la présente loi, les termes suivants sont ainsi définis: 1° Système d’Information Géographique (SIG): système informatique d’affichage et d’analyse des données spatialement référencées ; 2° Système Mondial de Positionnement (GPS): système de navigation satellitaire qui permet de déterminer la position et l’étendue des objets sur la surface de la terre ; O.G. n°31 of 03/8/2009 13 3° Amagambo y’icyongereza “Remote sensing” asobanura ubuhanga bwo kubona amakuru ku miterere y’ibidukikije n’ibintu biri ku butaka hifashishijwe amafoto cyangwa amashusho yafashwe n’indege cyangwa ibyogajuru; 4° Ibipimo by’amazi: uburyo bukoreshwa mu ikusanyamakuru ku mazi ashobora kugendwamo n’ubwato, nk’ibiyaga n’imigezi minini, ku mpamvu z’umutekano w’amato anyuramo; 5° Ibipimo by’imiterere y’ubutaka: ibipimo bijyanye n’ubutumburuke bw’ahantu hanyuranye ku gace kihariye k’ubutaka hanyuma bikerekanwa nk’imirongo ku ikarita y’ubutaka. 6° Ibipimo by’ubutaka: ibipimo byerekana ubuso nyakuri bw’ahantu, bigaragazwa mu buryo bufatika n’imbago zashinzwe mu butaka (ibiti, inguni zigizwe n’amabuye agerekeranye, igisima cyubakiye cyangwa ibindi bintu byerekana imbago). Ikarita ishushanywa hifashishijwe ibyo bipimo; 7° Icyegeranyo cy’amakuru yose anyuranye ajyanye n’ubutaka: urusobe rw’amakuru ku by’ubutaka akusanyijwe harimo ajyanye 3° Remote Sensing: the technique of obtaining data or information about the environment and the land cover by using photographs or images taken from aircrafts or satellites; 4° Hydrographic survey: process of gathering information about navigable waters, such as lakes and rivers, for the purposes of safe navigation of vessels; 5° Topographic Survey: a survey that measures the elevation of points on a particular piece of land and presents them as contours on a topographic map; 6° Land Survey: a technique of measuring the actual physical extent of a parcel of land or a property, typically witnessed by monuments or markers set into the ground, ( trees, piled cornerstones, piled, concrete stones or other types of demarcating feature) put in place no the basis of the date gathered; 7° Multipurpose Cadastre: integrated land information system containing legal information in a common and accurate reference framework; 3° Télédétection : technique qui permet d’obtenir des données ou des informations sur l’environnement et la couverture du sol en utilisant des photographies ou des images prises à partir des avions ou des satellites; 4° Relevé hydrographique : processus de collecte des informations sur les eaux navigables, telles que les lacs et les rivières, pour des raisons de navigation sûre des navires ; 5° Relevé géodésique : relevé de haute précision qui établit un réseau de points repères sur la surface terrestre utilisé comme référence pour établir et redéfinir la localisation d’une parcelle ; 6° Arpentage : technique qui mesure l’étendue physique réelle d’une parcelle ou d’un terrain, délimitée par les bornes (arbres, pierres angulaires entassées, béton ou autres types de bornage) fixées dans le sol et dont une fiche cadastrale est dressée sur base des données récoltées ; 12° Ikibanza: ni igice cy’ubutaka gifite imbibi n’icyo kigenewe gukoreshwa ahanini bizwi kandi kikaba gifite isano n’uburenganzira ku mitungire yacyo ku buryo bwemewe n’amategeko; 8° Geodetic Survey: a high accurate survey that establishes a network of landmarks on the earth surface used as a reference to determine and to re-define a plot location; 9° Cadastral Map: a map showing the boundaries of the subdivisions of land for purposes of describing and recording ownership and taxation; 10° Topographic Map: a map that represents the relief and essential physical phenomenon, natural and artificial, observed on a territory; 11° Thematic Map: a map depicting selected kinds of information relating to one or more specific themes of earth surface; 12° Land Parcel: portion of land