760 (2) ================:::=------= CHHATIISGARH ACf (No. l0of 2014) CHHATTISGARH CO-OPERATIVE SOCIETIES (A_'1ENDMENT) ACT, 2013 An Act further to amend the Chhattisgarh Co-operativeSocietiesAct. 1960(No.17 of 1961). Be it enacted by the Chhattisgarh Legislature in the Sixty-forth Year of the Republic oflndia, as follows:- Short title. extent 1. (1) This Act may be called the Chhattisgarh Co-operative Societies and commencement. (Amendment)Act, 2013. (2) It extends to the whole State of Chhattisgarh. (3) It shall come mtc force from the date of its Publication in the Official Gazette. Amendment of 2. For clause (jj) of Section 2 of the Chhattisgarh Co-operative Societies Act, i 960 (~o 17 Section 2. of 1961 ), (hereinafter referred to as the Principal Act), the following shall be substituted, namely:- "(ii) "State Election Commission" means the State Election Commission referred to in Article 243K of the Constitution oflndia which shall be the authority or body for the purpose of superintendence, direction and control of the preparation of electoral rolls for and the conduct of, all elections to a co-operative society, under the Article 243ZK of the Constitution oflndia_" Amendment of sub- 3. For Proviso of sub-section (8) of Section 49 of the Principal Act, the following shall be ~ection (8) of substituted, namely :- Section 49. "Provided that the Registrar may authorize any officer, or a person who in the opinion of the Registrar has experience in managing a Co-operatrve Bank or a Co-operative Society, as the case may be, to exercise the powers of the Board vested in him under this sub- section; and the officer or the person so authorized shall exercise such power from the date of such authorization for a period specified by the Registrar or till the elections are held by the State Election Commission, whichever is earlier." Amendment of sub- 4. For sub-section (1) of Section 50-B of the Principal Act, the following shall be section (I) of substituted, namely :- Section 50-B. "(l) The State Election Commission shall conduct all elections of co-operative society and exercise the superintendence, direction and control of the preparation of electoral rolls subject to the provisions of this Act." Amendment of sub- 5. For sub-section (2) of Section 50-B of the Principal Act, the following shall be section (2) of substituted, namely :- Section 50-8. "(2) The State Election Commission shaU in consultation wita ffie State Government appoint such numbers of officer• and other staff as may be required, in the opinion of the Commission for conducting election in reSf!ect of co-operative societies."

760 (3) 6. For sub-section (7) of Section 50-B of the Principal Act, the following shall be Amendment of sub- section (7) of substitued, namely:- Section 50-8. "(7) The Commission shall have the powers to requisition the services of other officers, to aid and assist in the election and such requisitioned officers shall be under the overall supervision and control of the Commission during the election." '7. For sub-section (9) of Section 50-B of the Principal Act, the following shall be Amendment of sub- section (9) of substituted, namely :- Section 508. "(9) All expenses incurred in conducting elections of the board of any society shall be paid to the commission, in advance, by the State Government and the same shall be recovered from such society by the State Government in the manner as may be prescribed by the State Government. 8. The Chhamsgarh Co-operative Societies (Amendment) Ordinance, 2013 (No. 1 of2013) is Repeal. hereby repealed.
