Sindh Protection of Human Rights (Amendment) Act, 2022 (Act No. III of 2023)

2. In the Sindb Protection of Human Rights Act, 2011, Amendment of hereinafter referred to as the aid Act, in section 2 - section 2 of Sindh Act No.XIII of (i) after clause (i), the following new clauses shall be 2011. inserted:- "(i-a) ''business and human rights" means the rights envisaged under the United Nations Guiding Principles (UNGPs) and corporate related human rights abuses; (i-b) '"Chief Minister" means the Chief Minister, indh;''; (ii) after clause (ii), the following shall be substituted:- "(ii-a) "Department" means the Sindh Human Rights Department, Government of Sindh;"; (iii) after clause (v), the following new clause shall be inserted:- "N tional Action Plan on Business and Human Rights" means the National Action Plan on Business and Human Rights formulated by the Ministry of Human Rights in keeping with UNGPs to ensure protection of human rights abuses by engaging bu iness to foster corporate respect and due diligence for human rights;".

3. Io the said Act, in ection 3 - Amendment of section 3 of Sindh (i) in sub-section (2) - Act No.XIll of (a) for clause (i), the following shall be 2011. substituted:- "(i) A person who has been a Chairperson Judge of the High Court, was or is· qualified as such, or a person having a demonstrable experience of fifteen (15) years in the field of Human Rights, to be appointed by Chief Minister"; (b) in clau e (ii), for the word "two", the word "three" shall be substitute,:; - TIIE SI (c) for clause (iii), F. EXT, FF.BIHJAI Y 13, 2023 the fo!lowing hall be PA. ff- IV substituted:- "(iii) two Members of the Members Provincial Assembly of Sindh, to be nominate by the Speaker, Provincial Assembly of Sindh"; (d) for clause (iii , the following, shall e substituted:- "(iii-a) Four persons with '.\-!embers demonstrable experi nee in the field of Human Rights, atleast one of whom hall be from minority community and o e shall haYe considera le experience in Business and Human Rights, to be appointed by Chief Minister"; (iii-b) An Additional ecretary or :Y'em er Deputy Secretary of the Department to be aomin ted by the Secretary of Department"; ,_ii aft r sub-section (4), the following shall be inserted:- ''(4-A) The Chairperson and Mem ers appointed under clause (i), (ii) and (iii-a) of sub-section (2), shall not be more than sixty fi ·e years of age."; (iii) for sub-section (5), the followin shall be substituted:- "(S) The Chairperson and Member s all, unless resigned or removed earlier, bold office for a single non-renewable term of four years.".

4. In the said Act, in section 4 - Amendment of section 4 of Sindb (a) after clause (ii), the following new clause sba I be Act No.XIH of inserted:- 2011. "(ii-a) serve as an alternate dispute resolution and accountability mechanism for business related abuse of human rights and providing easy access to remedy;"; 5 fllE Sl1 '011 CO\"f, c~ ZFXI E F ·1, FUHWAHY 13, 2023 PART- IV (b after clause (i ), the f llo"' ing new d use hall be inserted:- "(iv-a) to v1s1t any business enterprise or corporate entity, itb prior intimation to the concerned corporate entity' supervisory body or authority, to ascertain the reported viol.ations or abuse and the working conditions of employees, workers or inmates of the supply chain or the alue chain, as the ca'e may be;"; c) for clause (v), the following hall be substituted:- ''(v) review the safe guard provided by or under the Constitution or any law for the time being in force for protection of human right and also in the sphere of Bu ine s and Human Rights and National Action Plan on Business and Human Rights to ensure accountability and access to remedy as an lternate dispute forum and to recommend measures for effective implementation of laid down procedure and for due diligence in business enterprises;". 5. ln the said Act, in section ~, in sub-section (4), for the Amendment of words "four member", the words "five members'' shall be section S of Sindh Act No.Xlll of ubstituted. 201 l.

6. In the aid Act, in section 6 after clause (a , the Amendment of section 6 of Sindh following new clause shall be insertcd:- Act No.XllJ of "(a-i) is found lunatic or become of un ound mind;". 2011.