with boundaries and use generally known and has some implications on land ownership; référentiel commun et précis ; 8° Plan Cadastral : plan qui montre les limites des subdivisions parcellaires d’une portion du terrain pour des besoins d’allocation et d’enregistrement du droit de propriété et de taxation ; 9° Carte topographique : carte représentant le relief et les principaux phénomènes physiques, naturels et artificiels, qui sont visibles sur un territoire ; 10° Levé topographique (Altimétrie) : relevé qui mesure l’altitude des points sur une portion particulière de la terre et qui permet de dresser les courbes de niveau topographiques ; 11° Carte thématique : carte qui montre des types d’informations sélectionnée relative à un ou plusieurs thèmes spécifiques qui caractérisent la surface terrestre ; 12° Parcelle : portion de terre avec des limites et un usage généralement connus et qui a des implications sur le droit de propriété foncière ; 14° Cadastre: a methodically arranged public inventory of data concerning all legal land objects in a territory of a country or a region, based on a survey of their boundaries by indicating, for each different object, its nature, its area, its value, the rights and obligations associated to it as well as the owner; 15° National Geodetic Network: a national network of triangular polygons which are measured exactly by techniques of terrestrial surveying or by satellite geodesy, and determine precisely landmarks that are critical for land survey, cadastral survey and mapping; UMUTWE WA II: INSHINGANO N’UBUBASHA BYA NLC Ingingo ya 5: Inshingano za NLC Inshingano z’ingenzi za NLC ni izi zikurikira: NLC ni rwo rwego rushinzwe gucunga, kugenzura no guhuza ibikorwa birebana n’imicungire y’ubutaka, igenamigambi ry’imikoreshereze y’ubutaka n’imicungire y’imikoreshereze yabwo. By’umwihariko, NLC ifite inshingano zikurikira: 1° kugira uruhare mu gutegura politiki n’ingamba ku bijyanye n’imicungire n’imikoreshereze y’ubutaka mu Rwanda; 2° kwita ku bijyanye n’ubutaka byose no guhagararira Leta mu bijyanye no analyzing geographical information system (GIS) through teledetection system as well as through global positioning sytem technology and remote sensing system (GPS). CHAPTER II: RESPONSIBILITIES AND POWERS OF NLC Article 5: Responsibilities of NLC NLC shall have the following main responsibilities: NLC shall be the organ responsible for overall management and coordination of all activities related to land administration, land use planning and management. NLC shall particularly have the following responsibilities: 1° to participate in preparation of policy and strategies in matters related to landmanagement and use in Rwanda; 2° to supervise all land-related matters and represent the State in matters relating to d’appareils électroniques et informatiques dotés d’un système d’information géographique (SIG) au moyen d’un système de télédétection et d’un système de positionnement global (GPS). CHAPITRE II : ATTRIBUTIONS ET COMPETENCES DE NLC Article 5: Attributions de NLC Le NLC a les principales attributions suivantes : Le NLC est l’organe chargé de gérer, superviser et coordonner toutes les activités relatives à l’administration foncière, à l’utilisation et à l’aménagement des terres. NLC est particulièrement chargé de: 1° participer à l’élaboration des politiques et stratégies relatives à la gestion et à l’utilisation des terres au Rwanda ; 2° superviser toutes les questions relatives au domaine foncier et O.G. n°31 of 03/8/2009 17 gukurikirana no kugenzura ibijyanye n’imicungire y’ubutaka mu Rwanda; 3° gukora cyangwa gukoresha ibipimo by’inyigo y’imiterere ku bumenyi bw’isi, ibipimo by’imiterere y’ubutaka, iby’ibibanza n’amasambu, ibijyanye n’amazi, byose bishingiye ku mutungo w’ubutaka n’uw’amazi; 4° gutegura, gusakaza no gushyira ahagaragara amakarita anyuranye n’ibishushanyo bijyanye n’imitunganyirize y’ubutaka