Regulation 0 11 .fishing gear. - ( I) Fishing in any speci tied area by such kind of fishing gear is prohibited under clause (d) of sub-section (I) of section 4, namely: (a) Purse-seine; (b) Pelagic trawl; (c) Mid water trawl; (d) Bull trawl or Pair trawl; (e) New type of fi shing gear without prior approval. (2) Having regard to the matters referred to in sub-section (2) of section 4 fishing in any specified area by bottom trawl is prohibited from sunset to sunrise under clause (d) of sub-section (I) of section 4. (3)· Fishing in any specified area by the following kinds of fishing gear may be prohibited for such a period as notified by the Government under clause (d) of sub-section (I) of section 4, namely, (a) Ring-seine; {b) Bottom trawl. Regulation on Production, keeping 011d transportation of fishing vessel and fishing gear.-(1) The production, keeping and transp~rtation of fishing vessel in contravention to the provisions contained in item (a) and (b) of sub-rule (2) of Rule 3 is prohibited under clause (e) of sub-section (1) section 4. (2) The production, keeping and transportation of fishing gear in contravention to the provisions contained in sub-rule( I) and (5) of rule 4 is prohibited under clause (e) of sub-section (I) of section 4. 6 P I ·1 · · / d<. r ·1 t ·, ~ /nh111 mulwd (I) hshing from any specified area using such type of substance or material is prohibited under clause (f) of sub-section (I) of section 4, namely: (a) dynamite or other explosive substance;. (b) poison or noxious chemicals; (c) a11ificial light with more than 12 volt in total. (2) Fishing from any specified area using any type of fishing gear or aggregating device made up of the following substance or material is prohibited under clause (f) of sub-section (I) of section 4, namely: (a) Spadix, husk, leaf or other part of any plant; (b) Plastic material; (c) Used net; (d) Any other material as may be notified in the Gazette. 7. Registration <~{fishing vessel. (I) Every application for the registration of a fishing vessel shall be in the form specified in the Merchant Shipping (Registration of Indian Fishing Boats) Rules, 1988 and shall be accompanied by a fee specified for each category of fishing vessel in column (I) of the Table below co1Tesponding to the entries in column (2). Such registration or refusal, as the case may be, shall be made within a period of one month from the date of receipt of application. (3) Where the application for registration is refused the reasons for such refusal shall be recorded in writing and a copy of the same along with the order of refusal shall be furnished to the appltcant. (4) Wnere the application of registration is not refu s ed, a certificate of registration shall be granted in the form specified 111 the Merchant Shipping (Registration of Indian Fishmg Boats) Rules, 1988. (5) Every certificate of regi stration i ss~ed by the authorized officer shall be entered in a register kept by him m Form-1. (6) The registration mark assigned to a vessel by th~ authorized officer and its name shall be displayed on the top of both sides of fore and aft of the vessel. 8. Such rant or refusal, as the case ma~ be, shall be made within a period of on! month fro':1 th 6 e dhate of receipt of the application. A licence granted under section s all be 10 Fonn-3. (3) Where the application for the grant of licence is refused the reasons ~or refusal shall be recorded in writing and a copy of the ;ame along with the order of ref~sal shall be furnished to the applicant. On refusal of license, th~ security furnished and one half of the amount of fees paid by the applicant, shall be refunded to him. . ( 4) Every licence issued by the authorized officer shall be entered m a register to be kept by him in Form-4. . 9. Furnishing o.f in.formation about movement o.f registered fishing ves~e/.-( I) T he mformation to be furnished about the movement of a registered fish1!1g vessel from the area of one port to the area of another po~ under section I 0, shall be in writing and be send by registered st or dehve~ed m pe~son to the authorized officer concerned and also~ the hort officer havmg jurisdiction over the area where to such fishing vessel as b~en moved befo~e the vessel moves from the area of the former port, if the movement is for a period. of more than two months. . (2) In ~ther cases, information about any type of movement of a registered fishmg ve~sel shall be entered through online mobile a s named as Sagara envisaged by the Government. · PP 9 10. Returns to be made by owner o.f registered .fishing vessel.-( 1) Every owner of a registered fishing vessel shall furnish annual returns to the authorized officer before the end of July in every financial year in Form-5. (2) On failure to submit the annual re turns by the owner of a registered fishing vessel, the security furnished shall be liable to be forfeited and registration shall be liable to be suspended or cancelled. 