These Regulations may be cited as the Pesticides Control (Registration and Licensing) Regulations, 1987. 2. Interpretation. In these Regulations .. accompanying instruct ions" means any separate document, containing information, that is supplied with the pesticide eonteiner ; .. aetive ingredient" means any substance in a pesticide that is intended to have toxic effect on pests ; .. common name " means (a) the name assigned by (i) the Internetional Orgr.niemf.ion for Standardisation ; or (il) the British Standard Institution; or (b) where there is no name assigned under pa",graph (0), the ehemieal name of the active ingredient. 3. Pesticides to be~ as approved ~cides. (1) No person shall manufacture, import, advertise, use, sell, expose or offer for sale any pesticide unless that pesticide has been approved by the Boord and registered by the Board RS an approved pesticide and notice of such registration is published ill the Ga.utt~. (2) A person who desires to have a pesticide approved for the purposes of snbregulstion (1) shall submit. an application in the form set out a'J Form A-I in the Schedule. 4. Licence to impon or manufacture pesticide. An application for a licence to import or manufacture a pesticide under these Regulations shall be in the form set out as Form A - 2 in the Schedule. 5. Application by ftlCRrch institutes or orpnisations. (I) Notwithstanding these Regulations, a research institute or other organiation engaged in research, may apply in writing to the 'Board for authorisation to import and use, for research purposes only, limited quantities of a pesticide not approved under these Regulations. (:!) An application made under suhregnletion (1) must state the common: name, chemical name, proprietary name and the research work to be carried out. 174 Puti(" ~1, /J Control (Rf:g;~Irrr';01f artd Li('(Jrt~;rtg) Rf'f}ttlali()ftJt (3) Where perrnist..ion i.. granted to import and use a pesticide under tbiB Regulation (a) the pesticide shall not he sold or distributed, and shall be used onlv (i)' h~' the employees of the institute or orgenisation and for the pm'pw'" for which it is imported; and [ii) on the premises on which the research work is being done; (b) no crop, animal or product. of any animal to which sueh pesticide is applied may be used. as food for human consumption or &8 feed for animals, as the ease may be ; and (e) the Board mav require the researeh inscitute or orga~isation to submit. atechnical report on the pcsticide to tite Board after too research work is completed. 6, Use or pesticide Cor experimental purposes. (1) When an individual, or eompany not authorised under Regulation 5 desires to engage in experimental work using a pesticide not. registered as an approved pesticide under these Regulations, the individual or company shall apply to the Board for a permit to import and use such pesticide. (2) The Board may, notwithistanding these Regulations, issue to the individual, or company referred to subregulation (1) in respect of the pesticide BOught to he used, a permit. to import and use such pesticide in the form Bet out &8 A - 3 in the Schedule. (3) A permit issued under subregulation (2) must state (a) the period for which it. j." valid; (b) the quantity of pesticide which may he imported ; (e) the conditions regarding the use of the pesticide ; and (d) the date by which a technical report. on the pesticide, should be submitted. 7. Licence to import or manufacture a pesticide. A licence to impon or manufacture a pesticide mlty be granted on such t-erms and may be subject to such conditions as the Board mav think neeessarv and shall be in the fonn set out as Form A - 3 in the SchOOu'le. ' (2) The Board may review, renew, alter or revoke any lieenee 1)1' permit granted under these Regulations. 8. Power of Board as re~rds ~tion of pesticides. The Board may (a) refuse tc register a pesticide as an approved pesticide if (i) the person applying for such registration has not supplied all the information required by the Board in the form set out as Form A-I in the Schedule; (ii) the pesticide, when used in accordance with the information submitted with the application, is not considered by the Board to be safe or effective in controlling pests: or 175 (iii) the UMe of the pesticide in Saint Lucia may constitute a risk to the public health, domestic animais, wild-life or the environment; (6) at any time strike off the register of approved. pesticides any pesticide if it considers it· necessary to do SO in the interest of the public health for the tlafet)? of domestic animale and for the preservation of wild-life or the environment. 9. Licencin~ for the warehousin~, ~eka~n~, retai1in~ or approved pesticides. (1) No person shan shire, repackage, retail or otherwise deal with any pesticide registered hy the Board as an approved pesticide unless he first obtains from the Board a licence for the premises where he intends to store, repackage, retail or otherwise deal w-ith any pesticide. (2) An application for a licence under subregnlation (1) shan be in the form set out in Form B-1 in the Schedule. (3) The Board may, after considering an application made under sub regulation (2) visit the premises where the pesticide is being dealt with oofore granting or refusing to grant the licence. (4) The applicent, shall be notified of a visit by an Inspector in the form Bet out &8 Form B-2 in the Schedule. (5) No notice shall he issued for ~ub!'