hakoreshejwe intera zabugenewe; 5° gushyiraho no kubungabunga amakuru yose ajyanye n’ibipimo by’Igihugu bijyanye n’imiterere y’isi; 6° gutegura no gukosora buri gihe amakarita y’imiterere y’ubutaka n’ayandi makarita anyuranye; 7° gushyiraho ibipimo ngenderwaho ku micungire y’ubutaka, ku bipimo by’ubutaka, amakuru yerekeye ikoranabuhanga ku bumenyi bw’isi n’ubw’ikirere, amakarita y’ubumenyi bw’isi, amakuru ku bintu byose biri ku butaka bw’Igihugu n’ibibukorerwaho byose hisunzwe ikoranabuhanga n’ibindi biteganywa na Komisiyo y’Ubutaka ku supervision and monitoring issues related to land management in Rwanda; 3° to execute or cause to be executed geodetic, topographic, hydrographic and cadastral surveys in relation to land and water resources; 4° to prepare, to disseminate and to publish various maps and masterplans relating to land management using the most appropriate scales; 5° to establish and to maintain a national geodetic network control system; 6° to establish and to update basic topographic maps and thematic maps; 7° to define standards for land administration, land surveys, the geo information, spatial information and land information data collection and all cartographic representations of geographic features, national spatial data infrastructure and others that may be defined by the National Land Commission; 6° établir et garder à jour les cartes topographiques de base et les cartes dérivées ; 7° définir les normes pour l’administration foncière, l’arpentage, la géo-information et l’information spatiale, la collecte des données foncières et toutes les représentations cartographiques des entités géographiques, l’infrastructure des données spatiales nationales et d’autres qui sont définies par la O.G. n°31 of 03/8/2009 18 rwego rw’Igihugu; 12° kugira inama no gufasha Ibiro by’Ubutaka mu Turere mu rwego rwo gushyira mu bikorwa Politiki y’Igihugu y’Ubutaka n’Itegeko Ngenga rigena imikoreshereze n’imicungire y’ubutaka mu Rwanda; 13° kwakira no gusuzuma inyandiko zisaba 8° to provide access to land information, including land survey records, to any natural or legal person at a fee to be determined by the National Land Commission; 9° to coordinate all land information network for both national and District land registration systems; 10° to play a basic role in determining and commissioning aerial photography, its rectification and the production of photomap products; 11° to prepare guidelines, principles, instructions and planification on land use throughout the country; 12° to advise and provide support to District Land Bureaux in the implementation of the National Land Policy and the Organic Law determining the use and management of land in Rwanda; 13° to receive and evaluate proposals to Commission Foncière Nationale; 8° rendre disponibles les données foncières y compris celles d’arpentage, à toute personne physique ou morale intéressée moyennant paiement des frais fixés par la Commission Foncière Nationale; 9° coordonner le réseau d’information foncière des systèmes d’enregistrement foncier tant au niveau national qu’au niveau des districts; 10° jouer le rôle de premier plan dans la détermination et dans la commande des photographies aériennes, leur rectification et la production des cartes photographiques ; 11° établir une ligne directrice, les principes les instructions et la planification en matière de gestion foncière à travers tout le pays ; 12° conseiller et apporter un appui aux Bureaux Fonciers des Districts dans la mise en application de la Politique Nationale Foncière et de la Loi Organique portant régime foncier ; purchase or lease private state-owned land and to issue, on behalf of the Government, long term leases and permits to occupy on such lands in accordance with the Organic Law determining the use and management of land in Rwanda; 14° to monitor and to enforce the execution of terms of conditions of land lease