11. Impounding/Seizing of.fishing vessel.-( 1) A fishing vessel impounded or seized shall be under the control of the authorized officer and shall be kept in any berthing place. The fuel pump of the vesse l impounded or seized may be removed by the authorized officer with the help of mechanical staff and handed over to the nearest convenient office of the fisheries department to avoid forcible escape of such vessel from custody. (2) Disposal of seized fish and deposit of the proceeds thereof shall be in the manner prescribed under Rule 20. 12. Registration of Boat Building yard.-(1) Every appl ication for the registration of a boat building yard under section 9A shall be in Fonn-6. '" - -i 10 · (3) Every application for registration shall he accompanied by ·a c~p?' of the ?wnership certificate or lease agreement of land fo r a mm1mum penod o f 5 years which is attested by a Gazetted Officer. (4) Along with the application, the owner of the boat building yard shall submit an ~ndertaking that, all the statutory clearance from fire and s~fety, electncal u:ispectorate, local bodies, labour, pollution control board etc. shall be obtamed and provision for waste disposal facili ty shall he made before the functioning of the unit. . (5) On re~eipt of the application under this Rule, the authorized of(1c~r a fter makmg e?quiry as he deems fit, shall register the boat build mg yar? and shall issue a registration certificate in Form-7 or refuse the application for registration by an order. Granting of registration or refusal as the case may be, shall be made within a period of one month from the date of receipt of the application. (6) ln granting or refusing registration certificate under sub-section (5) of sect10n 9A, the authorized officer shall have regard to the following matters namely, 5 cents; ( a) The boat building yard shall have a minimum land area of . {~) The owner of the boat building yard shall furni sh declarat10n m Fom1-8 for showing the purpose and use of the vessel; ( c) The boat building yard should be equipped with fire safety system and first aid facility; ( d) ~ e owner of the boat building yard, shall obtain insurance coverage to the hfe of the third party. (7) The re?istration number and mark assigned to the boat building yard by the a~thonzed officer shall be displayed in a conspicuous place in the boat buildmg yard m the following manner: KL 01 - FBY - 01 Note:~ I. The letters and numbers in the registration number and mark assigned to a boat building yard indicate as follows: KL - Kerala 0 l - Thiruvananthapuram District FBY - Fishing Boat Building Yard 01 - Registration serial number / 11 2. The colour of the letters and numbers shall be black and the background shall be yellow. 3. Size of the letters shall be I 0cm. in height and 1.5cm. in thickness. (8) Every certificate of registration issued by the authorized officer shall be entered in a register to be kept by him in Fonn-9. 13. Functioning of the boat building yard. - Every owner of the boat building yard shall pursue the following conditions for its functioning; namely: (a) Prior sanction shall be obtained from the authorized officer for the construction of a new vessel having more than 15 meter LOA. For this, a declaration showing the purpose a nd use of the vessel shall be f umished by the owner; (b) Approva l of the design by a Naval architect with respect to sea worthiness and fitness of fishing vessel shall be obtained; · (c) The owner of a boat building yard shall furni sh an annua l report in Form-10 to the authorised officer within one month after the completion of every financial year; {d) On fai lure to submit the annual report in Form- I O by the owner of the boat building yard, the security shall be liable to be forfeited or the registration sha ll be suspe nded or cancelled according to the d iscret ion of the adjudicat ing officer; (e) No registered boat building yard shall construct vessels other than for fishing purpose. Any contravention in this regard shall be liable to forfeiture of the security or suspension or cancellation of registration. 14. Con.,'truction of.fishing vesse/.-The naval architect shall conduct inspection after the stages of laying of keel and planking and at the fina l stage o f the construction of fi shing vessel and the stage certificate shal l be mainta ined in a register by the owner of the yard to ensure that the construction is in adherence to the approved plan. 15. lm,pection of boar building yard.