(2 ) Any anima l , anima l prod uct ur ..: tHnmod i ties, eggs, feeds, feed add i t i ves and poultry imported in to Nigeria by land, sea or a i r may be subjected to exam ination, d isinfection, i noculation and quarant ine at the risk and expense of the owner as the CVON may deem necessary. (3 ) Any an ima l , an i mal products or commodit ies, eggs, pou l try, feed, feed addit ives and pet foods which for the pu rposes of trade or other purposes is brought into N igeri a across an i n ternat iona l border whether on hoof or by road, rai l , sea or air sha l l be subject to inspect ion at any of the Quarantine Stations or Control Posts l isted in Third and Fourth Schedu les to th is Act by an authorised officer for the purposes of ascertainment that such animals, animal products or commodities are duly permitted to be transported and fit to do so. ( 4) A person shall not import or export animals, animal products, semen, embryos, eggs, chicks, and w i ld bird species except under a permit issued by the CVON, who is the competent veterinary authority for the country, or by any Veterinary officer authorised by him. (2) The Federa l Department of Veterinary Services shal l be respons ib le for the contro l of vete r i nary b io l ogics, veter i nary med ic i na l products med icaments, infect ious agents, veterinary pest ic ides, and veterinary products of b iotechnology with i n N igeria, and the CVON shall issue permit authoris ing the use of the products before the products may be presented and accepted to undergo the mandatory process of statutory regulatory cert ificat ion by the appropriate authority or agency as prescr ibed by law. ( 3 ) Ho lders of annua l veter inary prem i ses l icense and veter inary practi s i ng l icense, or veter inary pharmacy cert i ficate issued by the Veterinary Counc i l of N i ger ia (VCN) on one hand, and veter inary pharmacy cert i ficate i ssued by the Internat ional Co l l ege of Veteri nary Pharmacy ( ICV P) or any other nat iona l or i nternat ional inst i tutions recogn ised by the YCN, on the other hand, shal l be accepted for t rade, import and export in veterinary bio logics, veterinary medic inal prod ucts, pet foods, feeds, feed addit ives or med icaments ' veter inary medical devices, veterinary products and for operation of veterinary premises or estab l i shments . Any an ima l , an ima l products or commod it ies, b io logics, veter inary med icinal products, infectious agents, or products of b iotechnology wh ich is not imported in accordance wi th the prov is ions of sect ions I and 2 sha l l be seized or caused to be destroyed i mmed iately on arriva l i n to N igeria by the competent authorit ies in col laborat ion with CVON, without prejud ice to the imposi tion of any penalty for the contravent ion of these provis ions provided that such seizure or destruction shal I be reported without delay to the Magistrate hav ingjur i sd iction in that area. 5.-( I ) A veter inary officer, po l ice officer or any authorised officer who has reason to be l ieve that there is i n any prem ises, an imal , an imal products or commod ities, pet foods, feeds, feed add it ives, b io logics, veterinary med ic ina l products, pest icides, infectious agents or products of veterinary b iotechnology wh ich have been imported into N igeria i n contravent ion of the prov i s ions of th is Act shal 1 (a) immed iate ly enter, i n spect the prem ises and exam ine any suspected an imal , an i ma l products or commod i t ies, pet foods, feeds, feed add i t ives. veter inary b io logics, veteri nary med ic ina l products, pest ic ides, i nfect ious agents or prod ucts of veterinary biotechnology there i n ; (b) demand, from the owner or person in charge or in possess ion, for the evidence of import perm it issued by the CVON to import such an imals, an imal products or commodi t ies, pct foods, feeds, feed add it ives, veteri nary medicinal products, pestic ides, b io logics or samp les or spec imen, infectious agents or products of veter inary b iotechnology found on the prem ises ; and (c) where he has reasonable grounds to bel ieve that such an imals, an ima l products or commodi t ies, pet foods, feeds, feed add itives, b iologics, veterinary medic ina l products, pest ic ides, i nfect ious agents or products of veterinary /\ 273 l : x por l a t i on o f au irna l'l and an imn f produc t� . ( 4 ) The freq uency and scope of d i sease surve i l l ance act iv i t ies sha l l be pro port iona l to the perce ived r isks or th reats posed by d iseases. c hem ica l s. rad iat ion or tox ic even ts as determ ined by �he CVON or State DY S. (3 ) A person who contravenes subsect ion (2 ) commi ts an offence and i l inb lc on convict ion to a fine of at least N500 000 or imprisonment for a term of three years or both . ( 4 ) O n ly veterinary surgeons are competent to diagnose, treat, prevent, contro l and erad icate diseases of wild l i fe. (5 ) A person who contravenes su bsection (4) commi ts an offence and i s l iab le on conv iction to a fine ofat least NS00,000 or imprisonment for a term of three years or both . 8.-( I ) A person hav i ng in h is charge or control any animal i nfected or suspected to be i nfected with any of the d i seases I isted - in the F i rst Schedu le to th i s Act o r any other emerging or re-emerging d iseases of soc io-econom ic, pub l ic health and food security consequences , sha l l keep such animals separate from other an ima l s not so infected or suspected to be i nfected and sha l l immed iately give notice o f the fact o f the an i mal being so i n fected or suspected to be infected to a veterinary officer or the nearest pub l ic veterinary officer or the authorised officer. (2) The person in charge of any trade an imal wh ich shows s igns of any d i sease or d ies wh i l e i n the process of be ing moved from one p lace to another, sha l l report the i l l ness or death of such an ima l to the author ised officer on arriva l at the first inspect ion station or contro l post, along the prescri bed routes, and in the case of death of the animal , sha l l dispose