Anukret (Sub Decree) of 2020 on the Enforcement of the List of Prohibited and Restricted Goods

Article 1

Article 1.- It is hereby put into force the Lists of Prohibited and Restricted Goods, which is in line with the Cambodia Customs Tariff 2017, appear as Annexes of this Anukret.

Article 2.- The Ministry of Economy and Finance shall timely update the commodity codes in the lists of the Annexes of this Anukret corresponding to the transposition of WCO Harmonized System and ASEAN Harmonized Tariff Nomenclature.

Article 3

Article 3.- A commodity which is subject to prohibition and restriction of importation- exportation and transit shall be determined in this Anukret. The amendment of commodity and/or treatment of prohibited and restricted goods shall be done by the Committee on Economic and Financial Policy.

Article 4

Article 4.- In the event that there is any risk which is required immediate action, the competent ministries may take temporary measures for control of importation-exportation and transit of the risky goods, despite the fact that commodity is not stated in this Anukret, and set precise timeframe of the measures, not exceeding 6 months. Article 5.- The Anukret No 209 ANKr. BK dated 31 December 2007 on the enforcement of the List of Prohibited and Restricted Goods and the Anukret No 208 ANKr. BK dated 08 September 2011 on the Amendment of Explanatory Note II of the Annex 2 of the Anukret No 209 ANKr. BK dated 31 December 2007 as well as other regulations which contradict this Anukret shall be nullified.

ANNEX 5 To Anukret No. 17 ANKr.BK dated 20 Febuary 2020 Explanatory Notes for the Enforcement of the Lists of Prohibited and Restricted Goods I- Definition Prohibited and Restricted Goods are goods whose imports or exports are subject to a certain condition for any of the following purposes: - The protection of national security; - The Protection of public order and standards of decency and morality; - The protection of human, animal or plant life or health; - The protection of national treasures of artistic, historic or archaeological value; - The conservation of natural resources; - The compliance with the provisions of any legislation of The Kingdom of Cambodia currently in force; - The fulfillment of obligations under the Charter of the United Nations. These lists are created in accordance with provision of Article 8 of the Law on Customs promulgated by Reach Kram No NS/RKM/0707/017 dated 20 July 2007. Import or export of any item in the lists is subject to: - Prohibition on import, export, or transit - Requirement of license, permit, or certificates as well as other legal documents in similar form prior to its import or export, or transit. This Anukret contains 4 annexes as follows: - Annex 1: list of prohibited goods - Annex 2: list of goods which require permit for import or export - Annex 3: list of goods which require certificate from exporting country - Annex 4: list of goods prohibited or required to get permit for international transit - Annex 5: Explanatory Note of implementation of the lists of prohibited and restricted goods. Unofficial translation 107 II- Notes: 1- The list in Annex 2 of this Anukret shall not be applicable to import or export of non- commercial goods such as sample, personal effects of passenger, stuff of moving accommodation, or others in similar kinds. However, items of high-risk to public health, security, and safety shall not be eligible for the above exemption. 2- Product, sample, and part of animals or plants which is listed in the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) shall require a permit from competent authority of the Ministry of Agriculture Forestry and Fisher, although it is not precisely specified in the Anukret. 3- The following items, which cannot be included in the Annex 1, due to technical issue of HS classification, are also prohibited on imports: - Right-hand drive vehicle; - Plastic bag with handle of less than 0.03 millimeter in thickness, and its bottom width of less than 250 millimeters; - Used commodities such as vehicle tires, and batteries; - Religious books, Politics books, Art work, Pornography, Advertisement Images, and other kinds of printed documents prohibited by law; - IPR infringing goods or counterfeit goods. 4- The following items, which cannot be included in the Annex 2, due to technical issue of HS classification, are also restricted on imports: - Used commodities such as computer, shoes, bag, air-conditioner, refrigerator, and freezer (under authorization of the Ministry of Environment); - Drone, other than those of subheadings 8802.20.90 and 8802.30.90 (under authorization of the Ministry of Post and Telecommunication). 5- Export/Import of commodities, which are administered by more than two or more competent ministries, shall require permit from only one ministry, based on the purpose of its use, except those goods of chapter 44 in the Annex 2 of this Anukret. Unofficial translation 108 6- In case where commodities have permission from the Council of Development for Cambodia (CDC), there shall be no need to request permit from other competent ministries or institutions for import. 7- Export of mining products shall have license or letter of permission in similar form from the Ministry of Mines and Energy. 8. For general export, in case that exporter is to have “certificate” in any determined forms, competent ministries/institution shall issue document as requested, even though those commodities are not in any annexed lists of this Anukret. III- Treatment Codes: (1) : License, import permission or other legal documents in similar forms, are required on importation from competent ministry/institution or its competent unit. (2) : License, Export permission, or other legal documents in similar forms are required on exportation from competent ministry/institution or its competent unit. (3) : Importation is prohibited. (4) : Importation and Exportation are prohibited. (5) : Veterinary certificate or hygiene certificate of meat or animal product from exporting country shall be required. (6) : Phytosanitary Certificate from exporting country shall be required. (7) : Fishery Pathology Certificate or Health/Quality Certificate on Fishery product from exporting country shall be required. (8) : Transit permission shall be required. (9) : Transit is prohibited. In order to read what prohibited/restricted treatment and under which ministry is to applied on any commodity, it is required to check all information in the annexes. For example, tariff line of 0101.21.00 is under the treatment code (1) (2) in the column MAFF of the annex 2, this means that import or export is required of “import permission” or “export permission” from competent authorities of the Ministry of Agriculture Forestry and Fisheries. 3. Goods under the treatment code (5), (6), (7) in the annex 3 shall be defined: • Imports shall be required to obtain “Certificate from exporting country” and this treatment shall not require import permission from competent ministry in Cambodia. • As for export from Cambodia, traders shall request Certificates from competent ministry in Cambodia only upon request by importing country. 4. Those commodities subject to treatment code (3), (4), and (9) are prohibited on import/export and transit. However, in case of necessity or national interest, the Royal Government may authorize import, export or transit of those items.
