Introduction The Netherlands became a party to the Stockholm Convention in 2002. This Convention concerns persistent organic pollutants and entered into force on 17 May 2004. It provides for a global ban on the production of and trade in eight pesticides (aldrin, chlordane, DDT, dieldrin, endrin, heptachlor, mirex and toxaphene), two industrial chemicals (hexachlorobenzene and PCBs) and two by-products of incineration processes (dioxins and furans). At the fourth Conference of Parties (COP4) held in Geneva, Switzerland, from 4 to 8 May 2009, it was agreed to add nine new substances to the Stockholm Convention. Two are pesticides (chlordecone and lindane), three occur in pesticides (α-hexachlorocyclohexane, [α-HCH], β-hexachlorocyclohexane [β-HCH], and pentachlorobenzene [PeCB]), and four are industrial chemicals (hexabromobiphenyl [HBB], perfluorooctane sulfonic acid [PFOS] and its salts, perfluorooctane sulfonyl fluoride [PFOS-F], and the commercial forms of pentabromodiphenyl ether [c-pentaBDE] and octabromodiphenyl ether [c-octaBDE]). PeCB is also released as a by-product of numerous incineration processes. All the above substances are designated as POPs (persistent organic pollutants). They are toxic, resist degradation and can be dispersed over large distances in the air and/or water. POPs are harmful to the environment and health because they accumulate in organisms, what may result in adverse effects on health, such as cancer, reproductive damage and impairment of the immune system. The ban on the production and use of the nine new POPs, and the goal of reducing their emissions took effect on 26 August 2010 (http://chm.pops.int). The Stockholm Convention imposes the obligation on the parties to develop, within two years of the Convention entering into force, a National Implementation Plan (NIP) describing the national situation in respect of the substances covered by the Convention and the steps that have been followed to implement the Convention. The Convention also obliges each party to develop a national action plan (NAP) specifying the actions they will take to meet the obligations under the Convention. The initial document, drawn up in 2006, was a combination of the NIP and the NAP. It described how far the Netherlands had come in meeting the Convention obligations and the actions still to be taken to meeting them in full. The document covers the period 2001 to 2004 and is accessible on http://chm.pops.int by selecting the menu “Countries” and the item “National Implementation”. The Dutch version is available at http://databankmilieu.nl/pdf/implementatieplan.pdf. The Stockholm Convention also stipulates that a NIP has to be updated every four years. As nine new POPs had been added to the Convention, the decision was taken to update and expand the first NIP with the latest insight into the 12 existing pollutants and a description of the Netherlands’ situation regarding the nine new ones. This latest NIP (with the NAP) covers the period 2005 to 20081. This new document was available for consultation for six weeks, so that everyone had the opportunity to submit their comments on the NIP to the Ministry of Infrastructure and the Environment (formerly the Ministry of 1 Everywhere in this report the reference to the period 2005 to 2008 means 2008 inclusive. 4 Housing, Spatial Planning and the Environment). No comments were received and in conformity with the Stockholm Convention, the final NIP is sent to the Convention’s Secretariat. The production, use, import and export of the eight pesticides and two industrial chemicals of the first Convention have been prohibited in the Netherlands for at least several decades. As regards the unintentional emissions of substances such as dioxins and furans, statutory measures were implemented in the past to keep them to a minimum. As a result, the Netherlands meets its obligations for the 12 existing pollutants under the Stockholm Convention. The other obligations under the Convention, relating to waste containing POPs for example, are likewise implemented in Netherlands legislation. For the nine new POPs added to the Convention, some measures are already in place in the form of existing EU and/or Netherlands legislation. These nine new POPs are included in a revised version of the EU’s POP Regulation ((EC) 850/2004, of 29 April 2004). For some of the nine, this means an outright ban on their production and use; for others, far-reaching limitations. The revision is established by Regulations (EU) 756/2010 and (EU) 757/2010 of 24 August 2010. Although the Convention substances have been phased out in the Netherlands or their emission minimised, these compounds are still present in the environment in the Netherlands. At a few locations, the soil pollution is attributable to use in the past. Despite the suppression of emissions, there are still small deposits of these substances. In the waste stage, PCBs are still found from time to time in oils that can leak from transformers and other devices. The Netherlands is also working on providing more insight into the possible occurrence of bromodiphenyl ethers (BDEs) in waste streams and hexachlorobenzene in fireworks. For tackling and controlling the substances during the waste stage, a harmonised EU approach is in place that draws on the Community Implementation Plan that the European Commission prepared on behalf of the European Community. It did so because the European Community is also a party to the Stockholm Convention. The Community Implementation Plan can be accessed on http://chm.pops.int by selecting the menu “Countries” and the item “National Implementation”, and then going to “European Union” on the list. 5 2. Country description For this section, please refer to the first NIP of the Netherlands (NIP (2006)). Between 2005 and 2008, no significant changes occurred. 6 3. Policy and legislation Following the first NIP of the Netherlands (NIP (2006)), a few changes in policy have occurred. In 1985, the Environmentally Hazardous Substances Act (Wet milieugevaarlijke stoffen, hereafter Wms) came into force in the Netherlands. Associated with the Act were a number of implementation decrees for POPs and substances containing POPs. The Environmentally Hazardous Substances Act was repealed, however, because of the introduction of the REACH Regulation, (EC) 1907/2006 (Registration, Evaluation, Authorisation and Restriction of Chemicals). REACH came into force on 1 June 2007 and since then has been the chemicals regulation directly applicable in the EU. The Act was repealed in stages and replaced by the provisions of REACH. A number of the Act’s provisions were retained, though, to become part of the Environmental Management Act. The above changes were regulated by the REACH Implementation Act, which took effect on 1 June 20072. The REACH Regulation replaces more than 60 European Directives and Regulations. Among them are Directive 76/769/EEC (restrictions on the marketing and use of certain dangerous substances and preparations), Regulation (EEC) 793/93 (evaluation and control of the risks of existing substances) and Directive 91/155/EEC (specific information on dangerous preparations (safety data sheets)). Regulation (EC) 1272/2008 contains new provisions for the classification, labelling and packaging of substances and mixtures. It is also sometimes referred to as the EU-GHS Regulation (globally harmonised system) or the CLP Regulation (classification, labelling and packaging). Annex VI to this Regulation contains a list of substances showing their legally required hazard classification. The EU GHS Regulation replaces the Dangerous Substances Directive, 67/548/EEC, and the Dangerous Preparations Directive, 1999/45/EC. It became fully effective on 5 January 2009 (http://www.rivm.nl/rvs/gevaar/eu/). Some parts of the Environmentally Hazardous Substances Act not regulated by REACH are now in Chapter 9 of the Environmental Management Act (Wet milieubeheer, Wm). Among the matters it regulates, is the implementation and enforcement of the REACH Regulation in the Netherlands. Additions to the Chapter are: • Part 9.2 Substances, preparations and genetically modified organisms; and • Part 9.3 The EC Regulation Registration, Evaluation, Authorisation and restriction of CHemicals. Part 9.3 sets out a number of national implementation rules concerning: • the designation of the national competent body for REACH, • the penalties for violating the provisions of REACH; and • the possibility to specify other implementation rules by Ministerial Decree. The supervision and administrative enforcement of Chapter 9 of the Environmental Management Act is regulated by other Chapters of the Act. 2 Expansion and amendment of the Environmental Management Act in connection with the implementation of the EC Regulation Registration, Evaluation, Authorisation and restriction of CHemicals (REACH) and the transfer of the provisions of the Environmentally Hazardous Substances Act to the Environmental Management Act, as well as the related amendments to other legislation (Implementation Act for the EC Regulation Registration, Evaluation, Authorisation and restriction of CHemicals (REACH) (Bulletin of Acts and Decrees 2007, no. 181). 