No. 906 of 2005 European Communities (Avian Influenza) (Control on Movement of Pet Birds) (Amendment) Regulations 2005 I, Mary Coughlan, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Decision 2005/862/EC1 of 30 November 2005, hereby make the following regulations 1. These Regulations may be cited as the European Communities (Avian Influenza) (Control on Movement of Pet of Birds)(Amendment) Regulations 2005. 2. The European Communities (Avian Influenza) (Control on Movement of Pet Birds) Regulations 2005 (S.I No. 708 of 2005) are amended by (a) the substitution, for the definition of “Commission Decision” in regulation 2(1), of " 'Commission Decision' means Commission Decision 2005/759/EC2 of 27 October 2005 and the corrigenda to Commission Decision 2005/759/EC of 5 November 2005 as amended by Commission Decision 2005/862/EC of 30 November 2005';", (b) the substitution, for the definition of “Commission Decision” in regulation 2(1), of " 'third country' means a country (other than Andorra, Faroe Islands, Greenland, Iceland, Liechtenstein, Monaco, Norway, San Marino, Switzerland or the Vatican City State) that is not a member state of the European Community';", (C) the substitution, for “four birds” in regulation 4(1), of " 'five birds';", GIVEN under my Official Seal, December 2005 Mary Coughlan Minister for Agriculture and Food 1 OJ No L317, 3.12.2005, p19 2 OJ No L291, 5.11.2005, p48 3 EXPLANATORY NOTE (This note is not part of the instrument and does not purport to be a legal interpretation.) This Order amends S.I No 708 of 2005 and gives effect to Commission Decision 2005/862/EC of 30 November 2005 concerning measures to combat Avian Influenza in birds other than poultry.
