MINISTERIAL ORDER N°006/16.01 OF 15/07/2010 ESTABLISHING SPECIAL REGULATIONS RELATING TO BURYING TOXIC WASTES The Minister of Environment and Lands; Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 49, 120, 121 and 201; Pursuant to Organic Law n° 04/2005 of 08/04/2005 determining the modalities of protection, conservation and promotion of environment in Rwanda, especially in Article 34; After consideration and approval by the Cabinet in its session of 01/04/2010; HEREBY ORDERS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines the modalities of burying toxic wastes. ARRETE MINISTERIEL N°006/16.01 DU 15/07/2010 RELATIF AUX REGLEMENTS PARTICULIERS CONCERNANT L’ENTERREMENT DES DECHETS TOXIQUES Le Ministre de l’Environnement et des Terres ; Vu la Constitution de la République du Rwanda du 04 juin 2003 telle que révisée à ce jour spécialement en ses articles 49, 120 ,121 et 201 ; Vu la Loi Organique n° 04/2005 du 08/04/2005 portant modalités de protéger, sauvegarder et promouvoir l’Environnement au Rwanda en son article 34 ; Après examen et adoption par le Conseil des Ministres, en sa séance du 01/04/2010; ARRETE : CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier : Objet du présent arrêté Le présent arrêté établit les modalités d’enterrer les déchets toxiques. Minisiti w’Ubuzima n’ubuyobozi bw’Akarere imyanda iherereyemo n’ubw’Akarere iteganywa gutabwamo bagomba kubimenywa Article 2: List of toxic wastes It is forbidden to burry toxic wastes referred to in the annex of this order, except in accordance with the provisions of this Order. Article 3: Reviewing the list of toxic wastes The list of toxic wastes attached to this Order shall be reviewed any time it is deemed necessary. Whenever research shows that other toxic wastes not on this list, the Minister in charge of environment may order that those toxic wastes be buried according to the provision of this Order. CHAPTER TWO: MODALITIES OF BURRYING TOXIC WASTES Article 4: Application for authorization to burry toxic wastes Authorization to burry toxic wastes shall be applied for in writing to Rwanda Environment Authority with a copy to the Minister in charge of environment. The Minister in charge of Health, District authorities where the toxic wastes are found and District authorities where those toxic wastes are expected to be buried Article 2 : Liste des déchets toxiques Il est interdit d’enterrer les déchets toxiques repris sur la liste en annexe au présent arrêté, sauf dans les conditions prévues par le présent arrêté. Article 3: Révision de la liste des déchets toxiques La liste des déchets toxiques mentionnée à l’article 2 du présent arrêté est renouvelée à tout moment en cas de besoin. Si les recherches révèlent d’autres déchets toxiques qui ne figurent pas sur la liste, le Ministre ayant l’environnement dans ses attributions peut ordonner que ces déchets soient enterrés conformément aux dispositions du présent arrêté. The application letter for the authorization should be accompanied by a professional study carried out and showing the following: 1° the curriculum Vitae of the owner of toxic wastes to be buried; 2° the name of the Country from which the products that those toxic wastes are from and the names of the producers of those wastes; 3° names of those who ordered them, the time and reasons of ordering them; 4° causes of the intoxication; 5° the names of those who shall burry them and the facilities they have; 6° the size or volume of those toxic wastes; 7° the name of trade mark of those wastes; 8° where they are stocked and how they are stocked; 9° category of those wastes and chemical composition; 10° consequences of those wastes to human lives and the environment in general; 11° where and how those wastes shall be buried and methodology to be used; 12° the type of soil where those wastes are going to be buried so as how to ensure they don’t destroy or affect it; 13° indication of the best way to remove those toxic wastes from where they are to where doivent être enterrés . Le document demandant l’autorisation doit être accompagné par l’étude d’un expert montrant : 1° l’identité de la personne propriétaire des déchets toxiques qui doivent être enterrés; 2° le nom du pays d’origine des produits source de ces déchets et le nom de l’institution qui les a fabriqués ; 3° les noms de la personne qui les a