7 Decrees and regulations formerly based on the Environmentally Hazardous Substances Act, but derived from other EC Directives and Regulations, such as the Act’s POP Decree (Wms POP Besluit) in which the EC POP Regulation ((EC) 850/2004) is implemented, still remain in force, but now as the POP Decree to the Environmental Management Act (POP Besluit Wm). Against this background, the DBB Decree, the PCB, PCT and Chloroethene Decree and the Ugilec 121-, Ugilec 141- and DBBT-Decree were initially embodied in the Environmental Management Act. Following the coming into force of Annex XVII of the REACH Regulation (restrictions), they were repealed as of 1 June 20093. For the nine newly added substances, the relevant EU legal frameworks are stated for each substance separately in Chapter 5 of the Act. In accordance with the POP Decree to the Environmental Management Act, the penalties relating to the amended EU POP Regulation concerned are regulated by a dynamic reference4. 3 Bulletin of Acts, Orders and Decrees 2008, no.160: Decree of 29 April 2008 for the amendment of various Orders in Council to implement the EC Regulation Registration, Evaluation, Authorisation and restriction of CHemicals (REACH) and because of the transfer of the provisions of the Environmentally Hazardous Substances Act to the Environmental Management Act (amendment of Orders in Council for the implementation of REACH). 4 Regulations (EC) 756/2010 and (EC) 757/2010. 8 4. Enforcement For this section, please refer to the first NIP of the Netherlands (NIP, 2006). No significant changes have occurred since its publication. The Netherlands has already begun enforcement for several of the nine newly added substances. 9 5. POPs in the Netherlands: the state of affairs This section of the NIP describes the changes in the situation in the Netherlands from 2005 to 2008 for each POP separately. Newly available information on the existing 12 POPs is reported insofar as it is considered relevant. Apart from this information, general information on the nine newly added POPs is included. In line with the first Netherlands’ NIP other matters discussed – to the extent that data is available – are production, admission data and use, waste streams, steps taken, presence in the environment, emissions and environmental quality. The Netherlands has not requested a specific exemption to be included in Annexes A (elimination), B (restriction) and C (unintentional production) to the Stockholm Convention for any of the substances it covers. The obligations arising from the Convention are implemented in the Netherlands (http://eur-lex.europa.eu) via the EU POP Regulation, (EC) 850/2004, including the most recent amendment of 24 August 2010 (Regulations (EU) 756/2010 and (EU) 757/2010). To determine the status regarding the various POPs in the Netherlands, a variety of information sources were used, as given by the reference list in section 8. As far as is known, stocks of unused batches of pure substances no longer exist in the Netherlands, with one exception: the stock of fire-fighting foam containing PFOS (Bruinen de Bruin et al., 2008). To determine the occurrence of POP waste streams, the reporting data of the National Waste Notification Office and the national information system relating to the EC’s Waste Shipment Regulation (EVOA, see Annex I) were utilised. In the case of PCBs and dioxins, an extensive investigation was conducted. A list of the other waste substances containing POPs for the period 1993 to 2008 is given in table 7 of Annex I. To supplement the current waste stream policy, studies are in preparation at EU and national levels to obtain a better understanding of the presence of PFOS and BDEs in products and waste streams, and how to treat such streams. The Inspectorate of the Ministry of Infrastructure and the Environment is currently (2010) preparing a study into methods for removing and eliminating BDEs and PFOS from production chains, and for the destruction of these POPs. Pursuant to Regulation (EC) 166/2006 of the European Parliament and of the European Council of 18 January 2006 establishing a European Pollutant Release and Transfer Register, the EU Member States have an obligation to issue a report each year on the national emissions from sources (companies) of pollutants above certain levels into air, water and soil separately. The existing and most of the new POPs are covered by this Regulation. For the Netherlands, the Ministry of Infrastructure and Environment is the reporting body (http://www.monitoringportaal.nl). Information on the reported emissions of POPs included in the updated NIP can be obtained from the Netherlands’ Pollutant Release and Transfer Register (http://www.emissieregistratie.nl). Owing to their persistent nature, it is highly likely that many POPs are still present in the various environmental media, air and soil being the principal ones. In many cases, the emission data reported indicate that direct emissions are below the reporting or detection thresholds, or in general no longer occur. As the release of POPs 10 from polluted media can reoccur, a certain degree of exposure through water, soil and food remains a possibility. The closing part of this section presents the conclusions drawn. 5.1. Update for existing POPs This section provides only updated or new information on the 12 existing POPs.Other information on the 12 existing POPs can be found in the first Netherlands’ NIP (NIP, 2006). The section provides a comprehensive description of the 9 new ones. The information sources consulted in the preparation of the current NIP are listed in section 8, References. 5.1.1 Aldrin, Dieldrin, Endrin (drins) Waste phase On one occasion in the Netherlands, in 2006, the delivery of approximately 1,000 kilotons of soil polluted with drins was reported (see table 1). The waste stream originated from the Municipality of Rotterdam. The polluted soil was thermally cleaned (Annex I). For the period 2006 to 2008, no further notifications of drins or soil polluted with drins were found. Table 1. Notification by a waste disposer in the Netherlands of soil (waste stream) polluted with drins, in the period 2005 to 2008. Subsequently the total national emissions are reported to the European Commission. No data on emissions into air were reported in the Netherlands for the period 1990 to 2008. The total amount of drins emissions into water reported in the Netherlands for 2008 was 0.0038 kg. No such emissions were reported for other years, and no emissions into soil were reported. 11 5.1.2 DDT Waste phase From 2005 to 2008, a total of 640 tonne of soil was reported in 2006 and 2008 as polluted with DDT (see table 2). The various soil flows originated from a municipality, a demolition company, and a project developer. Each stream was separated by chemical and/or physical processes, and then thermally cleaned. No data on emissions into air were reported in the Netherlands for the period 1990 to 2008. The total DDT emissions into water reported in the Netherlands for 1990 and 1995 were 0.4 kg and 0.3 kg, respectively. No such emissions were reported for other years, and no emissions into soil were reported. 5.1.3 Hexachlorobenzene (HCB) Production and use Both the production and use of HCB (CAS number 118-74-1) are banned by the EU POP regulation, (EC) 850/2004. It was recently discovered that a percentage of fireworks contained HCB. This led the Inspectorate of the Ministry of Infrastructure and the Environment to have its VBV (firework emergency squad) start an investigation into the matter. Of the fireworks examined, 15% contained HCB. The concentrations discovered varied from 11,000 to 12,000 ppm, 5.5 gram being the largest amount by mass. 12 Waste phase Fireworks containing HCB are confiscated and stored at a special site in the Netherlands. Depending on the judgment of the court and the classification of the fireworks, a decision can be taken to incinerate them in the Netherlands or in Germany. According to the official reports, no waste containing HCB has been encountered in the Netherlands since 1998 (See Annex I). Measures As from 4 July 2010, Directive 2007/23/EC, regulates the placing on the market of pyrotechnic articles, which includes fireworks. This Directive mandates the checking or testing of the chemical composition of fireworks. Following the discovery of HCB in fireworks made in China and on sale in the Netherlands, the problem was brought to the attention of the competent Chinese authorities. Emission The reports required by Regulation (EC) 166/2006 have to detail the emissions of HCB exceeding 10 kg/year, 1 kg/year and 1 kg/year by source (company) for air, water and soil respectively. No data on emissions into air were reported in the Netherlands for the period 1990 to 2008. Emissions can occur from the ignition of fireworks containing HCB. The use of HCB in fireworks is banned by the POP Regulation and this prohibition is enforced by the Inspectorate of the Ministry of Infrastructure and the Environment (see “Production and use”). Accordingly, this source is not included in the Pollutant Release and Transfer Register. Table 3 shows the total reported emissions of HCB into water in the Netherlands since 1990. No such emissions were reported for other years. Table 4 shows the total reported emissions of HCB into soil in the Netherlands since 1990. For the soil, too, no emissions were reported for other years. Table 3. In the Netherlands, the MPC level is 0.009 µg/l for surface water (National Institute of Public Health and the Environment, “Risico’s van Stoffen”). The data that the Association of River Waterworks (RIWA) reported each year on the concentration of HCB in various bodies of water for 2005 to 2008 were all under 0.001 µg/l which is the limit of detection (RIWA 2005, 2006, 2007, 2008). Based on these data, it can be concluded that the MPC is not exceeded. 