and to recommend amendments of the terms of the contract referred to in item 13 of this article; 15° to administer supporting revenue documents and account for all taxes, rents and other monies payable in respect of the sale and lease of land as may be prescribed by particular laws; 16° to undertake all State land valuation for the purposes of their classification for sale, lease or land cession; 17° to prepare for the National Land Centre a fair and just procedure to implement and set standards for the effective administration of land; 19° to participate in policy formulation and specifications for the regular acquisition of aerial imagery from aircraft and satellites for standard mapping purposes; 20° to initiate studies and formulate policy recommendations on the feasibility of specific land development projects; 21°to cooperate with other agencies and international organizations which have a close relationship with land use and management practices; 22° to carry out an inventory of all land resources in the country, their quality and their use, and act as the keeper and custodian of all national maps, aerial photomaps collections, and their databases; 23°to keep and to maintain the National Land Registry as a spatial database of land registration and the rights on land; 18° développer et gérer efficacement un système national de base des données foncières; 21° coopérer avec différentes agences tant nationales qu’internationales qui œuvrent dans le domaine de l’amélioration de la gestion de l’utilisation des terres; 22° dresser et conserver un inventaire détaillé de toutes les ressources foncières, leur qualité, leur degré modèle d’utilisation tout en jouant le rôle d’archives nationales et le gérant de toutes les cartes, les plans, les collections des photos, cartes ainsi que leurs bases de données ; 23° garder et maintenir le registre foncier national de la façon d’une base de données spatiale de l’enregistrement O.G. n°31 of 03/8/2009 21 mu buryo bw’ikoranabuhanga; 24° kuba urwego rushinzwe gukemura amakimbirane ajyanye n’imikoreshereze n’imitunganyirize y’ubutaka atashoboye gukemurwa n’inzego zibishinzwe ku rwego rw’Akarere cyangwa urw’Umujyi wa Kigali cyagejejweho n’inzego zibishinzwe; 25° haseguriwe ibiteganywa n’amategeko yihariye ku birebana n’Imijyi n’ahafatwa nkayo, gutegura ibishushanyo by’imikoreshereze y’ubutaka ku rwego rw’Igihugu cyangwa rw’Akarere. Ingingo ya 6: Ububasha bwa NLC Mu rwego rwo gusohoza inshingano zayo, Ikigo ‘NLC’ gifite ububasha bukurikira : 1° gukurikirana, gutunganya no guha uburenganzira inzego zose z’imirimo zigira uruhare mu micungire, mu igenamigambi ry’imikoresheze no mu micungire y’ikusanyamakuru by’ubutaka; 2° gukusanya amakuru yose ku bijyanye 24° to act as an organ to resolve conflicts relating to land use and management which were not resolved by relevant authorities at the District or City of Kigali levels which were referred by appropriate authorities; 25° without prejudice to provisions of specific laws relating to Cities and the related areas, to prepare policies master plans of the use of land at the national or District level. Article 6: Powers of NLC NLC has the following powers in order to fulfill its responsibilities: 1° to monitor, organize and grant rights to all functional bodies involved in land management, land use planning and land information management; 2° to collect all land information in order des terres, ainsi que les droits sur la terre; 24° servir d’organe administratif pour résoudre les conflits d’utilisation et d’aménagement des terres qui ne peuvent pas être résolus par les organes compétents au niveau du District ou de la Ville de Kigali adressés au Centre NLC par les autorités compétentes; 25° préparer, sans préjudice des dispositions des lois particulières relatives à l’aménagement urbain, les plans d’aménagement foncier au niveau national ou du District. Article 