(JO'" May.19 16) Thi~ Law may he c.:ited as the Wild Animals Preservarion Law. IS t f For the purpose of this Law. the Civil Service Com1111s,~ion may appoi111 a Chief Warden, Wardens and such other officers and employees as may be considered necessary. There shall be paid to any person appointed under this section such remuneration and allowances ( if :rny) as the C ivil Service Commiss ion ~hall determine. So soon as may .be, there shall be established an adv isory co111111i11ec for Ebonyi State wh ich sha ll be known as the Wild J imals Preservation J\dvisory Commiuce. It ~hall be the duty of the Commiucc to advise :ind to make recommendations to the Commiss io ner on all mailers and questions re lating to the animals o f Ebonyi State. The Commi11cc shall cons ist of a Chairman. who shal l be the Chief Warden, and such number of Olhcr members not exceeding eight in number as may be determined by the Commiss ioner. (-I) T here shall be paid 10 the members of the /\dvisory Committee such remunerat ion and allowances ( if any) as the Commiss ioner shall determine. No person shull hunt . kill or capture: (a) any of the animuls or hirds mentioned in the r:irst Schedule: (b) any o f the animals mentioned in the First or Second Schedules if the 'animal be (a) immature or (b) a female accompanied by her young; or (c) any female antelope. unless he is authorized by a special licence or other authority under this l.aw. Eve ry trophy. cons1st111g or ivory or rhinoccro~ horn. exported in accordance with the provis ions of ~cction I I or this Law ~hall be identified hy marks which shall he recorded in the export certificate. together with the weight of the trophy. 1;vcry other trophy exported shall. 1f possible. he ~imilarl y mnrkecl and ~ uch marks shall be recorded in the export certificate. 111 case it shall not be possible to mark any such trophy. it ~hall he dcscribed in the export certificate so as to identify it wi th a~ much certainty as poss ible. Nothing in section 11 shall be deemed to prohibit : (a) the posse~s ion, sale or purchase or any animal , bi rd or thing which ha~ been forfe ited to or is the property or the Government . and which has been sold by the order or the Commissioner: or (h) the sale of an y animal. bird or thing, o ther than an animal. hire! or th ing liable to forfe iture under this Law. fo rming part of the estate of a deceased person. if ~old by the persorwl representative of the deceased person: or (c) the sale or purc.:hasc hy a citizen of Nigeria o r the ne~h or any protected animal or bird which has been killed under a I icencc or permit. No person shall possess. se ll. purchase or transfer any powdered rh inoceros horn. (2) Such permit shall be known a~ a Free Dispo,al Permi1 :md shall be in such form as may be prescribed. (3) / y ivory or rhinoceros horn in re~pecl of which such pcrmil has nol been obtained shall be deemed to lw\'e been obta ined in con1ravent ion of this Law. ( IJ otwithstanding any1hing in 1his Law contained, no per~on shall be deen1ed to ha ve committed an offence against this Law by reason of his having killed or injured an) :inimal or bird in delcm:e of himself or any other person. hut he shall report such occurrence without delay to an aclminbtratiYc onicer. and when the animal killed i' an elephant or rhinoceros shall cause the tusks or horn to be takcn to a Government station and handed over to an administrati 1 e orticcr. When the carcass or remains of any protected an imal or an) protected bird shall be found. the head. horns. tusks. and feathers of such animal or bird shall he the propcrty o l' the Government: l'ru1 idcd that the Co1111111s~ioner nta): (a) waive this right in any case as he may deem fit: (h) direct the payment 10 any person of such compensation a~ \hall cover the cost of the trnnsport of any ivory or rhinoceros horn to the nc:1rcst Ciovcrn111c1H st<llion : and (c) direct the payment of rewanb for the linding of ivory or rhinoceros horn. (a) any specified species of anirnul or bird in any area dedarcd to be a game reserve: and (b) any specified species of protected animals (other th:m elephant or rhinoceros) mentioned in the First Schedule, in any area other than an area declared to be a g:une reserve. (2) such special licences shall be subject to such conditions as the Commissioner may by endorsement on the licence impose. It shall he shown to the satisfaction of a Local Govemmcnt Secretary of a Local Government Council, or any other officer appointed by the Commissioner in lhis behalf, that it is necessary, in order to protect the lives of any persons or to prevent the destruction of crops or of domestic stock or in time of famine or for any requirement relating to public health or public order, th:11 any protected animal or protected bird shall be destroyed, the Local Government Secretary or other officer as :1forcsaid may authorize any person to kill such animals or birds for such period and by such methods (even though prohibited by the provisions of this Law or the regulations made thereunder) and subject to such condilion as he may direct with due regard to the prevention of any unnecessary dcstrnction of protected animals or birds: Provided that such authority shall not be granted in the ca~e or animals or birds in a game reserve. Every licence gramed under this section shall expire on the same dale :1s !he resident non-Nigcrian's or visitor's licence held al the lime of the grant ing of such special licence by !he person 10 whom the same shall be granted and only one such 'pecial licence ~hall he granted to such person during the period of any such rcsiclcnl non-Nigeri an's or visitor's licence: Provided. however, if such person shall have taken out a special licence authorizing him lO hunt, kill or capture one elephant or rhinoceros only. he may. on paymenl of a funher Ice or rive thousand N:iira. he granted a licence authorizing him lO hum. kill or cnplurc a second elephant or rhinoceros. E1cry person who shall obtain a special licence tmdcr the lasl preceding 'cc1ion shall produce lo the officer granting the same his re,idcnl non-Nigcrian's or visilor's li cence and such officer shall endor,e thereon the' fact of such special licence having been granled and the nature of the licence. When thc holder of a res ident non-Nigcrian's or visitor's licence or a 'peci<:tl elephant or rhinoceros licence has been prevented by c ircumstances beyond his own contro l from making any use of >uch licence. he ,ha ll he granted. on appl ication. a similar licence free or charge al any lime within five years frolll lhc dale of his unu,cd licence.
