रजिस्टर्ड नं. एमएच/एमआर/साऊथ-२२९९/२००६-०८ ae AER VUiRIot राजपत्र प्राधिकृत प्रकाशन गुरुवार, सप्टेंबर १४, २००६/भाद्र २३, शके १९२८ भाग चार-ब \ महाराष्ट्र शासनाने महाराष्ट्र अधिनियमांन्वये तयार केलेले (भाग एक, एक-अ आणि एक-ल यांमध्ये प्रसिद्ध केलेले नियम व आदेश यांव्यतिरिक्त) नियम व आदेश. जलसंपदा विभाग मंत्रालय, मुंब ४०० ०३२, दिनांक २१ ऑगस्ट ok अधिसूचना महाराष्ट्र जलसंपत्ती नियमन प्राधिकरण अधिनियम, २००८. क्रमांक वेतन २०००५/(१११/००)/जसंअ.- महाराष्ट्र जलसंपत्ती नियमन प्राधिकरण अधिनियम, २००५ (२००५ चा महा. १८) याच्या कलम ६ आणि कलम ३० च्या पोट-कलम (३?) द्वारे प्रदान करण्यात आलेल्या अधिकारांचा आणि या बाबतीत त्यास समर्थ करणान्या इतर सर्व अधिकारांचा वापर करून, महाराष्ट्र शासनाने करण्याचे योजिलेल्या कलम ३० च्या पोट-कलम (१) नुसार पूर्व प्रसिद्धी करून महाराष्ट्र शासन र खालील नियम करीत आहे : १. संक्षिप्त नाव.-- या नियमांना, महाराष्ट्र जल संपत्ती नियमन प्राधिकरण (अध्यक्ष व सदस्य यांच्या सेवेच्या शर्ती) नियम, २००६, असे म्हणावे. २. व्याख्या.-- (१) या नियमांमध्ये, संदर्भानुसार दुसरा अर्थ अपेक्षित नसेल तर, .. (क) “ अधिनियम ” याचा अर्थ, महाराष्ट्र जलसंपत्ती नियमन प्राधिकरण अधिनियम, २००५ (२००५ चा महा. १८) असा आहे ; (१०३८) भाग चार-ब--६९ [किमत : रुपये ११.००] १०३९ पहाराष्ट्र शासन राजपत्र, सप्टेंघर १९४, २००६/भाद्र २३, शके १९९८. [भाग चार-ब (ख) “ प्राधिकरण ” याचा अर्थ, कलम ३ अन्चये स्थापन केलेले महाराष्ट्र जलसंपत्ती नियमन प्राधिकरण, असा आहे ; (ग) “ स्थानिक पूरक भत्ता ” याचा अर्थ, सदस्याला आपले कर्तव्य पार पाडताना, त्या कर्तव्याच्या विशेष परिस्थितीमुच्ठे (स्वरूपामुल्ठे) करवा लागणारा वैयक्तिक खर्च भागविण्यासाठी त्याला मंजूर करण्यात आलेला भत्ता, असा आहे ; ... ([घ) “ शासन ” याचा अर्थ, महाराष्ट्र शासन, असा आहे ; (ड) “ सदस्य ” याचा अर्थ, प्राधिकरणांचा सदस्य असा आहे, आणि त्यामध्ये अध्यक्षाचा समावेश हो ल. ह (२) यात वापरण्यात आलेले परंतु व्याख्या न केलेले शब्द व शब्दप्रयोग यांना, त्या अधिनियमात अनुक्रमे जे अर्थ नेमून दिलेले असतील, तेच अर्थ असतील, ३. अध्यक्ष व सदस्य यांना बेतन व भत्ते-- (१) प्राधिकरणाच्या अध्यक्षाला दरमहा सब्बीस हजार रुपये इतके बेतन देण्यात ये ल. भारतीय प्रशासन सेवेच्या सत्सम श्रेणीतील अधिकास्यांना, ज्या दराने महागा भत्ता व स्थानिक पूरक भत्ता अनुज्ञेय असेल त्याच दराने अध्यक्षदेखील महागा भत्ता व स्थानिक पूरक भत्ता मिलण्यासाठी हक्‍्कदार असेल : परंतु, अध्यक्ष हा केंद्रीय सेवेतील किंषा कोणत्याही राज्य सेवेतील सदस्य असेल किंवां माजी सदस्थ असेल तेच्हात्याच्या घेतनाची आणि भरत्त्यांची एकूण रक्कम आणि त्याला देय असलेल्था निवृत्तिवेतनाथी रक्‍्कम, तो अशा सेचेत असत्ताना त्याने aster Hacer वेतनाच्या रकमेपेक्षा अधिक असणार नाही. (३२) फ्राधिकरणाध्या संदस्थास रुपये २२,४००-०२०-२४,५०० या वेतनमानावर मासिक वेतन दिले जा ल. हा सदस्य भारतीय प्रशासन सेवेतील तत्सम दर्जाच्या सदस्थास अनुज्ेग असलेल्या दरानेच महागा भत्ता व इतर भत्ते, तसेच स्थानिक पूरक भत्ता मिलण्यास हक्‍्कदार असेल : परंतु, तो सदस्य केंद्रीय सेबेतील अथवा कोणत्याही राज्य सेघेतील सदस्थ rat ash wee order ay, ware वेतन व भत्ते आणि त्याला देव असलेली निवृत्तिबेतनाची एकूण रक्‍्कम ही, तो अशा सेवेत असताना त्याने घेतलेल्था शेवटच्या वेत्तनाच्या रकमेपेक्षा अधिक असणार नाही. ४. अध्यक्ष आणि सदस्य यांची निवासव्यवस्था.