6: Compétences du NLC Dans le cadre de la réalisation de sa mission, NLC jouit de la compétence suivante: 1° assurer le suivi, l’organisation et autoriser tous les organes professionnels impliqués dans l’administration, la planification de l’utilisation et la gestion de l’information foncières; 2° collecter toutes les informations en O.G. n°31 of 03/8/2009 22 n’ubutaka kugira ngo NLC ibe ububiko bw’amakuru yose yerekeranye n’ubutaka ; 3° gukurikirana ko amategeko agenga ubutaka akurikizwa neza. Kubera izo mpamvu, abakozi ba NLC bashobora guhabwa ububasha nk’ubw’abagenzacyaha na Minisitiri ufite ubutabera mu nshingano ze abisabwe na Minisitiri ushinzwe ubutaka; 4° gutanga amabwiriza yo mu rwego rwa tekiniki ku biro by’ubutaka by’Uturere ku byerekeye imicungire n’imikoreshereze y’ubutaka; 5° kugenzura no guhamya ibipimo n’amakuru ajyanye n’ubutaka, amakarita anyuranye no kwemeza ibipimo by’ubutaka byakozwe; 6° hakoreshejwe inyandiko ifite ikirangantego gisanzwe cyayo, NLC ishobora kwifashisha urwego rwa Leta cyangwa abikorera bakoranye amasezerano hakoreshejwe inyandiko ifite ikirango cyayo to develop a land related data base; 3° to ensure effective enforcement of land laws and regulations. Specifically, NLC has powers to conduct inspection, to suspend and to demolish constructions that do not conform to designated land uses or suppress regulations on use and management of land. For that purpose, the Minister in charge of Justice may appoint NLC employees to act as Judicial Police Officers upon request of the Minister in charge of lands. 4° to issue technical instructions related to land administration and management to District Land Bureaux; 5° to check and to approve surveys and geo-referenced data, various maps and to approve land surveys carried out; 6° to seek support from public or private organs with which NLC has signed contracts, using a document bearing its ordinary logo; vue de la constitution d’une base de données en matière foncière ; 3° veiller à la bonne application de la législation foncière. A cette fin, le Ministre ayant la justice dans ses attributions peut conférer la qualité d’Officier de Police Judiciaire aux agents du NLC sur demande du Ministre ayant les terres dans ses attributions. 4° donner des instructions techniques aux bureaux fonciers des Districts en rapport avec l’administration et la gestion foncière; 5° vérifier et approuver les données géo référenciées, les différentes cartes et certifier toutes les mesures d’arpentage effectuées ; 6° se faire assister par les instances publiques ou privées avec lesquelles NLC a conclu des contrats à travers un document portant son logo ordinaire; O.G. n°31 of 03/8/2009 23 gisanzwe; 7° kuba urwego rwemewe rugurisha amakarita anyuranye n’amakuru yose ayakomokaho, gufasha abantu gupima ubutaka no gukora amakarita anyuranye ku giciro kigenwa na Komisiyo y’Ubutaka ku rwego rw’Igihugu. UMUTWE WA III: URWEGO RUREBERERA NLC Ingingo ya 7: Urwego rureberera NLC n’amasezerano ya gahunda y’ibikorwa NLC irebererwa na Minisiteri ifite ubutaka mu nshingano zayo. Hagati y’iyo Minisiteri n’Inama y’Ubuyobozi, hakorwa amasezerano yerekeye gahunda y’ibikorwa agaragaza ububasha, uburenganzira n’inshingano bya buri ruhande mu kugera ku nshingano za NLC. Ayo masezerano amara igihe gihwanye na manda y’abagize Inama y’Ubuyobozi, akanashyirwaho umukono na Perezida w’Inama y’Ubuyobozi na Minisitiri ureberera NLC. 7° to act as a recognized organ to sell various maps and related data, to facilitate individuals conducting land surveys and design various maps at a price determined by the National Land Commission. CHAPTER III: SUPERVISING AUTHORITY OF NLC Article 7: Supervising authority of NLC and contract of performance NLC shall be supervised by the Ministry in charge of Lands. There shall be concluded a performance contract between the Ministry and NLC Board of Directors indicating powers, rights