- The authorized officer may, enter and inspect the boat building yard ·at any time without prior notice and check whether the conditio ns specified are satisfied or not. l f the conditions are not satisfied, the authorized officer shall take steps to issue 12 a stop memo at site or give seven days time for rectifying the defect. On failure to comply with the conditions, the authorized officer shall close and seal the boat building yard and report to the adjudicating officer. 16. Renewal of Registration.- ( I) Every application for renewal of registration of boat building yard under section 9B shall be made within s ixty days prior to the expiry of the certificate of registration and the procedures laid-down for new registration shall be complied with. (2) In case the application for renewal is made after the expiry of such date, the authorised officer may consider the application on payment of additional foe of 50 per cent of the fee prescribed under sub-rule (2) of rule 12 as enhanced rate. 17. Registration of fishing net produ9tion unit.- ( I ) Every application for the registration of a fishing net production unit under section 9E shall be in Form- I 1. (2) Every application for the regi stration of the fishing net production unit under sub-rule ( I), shall be accompanied by the fee and security deposit specified in the Table below: T ABLE Ca tego,y o.f.fishing net Fee Security production unit {( ) Deposit {( ) (I) (2) (3) Small (up to 300 MT annual installed 1,000 . 2,000 capacity) Large (more than 300 MT annual installed 5,000 10,000 capacity) (3) Every application for registration shall be accompanied by a copy o f the ownership certificate or lease agreement of land for a minimum period of 5 years which shall be attested by a Gazetted Officer. (4) On receipt of the application under this rule, the authorized officer after making enquiry as he deems fit , shall register the fishing net production uni! and shall issue a Certificate of Registration in Fonn-12 o~ 13 refuse such registration by an order. Such registration or refusal as the case may be, shall be made within a period of one month .from the date of receipt of the application. (5) In granting or refusing registration certificate under sub-~ti~n (5) of section 9E, the authorized officer shall have regard to the following matters namely, (a) The fishing net production unit shall have a m inimum land area of 5 cents; (b) The owner of the fishing net production unit shall furnish a dt!daration showing the particulars with respect to the mesh size of the proposed net to be produced; (6) Every certificate of registration issued by the authorized officer shall be entered in a register to be kept in Fonn-13; (7) The registration number and mark assigned to ~he fishin~ net production unit by the authorized officer shall be di spla yed 111 a conspicuous place in the unit in the following manner, namely, KL O 1 - FPU - 01 Note:- 1. The letters and numbers in the registration number and mark assigned to fishing net production unit indicate as follows: KL - Kerala 01 - Thiruvananthapuram District FPU - Fishing net Production Unit O 1 - Registration serial number 2. The colour of the letters and numbers shall be black and background shall be yellow; 3. Size of the letters and numbers shall be 10 cm. in height and 1.5 cm. in thickness. 18. J11spectio11 o fjishing net production unit.- ( I) The authori~ed officer may, enter and inspect the fishing net production unit at any ttme without prior notice and check whether the co nditions specified are satis fied or not. If the conditions are not satisfied, the authorized officer shall take steps to issue a stop memo at site or give seven days time for 14 rectifying the defect. On fai lure to comply with the conditions the authorized officer shall close and seal the fishino net production uni; and report to the adjudicating officer. 0 19. R~ne":'al of Registration ~f.fis:hing net production unit.-( l) Every app~1cation for renewal of reg1strat1on of fishing net production unit unde r ~ect1on ?E shall be made within sixty days prior to the expiry of the cer t1f1c ate of registration and the procedures laid-down for new reg1stratton shall be complied with. (2) In c ase an a~plication for renewal is made after the expiry of such date the authorised officer may consider the application on pay ment of additional fee of fifty percent of the fee prescribed under sub-rule (2) of rule 17 as enhanced fee. 20. Disposa l of s~ized .fish/vessel/gear/material.