Decree on the establishment of the State Sanitary and Epidemiological Supervision Department under the Ministry of Health (No. 299 of 1997)

1 Decree: ¹ 299 of 28th May, 1997 “On Formation of the State Sanitary-and-Epidemiological Supervision Department under the Ministry of Health of the Kyrgyz Republic” With the purpose of improvement of the sanitary-and-epidemiological agencies and institutions management system, rational use of personnel, material and technical base, liquidation of activities duplication, expansion of operations and in accordance with the Government of the Kyrgyz Republic’ s Decree ¹ 102 of 24 February, 1997 “On the Ministry of Health of the Kyrgyz Republic”, the Government of the Kyrgyz Republic decree: 1. To form the State Sanitary-and-Epidemiological Supervision Department under the Ministry of Health of the Kyrgyz Republic on the basis of the Republican Sanitary and-Epidemiological Station and Sanitary-and-Epidemiological Administrative Office under the Ministry of Health of the Kyrgyz Republic. 2. To confirm the attached Statute on the State Sanitary Supervision Department under the Ministry of Health of the Kyrgyz Republic, the management scheme and list of institutions under the Department. 3. The Ministry of Health of the Kyrgyz Republic to confirm the structure and the personnel list of the State Sanitary- and- Epidemiological Supervision Department of the Kyrgyz Republic. Djumagulov. 2 Confirmed by Decree of the Government of the Kyrgyz Republic ¹299 of 28th May, 1997 Statute On State Sanitary -and-Epidemiological Supervision Department under the Ministry of Health of the Kyrgyz Republic I. General Provisions 1. The State Sanitary-and-Epidemiological Supervision Department under the Ministry of Health of the Kyrgyz Republic is being established as autonomous institution through amalgamation of the Sanitary-and-Epidemiological Administrative Office under the Ministry of Health of the Kyrgyz Republic and the Republican Sanitary-and-Epidemiological Station. 2. The State Sanitary-and-Epidemiological Supervision Department under the Ministry of Health of the Kyrgyz Republic is a State institution of public health system, organising the State sanitary-and-epidemiological supervision, normative regulation; special authorisation, supervisory and monitoring measures for well-being insurance of the population of the Kyrgyz Republic. 3. The State Sanitary-and-Epidemiological Supervision Department under the Ministry of Health of the Kyrgyz Republic is guided by the Kyrgyz Republic Constitution, Laws, Presidential Edicts, Orders and Edicts of the Ministry of Health of the Kyrgyz Republic, Head Sate Sanitary Physician of the Kyrgyz Republic’s Decrees and the present Statute. 4. The State Sanitary-and-Epidemiological Supervision Department publishes a journal (information bulletin) “Sanitary-and- Epidemiological Service and Public Health”. 5. The State Sanitary-and-Epidemiological Supervision Department is a juridical person. It has its own autonomous balance sheet, budget, settlement and currency bank accounts, armorial seal and other stamps, firm sheets and other properties. II. Objectives and Functions of the State Sanitary-and-Epidemiological Supervision Department 6. The main objectives of the State Sanitary-and-Epidemiological Supervision Department are: the participation in pursuance of the State policy in the field of sanitary-and epidemiological well-being and radiative safety for the population; 3 the organisation and effectuation of the State Sanitary-and-Epidemiological Supervision; the organisation and management of the State Sanitary-and-Epidemiological Service of the Kyrgyz Republic; the co-ordination of the agencies of the State administration of the Kyrgyz Republic and the business entities’ activities on the questions of ensuring sanitary and- epidemiological well-being of the population; sanitary-and-epidemiological standardisation, the improvement of legal regulation of the public health issues in connection with the vital activity conditions and environmental factors unfavourable influence on a man; the identification of activity priority orientations in organisation of research, connected with ensuring sanitary-and- epidemiological well-being of the population; 7. The State Sanitary-and-Epidemiological Supervision Department in accordance with the tasks entrusted with it: forms the State policy, develops the Republican and regional programs in the field of ensuring sanitary-and-epidemiological well-being and radiative safety for the population; develops draft laws and other normative acts of the Kyrgyz Republic; manages the agencies of the State administration and institutions’ activities on the territory of the Kyrgyz Republic on fulfilment of sanitary legislation of the Kyrgyz Republic and ensures their co-operation; creates material and other reserves for the liquidation of the results of epidemics, accidents, disasters, ecological catastrophes and other extraordinary situations, dangerous for human life and health; identifies the major course and priorities of the Sanitary-and Epidemiological Service development; participates in medical personnel education and training, upgrade training and certification; identifies requirements for immunobiological preparations, disinfectant agents, nutrient medium, chemical reagent, testing systems, laboratory equipment, instruments, a.o., takes measures on providing treatment-and-protective and other institutions with these facilities; keeps records of the Sanitary- and-Epidemiological Service personnel in charge, takes measures on medical personnel distribution, effects selection of the personnel in charge; 4 manages the Republican, Oblast, Rayon and municipal sanitary-and epidemiological service institutions; accepts and analyses the reports on the Republican Sanitary-and Epidemiological Service and other Ministries, administrative institutions’ activity, examines the authenticity of statistical data ; in case of need, carries out the preventive and current state sanitary-and epidemiological supervision over the institutions, organisations, enterprises, associations irrespective of ownership forms, and other business entities on implementation of