5.1.4 Polychlorinated biphenyls (PCBs) Production and use Since the inception of the ban in 1985 on the production and use of PCBs, the Netherlands has adopted a range of measures for the replacement and elimination of existing applications (NIP, 2006). Equipment containing PCBs, such as transformers and capacitors, and oil containing PCB continue to be found, however. The effort the Inspectorate is putting in is concentrated on ending the use of PCBs and on their destruction (Syncera, 2008). Pursuant to Directive 96/59/EC (16 September 1996), equipment containing more than 5 dm3 by volume must have been taken out of use by year-end 2010 at the latest. A user of such equipment is often unaware that it contains PCB. Nevertheless, it can be stated based on available data that through replacement the issue of residual PCB post-2010 is considered minor (Spoelstra, 2009). Apart from the above-mentioned applications, PCBs are also used in paint and insulating sealants (Annex I). Data on amounts and possible release during demolition or other work are unknown, however. Waste phase Companies in the Netherlands that treat and process waste are handling less waste containing PCBs than before. This applies to waste originating in the Netherlands as well as to waste from abroad. Most of this waste originating in the Netherlands is from producers of gas and other forms of energy (see Annex I for details). Following a peak in the amount of waste containing PCBs presented in the period 2000 to 2003 (the maximum being 2034 tonnes in 2002), the annual amount dropped to approximately 300 tonnes for the period 2006 to 2008. The peak is attributable to a massive campaign between 2000 and 2003 to clear away transformers. Current data, though, shows a steady but minor presentation of waste containing PCBs. With the closing down of the Netherlands’ rotating drum oven, presented waste containing PCBs is processed abroad. Measures Pursuant to the European POP regulation, (EC) 850/2004, the production, sale and use of PCBs (with CAS 1336-36-3 and other numbers) are banned. The implementation of waste management falls under Regulation (EU) 756/2010, of 24 August 2010, which amended the POP Regulation, (EC) 850/2004. 14 Emission The reports required by Regulation (EC) 166/2006 have to detail the emissions of PCBs exceeding 0.1 kg/year by source (company), separately for air, water and soil. No data on emissions into air were reported in the Netherlands for the period 1990 to 2008. Table 5 shows the total reported emissions of PCBs into water in the Netherlands since 1990. No emission data were reported for other years. Table 6 shows the total reported emissions of PCBs into soil in the Netherlands since 1990. For soil, too, no emissions were reported for other years. Table 5. Total reported emissions of PCBs into water in the Netherlands since 1990 (in kg). 1990 1995 2000 2005 2007 2008 58.8 33.6 34.9 20.9 15.4 12.7 Table 6. Water authorities have even detected PCBs above permitted levels several times, but appropriate action was not always undertaken (Syncera, 2008). This waste stream was not part of the waste analysis for the period 1993 to 2008 (Meurs Milieu, 2006; Annex I). 15 5.1.5 Dioxins / Furans (PCDD / PCDF) Waste phase Various data sources are consulted for reporting the amounts and processing methods relating to waste containing dioxins in the Netherlands. In the period 2001 to 2008, most of this waste originated from steel and energy production, and waste incineration plants. Apart from 2004, the annual amount of waste containing dioxins that was presented varied between 2400 kilotons and 2700 kilotons. The peak was in 2004, an amount of 3400 kilotons. Among the large streams were soil ash from waste incineration plants and coal dust fly ash from power stations. Most of the waste containing dioxins is treated or put to good use. Measurements and analyses show that such applications produce no leaching of dioxins or furans. If the waste cannot be treated or used, it is transported to a controlled landfill. For each of the years 2005 to 2008, the total amount of waste containing dioxin that was treated was about equal to the amount presented (see Annex I). Measures The European POP Regulation, (EC) 850/2004, places restrictions on the release of dioxins and furans. The implementation of waste management falls under Regulation (EU) 756/2010, of 24 August 2010, which amended the POP Regulation, (EC) 850/2004. Emission The reports required by Regulation (EC) 166/2006 have to detail the emissions of dioxins and furans as the number of TEQs exceeding 0.0001 kg/year by source (company), separately for air, water and soil. Table 7 shows the total reported emissions of dioxins and furans into air in the Netherlands since 1990. The emissions are expressed in units of g I-TEQ, which is used for comparing dioxins in terms of toxicity. In relation to the previous reports, only small changes have occurred in the reported emissions, but these are due to modifications regarding source categories and calculation methods. Table 8 shows the total reported emissions of dioxins and furans into water in the Netherlands since 1990. No emission data were reported for other years. From 1990 to 2008, no emissions into soil were reported. 16 Table 7. The nine new POPs 5.2.1 Chlordecone General Chlordecone is a synthetic chlorinated compound. It is a highly persistent substance with health risks for humans and the environment (UNEP-a, 2007). The molecule comprises carbon and chlorine compounds and contains oxygen atoms. The formula is C10Cl10O and the CAS number is 143-50-0. Production and use No data is available on the production of chlordecone in the Netherlands in the past (UNEP-a, 2007; http://ecb.jrc.ec.europa.eu/esis/). Chlordecone was mainly used as a pesticide and sold under the trade names GC 1189, Kepone, Merex, ENT 16391, Curlone, Chlordecone concentrate and Protekton 190 (UNEP-a, 2007). The holders of import licences in the Netherlands were Rentokil Services and Protekta (Meurs Milieu, 2006). No reports of imports or exports involving the Netherlands from 2003 to 2008 were found in European Database Export Import of Dangerous Chemicals (EDEXIM, http://edexim.jrc.ec.europa.eu/). Waste phase No waste streams containing chlordecone were found in the Netherlands from 2005 to 2008 (see Annex 1). 17 Measures Under the Plant Protection Products and Biocides Act (Wet Gewasbeschermingsmiddelen en Biociden, 17 February 2007), it is forbidden in the Netherlands to sell or stock crop protection products or biocides, or to import or use them in the Netherlands unless the Act allows it, or, in the case of biocides with negligible risk, the import and use is registered (Section 20). The last registration of chlordecone as a pesticide or biocide was closed as from 1 February 1997 (Ctgb database, http://www.ctb.agro.nl/). Emission The reports required by Regulation (EC) 166/2006 have to detail the emissions of chlordecone exceeding 1 kg/year by source (company), separately for air, water and soil. No data on emissions into air, water or soil were reported in the Netherlands for the period 1990 to 2008. Environmental quality In the Netherlands, the ad hoc MPC levels are 2.2 10-11 µg/m3 and 9.0 10-7 µg/l for air and water respectively (http://www.rivm.nl/rvs). Limits are also defined for food (http://eur-lex.europa.eu/). As no monitoring data have been found for concentrations of chlordecone in the various environmental media, the above-mentioned limits cannot be evaluated. 