-- (१) अध्यक्ष, आपल्या संपूर्ण पदावधीमध्ये, तसेच त्यान॑तरच्या लग्तच्या पंधरा दिवसांपेक्षा अधिक नसेल एबढ्या कालावधीसाठी घोफत भाडे तत्त्वावर सरकारी निवासस्थान, म्हणजेच पलब्ध असेल तर १७५० चौरस फूट वा त्याहुन अधिक क्षेत्रफढ्ठ असलेली, परंतु ३२०० चौरस फूट एबढ्या कमाल मर्यदेषयत असलेली सदनिका मिव्ठण्यास हक्‍्कदार असेल. (२) सदस्य, आपल्या संपूर्ण पदावधीमध्ये, तसेच त्यानंत्रच्या लगतच्या, पंधरा दिवर्सापेक्षा अधिक नसेल एवढ्धा कालावधीसाठी, मोफत भाडे तस्‍्वावर, राज्यातील तत्सम दर्जाच्या, भारतीय प्रशासन सेवेतील सदस्थास अनुज्ञेब असलेल्या क्षेत्रफदाएवड्याच क्षेत्रफठाचे सरकारी निवासस्थान मिल्ण्यास हक्कदार असेल : .. भाग चारभ्ब] महाराष्ट्र शासन रोजपंत्र, संटटेजर १६, ९०७०६/भाद्र ९३, शके ९९२८ १०४० परंतु कोणत्याही कारणाने असे निवासस्थान पलब्ध झाले भाही तर, शॉसनास, अशा सदस्यासाठी योग्य ते निवासस्थान भाड़ेपट्ट्याबर घेता भ ल : परंतु आणखी असे की, अध्यक्ष वां सदर्य स्वत-च्या मालकीच्या घशत राहत असल तर, त्यास राज्यातील तत्सम दर्जाच्या, भारतीय प्रशासन सेलेतील अधिकाणय्यांना किया सदस्यास अनुशेय असंलेल्यां दरानेच घरभाड़े भत्ता देण्यात ये ल : परंतु तसेच, पंधरा दिवसांच्या अमुश्लेय मयदिषेक्षा अधिक हो ल अंशा कोणत्याही मुक्कामासाठी, अध्यक्ष वा सदस्य हा, राज्यातील तत्सम दर्जाच्या, भारतीय प्रशासन शैचेतील सदस्यास थां संदर्भात लागू असतील त्या नियमांनुसार गणना केलेले UTS बे इतर आंकोर प्रदान करण्यासे पात्र असेल. ~~ स्थष्टीकरंण.--या नियमाच्या प्रयीज॑नासाली, (एक) सरकारी मियोसस्थान थाचां अर्थ, शेसिमाच्यां भॉलकोचे फिंवां शासनाने भाडेपट्ट्याने घेत॑लेले कियो अधिग्रहण कंरूने यो अध्य प्रकारे शससितरामे ताब्बात घेसलैले मिवासस्थॉन, असां अंहि ; (दीन) भाड़े, वाोधध्ये पाणीपही आणि चौंज आकार धांचों अंतर्भीष कैलैला भांही. ७५... रजा.-- (१) अध्यक्ष च सदस्य हे पुढीलप्रमाणे रजा मिल्ठण्यास हक्‍्कंदार असतील : (एक) सेचेच्या पूर्ण केलेल्यो प्रत्येक चर्षासांठी किया स्वाच्या भागोंधांठी तीस दिवसांची अजित रजा : ' परंतु, ही अर्जित cor Ghat ात्यॉमंथ्ये, प्रत्येक eter वर्षाध्यों जानेयारी व जुले महिन्याच्या पहिल्या दिवशी, प्रत्येकी पंधरश दिवस याँप्रमांणे दौम हप््यभिध्ये आगर्कि जंवी फैली जा ल : परंतु आणखी असे की, अंगोरदेश्च्यां अर्ध-वर्षाच्यों शैंघेटी खॉत्यातं जमा झोलेली रजा, पुढील अर्ध वर्षमध्ये जमेस धंरण्यात ये ल. मात्र, पेहिल्या परंतुकानुसार खोत्यात जमा झालेल्या रजेसह अशा प्रकारे पार्जित झालेली रंजां तीमशे दिंवसंपिक्षा अधिक अंस्षणोर ore. (दीन) सेवेच्चा पूर्ण फेलेल्यी प्रत्येक चंचौच्चा बौघतीत बीस दिंवसांची पैच्कीये प्रमाणपत्रावर tear येणारी अर्धपगारी रंजा, अर्धपगांरी रमेंसालीचे con dart है, अर्जित रजेंच्यों कांटांत अनुज्ञेय असेलैल्धा wart चेंतंभाच्यां निध्मे एवडे असल : परंतु, पांजित झालेली con, arene cot जीत्वॉम॑ध्ये, प्रत्येक कैलेंडर वर्षाच्या जीनेजारी थे जुंप्ने मंहिस्याच्या पहिएयो दिघेशी प्रत्थेकी दहां दिवेशाच्यों दौम हफ्वोमिध्ये आगाऊ जता केली जॉ ल : परंतु, आणखी अंसे की, शासमाध्यां स्वेच्छामिणवेभुसरि हो अर्धवगारी री