and responsibilities of each party in fulfilling the responsibilities of NLC. Such a contract shall be valid for a period equal to the term of office of the Board members and shall be signed by the Chairperson of the Board of Directors and the Minister supervising NLC. 7° servir d’organe officiellement reconnu pour la vente des différentes formes de cartes et des données y relatives, aider les particuliers dans l’analyse pédologique et la cartographie moyennant un prix fixé par la Commission Nationale Foncière. CHAPITRE III: ORGANE DE TUTELLE DU NLC Article 7: Organe de tutelle du NLC et Contrat de performance NLC est placé sous tutelle du Ministère ayant les terres dans ses attributions. Il est signé, entre ce Ministère et le Conseil d’Administration du NLC, un contrat de performance déterminant les pouvoirs, les droits et les obligations de chaque partie en vue de la réalisation de la mission du NLC. Ce contrat est valide pour une durée égale au mandat des membres du Conseil d’Administration et est conjointement signé par le Président du Conseil d’Administration et le Ministre de tutelle du NLC. O.G. n°31 of 03/8/2009 24 Ingingo ya 8: Ibikubiye mu masezerano ya gahunda y’ibikorwa Mu byo amasezerano avugwa mu ngingo ya 7 y’iri tegeko agomba guteganya mu buryo bwumvikana harimo: 1° inshingano z’Inama y’Ubuyobozi; 2° ibigomba kugerwaho na NLC ; 3° aho umutungo wa NLC uva, imikorere yayo n’uburyo buhoraho bwo kubigenzura. UMUTWE WA IV : IMITERERE N’IMIKORERE BYA NLC Ingingo ya 9: Inzego za NLC NLC igizwe n’inzego ebyiri (2) zikurikira: 1° Inama y’Ubuyobozi; 2° Ubuyobozi. Article 8: Contents of the contract of performance The contract referred to in article 7 of this Law shall inter alia specify the following details: 1° responsibilities of the Board of Directors; 2° expected results of NLC; 3° source of the property of NLC, its functioning and regular auditing procedures. CHAPTER IV: ORGANISATION AND FUNCTIONNING OF NLC Article 9: Organs of NLC NLC shall comprise the following two (2) organs: 1° the Board of Directors; 2° the Management. Article 8: Contenu du contrat de performance Le contrat de performance visé à l’article 7 de la présente loi doit préciser notamment les points suivants : 1° les attributions du Conseil d’Administration; 2° les résultats attendus du NLC; 3° la provenance du patrimoine du NLC, son fonctionnement et les modalités de son audit permanent. CHAPITRE IV: ORGANISATION ET FONCTIONNEMENT DU NLC Article 9: Organes du NLC NLC est doté de deux (2) organes suivants: 1° le Conseil d’Administration; 2° la Direction. Ingingo ya 11: Inshingano z’Inama y’Ubuyobozi ya NLC Inshingano z’Inama y’Ubuyobozi ya NLC ni izi zikurikira: Section One: Board of Directors Article 10: Management body The Board of Directors shall be the supreme management and decision-making body of NLC. It shall have full powers and responsibilities to manage the property of NLC in order to fulfil its responsibilities. An Order of the Prime Minister shall appoint seven (7) members of the Board of Directors including the Chairperson and the Deputy Chairperson. At least thirty (30%) of the members of the Board of Directors shall be women. Members of the Board of Directors shall have a mandate of three (3) years renewable only once. Article 11: Responsibilities of NLC Board of Directors NLC Board of Directors shall have the following responsibilities: Section première : Conseil d’Administration Article 10: Organe de gestion Le Conseil d’Administration du NLC est l’organe suprême de gestion et de décision du NLC. Il est investi des pouvoirs étendus afin d’assurer la gestion du patrimoine pour la réalisation de la mission du NLC. Un Arrêté du Premier Ministre nomme sept (7) membres du Conseil d’Administration dont un Président et un Vice-président. Trente pour cent (30%) au moins des membres du Conseil d’Administration sont du sexe féminin. Les membres du