Nepal Tourism Board Act, 2053 (1997)

1. Sho rt Ti tl e C ommen cemen t: (1) T his Act may be ca lled “Nepal Tourism Board Ac t, 2 053 ( 19 97)”. (2) This Act s ha ll c ome into force fr om the date as spec ifie d by the Go ver nmen t o f N ep a l by pub lis h in g it in Ne pa l Gaza tte.

2. Defi ni ti on: Un les s t he Sub jec t or c ontext r equ ires ot herw ise, in th is Act : 1 (a) “Boar d” mean s “Nepa l Touris m Boar d” e stab lis hed u nder Sec t io n 3. (b) “Commit tee” mea ns E xec ut i ve Commit tee c ons tit ute d u nder Sec t io n 3. (c) “Chairpe rson ” means the Cha irpe rs on of the comm it tee. (d) “Vice Cha irperso n” mea ns t he vice Cha irpers o n of t he committee. (e) “Member” mea ns the mem ber o f t he comm ittee a nd t h is word a ls o inc lud es the Chairper son, vice Chairperso n a nd t he member secretary of the commit tee. (f) “Ch ie f Exec ut i ve Officer” mean s t he Chie f E xecut ive O fficer of the Boar d ap po inted un der Sec tio n 1 4. ( g) “To ur ist” mean s n on -Nepa li c it izen c oming to vis it Ne pal fr om fore ign co untr y. (h) “To ur ist b us ine ss” m ean s (1) A tra nsact io n of pr o vid ing na tio na l a nd in ternat io nal tran sporta tio n ser vice t o t o ur ist. (2) A tran sactio n of t he nature of pr o vid in g ful l or part ial tran sporta tio n, lod gin g, tra ve l lin g arra ngeme nt, re staur ant ser vice, s ight se eing, gu id ing, mo unta ineerin g, ra ftin g, and o the r ad ve nt ure s a nd en ter tain in g s er vice a n d ot her ser vice s to the t our ist s in any p lace w ith in or ou ts ide Nepal and ea rn ing foreign currency there from. 3. Est abl ishment of th e Boa rd: (1) A Board, b y t he name o f Nepal Tourism Board is hereb y es ta blis he d to de ve lo p, expand an d promo te tour ism b us ine ss to present Ne pa l in the in ter nat iona l ar ena as a fasc ina tin g t our ist de st inat ion. (2) The Cen tral O ffice o f t he Boar d sha l l lie in Kat hman du Valley and t he Boar d may ope n its bra nch o r Sub- bra nc h in an y place wit h in or ou t side Nepal as per nece ssit y.

4. Boa rd to be an Autonomous Bo dy: ( 1) T he Board sha ll be an aut o nomo us an d cor porate bod y w ith perp et ual succe ss ion. (2) The Board s ha ll ha ve a se parate seal for it s fu nct io n a nd act ion. (3) The Boar d, lik e a per son may acqu ire, e njoy, se ll or otherw ise mana ge its m o veab le and imm ovab le p ro per ty by it s own name. 3 (4) The Boar d like a per s on ma y s ue or be sued by it s name.

5. Obj ective s of the B oa rd: The ob ject ive s of the Board s ha ll be as follow s: (a) To introd uce N epa l in the Int ernat ional arena by de ve lop ing it as a fasc inat ing to ur ist des t ina tio n. (b) To de ve lop, e xpan d an d promote to ur ism bus ine s s upon pro tec t in g and p rom ot ing na tur al and cu lt ural he r ita ge, and environmen t of the cou ntr y. (c) To create max imum emp loyme nt op port un itie s by increas ing nat iona l produc tion an d fore i gn curr enc y earn in g t hro ugh t he develo pmen t, expa ns ion and promo t io n o f t our ism. (d) To estab lish N e pa l’ s image in a hi gh and d ign if ied way in t he internatio na l to ur ism co mmun it y by de ve lop ing N epa l a s a sa fe, reliab le and attr act ive t our ist des tinat ion. (e) To co n duct or ca use to be co nduc t fu nct io nal research, as per necessar y, for fin din g out w ays an d mean s t o so lve prob lems encou nte red in t our ism sec tor so as to pr o vid e qualit at i ve ser vice s t o t he touris t. 6. Functi ons, Po wers and D uti es of the Bo ard: The func tio ns, powers and du ties o f the Board sha ll be as follow s:- (a) To ac t as the representa ti ve o f t he Go vernme n t o f Nepal or of any per son or ins t it utio n/b ody w it h the appr oval o f t he Go ver nme nt of Nepa l for carrying ou t an y act i vit ie s re lated to 4 tour ism. (b) To for mu la te and imp leme nt or ca use t o be im plemen ted necessar y pro gram on infras truc ture de ve lopme nt, to ur ist ser vice, fac ilit y e xte ns ion, hum an re so urce develo pm en t and inc lud ing o thers t he ac t i vit ie s related w it h e n vir o nmen tal pro tec t io n in the to ur ist de stin at ion s for the e sta blish men t, imp ro vement, de ve lo pme nt, ex te nsio n, pr omotio n and pro tec t io n o f to ur ism busin es s.