importés, la date et la cause de l’importation ; 4° les causes de l’intoxication ; 5° le nom de la personne qui va les enterrer et sa capacité de le faire ; 6° La quantité de ces déchets toxiques ; 7° noms (commerciaux et nom utilisés par les experts) de ces déchets ; 8° endroit où se trouve le dépôt de ces déchets et la façon dont ils sont conservés ; 9° la catégorie de ces déchets ainsi que leur composition chimique ; 10° les conséquences de ces déchets sur la vie des personnes et l’environnement en général ; 11° l’endroit où les déchets seront enfouis et la méthodologie à utiliser ; 12° le type de sol où ils vont être enterrés et les mesures prises pour éviter les dommages pouvant affecter sa nature ; 13° la bonne méthodologie prévue pour déplacer les déchets de leurs dépôts vers Official Gazette no 35 bis of 30/08/2010 97 14° ko ubwo buryo bwose bwavuzwe haruguru nta ngaruka mbi buzagira ku ihumana ry’ubutaka, amazi y’ikuzimu, amasoko, imigezi, umwuka wo mu kirere no ku buzima bw’abantu; 15° uruhare rw’abafatanyabikorwa bose; 16° ingaruka mbi zose zishobora kuvuka n’uburyo bwose buteganyijwe bwo kuzirinda ndetse no mu gihe habaye impanuka zitunguranye; 17° uko ubugenzuzi n’ikurikirana ry’ingaruka mbi zishobora kuvuka ku bijyanye n’itabwa ry’iyo myanda ihumanya buzakorwa mu gihe kigufi n’igihe kirekire; 18° impamvu zahereweho kugira ngo hasabwe gukoresha ubwo buryo bwo gutaba ikuzimu imyanda ihumanya; 19° ibisobanuro by’inyongera bya ngombwa. Ingingo ya 5: Igihe usaba uruhushya ahabwa igisubizo Usaba uruhushya rwo gutaba imyanda ihumanya ahabwa igisubizo kimwemerera cyangwa kimuhakanira mu gihe kitarenze iminsi makumyabiri (20) uhereye umunsi ibaruwa isaba yagereye ku Kigo cy’Igihugu cyo Kubungabunga Ibidukikije. Iyo aramutse atemerewe amenyeshwa impamvu zashingiweho. they going to be buried; 14° indication on how all those ways mentioned above have no consequences to water, soil, underground water sources, rivers, air space and human lives; 15° indication of the role of all business partners or stakeholders; 16° all the consequences that may occur and all precautions taken and how to intervene in case of accidents and unexpected reactions; 17° indication on how the inspection and follow up of consequences can arise and intervention methods on long and short term bases; 18° reasons for requesting the use of this methodology of burying toxic wastes; 19° supplementary explanation and details. Article 5: Period for the applicant to get an answer The applicant for the authorization to burry the toxic wastes shall get an affirmative or negative answer within a period of twenty (20) days starting from the date the requesting letter has been received by the Rwanda Environment Authority. Article 5 : Temps de répondre à la demande d’une autorisation. Le demandeur d’autorisation d’enterrer les déchets toxiques reçoit une réponse positive ou négative endéans vingt (20) jours compté à partir du jour où la demande d’autorisation est arrivée à l’Office Rwandais de Protection de l’Environnement. En cas de réponse négative, l’Office Rwandais de protection de l’Environnement informe le demandeur en les motifs des raisons du rejet de sa demande. UMUTWE WA III: INAMA NGISHWANAMA Ingingo ya 7: Inshingano Inama ngishwanama ifite inshingano zo gutanga ibitekerezo n’ibyifuzo byerekeranye n’itabwa ry’imyanda ihumanya ikuzimu. Ingingo ya 8: Abagize Inama Ngishwanama Inama ngishwanama igizwe n’aba bakurikira: 1° umunyamabanga Uhoraho muri Minisiteri ifite ibidukikije mu nshingano zayo; The period stated in paragraph 1 of this Order may be extended, but the applicant shall be notified of that extension in writing before the expiration of the period. Article 6: Cost of burying toxic wastes The cost of burying the toxic wastes and the appropriate study is met by the owner of toxic wastes. When the owner of toxic wastes is unknown, the District where the toxic wastes are found pays all necessary fees for burying those wastes. CHAPTER III: CONSULTATIVE COMMITTEE Article 7: Responsibilities The Consultative Committee shall have responsibilities of providing views and recommendations related to burying toxic wastes. Article 8: Composition The Consultative Committee shall be composed of the following: 1° the Permanent Secretary in the ministry in charge of environment ; L’échéance stipulée dans le précédent alinéa peut