चूर्ण पंगारी रजैगथ्मी परिंवतित करता यै ल, पात्र, ती पैधेकीयें फारंणोसोी पेललेली अशावी आणि तिंखों stettetteret नोदणीकृर्त वैधक ध्यवशाधिये प्रमाणपत्र जीडलेले अशावे भोग चार-ब-६९अ १०४१ महाराष्ट्र शासन राजपत्र, सप्टेंबर १४, २० (तीन) राज्यातील तत्सम दर्जाच्या भारतीय प्रशासन सेवेच्या सदस्यास अनुज्ेय असलेली नैमित्तिक TT sat sae eT (२) अध्यक्ष किंवा सदस्य ज्या दिनांकास आपले पद सोडील, त्या दिनांकापासून त्या अध्यक्षाच्या किंवा सदस्याच्या खात्यात जमा झालेली कोणतीही रजा व्यपगत हो ल : परंतु, असा अध्यक्षाने किंवा सदस्याने, (एक) रजेसाठी अर्ज केला असेल आणि तो नाकारण्यात आला असेल तर ; किंवा (दोन) ज्या रजेसाठी अर्ज केला असेल ती रजा, जनसेवेच्या आवश्यकतेच्या कारणावरून नाकारण्यात ये ल, अशी मंजुरी प्राधिकाज्याकडून खात्री करून घेतलेली असेल तर, अशी रजा व्यपगत होणार नाही. (३) महाराष्ट्र नागरी सेवा (रजा) नियम, १९८१ यामध्ये काहीही अंतर्भूत असले तरी, अध्यक्ष किंवा सदस्य ज्या दिनांकास आपले पद सोडील त्या दिनांकास त्याच्या खात्यात जमा झालेल्या अर्जित रजेस समान असा भत्ता मिठ्ण्यास तो हक्‍्कदार असेल. मात्र, रजा वेतनाशी समान असे भत्त्याचे प्रदान, जास्तीत जास्त एकशे पन्नास दिवस एवढ्या अर्जित रजेच्या मर्यदिपर्यतच केले जा ल. पद सोडल्यानंतर, रजा वेतन एकदाच पूर्णतः व ठोक रकमेत देण्यात ये ल. स्पष्टीकरण.-- या भत्त्यांची गणना करण्याच्या प्रयोजनासाठी स्थानिक पूरक भत्ता आणि घरभाडे भत्ता त्यात जमेस ध॑रण्यात येणार नाहीत. & रजा मंजुरी प्राधिकारी.-- या बाबतीत, (क) अध्यक्ष, शासनाच्या जलसंपदा विभागाचा प्रभारी मंत्री ; आणि (ख) सदस्य-अध्यक्ष, हे रजा मंजूर करण्यास सक्षम असणारे प्राधिकारी असतील. ७. निवृत्तिवेतन आणि पदान.-- (१) अध्यक्ष किंवा यथास्थिती सदस्य याने प्राधिकरणामध्ये केलेल्या सेवेच्या कालावधीसाठी तो निवृत्तिवेतन मिव्ठण्यास हक्‍्कदार असणार नाही. (२) अध्यक्ष आणि सदस्य यांनी प्राधिकरणामध्ये केलेल्या सेवेच्या प्रत्येक पूर्ण वर्षासाठी तीस दिवसांचे वेतन या दराने पदानाचा लाभ मिव्ठण्यास ते हक्‍्कदार असतील. परंतु, त्या अध्यक्षाने आणि सदस्याने पदानास हक्‍्कदार होण्याकरिता, प्राधिकरणाच्या सेवेत किमान दोन वर्षाचा कालावधी पूर्ण केलेला असावा : परंतु, आणखी असे की, या अधिनियमाच्या कलम ७ च्या पोट-कलम (३) च्या खंड (क), (ख), (घ) किंवा (ड.) यामध्ये नमूद केलेल्या कोणत्याही कारणावरून अध्यक्षास किंवा सदस्यास पदावरून काढून टाकले असेल, तर त्यास कोणतेही पदान देय असणार नाही. भाग चार-ब] महाराष्ट्र शासन राजपत्र, सप्टे ८. वाहन व्यवस्था.-- (१) अध्यक्ष व सदस्य यांना कार्यालयीन वापरासाठी प्राधिकरणाच्या खर्चाने शोफरसहित बाहनाची सोय करण्यात ये ल : परंतु, कोणत्याही कारणामुल्ठे कार्यालयीन वाहन पलब्ध नसल्यास अध्यक्ष व सदस्य, मुख्यालयामधील त्याच्या कामाच्या संबंधात केलेल्या प्रवासाच्या प्रयोजनासाठी खर्च झालेल्या टेंक्सी भाडयाच्या प्रतिपू्तीसाठी हक्कदार असतील (२) अध्यक्ष व सदस्य यांना पुरविण्यात आलेली गाडी, त्यांच्या खाजगी प्रयोजनांसाठी वापरण्याची परवानगी, राज्य शासनातील तत्सम श्रेणीच्या भारतीय प्रशासकीय सेवेतील सदस्याला लागू असतील अशा अटी व शर्तीबर देण्यात ये ल. ~ & प्रवास भत्ता.