5.2.2 α-, β- and γ-hexachlorocyclohexane (HCH) General In the Stockholm Convention, α-, β- en γ-HCH are included separately in Annex I. The CAS numbers, stated in the Convention, are 319-84-6 (α-HCH), 319-85-7 (β-HCH) and 58-89-9 (γ-HCH). During the production of γ-hexachlorocyclohexane (γ-HCH, commonly known as lindane) by photochemical reaction (chlorination) of benzene, α- and β-HCH are also created. α-, β- and γ-HCH are all persistent and bioaccumulating substances, as well as potentially carcinogenic (UNEP-b, 2006; UNEP-g, 2007; UNEP-j, 2008). γ-HCH can also have an adverse hormonal effect (UNEP-b, 2006). HCH is persistent, bioaccumulating and toxic. It is found in the environment everywhere in the world. The molecule comprises carbon, hydrogen and chlorine compounds and has C6H6Cl6. as its formula. Production and use Technical HCH (CAS number 608-73-1) is an isomeric mixture that contains mainly five forms of HCH. Initially, technical HCH was also used in the Netherlands as an insecticide, resulting in the release of persistent HCH isomers into the environment. The main components of technical HCH are α-HCH (53%–70%), β-HCH (3%–14%) and γ-HCH (11%–18%). Technical HCH was produced between 1947 and 1952 (Vijgen, 2006). 18 Vijgen (2006) describes five production facilities in the Netherlands, each with its own production and pollution history. Few data are available on the amounts these facilities produced. A consequence of the use of technical HCH was that no root vegetable could be cultivated for a certain period on the ground that had been treated. This was due to a musty odour that came from the soil and entered the crop. Animal feed contaminated with HCH also reduced the flavour of foodstuffs such as poultry, meat and eggs. To avoid these problems, the active γ-HCH was extracted from the technical mixture of HCH isomers, leaving a product comprising at least 99% γ-HCH (lindane), which ultimately had only a negligible effect, if any, on the taste of food (Chemische feitelijkheden, 1996). Lindane was used in the Netherlands until 1998 (1985: 29 tonne; 1988: 24 tonne; 1991: 21 tonne; 1994: 19 tonne; 1998: 21 tonne) and stored until the end of the 1990s (Vijgen, 2006). No reports of imports or exports involving the Netherlands from 2003 to 2008 MPC were found in European Database Export Import of Dangerous Chemicals (EDEXIM, http://edexim.jrc.ec.europa.eu/). α-HCH and β-HCH are by-products from the manufacture of lindane (γ-HCH). Of the three isomers, lindane is the most powerful for use as a pesticide. It was often employed to treat seeds, leaves, trees, wood and soil. Lindane was also used in the treatment of ectoparasites (external parasites) on cattle and humans, against head lice for example. Lindane has been banned as a pesticide in the Netherlands since 1 October 1999 (Ctgb). Member States of the European Union were permitted by the POP Regulation, (EC) 850/2004, to allow authorised exemptions until 1 September 2006, though. Since 1 January 2008, however, these exemptions have also been forbidden, which means that since that date the production, sale and use of technical HCH and lindane in preparations or as a component of products has been banned throughout the EU (EC/850/2004). The ban is a consequence of adding HCH, including lindane, to the UNECE POP protocol. Waste phase Table 9 shows the waste stream containing HCH that was found in the Netherlands and the amount of HCH it contained. It concerns a one-time collection in 2005 of over 1500 kg of technical HCH. The stream originated from a manufacturer of agricultural chemicals. Pesticides originating from a collection company are incinerated abroad in rotary kiln incinerators. Table 9. Total waste streams of technical HCH reported in the Netherlands in the period 2005 to 2008 MPC. WASTE DISPOSER WASTE DESCRIPTION PROCESSING METHOD EURAL CODE YEAR HVH (kg) Waste disposer 5 Technical HCH Storage 080117 2005 1569 No other waste streams of technical HCH or HCH isomers were found in the Netherlands from 2005 to 2008 (see Annex 1). 19 Measures Under the Plant Protection Products and Biocides Act (Wet Gewasbeschermingsmiddelen en Biociden, 17 February 2007), it is forbidden to sell or stock crop protection products or biocides, or to import or use them in the Netherlands unless the Act allows it, or, in the case of biocides with negligible risk, the import and use is registered (Section 20). The last plant protection product containing lindane that was permitted in the Netherlands had a use-by date of 30 September 1998 and had to be used up before 1 October 1999 (http://www.ctgb.agro.nl/). Pursuant to the EU POP Regulation, (EC) 850/2004, all use of technical HCH (CAS number 608-73-1) and lindane (CAS number 58-89-9) had already been banned in the Netherlands as from 1 January 2008, including the period permitted for use of lindane to treat scabies. Apart from a ban on the production and use of lindane, the Stockholm Convention also applies to α-HCH (CAS number 319-84-6) and β-HCH (CAS number 319-85-7). The Convention includes an exemption for the use of lindane in pharmaceuticals for treating head lice and scabies. In the recently revised version of the EU POP Regulation (EC) 850/2004, this ban is implemented as a ban on α-, β-and γ-HCH and technical HCH, with no exemptions allowed, making the Regulation stricter than the Convention. Emission The reports required by Regulation (EC) 166/2006 have to detail the emissions of technical HCH (CAS number 608-73-1) and lindane (CAS number 58-89-9) by sources (companies). This applies to emissions of 10 kg/year for air, 1 kg/year for water and 1 kg/year for soil per source in the case of technical HCH, and 1 kg/year for air, water and soil per source in the case of lindane. No data on emissions into air were reported in the Netherlands for the period 1990 to 2008. Table 10 shows the total reported emissions of HCH into water in the Netherlands since 1990. No data are available for other years. Table 11 shows the total reported emissions of HCH into soil in the Netherlands since 1990. For soil, too, no emissions were reported for other years. The total of γ-HCH emissions reported in the Netherlands for 1990 and 1995 are 176 kg and 92 kg respectively. As in other cases, no emission data were reported for other years. Table 10. In 2004, 290 sites suspected of being polluted with HCH were identified. These polluted sites arise from the transport and recycling of contaminated soil, normal emissions and wind erosion moving soil from the storage site at the production site. A number of these sites were cleaned up using a variety of methods, such as chemical extraction and incineration, and measures to prevent further dispersion via ground water by installing sheet piling. At the production site in Overijssel, cleaning up has so far been carried out by pumping ground water to the surface from a depth of 45 m, purifying the water with carbon filters and then discharging it into the Twente Canal. The Province of Overijssel expects to have taken care of all sites in urgent need of cleaning up by 2015, but not the goal of cleaning up the soil by 2030 (see also section 5.3). The cleaning targets depend on the future use of the soil. More details can be found in Brouwers (1994) and the report from Vijgen (2006). In the case of technical HCH (CAS number 608-73-1), European proposed standards have been derived for surface water. The criterion for fresh water is 0.02 µg/l (annual average) and 0.04 µg/l for the maximum allowable concentration (2008/105/EC). In the case of HCH, an ad hoc MPC of 0.000252 µg/m3 has also been derived for air. As regards the HCH isomer α–HCH, an MPC of 3.3 µg/l has been derived for surface water and 290 µg/kg of dry material for sediment. As regards β–HCH, an MPC of 0.86 µg/l has been derived for surface water and 920 µg/kg of dry material for sediment. In the case of lindane, the MPC level is 0.9 µg/l for surface water and 230 µg/kg of dry material for sediment (http://www.rivm.nl/rvs/). The lindane criterion for drinking water is 0.1 µg/l (Directive 98/83/EC). Every year, RIWA reports monitoring data on α-HCH, β-HCH and γ-HCH in various bodies of water. Table 12 below provides a summary for 2005 to 2008 MPC. Table 12. Maximum concentrations (µg/l) measured in Netherlands waters (RIWA, 2005, 2006, 2007 en 2008). 