Conseil d’Administration sont désignés pour un mandat de trois (3) ans renouvelable une seule fois. Article 12: Convening of Board of Directors and mode of taking decisions NLC Board of Directors shall meet once a term in an ordinary session and whenever necessary in an extraordinary session. Article 12: Invitation du Conseil d’Administration et mode de prise de décisions Le Conseil d’Administration du NLC se réunit une fois par trimestre en session ordinaire et, chaque fois que de besoin, en session extraordinaire. Article 13: Invitation of a resourceful person to the Board of Directors meetings The Board of Directors may invite to its meetings any person from whom it may seek advice on a certain issue on the agenda. Article 14: Resolutions and minutes of the Board of Directors meeting The Board resolutions shall be signed by its members as soon as the meeting ends and a copy thereof shall be sent to the Minister supervising NLC within five (5) days for his/her views and opinions within fifteen (15) days from its receipt. After this period with no reaction from the Minister, the resolutions shall be deemed definitively approved. Article 19: Attributions particulières du Directeur du NLC en tant que Conservateur des Titres Fonciers Le Directeur du NLC a les attributions particulières suivantes : 1° conserver les titres fonciers de tout le territoire national; 2° coordonner et superviser les activités des Conservateurs des titres fonciers adjoints; 3° délivrer des actes pour les terres prévues aux articles 12, 15 et 72 de la Loi Organique n° 8/2005 du 14/07/2005 portant régime foncier au Rwanda; 4° désigner le Conservateur des titres fonciers parmi ses adjoints qui le remplace en cas d’empêchement pour une période de plus de quinze (15) jours; 5° désigner le Conservateur des titres foncier adjoint, en cas de besoin, qui assiste le Conservateur des titres fonciers adjoint d’un autre ressort. D’une façon particulière, le Conservateur des titres fonciers adjoint a les attributions suivantes dans son ressort : 1° apposer sa signature sur les titres fonciers et sur les contrats de location de terre de longue durée; 2° approuver l’aliénation définitive des terres; 3° enregistrer et rayer du registre la garantie sur la propriété immobilière muni d’un titre ; 4° approuver la cession de droits sur la propriété immobilière ; 5° procéder au transfert de garantie ; 6° approuver la perte du titre foncier. Abakozi ba NLC bagengwa n’amategeko rusange agenga abakozi ba Leta n’inzego z’imirimo ya Leta. UMUTWE WA V: UMUTUNGO N’IMARI BYA NLC Ingingo ya 23: Ibigize umutungo wa NLC n’aho ukomoka Umutungo wa NLC ugizwe n’ibi bikurikira: 1° ingengo y’imari igenerwa na Leta; 2° ibikomoka ku mirimo ikora; 3° inkunga zaba iza Leta cyangwa of NLC shall be determined in accordance with legal provisions governing remuneration of staff members of public institutions. Article 22: Organizational structure and job descriptions of NLC The organizational structure and job description of NLC shall be determined by an Order of the Prime Minister upon proposal by the Minister supervising NLC, after consultation with the Board of Directors. NLC staff members shall be governed by the General statutes for Rwanda Public Service. CHAPTER V: PROPERTY AND FINANCE OF NLC Article 23: Composition and source of NLC property NLC shall derive its property from the following: 1° State budget allocations; 2° Revenue from services rendered ; 3° Government or donor grants; et au personnel du NLC sont prévus par les lois régissant la rémunération du personnel des établissements publics. Article 22: Structure et cadre organique du NLC L’organisation et le cadre organique du NLC sont déterminés par Arrêté du Premier Ministre, sur proposition du Ministre de tutelle du NLC, après avis du Conseil d’Administration. Le personnel du NLC est régi par le Statut général de la fonction publique rwandaise. CHAPITRE