-- अध्यक्ष व सदस्य दौन्यावर असताना (यात त्याचा पदावधी समाप्त झाल्यावर त्याने आपल्या स्वग्रामी जाण्यासाठी केलेल्या प्रवासाचा अंतर्भाव आहे) तत्सम श्रेणीच्या भारतीय प्रशासकीय सेवेतील सदस्याला लागू असेल अशा दराने प्रवास भत्ते, दैनिक भत्ते, वैयक्तिक चीज वस्तूंची वाहतूक आणि इतर तत्सम बाबींसाठी मित्ठण्यास हकक्‍्कदार असेल : परंतु, शासकीय निवास व्यवस्था पलब्ध नसल्यास, असा अध्यक्ष किंवा सदस्य यांनी केलेल्या प्रत्यक्ष खर्चाच्या आधारावर त्याने त्याच्या पुष्टयर्थ दिलेल्या आवश्यक त्या प्रमाणकांच्या आधारे दैनिक भत्ता मंजूर करता ये ल. परंतु, आणखी असे की, मुख्यालयातून प्रस्थान/निर्गमन केल्याच्या वेब्ठेपासून परत येण्याच्या वेल्ठेपर्यत झालेल्या अनुपस्थितीची गणना करून अध्यक्ष व सदस्य, प्राधिकरणाच्या मुख्यालयातील त्याच्या अनुपस्थितीच्या संपूर्ण कालावधीसाठी दैनिक भत्ता मिव्ण्यास हक्‍्कदार असतील. (२) अध्यक्ष व सदस्य, राज्यातील तत्सम श्रेणीच्या भारतीय प्रशासकीय सेवेतील सदस्याला लागू असेल त्याच दराने रजा प्रवास सबलत (एल. टी. सी.) मिव्ठण्यास हक्कदार असतील. (३) अध्यक्ष आणि सदस्य, शासनाच्या जलसंपदा विभागाच्या प्रभारी मंत्र्यांची पूर्व परवानगी घेतल्याखेरीज त्याच्या कार्यालयीन प्रयोजनांसाठी विदेशी दौज्यावर जाऊ शकणार नाहीं आणि त्याशिवाय, ज्यातील भारतीय प्रशासकीय सेवेतील अधिकान्यांना किंवा तत्सम श्रेणीच्या सदस्यांना लागू असल्यानुसार, केंद्र शासनाकडून परवानगी मिव्ठवील. १०. दूरध्वनी सुविधा.-- अध्यक्षाला आणि सदस्याला प्राधिकरणाच्या खर्चाने त्याच्या निवासस्थानी एस.टी.डी. व आय.एस.डी. सुविधेसह दूरध्वनी पुरविण्यात ये ल. त्याला त्याचे पद सोडल्यानंतर जास्तीत जास्त दोन महिन्यांच्या कालावधीसाठी तो ठेवून घेण्याची परवानगी देता ये ल. ११. वैद्यकीय पचार.-- अध्यक्ष व सदस्य, महाराष्ट्र राज्य वैद्यकीय परिचर्या नियम, १९६१ आणि शासनाने वेव्ठोवेव्ठी काढलेले आदेश या अन्वये राज्यातील तत्सम श्रेणीच्या राज्य शासनाच्या अधिकान्याला लागू असतील असे वैद्यकीय पचार मिव्ठण्यासाठी आणि वैद्यकीय खर्चाच्या प्रतिपूर्तीसाठी हक्कदार असेल, १०४३. महाराष्ट्र शासन राजपत्र, सप्देक्षर १४, २००६/आाद्र ९३, शके १९९८. [भाग चार-ब १२. शासकीय बैठकींकील जर्व आधि आतित्य भत्ता.-- (१) ज्या बैठफीमध्ये चहा, कॉफी आणि अल्पोपाहाराची तरतुब करण्बात येते त्या बैठकीमध्ये त्यासाठी प्राधिकरणाररे करात्रयाया खर्च अध्यक्ष प्राधिकृत कक शकेल. | | (२) प्राधिकरणाच्या अभ्यागतांच्या आतिध्यावर वाजवी खर्च करण्यास अध्यक्ष प्राधिकार देऊक शकेल. १३. इतर भत्ते.-- अध्यक्ष ज सवस्य, राज्यातीण तत्सम दर्जाच्या भारतीय प्रशासन सेवेच्या सदस्याला जे इतर भत्ते लागू असतील असे इलर भस्‍्ते मिक्ृत्यास हक्‍कदार असतील. १४. संकीर्णा,-« नियमांच्या सिर्वंधनाबाजत/अर्थधिशदीफरणाबाबत क्रोणतीही शंका द्भवल्थास, किया एखाद्या विशिष्द प्रकरणाबिषयी मियमांमध्ये स्पष्ट सरतुद केलेली ससेल तेव्हा, ती बाब शासनाकडे बिचारार्ध पाठविण्याल बेइल व त्याचा निर्णय अंतिम असेल. महाराष्ट्राचे राज्यपात्त बांच्या आदेशासुसार व नावाने, मु, खं. कुलकर्णी, शासनाचे प्रधान सचिव. भाग चार-ब] महाराष्ट्र शासन राजपन्न, सप्टेंबर १४, २००६/भाद्र २३, शके १९३८ ९०४४ WATER RESOURCES DEPARTMENT Mantralaya, Mumbai 400 032, dated 21st August 2006 NOTIFICATION MauarasHTrA WATER RESOURCES ReGcuLATORY AUTHORITY Act, 2005. No. Salary-2005/111/05) WRI.