Ingingo ya 2 : Ibisobanuro by‟amagambo Muri iri tegeko, amagambo akurikira afite ibisobanuro bikurikira : 1° Urubyiruko: umuntu ufite kuva ku myaka cumi n‘itandatu (16) kugeza ku myaka mirongo itatu (30) y‘amavuko. 2° Inama y‟Igihugu y‟Urubyiruko: urubuga urubyiruko ruhuriramo, rukungurana ibitekerezo hagamijwe kwiteza imbere no guteza imbere Igihugu. ADOPTS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Law This Law determines the mission, organization and functioning of the National Youth Council. Article 2: Definition of terms In this law, the following terms shall have the following meanings: 1° youth: any person aged between sixteen (16) and thirty (30) years; 2° National Youth Council: a platform that provides opportunities for the youth to share ideas for self and national development. Article 3: Autonomy of the National Youth Council The National Youth Council shall have legal personality, financial and administrative autonomy. ADOPTE : CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier : Objet de la présente loi La présente loi porte mission, organisation et fonctionnement du Conseil National de la Jeunesse. Article 2 : Définition des termes Aux fins de la présente loi, les termes repris ci après ont les significations suivantes : 1° jeunesse : toute personne âgée de seize (16) ans à trente (30) ans ; 2° Conseil National de la Jeunesse : cadre de rencontre de la jeunesse pour l‘échange d‘idées en vue de leur propre développement et du développement national. Article 3 : Autonomie du Conseil National de la Jeunesse Le Conseil National de la Jeunesse jouit de la personnalité juridique et de l‘autonomie financière et administrative. Inama y‘Igihugu y‘Urubyiruko igirana amasezerano y‘imihigo na Minisiteri ifite urubyiruko mu nshingano zayo yerekeye gahunda y‘ibikorwa n'isuzumamikorere. Amasezerano y‘imihigo agaragaza ububasha, uburenganzira n‘inshingano bya buri ruhande mu kugeza Inama y‘Igihugu y‘Urubyiruko ku nshingano zayo. Ingingo ya 5: Icyicaro cy‟Inama y‟Igihugu y‟Urubyiruko Inama y‘Igihugu y‘Urubyiruko ifite icyicaro cyayo mu Mujyi wa Kigali, Umurwa Mukuru wa Repubulika y‘u Rwanda. Icyicaro cyayo gishobora kwimurirwa ahandi mu Rwanda igihe cyose bibaye ngombwa. Ingingo ya 6: Inshingano z‟Inama y‟Igihugu y‟Urubyiruko Inama y‘Igihugu y‘Urubyiruko ifite inshingano zikurikira : 1° kujya inama no gukora ubuvugizi kuri politiki zisubiza ibibazo by‘urubyiruko; Article 4: Supervising authority of the National Youth Council The National Youth Council shall be under the supervision of the Ministry in charge of youth. The National Youth Council shall enter into a performance contract relating to the action plan and evaluation with the Ministry in charge of youth. The performance contract shall indicate competence, rights and obligations of each party in order to help the National Youth Council to fulfil its mission. Article 5: Head office of the National Youth Council The head office of the National Youth Council shall be located in Kigali City, the Capital of the Republic of Rwanda. The head office of the National Youth Council may be transferred elsewhere on the Rwandan territory, if considered necessary. Article 6: Responsibilities of the National Youth Council The National Youth Council shall have the following responsibilities: 1° to consult on and advocate for policies that are responsive to the problems facing the youth; Article 4 : Organe de tutelle du Conseil National de la Jeunesse Le Conseil National de la Jeunesse est placé sous la tutelle du Ministère ayant la jeunesse dans ses attributions. Le Conseil National de la Jeunesse conclut avec le Ministère ayant la jeunesse dans ses attributions un contrat de performance portant sur le plan d‘action et l‘évaluation. Le contrat de performance détermine les compétences, les droits et les obligations de chaque partie dans la réalisation de la mission assignée au Conseil National de la Jeunesse. Article 5 : Siège du Conseil National de la Jeunesse Le siège du Conseil National de la Jeunesse est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Le siège du Conseil National de la Jeunesse peut, en cas de besoin, être transféré en tout autre lieu du territoire du Rwanda. Article 6: Attributions du Conseil National de la Jeunesse Le Conseil National de la Jeunesse a les attributions suivantes: 1° faire des consultations et le plaidoyer en faveur des politiques répondant aux problèmes de la jeunesse ; Official Gazette n° Special of 05/02/2016 10 2° gushyira mu bikorwa ingamba zigamije guteza imbere urubyiruko ; 3° gukangurira urubyiruko kwiga imyuga, ubukorikori n‘ikoranabuhanga no guhanga umurimo; 4° kugira uruhare mukuvumbura no guteza imbere impano mu rubyiruko. 