être plus longue , mais le demandeur doit être informé par écri t avant l’expiration de la période initiale. Article 6 : Coût de l’enterrement des déchets Le coût d’enterrement des déchets toxiques et l’étude appropriée est à la charge du propriétaire des déchets. Au cas où le propriétaire des déchets n’ est pas connu, le District dans lequel se trouvent ces déchets supporte tous les frais nécessaires pour l’enterrement de ces derniers. CHAPITRE III : COMITE CONSULTATIF Article 7 : Attributions Le comité consultatif a la mission de donner des avis et recommandations sur les points relatifs à l’enterrement des déchets toxiques. Article 8 : Composition du comité Le comité consultatif est composé des membres suivants : 1° le Secrétaire Permanent au Ministère ayant l’Environnement dans ses attributions ; Official Gazette no 35 bis of 30/08/2010 99 2° uhagarariye Minisiteri ifite ibikorwa remezo mu nshingano zayo; 3° uhagarariye Minisiteri ifite ubuzima mu nshingano zayo; 4° uhagarariye Minisiteri ifite ubuhinzi n’ubworozi mu nshingano zayo; 5° uhagariye Minisiteri ifite Ubucuruzi mu nshingano zayo; 6° uhagarariye Ikigo cy’Igihugu cy’Ubuziranenge; 7° uhagarariye Polisi y’Igihugu; 8° umuyobozi w’Ikigo cy’Igihugu cyo kubungabunga Ibidukikije; 9° uhagarariye abikorera ku giti cyabo. Ingingo ya 9: Inama z’Inama Ngishwanama Inama Ngishwanama itumizwa kandi ikayoborwa n’Umunyamabanga Uhoraho muri Minisiteri ifite ibidukikije mu nshingano zayo; iterana kabiri (2) mu mwaka n’ikindi gihe cyose bibaye ngombwa. Muri iyo nama hashobora gutumirwamo umuntu wese ukenewe ngo Inama ngishwanama yuzuze inshingano zayo. UMUTWE WA IV: INGINGO ZISOZA Ingingo ya 10: Ibidateganyijwe muri iri teka Ibidateganyijwe muri iri teka bikurikiza amategeko asanzwe agenga imicungire 2° the Representative of the ministry in charge of infrastructure; 3° the representative of the ministry in charge of health; 4° the Representative of the ministry in charge of agriculture and animal resources; 5° the Representative of the ministry in charge of commerce; 6° the Representative of Rwanda Bureau of Standards; 7° the Representative of Rwanda National Police; 8° the Director General of Rwanda Environment Management Authority; 9° the Representative of the private sector. Article 9: Meetings of the committee The Consultative meeting shall be convened and chaired by the Permanent Secretary in the ministry in charge of environment; it shall be held twice (2) a year and at any time it is deemed necessary. In that meeting, any person needed to help the Consultative Committee to fulfill its duties may be invited. CHAPITER IV: FINAL DISPOSITIONS Article 10 : Provisions not provided Other provisions not provided in this Order are governed by ordinary laws relating to wastes 2° le représentant du ministère ayant des infrastructures dans ses attributions; 3° le représentant du ministère ayant la santé dans ses attributions ; 4° le représentant du ministère ayant l’agriculture et l’élevage dans ses attributions ; 5° le représentant du ministère ayant le commerce dans ses attributions ; 6° Le représentant de l’Office Rwandais de Normalisation ; 7° le représentant de la Police Nationale du Rwanda ; 8° le Directeur General de l’Office Rwandais de Protection de l’environnement ; 9° le représentant du Secteur Privé. Article 9 : Réunions du Comité Le comité consultatif est convoqué et présidé par le Secrétaire Permanent au ministère ayant l’environnement dans ses attributions. Il se réunit deux (2) fois l’an et chaque fois que de besoin. Ce comité peut inviter, dans ses réunions, toute personne qui peut l’aider à mieux s’acquitter de sa mission. CHAPITRE IV: DISPOSITIONS FINALES Article 10 : Disposition non prévue Les dispositions non prévues par le présent arrêté sont régies par la législation en vigueur Official Gazette no 35 bis of 30/08/2010 100 y’imyanda. Flux de déchets Déchets cliniques provenant de soins médicaux dispensés dans des hôpitaux, centres médicaux et cliniques : 1. Déchets issus de la production et de la préparation de produits pharmaceutiques; 2. Déchets de médicaments et produits pharmaceutiques; 3. Déchets issus de la production, de la préparation et de l'utilisation de biocides et des produits phytopharmaceutiques; 4. Déchets issus de la fabrication, de la préparation et de l'utilisation des produits de préservation du bois; 5.