2005 2006 2007 (Jan-June) 2008 Rhine Lek Canal Rhine Lek Canal Rhine Lek Canal Rhine Lek Canal Limit of detection (µg/l) 0.001 0.01 0.001 0.01 0.001 0.01 0.0001 0.01 α-HCH <0.001 <0.01 <0.001 <0.01 <0.001 <0.01 0.0006 <0.01 β-HCH 0.002 <0.01 <0.001 0.01 <0.001 <0.01 0.0009 <0.01 γ-HCH <0.001 <0.01 <0.001 <0.01 <0.001 <0.01 0.0009 <0.01 As the components of technical HCH include α-HCH, β-HCH and γ-HCH isomers, the sum of the concentrations measured provides a good idea of the level compared with the criterion. It can be concluded that Rhine water does not exceed the European fresh water criterion for technical HCH (0.02 µg/l). This cannot be fully claimed for the Lek Canal, as the values for the level of detection are of the order of 0.01 µg/l lag. However, there is no reason to assume that the concentration of HCH compounds in the Lek Canal differs from that in the Rhine. It is therefore expected that the European fresh water criterion is not exceeded in the Lek Canal or in other 21 Netherlands surface waters. Measurements were also taken in sewage treatment plants, but the concentrations found for lindane were below the detection limit (Stowa, 2003). For the α-, β- en γ-HCH isomers, it can be concluded that the MPC levels for surface water are not exceeded. In the case of α-HCH, no measurement data for air were found that could be evaluated against the criterion. Similarly in the case of α-HCH, β-HCH and γ-HCH, no measurements for sediment were found that could be used for evaluation against the criterion. 22 5.2.3 Hexabromobiphenyl General In the Stockholm Convention, hexabromobiphenyl (HBB) is included in Annex A with CAS number 36355-01-8, which stands for the most commonly occurring isomers of hexabromobiphenyl (UNEP-c, 2006). HBB is a persistent and highly bioaccumulating organic compound. It is also suspected of being carcinogenic and toxic for humans (UNEP-c, 2006). The molecular formula is C12H4Br6. Production and use No data is available on the production in the Netherlands in the past (European chemical Substances Information System, http://ecb.jrc.ec.europa.eu/esis/). HBB was used as a flame retardant in plastics, fabrics and other articles. The use of this substance was also common in the electronics and electrical engineering industries, for example, in printed circuit boards and in the plastic casing of equipment. Hexabromobiphenyl is better known under the trade names FireMaster(R) BP-6 or FireMaster(R) FF-1 (UNEP-c, 2006). Although the composition of FireMaster can differ by production unit and batch, it always contains several polybromobiphenyl materials and isomers. HBB is also employed in the chemical industry to eliminate by-products. HBB is a dioxin forming chemical. In the Netherlands, only one company manufacturers flame retardants containing bromine. As far as is known, though, it has never produced HBB. No reports of imports or exports involving the Netherlands from 2003 to 2008 were found in European Database Export Import of Dangerous Chemicals (EDEXIM, http://edexim.jrc.ec.europa.eu/). Waste phase No waste streams containing hexabromobiphenyl were found in the Netherlands from 2005 to 2008 (see Annex I). Measures Hexabromobiphenyl is a polybromobiphenyl with 6 bromine atoms. It is one of the polybromobiphenyls. The use of polybromobiphenyls (PBBs with CAS number 59536-65-1) had already been subject to restrictions since 1983, which meant that PBBs were not permitted to be used in textile articles that could come in contact with skin, such as clothing, underwear or linens. Items that contained PBBs and could come in contact with skin were not allowed to be sold (Directive 76/769/EEC). This restriction was included in full in Annex XVII to Regulation (EC) 1907/2006. In line with Directive 2002/95/EC, there has been a ban on the presence of PBBs in electric and electronic equipment since 1 July 2006. In the Netherlands, a complete ban on the production and use of HBB with CAS number 36355-01-8 has been in force since 2004, pursuant to the EU POP Regulation, (EC) 850/2004. 23 Emission The reports required by Regulation (EC) 166/2006 have to detail the emissions of HBB exceeding a limit of 0.1 kg/year by source (company), separately for air, water and soil. No data on emissions into air were reported in the Netherlands for the period 1990 to 2008. Total reported emissions into water in the Netherlands in 2007 were 3 kg. No emission data were reported for other years. No reports on emissions into soil are available. Environmental quality Ad hoc quality criteria applying to HBB have been set in the Netherlands for the media air, water and sediment. They are referred to as ad hoc MPC values and are as follows: MPCair is 0.0000406 µg/m3, MPCwater is 0.002 µg/l, and MPCsediment is 3.30 µg/kg dry material (http://www.rivm.nl/rvs). The concentrations that RIWA measured in the Netherlands’ surface waters from 2005 to 2008 were under 0.0005 µg/l, which is the limit of detection (RIWA 2005, 2006, 2007, 2008). It can be concluded from the measurements that the reference water quality criteria for surface water are not exceeded. No evidence was found of HBB in air or sediment. 5.2.4 Commercial bromodiphenyl ethers pentaBDE and octaBDE General Commercial pentabromodiphenyl ether (c-pentaBDE) and octabromodiphenyl ether (c-octaBDE) are both mixtures of various bromodiphenyl ethers. Commercial pentabromodiphenyl ether (c-pentaBDE) is included in the Stockholm Convention as tetrabromodiphenyl ether and pentabromodiphenyl ether. The exact description in the Convention is: 2.2’,4.4’-tetrabromodiphenyl ether (BDE-47 with CAS number 40088-47-9), 2.2’,4.4’,5’ pentabromodiphenyl ether (BDE-99 with CAS number 32534-81-9) and other tetrabromodiphenyl and pentabromodiphenyl ethers present in c-pentaBDE. Commercial octabromodiphenyl ether (c-octaBDE) is included in the Stockholm Convention as hexabromodiphenyl ether and heptabromodiphenyl ether, which refer to 2.2’,4.4’,5.5’-hexabromodiphenyl ether (BDE-153 with CAS number 68631-49-2), 2.2’,4.4’,5.6’-hexabromodiphenyl ether (BDE-154 with CAS number 207122-15-4), 2.2’,3.3’,4.5’,6 heptabromodiphenyl ether (BDE-175 with CAS number 446255-22-7), 2.2’,3.4,4’,5’,6-heptabromodiphenyl ether (BDE-183 with CAS number 207122-16-5) and other hexabromodiphenyl and heptabromodiphenyl ethers present in c-octaBDE. The above BDEs, present in c-pentaBDE and c-octaBDE, as referred to in the Stockholm Convention, degrade slowly in the environment, can be transported over long distances, and can cause adverse effects on health (UNEP-d, 2006; UNEP-e, 2007). 24 Production and use Flame retardants containing bromine (which are more inclusive than pentaBDE and octaBDE) are used mainly in the polymer, plastics and textile industries, where they are added to or mixed into plastics to make them non flammable. These materials are also used in the casings of electronic and electric equipment, such as printed circuit boards and plastic casings (EU-RAR, 2003; UNEP-d, 2006). Specific examples are pentaBDE in polyurethane foam (mainly in the United States) and octaBDE in ABS plastics. The Netherlands has only one manufacturer of flame retardants containing bromine that produced both c-pentaBDE and c-octaBDE between 1978 and 1995. (Source: Netherlands Competent Authority, 2010, “Questionnaire for submission of information on New POPs in accordance with SC-4/19”.) Part of the output was exported. No reports of imports or exports involving the Netherlands between 2003 and 2008 were found in European Database Export Import of Dangerous Chemicals (EDEXIM, http://edexim.jrc.ec.europa.eu/). Waste phase The last notifications of waste streams containing bromodiphenyl ethers (BDEs) in the Netherlands were at the end of the 1990s (Annex I). From 2005 to 2008, no other waste streams containing BDEs that satisfy the selection criteria were found in the Netherlands (Annex 1). The relevant documents submitted by waste disposers in the Netherlands include general descriptions such as “solid mixtures containing bromine”, “solid materials containing bromine” and abbreviations, HBCD for example (See Annex I). Measures Since 2003, the use of pentaBDE and octaBDE (and derivatives) had been regulated by the Restrictions Directive 76/769/EEC. As from 2006, however, the use of both BDEs (and derivatives) has been included in REACH Annex XVII (EC) 1907/2006. It states there that they may not be sold or used as a substance or in mixtures at a concentration exceeding 0.1% by weight. In addition, items may not be sold if they, or their flame retardant components, contain a concentration of pentaBDE or octaBDE exceeding 0.1% by weight. Exempt from the foregoing are items in use in the European Community before 15 August 2004, and electric and electronic equipment covered by Directive 2002/95/EC. In line with this Directive, there has been a ban on the presence of polybromodiphenyl ethers in electric and electronic equipment since 1 July 2006 (Directive 2002/95/EC). Pursuant to Directive 689/2008/EC, notification has been obligatory for exports of pentaBDE with CAS number 32534-81-9 (BDE-99) and octaBDE with CAS number 32536-52-0 since 17 June 2008. TetraBDE, pentaBDE, hexaBDE and heptaBDE were included in the revised version of the European POP Regulation (EC) 850/2004, resulting in far-reaching restrictions on their production and use. Consequently, pentaBDE has ceased to fall within the scope of the REACH Regulation (EC) 1907/2006 in 2011. Emission The reports required by Regulation (EC) 166/2006 have to detail the emissions of bromodiphenyl ethers (BDEs) exceeding a limit of 0.1 kg/year by source (company), separately for air, water and soil. (The emissions have to 25 be stated as the total quantities of pentaBDE, octaBDE and decaBDE.) No data on emissions into air were reported in the Netherlands for the period 1990 to 2008. Table 13 shows the total reported emissions of bromodiphenyl ethers into water in the Netherlands since 1990. No emission data were reported for other years. No reports on emissions into soil are available for the period 1990 to 2008. Table 13. Total reported emissions of bromodiphenyl ethers (aggregate of pentaBDE, octaBDE and decaBDE) into water in the Netherlands since 1990 (in kg). 