5° kugira uruhare mu gutoza urubyiruko indangagaciro z‘umuco nyarwanda no guteza imbere ururimi rw‘Ikinyarwanda ; 6° gukangurira urubyiruko kurwanya jenoside n‘ingengabitekerezo yayo, no kurwanya amacakubiri n‘ibindi bikorwa byose byasenya Igihugu; 7° kugira uruhare mu gushyigikira no gukurikirana imikorere y‘amakoperative, amashyirahamwe n‘indi miryango by‘urubyiruko; 8° gutoza urubyiruko kwikemurira ibibazo no kurukangurira kugira uruhare mu ifatwa ry‘ibyemezo, mu bikorwa byarwo no kujya mu nzego zifata ibyemezo; 9° gushyiraho no gukurikirana gahunda zo gukangurira urubyiruko ibijyanye no kwirinda kwishora mu biyobyabwenge, 2° to implement youth economic empowerment strategies; 3° to sensitize the youth to take technical, vocational and technological training and embrace entrepreneurship; 4° to participate in the detection and development of talents among the youth; 5° to contribute to inculcating values of the Rwandan culture into the youth and promoting Ikinyarwanda; 6° to sensitize the youth to fight genocide and its ideology, divisionism and any other acts that are likely to destroy the country; 7° to contribute in supporting and monitoring the functioning of youth cooperatives, associations and other youth organizations; 8° to educate the youth on finding solutions to their problems, mobilize them to take part in decision-making processes and in their activities and to join decision making organs; 9° to put in place and monitor programs aimed at sensitizing the youth to avoid the 2° mettre en œuvre les stratégies d‘autonomisation économique de la jeunesse; 3° sensibiliser la jeunesse à la formation technique, professionnelle et technologique et à l‘entreprenariat; 4° participer à la détection et au développement des talents chez la jeunesse ; 5° contribuer à l‘inculcation des valeurs de la culture rwandaise à la jeunesse et à la promotion d‘ikinyarwanda; 6° sensibiliser la jeunesse à la lutte contre le génocide, l‘idéologie du génocide, le divisionnisme et tous autres actes de nature à détruire le pays; 7° contribuer à soutenir et surveiller le fonctionnement des coopératives, des associations et autres organisations de la jeunesse; 8° éduquer la jeunesse à la recherche des solutions à ses problèmes, la mobiliser à participer aux processus de prise de décisions et à ses activités et à entrer dans les instances de décision; 9° mettre en place et faire le suivi des programmes visant à sensibiliser la jeunesse à éviter la consommation de Official Gazette n° Special of 05/02/2016 11 kwirinda ibibazo bishingiye ku buzima bw‘imyororokere n‘izindi ngeso zangiza ubuzima; 10° guteza imbere ubutwererane n‘umubano mwiza hagati y‘urubyiruko rw‘u Rwanda n‘urubyiruko rwo mu mahanga. UMUTWE WA II : IMITUNGANYIRIZE N‟IMIKORERE BY‟INAMA Y‟IGIHUGU Y‟URUBYIRUKO Icyiciro cya mbere: Inzego z‟Inama y‟Igihugu y‟Urubyiruko, imiterere, imikorere n‟imikoranire yazo n‟izindi nzego Ingingo ya 7: Inzego z‟Inama y‟Igihugu y‟Urubyiruko Inama y‘Igihugu y‘Urubyiruko ifite inzego eshatu (3) zikurikira: 1° Inteko Rusange ni rwo rwego rukuru ruyobora, rukanafata ibyemezo by‘Inama y‘Igihugu y‘Urubyiruko; 2° Komite Nyobozi, ni urwego rushinzwe gushyira mu bikorwa ibyemezo byafashwe n‘Inama Rusange no guhuza ibikorwa by‘abafatanyabikorwa; 3° Ubunyamabanga Nshingwabikorwa, ni urwego tekiniki rushinzwe imikorere ya buri munsi, rugashyira mu bikorwa use of narcotics, sexual risk behaviours and any other behaviours detrimental to health; 10° to promote cooperation and good relationship between the Rwandan youth and the youth from abroad. CHAPTER II: ORGANIZATION AND FUNCTIONING OF THE NATIONAL YOUTH COUNCIL Section One: Organs of the National Youth Council, their organization and functioning and relationship with other organs Article 7: Organs of the National Youth Council The National Youth Council shall have the three (3) following organs: 1° the General Assembly which is the supreme management and decision making organ of the National Youth Council; 2° the Executive Committee which is the organ responsible for implementing resolutions of the General Assembly and coordinating partners‘ activities; 3° the Executive Secretariat which is the technical organ responsible for the day to-day functioning and implementation of stupéfiants, les comportements sexuels à risque et d‘autres vices préjudiciables à la santé ; 10° promouvoir la coopération et les bonnes relations entre la jeunesse du Rwanda et la jeunesse de l‘étranger. CHAPITRE II: ORGANISATION ET FONCTIONNEMENT DU CONSEIL NATIONAL DE LA JEUNESSE Section