of the carcass in a hygienic and en vironmenta l ly safe manner as d i rected by the authorised officer. (3 ) A person having in h is charge or control any an ima l products or commod i t ies that i s contam i nated or adu l terated or suspected to have been contaminated or adu l terated, sha l I keep such an imal prod ucts or commodities separate from other animal prod ucts or commod ities not contam inated or adu l terated and sha l l immediately give notice of the tact of the anima l products or com mod i t ies to a veter inary officer, the nearest veterinary surgeon or t he authorised officer. ( 5 ) A person sha l l not keep in h i s possess ion veteri nary med ic ina l products, bio logics, in fect ious agents or products o f veter inary b iotechno logy for commercial or any other purposes w i thout the registrat ion of such prem ises by the Veter inary Coun c i l of N iger ia (VCN). (6) The DY S sha l l transm it such in format ion as regards the registrat ion of such prem ises concerned to the office of the CVON for h i s consent and necessary act ions . (7 ) A person in charge of any contaminated or adul terated med icated an ima l feeds, feed add it ives, pet foods, substandard veterinary med ic i na l products, substandard veterinary med ical devices and other veterinary products, sha l l report such to the authorised officer and sha l l d i spose of the items as d i rected by the authorised officer i n an env i ronmenta l ly friend ly manner. (8) When any an imal so infected or suspected to be infected i s bei ng transported, n either such animal nor any an imal with which it has been in contact shal l be moved except in so far as may be necessary for effect ing iso lation or for (a) procuring food or water pending the d irections of a veterinary officer ; (b) an imals to be transported in accordance with the OI E gu ide l ines ; (c) un load ing faci l ities wh ich must be fit for the purpose of preventing i njuries to an imals ; (d) al l an imals to be inspected on arrival ; and (e) an i mals that are severely d istressed or inj u red to be s laughtered or be cu l led immed iate ly. ( 1 0) I f the veterina ry o flicer i s o f the op in ion thn l any an imal is in fected w ith an , d i sca c or he has reason to bel i eve that any anima l has been ex posed to infect ions , shal l at a cost to the owner administer treatment, or issue such orders. d i rections or prohibit ions as he may consider necessary to prevent the spread of the d isease and may cause any such an imal to be slaughtered, in accordance wi th the Animal \Ve I fare Code of Practice, i f he considers that the s l augh ter of such animal is necessary for the prevention of the spread of the disease and shall inform the police immed iately. ( 1 l ) All veterinary biologics, veterinary medic inal products, veter inary pesticides and veterinary medical devices shal l be hand led, sold or administered only by a veterinary surgeon, or any authorised officer under h is supervision, w ith up-to-date annual practising license issued by the VCN. ( 12) The CVON through the State DYS shal l immediately be notified of any outbreak of zoonotic or transboundary an imal d i seases i n order to ensure timely implementat ion of prevention, containment, contro l and erad ication strategies, and other necessary risk management or m it igat ion measures . ( 1 3) The official notification, as stipulated in subsection ( 1 2), shal l contain the (a) location of outbreak ; ( b) date of the outbreak ; (c) species, number, sex and age of anima ls involved ; (d) morbid i ty and morta l i ty ; (e) tentative d iagnosis ; (/ ) laboratory tests and resu l ts ( if any) ; (g) disease control measu res taken in relat ion to the outbreak ; (h) possible o r known ori g in of the l isted diseases ; and ( i) d isease outbreak investigation report. (2) The CVON shall be responsible for the contro l of trade animals prescribed under thi s Act and also for the establ i shment and maintenance of electronic animal identification system throughout the federation for the purpose of tracing, prevention and control of zoonotic and transboundary animal d iseases. (3 ) The CVON in consultation with the Nigerian Agricultura l Quarantine Services (NAQS), State DYS, private sector, other rel evant government agencies and stakeholders shall des ign and review a framework for the implementation and enforcement of animal identification and traceab i l ity in N igeria based on (a) the outcomes of the risk assessment ; . . (b) the animal and pub l ic health situation (inc luding zoonoses and re l ated programmes) ; (c) animal popu lation parameters (such as species and breeds, numbers and distribution) ; (d) types of product ion ; (e) animal movement patterns ; (/) available techno logies ; (g) trade in animals and anima l products ; (h) cost or .benefit analysis ; ( i ) o ther econom ic , cu l t u ra l , geograph ica l and environmenta l cons iderat ions ; and (i) confidentiality of data, accessibility issues and efficient exchange of infonnation. (7) A person who appl ies, or causes the appl icat ion of, an approved means of identifi cation and registrat ion of an an imal , the carcass or the ed ib le offa l , shal I ensure that such identification material is applied correctly and appropriate ly. (8) Except as provided i n t h i s Part, a person who own s or has in h i s possession, care or control a l i ve or carcass of a bovine, porc ine, ov ine, caprine or any other an ima l s sha l l ensure that i t bears the approved method o f iden t ificat ion a n d registration referred to i n su bsect ion ( 6 ) a t a l l t i mes, even after i t might have been removed from its farm of origi n . (2) There is establ ished a National Cou nci l on Animal Welfare (NCA W) (in this Act referred to as ''the Counci l"), charged with the overal I responsibil ities of formulating a National Standard for the use and .care of an imals and implementing policies on matters concerning the general care and use of an imals in research, teaching and mandatory testing of products or other scientific purposes in Nigeria .