1990 1995 2000 2005 2007 2008 78.8 132.1 190.0 141.5 124.2 114.8 It can be seen from the above table that, following a rise after the 1990s, a decline seems to have set in after 2000. However, more emission data are needed to draw firmer conclusions. Environmental quality Only surface water criteria exist for both BDEs. The criteria were derived for the situation in Europe. The criterion derived for bromodiphenyl ethers (CAS number 32534-81-9) in fresh water is 0.0005 µg/l (annual average environmental quality criterion; Directive 2008/105/EC). The limit applies to the total concentration of the BDE isomers 28, 47, 99, 100, 153 and 154. Environmental data are available in the Netherlands. Some concentrations of tetraBDE, pentaBDE and hexaBDEs have been measured in fish products and in waste water processed by sewage treatment plants (de Boer et al., 2003; Stowa, 2003). From 2005 to 2008 , concentrations of BDE47, BDE85, BDE99, BDE138 and BDE153 below the limit of detection of 0.0005 µg/l were reported in the Rhine (RIWA 2005, 2006, 2007, 2008). As the criterion for fresh water (2008/105/EC) applies to the aggregate of BDE isomers 28, 47, 99, 100, 153 and 154, and the fresh-water concentration data for the Netherlands are limited to a subset of these isomers (whose concentrations are also under the limit of detection), the concentrations in the Netherlands cannot be evaluated against the criterion. 5.2.5 Perfluorooctane sulfonic acid (PFOS) General PFOS is a surface-active substance. The Stockholm Convention refers to PFOS as perfluorooctane sulfonic acid (CAS number 1763-23-1), its salts and perfluorooctane sulfonyl fluoride (CAS number 307-35-7). The CAS numbers in the Convention are those of the PFOS salts that are commercially important: 2795-39-3, 29457-72-5, 29081-56-9, 70225-14-8, 56773-42-3 and 251099-16-8 (UNEP-f, 2006). PFOS is highly persistent, bioaccumulative, toxic and has the capacity to be transported over long distances in the environment (UNEP-f, 2006). 26 Production and use PFOS are fluorinated compounds. In the past, they had countless uses in products such as textiles, leather, carpets, paint, paper, cardboard and fire-fighting foam. PFOS also has a number of specific industrial uses in a wide variety of products and processes, among them being microchips, chrome plating, and as a component of hydraulic fluids for aircraft (UNEP-f, 2006). As far as is known, PFOS has never been produced in the Netherlands (UNEP-f, 2006: European chemical Substances Information System, http://ecb.jrc.ec.europa.eu/esis/). PFOS was imported over a long period, however, for a variety of industrial applications. An estimated 390 kilo PFOS was used each year in the Netherlands for a specific application in the metalworking industry (Bruinen de Bruin et al., 2009). Estimates have also been made of the stocks of fire-fighting foam containing PFOS still existing in the Netherlands. The largest stocks of this type of foam exist at airports and chemical industry sites, such as paint factories and petrochemical industrial parks. The total amount of this foam still present throughout the Netherlands is estimated at 18,540 m3 (Bruinen de Bruin et al., 2009). As there are no producers in the Netherlands, it can be stated with certainty that all the PFOS in the country has been imported. Total import volumes are not known. Waste phase No waste streams containing PFOS were found in the Netherlands from 2005 to 2008 (Annex 1). Measures In the Netherlands, the use of PFOS has been restricted for most applications since 12 December 2006 by the operation of Directive 2006/122/EC. PFOS has been included in Annex I to the Restrictions Directive 76/769/EEC since 27 December 2006. As from 22 June 2009, these restrictions have been regulated in the Netherlands via Annex XVII of the REACH Regulation (EC) 1907/2006. PFOS was included in the revised version of the European POP Regulation (EC) 850/2004 in 2010, resulting in far-reaching restrictions. Consequently, PFOS has ceased to fall within the scope of the REACH Regulation (EC) 1907/2006 in 2011. Emission PFOS and PFOS-related substances can be released into the environment during the production of materials or products containing PFOS, during their use in industrial and consumer applications, and during the waste stage after their use. Few measurement data are known in the Netherlands. Emission estimates have been made for specific applications, however, in the framework of Directive 2006/122/EC. In a worst-case scenario, 390 kg of PFOS are released each year in the Netherlands during the use of PFOS as a demister and humidifier for non-decorative chrome-plating purposes (Bruinen de Bruin et al., 2009). Emissions occur during the use of fire-fighting foam 27 that contains PFOS. Exact data on volumes are not available, though. No emissions into air have been reported pursuant to Regulation (EC) 166/2006. Environmental quality Environmental criteria have been proposed in the Netherlands for the PFOS content of fresh water, drinking water and sea water, but not formally adopted yet. It is likely that European criteria will be derived under the umbrella of the European Water Framework Directive. When EU criteria are known, concentrations in various bodies of water in the Netherlands can be evaluated against them (RIWA, 2007 and 2008). The criterion for the total ingestion of PFOS via food each day is the acceptable daily intake (ADI) of 150 ng/kg body weight (EFSA, 2008). Detected background concentrations in fish caught in the Netherlands have been reported by van Leeuwen and de Boer (2006; cited in Bakker and Te Biesebeek, 2009). Measurements have been taken of flounder (Westerschelde and Waddenzee), perch (Hollands Diep and IJsselmeer) and eel (six locations, including the rivers Rhine and Maas, and IJsselmeer and Ketelmeer). Based on the average consumption patterns of the Netherlands’ population and the concentrations measured in food products, among them fish, Bakker and Te Biesebeek (2009) concluded that the total daily ingestion of PFOS per capita in the Netherlands will turn out to be less than 150 ng/kg body weight. The level being exceeded by people who eat large amounts of fish cannot be ruled out, however (EFSA, 2008; cited in Bakker and Te Biesebeek, 2009). 28 5.2.6 Pentachlorobenzene (PeCB) General Pentachlorobenzene (PeCB) is an organic compound. It occurs as colourless to white crystals with a significant odour and does not dissolve easily in water. PeCB can also occur as a gas, however. The substance has the chemical form of a benzene ring substituted with five chlorine atoms (C6HCl5) and CAS number 608-93-5. PeCB can affect the liver, causing it to malfunction. Tests conducted on animals indicate that it can interfere with the reproductive process and human growth. PeCBs have to be considered persistent based on their estimated and experimental half-life in the air, soil, sediment and water (UNEP-h, 2007). The substance meets the criteria to be classified as transportable over long distances and as bioaccumulative (UNEP-h, 2007). Production and use Pentachlorobenzene can be produced as a by-product of the synthesis of tetrachloromethane and benzene. It is extracted from the reaction mixture by distillation and crystallisation. Pentachlorobenzene was originally used in the production of pesticides, one of them being quintozene (pentachloronitrobenzene), in which it occurs as an impurity (UNEP-i, 2008). PeCB was also used as a flame retardant and as an agent for reducing the viscosity of materials containing PCB that were used as heat conductors. No notifications were found concerning the use of pentachlorobenzene in pesticides in the Netherlands (Ctgb). No data is available on any production in the past (European chemical Substances Information System, http://ecb.jrc.ec.europa.eu/esis/). Pentachlorobenzene is not included in the European Database Export Import of Dangerous Chemicals (EDEXIM, http://edexim.jrc.ec.europa.eu/). Waste phase No waste streams containing pentachlorobenzene were found in the Netherlands from 2005 to 2008 (Annex 1). Measures As PeCB and PCBs were both used in accumulators, it can be assumed that the measures taken to trace and destroy oil and equipment containing PCBs, such as transformers and capacitors, also help to reduce the presence of PeCB (UNEP-h, 2007). The Inspectorate has focussed its efforts in the Netherlands on ending the use of PCBs, including their destruction. As such, these efforts also tackle the issue of PeCB. Under the Plant Protection Products and Biocides Act (Wet Gewasbeschermingsmiddelen en Biociden, 17 February 2007), it is forbidden in the Netherlands to sell or stock crop protection products or biocides, or to import or use them in the Netherlands unless the Act allows it, or, in the case of biocides with negligible risk, the import and use is registered (Section 20). As a consequence of this Act, PeCB and quintozene – in which PeCB can occur as an impurity – are both banned as plant protection products in the Netherlands. 