Short title 2. Interpretation 3. Section 12 inserted in principal Act An Act To amend the Pas Géométriques Act ENACTED by the Parliament of Mauritius, as follows – 1. Short title This Act may be cited as the Pas Géométriques (Amendment) Act 2024. 2. Interpretation In this Act – “principal Act” means the Pas Géométriques Act. 3. Section 12 inserted in principal Act The principal Act is amended by inserting, after section 11, the following new section – 12. Lease of barachois situate wholly or partly upon Pas Géométriques (1) Notwithstanding this Act and any other enactment, the Minister may, by private contract, lease vested barachois on such terms as to the payment of rent and other conditions as may be approved by the Minister. (2) The rent shall be payable in advance and, in default of payment of any instalment within one month after service of a notice claiming payment, the Minister may, by Order in writing, cancel the lease, and thereupon Government shall be entitled without any further formality to resume possession of the barachois. (3) In this section – “Minister” means the Minister to whom responsibility for the subject of fisheries is assigned; “vested barachois” means barachois, situate wholly or partly upon Pas Géométriques, which has been vested in the Ministry responsible for the subject of fisheries.