première : Organes du Conseil National de la Jeunesse, leurs organisation et fonctionnement et relations avec d‟autres organes Article 7: Organes du Conseil National de la Jeunesse Le Conseil National de la Jeunesse a les trois (3) organes suivants : 1° l‘Assemblée Générale qui est l‘organe suprême de direction et de décision du Conseil National de la Jeunesse; 2° le Comité Exécutif qui est l‘organe de mise en œuvre des résolutions de l‘Assemblée Générale et de coordination des activités des partenaires; 3° le Secrétariat Exécutif qui est l‘organe technique chargé du fonctionnement quotidien et de la mise en œuvre des Official Gazette n° Special of 05/02/2016 12 ibyemezo by‘Inama Rusange n‘ibya Komite Nyobozi ku rwego rw‘Igihugu. Ingingo ya 8: Imikoranire y‟Inama y‟Igihugu y‟Urubyiruko n‟izindi inzego Inzego z‘imiyoborere y‘Igihugu zikorana n‘Inama y‘Igihugu y‘Urubyiruko mu kuyifasha kugera ku nshingano zayo hagamijwe guteza imbere urubyiruko. Inama y‘Igihugu y‘Urubyiruko ikorana n‘abafatanyabikorwa, igahuza kandi ibikorwa byabo hagamijwe iterambere ry‘urubyiruko. the resolutions of the General Assembly and the Executive Committee at the national level. The General Assembly and the Executive Committee shall operate at the national, District, Sector, Cell and Village levels. The Executive Secretariat shall operate at the national level. A Prime Minister‘s Order shall determine the responsibilities, organization and functioning of the organs of the National Youth Council and responsibilities of members of the Executive Committee. Article 8: Relationship between the National Youth Council and other organs National administrative entities shall collaborate with the National Youth Council to help achieve its mission towards youth promotion. Article 8: Relations entre le Conseil National de la Jeunesse et d‟autres organes Les entités administratives du pays collaborent avec le Conseil National de la Jeunesse pour l‘aider à réaliser sa mission en vue de la promotion de la jeunesse. Article 15: Term of office of members of the Executive Committee and modalities for their election Members of the Executive Committee of the National Youth Council shall, from the Village level to the national level, be elected for a term of five (5) years renewable only once. The General Assembly at each level shall elect from among its members an Executive Committee. Subsection 3: Members of the Executive Secretariat Article 16: Members of the Executive Secretariat and their appointment The Executive Secretariat of the National Youth Council shall be composed of the Executive Secretary and other staff. The Executive Secretary of the National Youth Council shall be appointed to office by a Prime Minister‘s Order. Article 17: Statutes governing members of the Executive Secretariat and their benefits Members of the Executive Secretariat shall be governed by the General Statutes for Public situation de ces écoles. Le Secrétaire Exécutif du Conseil National de la Jeunesse est nommé par Arrêté du Premier Ministre. Article 17:Statut régissant les membres du Secrétariat Exécutif et leurs avantages Les membres du Secrétariat Exécutif sont régis par le Statut Général de la Fonction Publique. Benefits entitled to the Executive Secretary of the National Youth Council shall be determined by a Prime Minister‘s Order. Benefits entitled to other staff members of the Executive Secretariat shall be determined in accordance with legal provisions determining benefits to public servants. Subsection 4: Suspension and dismissal of members of organs and dissolution of organs Article 18: Suspension, replacement and dismissal of members of organs and dissolution of organs The suspension, replacement and dismissal of members of the organs of the National Youth Council as well as the dissolution of its organs shall be determined by a Prime Minister‘s Order. Article 20: Use, management and audit of the property The use, management and audit of the property of the National Youth Council shall be carried out in accordance with the relevant legal provisions. Article 21: Activity report and action plan The National Youth Council annually submits its activity report, action plan and financial report to the Ministry in charge of youth. Article 21: Rapport d‟activités et plan d‟action Le Conseil National de la Jeunesse soumet annuellement son rapport d‘activités, son plan d‘action et son rapport financier au Ministre ayant la jeunesse dans ses attributions. CHAPITRE IV: DISPOSITIONS FINALES Article 22: Initiation, examen et adoption de la présente loi La présente loi a été initiée, examinée et adoptée en ikinyarwanda.