!E'qucnt. risit.c; by an Inspector. (6) A Iioenee issued under this Regulation must be stamped with the official stamp of the Board and shall be displayed in a conspicuous place on the approved premises. (7) A licence issued under this Regulation maybe valid for a period of one year or such shorter period as may be determined b)' the Board and shall be in the form set out as Form B-3 in the Schedule. 10. Caneellation of Iieenee, (1) A licence issued under Regulation 9 shall be deemed to be invalid if there is any change in (0) the location of the area where the pesticide is being dealt with or handled even if it may be carried out in the same building ; (6) the design of the room in which the pesticide is being dealt with or handled ; or (c) the location of various approved pesticides, (2) Where any ehenge referred to subregulation (1) has been carried out a new application must be made to the Board to give effect to such a change. (3) The Board may refuse to issue ffl' may at any time cancel or amend a licence issued under thls Regulation if the applicant fails to comply with the requirements for or any condition attached to the licence. 11. Record of pesticides. The Board may, whenever it deems necessary. specify restrietiens on the sale of a pesticide and may stipulate that a record be kept &CJ in the form set out as Form C in the First Schedule in which the names, addresses and proof of identity (if all persons purchasing sueh pesticide can be entered together with the quantity purehaeed and the date of purch8118. 1;6 Pmu;wel Control (Rcg;....tration and Lict'''~''9) Regulation~ 12. Notice to penon affected by derision of the Board. The Secretar;.\' of the Board shall, within fourteen days of a decision of the Board to (a) approve or refuse appro,-a.l of a pesticide; (6) withdraw its approval of a pesticide : te) refuse to issue a licence ; or (d) cancel or amend a licence, give notice of that decision to the person affected thereby. 13. Applieation for reconsideration of Board's decision. (1) Where the Boanl (a) refuses to appro\"'e a pesticide ; (6) withdraws its approval of a pe~icide : (e) refuses to issue :>. licence; or (d) cancels or amends a licence, a person affected by the decision of the Board may within thirt)' days of receiving notice of the Bosrd's decision, r.pply by letter addressed to the Secret.arv to have the decision reconsidered by the Board. (2) The Board shall onreceiving a letter"under this Regulation, fix a date for reconsidering its decision and shall give the applicant an opportunity to be heard and to be represented by counsel if he so desires. (3) The Board may, after reconsidering the application (a) revoke its former decision and substitute another decision therefor; or (6) confirm its former decision. 14. Pesticide, sold or distributed to be aerompanied by conditions. Each eolltainer or package of a pesticide sold or distributed shall be accompanied by a copy of the conditions regarding its use and storage as laid down by the Board under the Pesticides Control (Labelling of Pesticides) Regulations 1987 (No. 70 of (987). 15. 1Dferior products. Xo person shall supply &8 a pesticide a product that bas decomposed or is deteriorated so as to be ineffective or dangerous, or which is packaged in containers that have deteriorated or have boon damaged 80 as to be dangerous in storace or use. 16. False adftl1isin~. (I) No person shall advertase any pesticide in a manner which is false, misleading. or ineonsisterrt, with the information supplied to the Board at the time cf registraficn. (2) All infonnation contained on the label and aeeompanving instmctions ~han be in accordance with the information supplied to the Board at tho time of applicat.ion for registratkm, end shell not include any misleading or fictitious claims. 17. Containers. (I) An JX'&~icides imported into, transported. within or exposed or offered for sale or orherwise distributed in Saint Lucia shan be packed in containers deemed suitable for the purpose by the Board. I I I (2) Where an unsuiteble container is in URe the Board shall give not-ice thereof in writing to the pen-on responsible, who shall he held to be in contraven tion of these Regulations if he fails to ensure thet the unsuitable eontainer is replaced by a suitable container within three months of the date of the notice. 18. Transportation of pesticides. Xo person shell transport any pesticide unlesB (a) it is 8t'CtU'Cb- peckaged to avoid leaksge arising from the ordinary risk of hendlinu ; (6) the outside of tile package containing the pesticide is labelled conspicuously with the name and description of the pesticide and a notice Indicating that it i~ to be kept separate from food eontainers is delivered by the distributor or seller to the transporter ; or (c) adequate precautions from the risk of contaminating food for human consumption or animal feed, utensils and water supplies are taken and similar precautions egainst the accidental destruetion or eonteminetion of plant and animal life are also taken. 19. PeDal~. Any penton who contravenes these Regtda.tions is liable to the pelU~lt.ieR imposed by section 9 (2) of the Pesticides Control Act, 1975 (No.7 of 1975).