- ( l) The seized fish shall be auctioned 1 mmediately and the sale proceeds shall be remitted to the revenue head within next working day. . (2) If the s~ized fish is not in ~aleable or edible condition, it shall be d 1sp~sed acco rdmgly after recording the item wise quantity and ·other details, 1f any, with reason for disposal. (3~ In case of any vessel, gear or other material seized, it shall be ta~en mto the separate stock of stores with proper record up to the adJud1cat10n date and after that shall be released or auctioned and the sale proceeds shall be remitted to the revenue head accordingly. (4~ In ca~e of ill~g~l material, if any, seized shall be destroyed after obtammg prior pern11Ss10n from the Joint Director of Fisheries of the zone concerned. . (5) In the case of boat building yard or fishing net production unit, it shall be attache~ and sold only after the issuance of notice to the person concerned by registered post for 2 times, with an interval of not more than 14 days. I f the notice is returned due to the non-receipt by the person concerned, the notice shall be pasted on any entrance of the unit. 21. Adjudic~tion.-( 1) On receipt of a report from the authorized officer . und~r section 16, the adjudicating officer shall issue notice thereof to the parties c~ncerned,. directing them to file objections, if any, and t~ appear before lum for bemg heard on a -specified date which shall not be later than ten days from the date of receipt of the report. 15 (2) The adjudicating officer shall examine the objections filed by the parties and hear them, if they appear before him either in person or through a lawyer and pass appropriate orders. The adjudicating officer shall observe the principles of natural justice while hearing and disposing the objections. 22. Appeal against orders re.fusing grant of registration or /ic:ence.- (1) Any owner of the fishing vessel aggrieved by an order of the authorized officer refusing, suspending· or cancelling the registration or licence or refusing the renewal of registration or licence may, within 30 days from the date of receipt of such order, prefer an appeal to the Joint Di1 ·ctor of Fisheries, Government of Kerala, of the zone concerned. (2) On receipt of an appeal under sub-rule ( 1 ), the Joint Director of Fisheries, Government of Kerala of the zone concerned shall, after conducting such-enquiry as be deems fit and after giving the appellant and the authorized officer concerned an opportunity of being heard and pass such orders thereon as be deems fit. 23. Penalty.- If the penalty imposed by the adjudicating officer under section 17 is not remitted by the person concerned after the issuance of · notice for twice with an interval of not more than fourteen days, the vessel or any other asset of the person concerned shall be seized, sealed and disposed through public auction and the sale proceeds shall be remitted to the revenue head of the department. 24. The fee payable for the supply of copies of documents or orders as per section 24(2) ( 1) of the Act shff'll be in accofdance w ith the provisions of the Right 10 · Information Act, 2005 . The fee regarding rendering of any service by any officer or authority under this Act shall be as prescribed under the respective rules. By order of the Governor, K. R. In exerci se of the powers conferred by sub-section (I) and (2) of Section 24 of the Kerala Marine Fishing Regulation Act, 1980 (I O of 198 I) the Government of Kerala issued the Kerala Marine Fishing Regulation Rules, 1980 vide G. 0. (Ms.) No·. 141 /80/F&PD dated 29-11-1980, published as S.R.O No. l 141/80. However comprehensive amendme nts were brought to the parent Act by the Kerala Marin~ Fishing Regulatiqn (Amendment) Act, 2017 (Act 22 of 2017) and several new provisions were introduced. In the result, it became necessary to make consequential amendments in the existing rules as well. Therefore, Government have decided to issue fresh rules superseding the existing one, so as to carry out the provisions of. the Act. Pennissive sanction from the authorised officer for construction of a new vessel should be sought by the owner. 2. Design with respect to sea worthiness and fitness sho uld be authenticated by a designated naval architect. 3. Fish hold capacity in a multiday vessel should not exceed 30% of total volume of the vessel and should have toilet and kitchen facilities (in vessels with > 20 MOAL). 1 The registration certificate shall not be made transferrable. 5. On expiry of the registration the application for renewal o f registration shall be submitted 30 days before the date of expiration. 6. On verification/inspection the certificate shall be produced before the officer concerned. 7. The registration is liable to be cancelled or suspended and the security if any furnished shall be liable to be forfeited in whole in part for failure to comply with the conditions subject to which the registration has been granted or for contraven tion of any of the provisions of the KMFR (Amendment) Act, 2017 or the rules/ orders issued there under. 8. The registration is liable to be cancelled or suspended if the registration has been ob tained by misrepresentation as to an essential fact. 9 .
