MINISTERIAL ORDER N°003/11.30 OF 18/08/2010 SETTING FORTH CONDITIONS REQUIRED FOR MARKETING QUALITY SEEDS The Minister of Agriculture and Animal Resources; Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003, especially in Articles 93, 120 and 201; Pursuant to Law n° 14/2003 of 23/05/2003 on Production, Quality Control and Marketing of plant quality seeds, especially in Articles One, 5, 7, 8, 9, 10, 11, 14 and 15; After consideration and approval by the Cabinet, in its session of 14/05/2010; HEREBY ORDERS: Article One: Compliance with regulations Seeds marketed as quality seeds should have been produced in accordance with regulations governing the production of commercial quality seeds. ARRETE MINISTERIEL N°003/11.30 DU 18/08/2010 FIXANT LES CONDITIONS REQUISES POUR LA COMMERCIALISATION DES SEMENCES DE QUALITE Le Ministre de l’Agriculture et des Ressources Animales; Vu la Constitution de la République du Rwanda du 04 juin 2003, spécialement en ses articles 93, 120 et 201 ; Vu la Loi n° 14/2003 du 23/05/2003 portant sur la production, le contrôle de qualité et la commercialisation des semences végétales, spécialement en ses articles premier, 5, 7, 8, 9, 10, 11, 14 et 15; Après examen et adoption par le Conseil des Ministres, en sa séance du 14/05/2010; ARRETE: Article premier: Conformité aux normes Les semences commercialisées comme semences de qualité doivent avoir été produites selon les normes régissant la production des semences commerciales de qualité. Official Gazette nº40 of 04/10/2010 15 Ingingo ya 2: Ibyubahirizwa ku mbuto zicuruzwa Imbuto zicuruzwa zigomba kuba zarakorewe igenzurwa ry’ubwiza hakurikijwe amabwiriza agenga igenzurwa ry’imbuto nziza. Izo mbuto zigomba kuba zifite icyemezo cy’ubwiza gitangwa n’ikigo kibishinzwe kandi kitarengeje amezi atandatu (6) guhera igihe cyatangiweho. Iyo kirengeje icyo gihe nta gaciro kiba gifite. Ingingo ya 3: Imbuto zemewe gucuruzwa Imbuto zemerewe gucuruzwa ni iz’ubwoko bwanditse ku rutonde rw’amoko y’ibihingwa yemewe mu Rwanda zonyine. Ingingo ya 4 : Ibyubahirizwa ku mbuto zitumijwe mu mahanga Imbuto zatumijwe mu mahanga zigenewe gucuruzwa mu Rwanda zigomba kuba zubahirije amabwiriza n’amategeko agenga imbuto zatuburiwe mu Rwanda. Mu gihe ibyo bidashobotse, hakurikizwa ibipimo ngenderwaho mpuzamahanga. Buri gihe izo mbuto zigomba guherekezwa n’icyemezo cyatanzwe n’Igihugu izo mbuto ziturukamo kigaragaza ubwimerere, ubutote, Article 2: Procedures to be followed in marketing quality seeds Commercial seeds should have been subjected to quality control according to standards required for quality seeds. Such seeds shall have a certificate of quality issued by the competent authority and the validity of the certificate shall not exceed six (6) months from the date of issue. Beyond this period, the certificate no longer has value. Article 3: Quality seeds accepted to be marketed Only the seeds of a variety registered on the list of approved varieties in Rwanda may be marketed as quality seeds. Article 4: Conditions required for imported seeds Imported seeds for marketing in Rwanda shall satisfy the standards and regulations governing seeds produced in Rwanda. Where this is not possible, relevant international standards shall apply. These seeds shall always be accompanied by an official certificate from the country of origin, indicating their purity, moisture content, Article 2: Procédures à suivre dans la commercialisation des semences de qualité Les semences commerciales doivent avoir été l’objet du contrôle de qualité selon les normes régissant le contrôle des semences de qualité. Ces semences doivent avoir un certificat de qualité délivré par le service habilité et n’ayant pas dépassé six (6) mois à compter de la date de sa délivrance. Au-delà de cette période le certificat est sans valeur. Article 3: Semences de qualité admises à la commercialisation Seules les semences de variété inscrites dans le catalogue des variétés agréées au Rwanda peuvent être commercialisées comme semences de qualité. Article 4: Conditions requises pour les semences importées Les semences importées destinées à être commercialisées au Rwanda doivent satisfaire aux normes et règles régissant la production des semences de qualité au Rwanda. En cas d’impossibilité, les normes internationales sont d’application. Ces semences doivent toujours être accompagnées d’un certificat officiel du pays d’origine indiquant la pureté, l’humidité, le taux de germination ainsi que l’état sanitaire en ce qui concerne les maladies Official Gazette nº40 of 04/10/2010 16 ubushobozi bwo kumera n’ibigaragaza ko nta ndwara zanduzwa n’imbuto zizirangwamo. Icyo cyemezo ntikigomba kurenza igihe cy’amezi atandatu (6) kuva igihe cyatangiweho. Izo mbuto zigomba gukorerwa igenzurwa hakurikijwe ibipimo ngenderwaho n’amabwiriza agenga imbuto nziza mu Rwanda. Ingingo ya 5: Imiterere y’imbuto zicuruzwa Imbuto zicuruzwa zigomba kuba zitunganyijwe hakurikijwe ibikubiye mu iteka rya Minisitiri rishyiraho amabwiriza asobanura uburyo imbuto zitunganywamo. Ingingo ya 6: Ibisabwa kuba umucuruzi w’imbuto Umuntu ku giti cye cyangwa ishyirahamwe ry’abantu bemerewe gucuruza imbuto nziza bagomba kuba bujuje ibisabwa n’ingingo z’iri teka kandi banditswe mu gitabo cy’urutonde rw’abacuruza imbuto nziza kibarizwa muri Minisiteri ifite ubuhinzi mu nshingano zayo. Ingingo ya 7: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi germination rate and testifying that they are free from any diseases that can be transmitted. Such a certificate shall not exceed six (6) months from the date of issue. The seeds should be inspected according to the standards and regulations relating to seeds in Rwanda. Article 5: Nature of commercial seeds Commercial seeds shall be processed according to the Ministerial Order setting standards for the processing of quality seeds. Article 6: Conditions required for marketing quality seeds Individuals or enterprises authorised to market quality seeds shall fulfill all the requirements of this Order and be listed in the register of quality seed dealers kept at the Ministry in charge of agriculture. Article 7: Repealing provision All prior provisions contrary to this Order are transmissibles par les semences. Ce certificat ne doit pas dépasser une période de six (6) mois à compter de sa date de délivrance. Ces semences doivent faire l’objet d’un contrôle selon les normes et règles régissant les semences au Rwanda. Article 5: Nature des semences commercialisées Les semences commerciales de qualité doivent être conditionnées tel que prévu dans l’arrêté ministériel déterminant les normes régissant le conditionnement des semences de qualité. Article 6: Conditions requises pour commercialiser les semences de qualité Les personnes physiques ou morales autorisées à commercialiser les semences de qualité doivent satisfaire toutes les conditions définies par le présent arrêté et doivent être inscrites au registre des vendeurs des semences de qualité disponible au Ministère ayant l’agriculture dans ses attributions. Article 7: Disposition abrogatoire Toutes les dispositions réglementaires contraires Official Gazette nº40 of 04/10/2010 17 zinyuranyije na ryo zivanyweho. Article 8: Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