29 Specifically in the case of PeCB unintentionally released as a by-product from a variety of sources, it is expected that the application of BAT and BEP to incineration plants – to reduce emissions of PCDDs and/or PCDFs for example – will result in an evident reduction in PeCB emissions (Hogendoorn et al., 2009). Emission Both the risk profile and risk management report for PeCB show that unintentional emissions are the primary cause of its presence in the environment. Examples of unintentional sources are the formation of PeCB as a by product during incineration processes such as waste incineration, fires in barrels and open hearths, and the burning of wood for agricultural purposes. The reports required by Regulation (EC) 166/2006 have to detail the emissions of HBB exceeding a limit of 1 kg/year by source (company), separately for air, water and soil. In the Netherlands, the aggregate of chlorobenzene emissions into water and soil was reported, with those attributable to pentachlorobenzene included in the figure. It is not possible to state the specific pentachlorobenzene emissions. Environmental quality In the case of pentachlorobenzene, European environmental quality criteria for air and water were derived and adopted (Directive 2008/105/EC). The annual average criterion for fresh water is 0.007 µg/l and 0.0007 µg/l for other types of water (Directive 2008/105/EC). In the Netherlands, the special-purpose MPC levels for the media air and sediment are 0.071 µg/m3 en 100 µg/kg (dry material) respectively (http://www.rivm.nl/rvs). Table 14 shows the maximum concentrations (in µg/l) measured in Dutch waters. 30 Table 14. Maximum concentrations (µg/l) measured in Dutch waters (RIWA, 2005, 2006, 2007 en 2008). 2005 2006 2007 (Jan-June) 2008 Rhine Lek Canal Amsterdam Rhine Canal Rhine Lek Canal Amsterdam Rhine Canal Rhine Lek Canal Rhine Lek Canal Amsterdam Rhine Canal Limit of detection (µg/l) 0.001 0.01 0.01 0.001 0.01 0.01 0.001 0.01 0.0001 0.01 0.01 PeCB <0.001 <0.01 <0.01 <0.001 <0.01 <0.01 <0.001 <0.01 0.0001 <0.01 <0.01 Based on the above concentrations, it can be stated with certainty that in one case (Rhine in 2008) the European criterion was met. The same cannot be stated with certainty for the other years and locations, as most of the concentrations measured are under the limit of detection, which is itself higher than the European water quality criterion. For the media air and sediment, no measurement data were found that could be evaluated against the MPC level. 5.3 Locations contaminated with POPs To identify all actual and potential cases of soil pollution in the Netherlands, the central government, provinces and municipalities carried out the Landsdekkend beeld [nationwide picture] project. The project is an offshoot of the third National Environmental Plan, which mandated that a nationwide inventory of soil pollution had to be made, with the object of identifying the full extent of soil pollution in the Netherlands. The project culminated in 2005 with the revelation that the soil in the Netherlands was possibly polluted at more than 600,000 locations. Owing to the high cost of cleaning up, it is important to set priorities for the necessity of this remediation at specific locations. From 2004 to 2008, many locations were dealt with, either by being cleaned up or, following an examination, being considered as not in need of remediation. At the end of 2008, the number of locations that were possibly seriously polluted was set at 265,000. Of these, 16,000 have been prioritised as potentially emergency sites because of the risks they present for humans and the environment. The number is split into locations with risks for humans and those with risks for the environment. The locations with the greatest risks for humans have to be tackled before 2015. Of the other polluted locations, the soil must be cleaned up or in a manageable condition by 2030 at the latest. It is still not known precisely how many of these locations are contaminated with POPs. 5.4 Conclusions regarding the obligations The production and use of the POPs included in the Stockholm Convention are banned in the Netherlands. This prohibition is laid down in European as well as in Dutch legislation. Well before the Convention took effect, the substances it covers – the 12 existing ones and the 9 new ones – were no longer being produced or used in the Netherlands. Concerning the import and export of the Convention POPs, as well as waste containing them, these 31 activities are subject to the provisions of the Basel Convention and the Rotterdam Convention, which have been translated into both European and Dutch legislation. Emissions of POPs included in Annex C to the Stockholm Convention are limited as much as possible by existing statutory frameworks. As regards the unintentional emissions of substances such as HCB, PCBs, dioxins and furans, measures were implemented in the past to keep them to a minimum. In some cases, the Netherlands’ measures go further than those embedded in EU legislation. Because of the measures already taken regarding the production, use, and import and export of POPs, the main issues in the Netherlands are the widespread environmental pollution due to use in the past, possible existing sites with soil pollution, and POPs in the waste stage. For a number of POPs, the current objectives formulated for the Water Framework Directive will not be achieved by 2015. Solutions for these POPs will need to be found within the Netherlands’ policy on water quality. The cleaning up of locations contaminated with POPs is being carried out in line with the Netherlands’ policy on soil, as embedded in the Soil Protection Act. Above all, it is the policy on POPs in the waste stage and their management that necessitates a harmonised EU approach. Table 15 shows for each POP the indicative first year of worldwide production and the final year of use in the Netherlands. Table 15. Monitoring Article 11 of the Stockholm Convention contains recommendations on the monitoring of POPs in the environmental media. The Netherlands has monitoring and reporting obligations under different international conventions and European regulations (NIP, 2006). The resulting monitoring programme in the Netherlands has not changed appreciably since 2006. The study conducted in 2006 into monitoring activities shows that only hexachlorocyclohexane, pentabromodiphenyl ether and pentachlorobenzene are monitored in different media. Because the issue is topical, it is likely that the monitoring activities for both diphenyl ethers and for perfluorooctane sulfonic acid will be expanded over the next few years. The Convention imposes no obligations in this respect, however. Chlordecone and hexabromobiphenyl are not part of current monitoring programmes. In view of their production and use in the past, few problems are anticipated for these substances. ch lo rd ec on e he xa br om ob ip he ny l he xa ch lo ro cy cl oh ex an e oc ta br om od ip he ny l e th er pe nt ab ro m od ip he ny l e th er pe rf lu or oo ct an e su lf on ic a ci d pe nt ac hl or ob en ze ne surface water + + + drinking water + + ground water rain water + suspended matter + + + sediment + + soil air flora/fauna + + + food + animal feed + = monitored Of the nine new substances added to the Convention, only pentachlorobenzene is included in Annex C (unintentional emissions). Of the other substances, chlordecone, hexachlorocyclohexane and perfluorooctane sulfonic acid are also included for emissions into air, and chlordecone, hexachlorocyclohexane, pentabromodiphenyl ether and octabromodiphenyl ether for emissions into water. The emissions of the above-mentioned substances into air and water have to be reported if they exceed the threshold values the Regulation specifies. 