—In exercise of the powers conferred by sub-section (7) of section 30 read with section 6 of the Maharashtra Water Resources Regulatory Authority Act, 2005 (Mah. XVIII of 20085), and all other powers enabling it in this behalf, the Government of Maharashtra hereby makes the following rules the same having been ५७ iously published as required by sub-section (1) of the said section 30, namely :— 1 Short Title-——These rules may be called the Maharashtra Water Resources Regulatory Authority (Conditions of Service of Chairperson and Members) Rules, 2006. 2 Definitions— (1) In these rules, unless the context otherwise requires ,— (a) “Act” means the Maharashtra Water Resources Regulatory Authority Act, 2005 (Mah. XVIII of 2008) ; (6) “Authority” means the Maharashtra Water Resources Regulatory Authority established under section 3 ; (c) “Compensatory local allawance ” means an allowance granted to a Member to meet his personal expenditure necessitated by the special circumstances of the duty which he performs ; (d) “Government” means the Government of Maharashtra ; (e) “Member” means a Member of the Authority and includes the Chairperson. 72) Words and expressions used but not defined herein shall have tl .' respective meanings, as assigned to them in the Act. 3. Pay and allowances to Chairperson and Members.—(1) The Chairperson of the Authority shail be paid a salary of rupees twenty-six thousand per month. The Chairperson shall be entitled to receive dearness allowance and compensatory local allowance at the same rate as are admissible to the officers of the corresponding grade of the Indian Administrative Service : Provided that, when the Chairperson is a member or past member of the Union Service or of any State Service the sum total of his pay and allowances and the amount of pension due to him shall not exceed the amount of last pay drawn by him while he was in such service. vat १०४५ महाराष्ट्र शासन राजपत्र, सप्टेंबर १४, २००६/भाद्र २३, शके १९२८ [भाग चार-ब (2) A Member of the Authority shall be paid a monthly salary in the pay scale of rupees 22,400-525-24,500. A member shall be entitled to dearness allowance and other allowance and compensatory local allowance at the same rate as are admissible to a member of the corresponding grade of the Indian Administrative Service : Provided that, when the such member is a member or past member of the Union Service or of any State Service, the sum total of his pay and allowances and the amount of pension due to him shall not exceed the amount of last pay drawn by him while he was in such service. 4. Accommodatien to Chairperson and Members.