Regulation of the President of the R.I. No. 53/2014 amending Presidential Regulation No. 39/2010 on Biosafety Commission of Genetically Modified Product

THE PRESIDENT REPUBLIC OF INDONESIA REGULATION OF THE PRESIDENT OF THE REPUBLIC OF INDONESIA NUMBER 53 YEAR 2014 CONCERNING AMENDMENT OF PRESIDENTIAL REGULATION NUMBER 39 YEAR 2010 ON BIOSAFETY COMMISSION OF GENETICALLY MODIFIED PRODUCT BY THE GRACE OF GOD ALMIGHTY PRESIDENT OF THE REPUBLIC OF INDONESIA, Considering: a. that for increasing the effectiveness of Biosafety Commission of Genetically Modified Product, necessitate change in the composition and tenure membership of Biosafety Commission of Genetically Modified Product; b. that based on consideration as intended in item a, necessitate the stipulation of Presidential Regulation concerning Amendment of Presidential Regulation Number 39 Year 2010 concerning Biosafety Commission of Genetically Modified Product; In view of: 1. Article 4 paragraph (1) of the 1945 Constitution of the Republic of Indonesia; THE PRESIDENT REPUBLIC OF INDONESIA 2 2. Law Number 21 Year 2004 concerning Ratification of Cartagena Protocol on Biosafety to the Convention on Biological Diversity (State Gazette of the Republic of Indonesia Year 2004 Number 88, Addendum Number 4414); 3. Law Number 32 Year 2009 concerning Environment Protection and Management (State Gazette of the Republic of Indonesia Year 2009 Number 140, Addendum Number 5059); 4. Government Regulation Number 21 Year 2005 concerning Biosafety of Genetically Modified Product (State Gazette of the Republic of Indonesia Year 2004 Number 44, Addendum Number 4489); 5. Presidential Regulation Number 39 Year 2010 concerning Biosafety Commission of Genetically Modified Product; DECIDES: To Stipulate: PRESIDENTIAL REGULATION CONCERNING AMENDMENT OF PRESIDENTIAL REGULATION NUMBER 39 YEAR 2010 ON BIOSAFETY COMMISSION OF GENETICALLY MODIFIED PRODUCT. Article I Several provisions in the Presidential Regulation Number 39 Year 2010 concerning Biosafety Commission of Genetically Modified Product is amended as follow: 1. Provision of Article 3 is amended to read as follows: Article 3 KKH PRG has a membership of 19 (nineteen) people consisting of elements of Government, college and community. THE PRESIDENT REPUBLIC OF INDONESIA 3 2. Provision of Article 4 is amended to read as follows: Article 4 (1) Composition of membership of KKH PRG consists of: a. Chairman cum Member; b. Vice Chairman of Food Safety cum Member; c. Vice Chairman of Feed Safety cum Member; d. Vice Chairman of Environmental Safety cum Member; and e. Member (2) Chairman cum Member as intended in paragraph (1) item a can be held by elements of Government, college, or community. (3) Vice Chairman of Food Safety as intended in paragraph (1) item b is held by middle rank of High Level Official in a non-ministerial government agency that organizes government affair in food and drug. (4) Vice Chairman of Feed Safety as intended in paragraph (1) item c is held by middle rank of High Level Official in the ministry that organizes government affair in agriculture. (5) Vice Chairman of Environmental Safety as intended in paragraph (1) item d is held by middle rank of High level Official in the ministry that organizes government affair in environment protection and management. (6) Member as intended in paragraph (1) item e that originate from government element consist of: a. ministry that organizes government affairs in forestry; b. ministry that organizes government affairs in marine affairs and fisheries; c. ministry that organizes government affairs in trade; d. ministry that organizes government affairs in industry; e. ministry that organizes government affairs in health; f. ministry that organizes government affairs in research and technology; THE PRESIDENT REPUBLIC OF INDONESIA 4 g. non-ministerial government agency that organizes government affairs in development and implementation of technology; and h. non-ministerial government agency that organizes government affairs in science. (7) Member as intended in paragraph (1) item e that originate from college element consisting of 3 (three) people. (8) Member as intended in paragraph (1) item e that originate from community element consisiting of 5 (five) people. 3. Provision of Article 5 is amended to read as follows: Article 5 (1) Membership of KKH PRG is appointed and dismissed by the President on recommendation of the minister that organizes government affairs in environment protection and management. (2) Membership tenure of KKH PRG that originate from college or community is 4 (four) years and can be reappointed for 1 (one) additional tenure. Article II This Presidential Regulation is in effect on the date of its legislation. For public cognizance, it is ordered that this Presidential Regulation be promulgated by its placement in the State Gazette of the Republic of Indonesia.