V: PATRIMOINE ET FINANCES DU NLC Article 23: Composition et source du patrimoine du NLC Le patrimoine du NLC provient: 1° des dotations du budget de l’Etat; 2° du produit des services prestés; 3° des subventions de l’Etat ou des O.G. n°31 of 03/8/2009 37 iz’abaterankunga; 4° impano n’indagano. UMUTWE WA VI:INGINGO Z’INZIBACYUHO N’IZISOZA Ingingo ya 26: Ububasha bwimuriwe muri NLC Guhera igihe iri tegeko ritangarijwe mu Igazeti ya Leta ya Repubulika y’u Rwanda, 4° donations and bequests. Article 24: Use, management and audit of property of NLC Use, management and audit of NLC property shall be carried out in accordance with relevant laws. NLC internal audit department shall submit a report to the Board of Directors with a copy to the Director of NLC. Article 25: Budget of NLC The budget of NLC shall be approved and managed in accordance with relevant Laws. CHAPTER VI: TRANSITIONAL AND FINAL PROVISIONS Article 26: Powers transferred to NLC Upon publication of this Law in the Official Gazette of the Republic of Rwanda, land donateurs; 4° des dons et legs. Article 24 : Utilisation, gestion et audit du patrimoine du NLC L’utilisation, la gestion et l’audit du patrimoine du NLC sont effectués conformément aux dispositions légales en la matière. Le Service d’audit interne de NLC transmet son rapport au Conseil d’Administration et réserve copie au Directeur du NLC. Article 25: Budget du NLC Le budget du NLC est adopté et géré conformément aux dispositions légales en la matière. CHAPTER VI: DISPOSITIONS TRANSITOIRES ET FINALES Article 26 : Compétences transférées à NLC A partir de la date de la publication de la présente loi au Journal Officiel de la O.G. n°31 of 03/8/2009 38 imirimo ifitanye isano n’imicungire y’ubutaka n’indi mirimo ijyanye n’imicungire n’imikoreshereze y’ubutaka, iri mu nzego za Leta zinyuranye byimuriwe muri NLC. Imirimo, ibikoresho, ibitabo by’ubutaka, amakarita anyuranye n’amakuru ajyanye nayo n’izindi nyandiko z’ubutegetsi biri mu nzego za Leta zavuzwe haruguru nabyo byimuriwe muri NLC. Iteka rya Minisitiri w’Intebe rigena ibyimurirwa muri NLC. Ingingo ya 27: Itegurwa, isuzumwa n’itorwa ry’iri tegeko Iri tegeko ryateguwe mu rurimi rw’icyongereza, risuzumwa kandi ritorwa mu rurimi rw’ikinyarwanda. Ingingo ya 28: Ivanwaho ry’ingingo zinyuranyije n’iri tegeko Ingingo zose z’amategeko abanziriza iri kandi zinyuranyije na ryo zivanyweho. management-related functions and other functions related to land use and management that are entrusted to various public entities are hereby transferred to NLC. Functions, equipment, land registers, various maps and related data as well as other relevant administrative documents in public entities referred to in the preceding paragraph shall also be transferred to the NLC. An Order of the Prime Minister shall determine what to be transferred to NLC. Article 27: Drafting, consideration and adoption of this Law This Law was drafted in English, considered and adopted in Kinyarwanda. Article 28: Repealing of inconsistent provisions All prior legal provisions inconsistent with this Law are hereby repealed. République du Rwanda, les fonctions relatives à la gestion des terres et autres fonctions relatives à la gestion et à l’utilisation des terres précédemment dévolues aux différentes entités publiques sont transférées à NLC. Les fonctions, le matériel, les documents fonciers, les cartes diverses et les données y relatives ainsi que d’autres documents administratifs y afférents des entités publiques visées à l’alinéa précédent sont également transférés à NLC. L’Arrêté du Premier Ministre détermine ce qui doit être transféré à NLC. Article 27 : Initiation, examen et adoption de la présente loi La présente loi a été initiée en anglais, examinée et adoptée en Kinyarwanda. Article 28 : Disposition abrogatoire Toutes les dispositions légales antérieures contraires à la présente loi sont abrogées.