35 7. National Action Plan In the framework of European Regulation (EC) 850/2004 and the Stockholm Convention, the State Secretary for the Environment is the primary responsible and competent authority. The State Secretary is responsible for fulfilment of the reporting obligations and other elements stemming from the Regulation and the Convention. In the framework of the Regulation, and that of the Convention, actions were set out in the Netherlands’ National Action Plan (NAP) that was part of the NIP (NIP, 2006). Over the past four years, all the actions have been carried out. The Netherlands has met the yearly and four-yearly reporting obligations under the Convention. A study into the registration of polluted sites in the Landsdekkend beeld [nationwide picture] database shows that it is not yet possible to extract data specifically on POPs. A follow-up study into the extraction of data from local databases was not carried out because of feasibility reasons and the extensive effort that would have been required. It was stated in the previous National Action Plan that it was unlikely that all the POP objectives of the Water Framework Directive would be achieved. The Netherlands takes a national approach to substances that are released from a wide variety of sources: an implementation programme for widespread sources of water pollution, known as BWL2007122130A. Reports on the programme have been submitted regularly to the Lower House of the Netherlands parliament. The Netherlands has pleaded to have European measures adopted for substances that find their way into water from a wide variety of sources. The Netherlands makes every effort to have actions taken as much as possible for Europe as a whole, as this seems the best approach for avoiding duplication by different countries and for achieving greater efficiency. To provide better understanding of the obligations under the Stockholm Convention following the addition of the nine new substances, the NIP from 2006 has been brought up to date. Accordingly, this current NIP also includes an updated NAP, which sets out the actions the Netherlands intends taking over the next few years. 9.1 Inclusion of BDEs in international regulations The Stockholm Convention includes commercial pentaBDE in Annex I as BDE-47, BDE-99 and other tetrabromodiphenyl ethers and pentabromodiphenyl ethers present in commercial pentaBDE. Commercial octaBDE is defined as BDE-153, BDE-154, BDE-175, BDE-183 and other hexabromodiphenyl ethers and heptabromodiphenyl ethers present in commercial octaBDE. Pursuant to the Water Framework Directive (2008/105/EC), Europe-wide environmental criteria have been derived for bromodiphenyl ethers (CAS number 32534-81-9) in surface water, as a limit on the aggregate of the BDE isomers 28, 47, 99, 100, 153 and 154. The EU Regulation establishing a European Pollutant Release and Transfer Register, E-PRTR (EC) 166/2006, includes an aggregate criterion for BDEs (sum of pentaBDE, octaBDE and decaBDE). To draw conclusions for the Netherlands on concentrations of the BDEs covered by the Stockholm Convention, the currently available environmental data measured in connection with the Water Framework Directive are inadequate. This is because the BDE isomers measured in Netherlands’ waters (BDE47, BDE85, BDE99, BDE138 and BDE153) only partly 40 correspond to the BDEs included in the Convention. To take measures, it is considered relevant to include the individual isomers of the E-PRTR Regulation. As an action point, the Netherlands will examine whether the missing isomers can be added to its own monitoring programme and will lobby for an EU-wide discussion on this issue, so that the situation can be tackled with a harmonised approach. 9.2 Substances in waste streams and stocks PBBs, BDEs and PFOS The registration of waste streams employs codes, which helps provide insight into the volumes and the processing. An international discussion is currently underway on the waste problem presented by a number of POPs. The elimination of PBBs, BDEs and PFOS from products and their treatment during the waste stage are the main aspects requiring more understanding in order ultimately to tailor waste policy to them. The Netherlands will lend its support to developments leading to the adoption of concentration limits for POPs in waste matter, as well as the potential necessity for effective screening and separating waste streams. PCBs In the mid-1980s and around 2003, collection campaigns were conducted in the Netherlands with the aim of eliminating PCBs from storage batteries and transformers. Incidents reveal that PCBs are still released from minor sources. For example, oil containing PCB was recently discovered in the hydraulic mechanisms of bridges, and various European countries have reported the presence of PCB in building materials. The Netherlands has in the past – and will continue to do so – use enforcement to remain attentive to the emission of PCBs from different sources and to the obligation as of year-end 2010 to eliminate storage batteries and transformers containing PCB (Directive 96/59/EC). HCB The import of pyrotechnic products into Europe is governed by Directive 2007/23/EC. Products still appear on European markets, the Netherlands among them, containing substances that fail to satisfy the obligations of restriction or authorisation, or are the subject of a complete ban. Many of these products come from China, an example being fireworks containing HCB. On this specific issue, the Inspectorate of the former Ministry of Housing, Spatial Planning and the Environment initiated discussions with the Chinese authorities, who agreed to take action. The Netherlands will develop suitable enforcement methods and tools to prevent fireworks containing HCB from being sold on the market within its borders. In addition, the Notified Body designated by the Ministry of Infrastructure and Environment pursuant to Directive 2007/23/EC has stated that, within the limits of its jurisdiction, it will be watchful for pollution by HCB. 41 PFOS REACH Annex XVII has a provision allowing fire-fighting foam containing PFOS that was for sale before 1 December 2006 to be used until 27 June 2011 . The Netherlands will develop suitable enforcement methods to remove this foam from the market within its borders before 27 June 2011 and have it destroyed as rapidly as possible. 9.3 Reporting obligations Reporting in the framework of the Stockholm Convention 1. Article 15. Reporting. Reporting is at regular intervals in a format and with a frequency established by the Conference of the Parties (COP) during its first session. At the Conference of the Parties in May 2005, it was decided that reporting should be every four years. The next reporting year is 2014 for the period 2009 to 2013. 2. Annex A. Elimination. Part II. A report on progress with the elimination of PCBs must be prepared every five years and submitted to the COP in accordance with Article 15 of the Stockholm Convention. Reporting in the framework of EU obligations 1. Every three years, the Member States must provide the European Commission with data on the application of Article 12.1 of Regulation (EC) No 850/2004, including data on violations and sanctions. 2. Under the provisions of Article 12.2 of Regulation (EC) 850/2004, each Member State must provide the European Commission every year with data on the total production and quantities placed on its market in the substances listed in Annex I and Annex II. 3. Every three years, the Member States must report information on the stocks of substances covered by Regulation (EC) 850/2004 to the European Commission. 4. Pursuant to Article 12.3 of Regulation (EC) 850/2004, the Member States must report the emission data for the substances listed in Annex III of the Regulation to the European Commission every three years. Not only must emissions of these substances be reported to the European Commission every three years, but also the emission data on the substances covered by the LRTAP Convention and the Stockholm Convention. 5. Pursuant to Article 12.3 of Regulation (EC) 850/2004, the Member States must report the monitoring data for the substances listed in Annex III of the Regulation (dioxins, furans and PCBs) to the European Commission every three years. 52 5.2 Resultaten PCB meldingen analyse a. 53 Tabel 1 Overzicht hoeveelheden per afvallijn in afvalbeheerketen PCB in periode 2001-2008 Hoeveelheid in ton LIJN 2001 2002 2003 2004 2005 2006 2007 2008 Inzamelaar/bewaarder- bewerker 4 4 3 10 8 23 45 8 Inzamelaar/bewaarder- verwerker 214 110 470 106 Ontdoener- inzamelaar/bewaarder 137 172 553 122 169 200 215 112 Ontdoener- bewerker 583 765 322 123 24 94 99 190 Ontdoener- verwerker 959 603 486 215 Inzamelaar/bewaarder- buitenlandse verwerker 4 494 0 0 222 216 688 717 Bewerker- verwerker 518 412 326 82 149 116 122 53 Bewerker- buitenlandse verwerker 142 94 126 57 294 251 288 289 Buitenlandse ontdoener- bewerker 855 740 904 422 1.221 1.047 655 821 Buitenlandse ontdoener- verwerker 1007 959 324 398 288 365 125 217 b. 73 7.3 Aldrin, Dieldrin en/of Endrin houdend afval a. Stork in Hengelo (O). In Nederland waren eind 2008 zes kolencentrales gevestigd.