—(1) A Chairperson shall, throughout his term of office and immediately thereafter for a period not exceeding fifteen days be entitled to an official residence free of rent i.e. a flat admeasuring 1750 square feet, or of more area, subject to the maximum limit of 3200 square feet, if available. (2) A Member shall, throughout his term of office and immediately thereafter for a period not exceeding fifteen days be entitled to an official residential accommodation, free of rent, of the equal area admissible to a member of the Indian Administrative Service of the corresponding grade in the State: Provided that, in the event of such accommodation not being available for any reason, the Government may take a suitable accommodation on lease for such member : Provided further that, if a Chairperson or a Member is staying in his own house, he shall be paid a house rent allowance at the same rate admissible to the officers or to a member of the Indian Administrative Service of the corresponding grade in the State: Provided also that, for any overstay beyond the permissible limit of fifteen days, a Chairperson or a Member shall be liable to pay rent and other charges calculated in accordance with rules applicable in that behalf to the member of the Indian Administrative Service of the corresponding grade in the State. : Explanation.—For the purpose of this rule,— (i) “official residence ” means an accommodation owned or taken on lease or requisitioned or otherwise, by the Government ; (ii) “rent” shall not include water and electricity charges. भाग चार-बॉ महाराष्ट्र शासन राजपत्र, सप्टेंबर १४, २००६/भाद्र २३, शके १९२८. १०४६ 5. Leave.—(1) The Chairperson and a Member shall be entitled to a leave as follows :— (i) Earned Leave of Thirty days for every ‘completed year of service or a part thereof: Provided that, the leave account shall be credited with Earned Leave, in advance, in two instalments of Fifteen days each on the first day of January and July, of every calendar year : Provided further that, the leave account at the credit of the close of previous half-year shall be carried forward to the next half-year subject to the condition that the leave so accrued including the leave credited in accordance with the first proviso shall not exceed three hundred days. (ii) Half Pay Leave on medical certificate of Twenty days in respect of each completed year of service. The leave salary for Half Pay Leave shall be equivalent to half of the leave salary admissible during the Earned Leave : Provided that, the leave accrued shall be credited with Half Pay Leave in advance in two instalments of ten days each on the first day of January and July, of every calendar year: Provided also that, such Half Pay Leave may be commuted to Full Pay Leave (twice of Half Pay Leave) at the discretion of the Government, provided it is taken on Medical Ground and is supported by a Medical Certificate by a registered Medical Practitioner. (iii) Casual Leave and other leave as admissible to a member of the Indian