sanitary-and-epidemiological standards and rules, hygienic norms; develops and confirms in established order the Republican sanitary rules and standards, directives, instructions, hygienic norms; carries out the sanitary-and-epidemiological expert examination of produce, liable to obligatory certification; implements the state registration of potentially toxic and chemical elements; makes decisions on issuing the special permits and licenses for manufacturing, selling, import and export of food raw materials, products, food admixtures, cosmetics, hygienic articles and also for overseas tours; On the instruction of the Ministry of Health of the Kyrgyz Republic, the Head State Sanitary Physician of the Kyrgyz Republic: confirms the Statute on Agencies and Institutions of the State Sanitary-and Epidemiological Service of the Kygyz Republic; co-ordinates the introduction of special operating, registration, conveyance of people and transportation conditions, oriented on prevention of mass diseases dissemination; realises the international and inter-republican co-operation in the field of ensuring sanitary-and- epidemiological well-being and radiative safety for citizens. III. The State Sanitary-and- Epidemiological Supervision Department’s Rights 8. The State Sanitary-and- Epidemiological Supervision Department has a right: to determine the strategy, tactics and principal course of the Sanitary-and Epidemiological Service development on the territory of the Republic; to manage the operation of the Republican, Oblast, Rayon and municipal institutions of the Sanitary-and Epidemiological Service, co-ordinate the operation of the sanitary-and-epidemiological institutions, which are on the territory of the Republic; 5 to give instructions, obligatory for implementation by the State and other organisations, officials and citizens of the Republic, pass the decrees on removal of sanitary standards and rules and hygienic norms breaches; to form the reserve of the personnel in charge for Sanitary-and Epidemiological Service and upgrade their skill in service organisation; on the Ministry of Health of the Kyrgyz Republic’s instruction to represent the interests of the Kyrgyz Republic in the foreign countries, conduct the international negotiations and conclude the contracts on sanitary-and-epidemiological and economical questions; to obtain from the Ministries, institutions, enterprises and organisations, irrespective of the property forms, the economical, ecological and technical information, necessary for the development and realisation of the programs on ensuring sanitary-and-epidemiological and radiative safety for the population of the Republic; to confirm, within the limits of their competence, the sanitary standards and rules, normative acts, hygienic norms and methodical documents; to issue the licenses and certificates to manufacture and realisation of food admixtures, hygienic facilities, cosmetics, dyes, perfumery and also the licenses for the right to prophylactic operation for specialists, the State and non-state institutions on the territory of the Kyrgyz Republic, irrespective of the licensee’s operations, and in accordance with the legislation of the Kyrgyz Republic; to set up in established order the structural subdivisions operating on a self supporting basis, or covering costs for account of borrowed finances; to organise paid services and works on the agreement basis with the physical and juridical persons in accordance with the legislation of the Kyrgyz Republic. IV. The State Sanitary-and- Epidemiological Supervision Department’s Operation 9. The State Sanitary-and- Epidemiological Supervision Department of the Ministry of the Kyrgyz Republic is headed by the General Director, appointed and dismissed by the Ministry of Health of the Kyrgyz Republic by recommendation of the Kyrgyz Republic’s Head State Sanitary Physician. 10. The General Director of the State Sanitary-and-Epidemiological Supervision Department is a Deputy-Head State Sanitary Physician of the Kyrgyz Republic. 11. The State Sanitary-and-Epidemiological Supervision Department is accountable to the Ministry of Health of the Kyrgyz Republic and the Head State Sanitary Physician of the Kyrgyz Republic. 6 12. The General Director of the State Sanitary-and-Epidemiological Supervision Department: is personally responsible for the fulfilment of the tasks, entrusted to the Department; appoints his Deputies by agreement with the Head State Sanitary Physician of the Kyrgyz Republic; distributes the duties between the Deputies-General Director; determines the scope of liability of the managers of the Department’s structural subdivisions; confirms the Provisions on the structural subdivisions of the Department, including those, operating on a cost accounting basis; makes the suggestions to the Ministry of Health of the Kyrgyz Republic on suspension and repeal of the normative acts, contradicting to the legislation of the Kyrgyz Republic in the field of State Sanitary-and-Epidemiological Supervision; effects the other powers given to him by the legislation of the Kyrgyz Republic. V. Sources of Finance. The State Sanitary-and-Epidemiological Supervision Department’s Property. 13. The major sources of finance for the State Sanitary-and-Epidemiological Supervision Department’s operation are: the State budget; the voluntary contributions and donations made by the physical and juridical persons; the foreign investments, grants, bank credits; the established by the Ministry of Health of the Kyrgyz Republic interest on an amount of funds, collected at the expense of satisfaction of the Department’s claims made on physical and juridical persons, expenses on treatment-and-protective measures in case of accidents, breaches of technological process, entailed health impairment or disability of the citizens, and also charges for environmental contamination, breach of sanitary standards and rules; funds collected from physical and juridical persons for rendering of paid services and services supplied under the contracts; 14. The State Sanitary-and-Epidemiological Supervision Department uses the State property, buildings, structures, equipment, inventory and other physical values. 15.
