Funl·tions of an 11:nvirtinnH~ntal Lal,ornJory.-Tlir t\111ctiu11s ; laboratory shall be -- • (a) to· test and analyze samplesof air, water, soil, cnluepts or wastes sent to it hy any fadory or any person authori.zi::d by the Agency to determi1w whether ·such samples comply with the Sindh Environmental Qpa!ity Standurds; • (b) to mc~i.surc nois.c being emitted at any place by miy in~liistrial or other t1ctivity or. motor vehicle; . . (c) to issue test reports containing the results of tests and analyses carried.out tinder clausc·s (a) and (b); . . (d) to carry out such experiments, studies and investigations as n!ay be required by the • Agency to! monitor and criforcc and. where necessary to propose revision .or the Sindh Environmental Quality Standards; (c) to send an annual report of its activities to the Agency, indp<ling a list of all test reports issued by it and Environmental Management Plan and Audit report; and (i) to carry out such other functions as may be entrusted lo it by the Agency from time to time. • 4. Application for "ccrtific~•tion) (I) Any laboratory" which fullills the· criteria laid down in regulation 5 may make rin application ii1 the forin set out in Schc,dulc-I, to the Agen~y for certification as an enviro11111cntal laboratory. (2) Every such application for ccrtiiicatior1 shall b~ accompanied by a non-refundable scrutiny fee at the rate specified in Schc(lule-!T. • PART-I THE SINDH GOVT. GAZETTE EXT .. (1) Every application for ccrti fication shall be scrutinized by the • I , .. (2) The Cornmittce shall carry out such inquiry as it 1f1ay deem necessary to verify and evaluate the date mc!Hioned i11 the application which shall include se11ding or trial sample; and obtaining sample test reports a'nd a visit to the laboratory by the Cmnmittcc .itself, or its subcommittee, or a panel of CXp!.!rls appointed by the. Commi.Ucc for the p11i;pose, for an Ol~site assessment of its capability and dtpacity as to whether or not it fulljlls the criteria laid :down in regulation 5. • •• • • (3) Subject to clause (4), the Committee sha'il submit its recommendations, in writing, to the Agency which may, after such further inquiry as it may. consider necessary, accept or reject the said recommendations. (4) in ~ase the Agency d~cidcs to reject the r~commen<latii.rn:s referred lq in clause 3, it shall record th·e reasons for decision. 7. Decision on application;- ( 1) Subject to sub-regulation (2), an application for certification may be rejcctc<l, accepted in full, or acccptcd'partialty for certain purposes or p~m.uncters only. (2)Bct'orc the Agency decide~ .to reject 1:\11 application or acccpl 'it partially or conditionally, ii shall give the applicant an Qppohunity of beii1g heard. • (3) Where .the Agency rejects n~l application, the .apr;licant shall be infonncd or the, •. reasons for such rejection. • • (4)Subject to sub--regulation (5), the rcjcctio~ ofon application for certit1cation shall not debar· a laboratory from submitting a fresh application for c·crtitkation . . Conditiims of certification. Validity of certifica~ion. (1) .Subject to sub-regulation (2), a· certificate issued under regulation 8. shall, unless earlier suspended or revoked, be valid frH· a period or two·yctli's frclln the date of issue; provided that all certificates· issued immcdfotcly before the co1-11nieilcement or these regulations shall cpntinue to be valid for a period for which thcy we!·e granted. (2) If un applicatio11 for- renewal ot certificatio·n is made under regulation 13, the ce1irficate shall continue to rcrriain valid till the application for renewal is decided. 11. Bar to function without certification. No laboratory shall function as an environmental laboratory unless itis granted c~r(ification .under these regulations. • 12. Tc~t reports. A .. n Environmental Laboratory shall issue test r~ports in the form set out in Schedule-VI containing the results. of tests· arid ai1alysis carried out in discharge or its functions. as provided ·under clauses (a) and (b) or regulation 3. 13: Renewal ofccrtification. (i) An application for renewal of ccrtilicatio11 shall be made in the form set .out in Schedule-IV, to theAgency at least thirty days prior to the date of.expiry oF the. cc1iificate issuc·d under regulation 8. • (2) An applic11tioi1 for renewal shall be ~1ccompanicd by a copy of the annual report of" the activities including Environinental Audit report of environmental laboratory pre[iared by third party. (3) An application for rem:\val shall be dealt with, scrutinized and decided exactly in the . same mannc1: as an applica.tion for ce1iifici.1tinn t111cl 'the provisions or these regul:.:tions rclati1ig to an ariplication for certification .shall, mutatis mulamlis, apply to Ul1 application for renewal of ce1iification. ' • (4) The fee for renewal of ce11ific,"~tion shall be paya!,le at the rate specified in Schedule II, and the certiiicatcissticd on receipt thereof shall also• be in the form set out i11 Schedule V. • 14: Revocation or ·suspension of certification.~·( l} Withou.t prejudice t.o any other action ~hat may be-taken against an environmental laborfttory under the Act, Rules or regulations or unyothd law for the time being in force, the Agency mtty, by an order in writing stating the reasons therefore, revoke a certification,· or suspend it foi· such period as the Agency deems lit, if the environmental laboratory (c) (d) (e) (f) fails- to comply with any of the ·conditions of certification listed in reguh1tion 9; • violates aids or abets in the violation of~ any of the provisions of the Act, rules or regulations; • . issues any report which is false, or which is designed to misrepresent or conceal or suppres·s any material· fact; • • has obtained certification through fraud or inisreprcscntat,ion; fails or ceases to perform or is rendered incapable of performing ·any of the functions of an enviroi1mental laboratory·listed in -regulation 3; or no longer fulfills the crite1ia for certification as an environ mental laboratory as laid down: .in ic;gulation 5; or 532 533 THE SINDH GOVT. Where any order of revocation or sHspcns-ion. has been pass<.:d, the lab()ratory slialJ rorthwith surrender its certi!ict1tc to the Agency who:shnll make an entry of the revocation or suspcnsio~1 thereon. (4) Certificate shall be rctu'rned to the laboratory Oil expiry. or the suspension period or on restoration or the ccrti fication in appeal, aftci· the Agcm~y has mqJc necessary cnt1-ysthercon. (5) Where ccrtilicatinn or an c11virn11mcntal laboratory has been revoked, il sh~ill not be eligihk to apply again for c'.crtification until lapse o(ar-lc:ast one year fro·rn the date of such revocation or for .si.1ch period as the Agency may, allcr considering t.hc reasons submitted by cnvimnrncrital laborntory, deem lit. 15. : Appeal.- (I) Any person aggricvei.l by an ·order or' the Agency on .an application for certificatiOl1 or an application for renew.'d of certilication 01· by :rn ordc,: revoking or 'sus pcnding, or refusing lo revoke or suspend; ,1: certifo.:ation may, within thirty days <Jf ·the date of communica(ion ofthe impugned order, lile an' appeal with the l:~nviro1.1111ental Pfotcction Tribu;1al, as provided under section 27.