Administrative Service of the corresponding grade in the State. (2) Any leave at the credit of the Chairperson or a Member shall lapse on the date on which such Chairperson or Member vacates his office : Provided that, the leave shall not lapse if such Chairperson or Member has,— (i) applied for leave and the same has been refused; or (i) ascertained, in writing, from the sanctioning authority that the leave, if applied for, will be refused on the ground of the necessity of public services. १०४७ महाराष्ट्र शासन राजपत्र, सप्टेंबर १४, २००६/भाद्र २३, शके १९९८. [भाग चार-ब (3) Notwithstanding anything contained in the Maharashtra Civil Services (Leave) Rules, 1981, a Chairperson and a Member shall be entitled to an allowance equivalent to the Earned Leave to his credit, on the date on which he vacates his office, subject to the condition that, the payment of allowance equivalent to the leave salary shall be limited to Earned Leave for a maximum of One hundred and fifty days. The leave salary shall be paid in full in lump sum, as one time settlement, upon vacating office. Explanation.—For the purpose of computation of such allowance, the “compensatory local allowance or the house rent allowance shail not be counted. 6. Leave sanctioning authority.—In case of,— (a) the Chairperson, the Minister-in-charge of the Water Resources Department of the Government ; and (b) the Members— the Chairperson, shall be the authority competent to sanction leave. 7. Pension and Gratuity—(1) The Chairperson or, as the case may be, the Member, shall not be entitled for pension for the period of service rendered by him on the Authority. (2) The Chairperson and the Member, shall be entitled to the benefit of gratuity at the rate of thirty days of pay for each completed year of service on the Authority : Provided that, such Chairperson and Member should have completed a minimum of two years of service on the Authority to be entitled for gratuity : — Provided further that, no gratuity shall be payable to the Chairperson or the Member on his removal from the office on any of the grounds specified in clause (a), (b), or (e) of sub-section (3) of section 7 of the Act. 8. Conveyance.— (1) A Chairperson and a Member shall be provided with a chauffeur driven car for official purposes at the cost of the Authority : Provided that, in the event the official vehicle is not available for any reason, a Chairperson and a Member may, for the purpose of travel in connection with his duty at the headquarters, shall be entitled to the reimbursement of the taxi-fare incurred. भाग चार-ब] महाराष्ट्र शासन राजपंत्र, सप्टेंबर १४, २००६/भाद्र २३, शके १९२८ १०४८ (2) A Chairperson and a Member shall be permitted to use the car provided to him for his private purposes on the same terms and conditions as applicable to a member of the Indian Administrative Service of the corresponding grade in the State Government. 9. Travelling allowance-—(1) The Chairperson and the Member while on tour (including the journey undertaken or on expiry of his term to proceed to his hometown) shall be entitled to travelling allowances, daily allowances, transportation of personal effects and other similar matters at the same rates as applicable to a member of the Indian Administrative Service of the corresponding grade in the State: Provided that, in the event of Government accommodatien not being available, the daily allowance on the basis of actual expenditure incurred by such Chairperson or a Member, supported by necessary vouchers, may be granted : Provided further that, the Chairperson and Member shall be entitled to a daily allowance for the entire period of absence from the headquarter of the Authority, the absence being reckoned from the time of departure from the headquarter till the time of return. (2) A Chairperson and Member shall be entitled to Leave Travel Coneession (L.T.C.) at the same rate as are applicable to a member of the Indian Administrative Service of the corresponding grade in the State. (3) A Chairperson and Member shall not go on foreign tour for his offigial purposes, unless he has obtained prior permission of the Minister in-charge of the Water Resources Department of Government. In addition to the same he shall obtain clearance from the Central Government, as applicable to the officers of the Indian Administrative Service or members of the carresponding grade in the State. 10. Telephone facilities -—The Chairperson and the Member shall be pravided with a telephone with S.T.D. and IS.D. facilities at his residenge, at the east of authority. Medical treatment.— The Chairperson and the Member shall be entitled to medical treatment and reimbursement of medical expenses as applicable to an officer of the State Government of the corresponding grade in the State as per the Maharashtra State Medical Attendance Rules, 1961 and the Orders of the Government issued, from time to time. 12. Expenses on official meetings and entertainment allowance. (1) The Chairperson may authorise expenses to be incurred by the Authority in meetings in which tea, coffee and refreshment might be provided. (2) The Chairperson may authorise reasonable expenses on the entertainment of visitors to the Authority. 13. Other allowances.—The Chairman and the Member shall be entitled to such other allowances as are applicable to a member of the Indian Administrative Service of the corresponding grade in the State. 14. Miscellaneous.—-In case of any doubt regarding interpretation of the Rules or when express provision has not been made in the Rules about a particular matter, the same shall be referred to the Government, whose decision shall be final.
