Regulation of the Minister Public Works Number 08/PRT/M/2010, concerning Organization and Work Procedure of the Ministry of Public Works; ON STANDARD MINIMUM SERVICE ON PUBLIC WORKS AND SPACE LAYOUT. CHAPTER I GENERAL PROVISION Article 1 What is meant in this Regulation of the Minis ter by: 1. Standard Minimum Service on Public Works and Space Layout hereinafter referred to as SPM on Public Works and Space Layout shall be terms on the type and quality of basic services on Public Works and Space Layout constituting obligatory affairs of the region that every individual has the right to obtain it at the least. 2. Basic Service on Public Works and Space Layout shall be the type of public service on Public Works and Space Layout constituting the mandatory ba sis for filfillment of the society's need for living in social and economic life. 3. SPM Indicator shall be benchmark of both quan tity and quality used to indicate the target vol ume to be fulfilled in accomplishing SPM in input, output process, result and/or benefit of the basic service. SPM on Public Works and Space Layout In Regency/Municipality Region Article 6 (1) The Government of Regency/Municipality shall provide Basic Service on Public Service and Space Layout according to the SPM on Public Works and Space Layout. (2) The SPM on Public Works and Space Layout re ferred to in point (1) consists of services of basic type, target, indicator, and deadline for accom plishment. Article7 (1) The SPM on Public Works and Space Layout re ferred to in Article 6 covers basic service on: a. Water Resources. Standard water supply for the people's need is as shown in the indicator namely: 1. Percentage of available standard water to fulfill at least the principal daily need; and 2. (2) The target for accomplishment of SPM on Public Works and Space Layout referred to in Article 5 and Article 7 may be adjusted based on the result of evaluation of SPM accomplishment by the end of the deadline for accomplishment. CHAPTER IV OPERATOR OF SPM ON PUBLIC PUBLIC WORKS AND SPACE LAYOUT Article 10 (1) The Governor is responsible for implementing SPM on Public Works and Space Layout in Pro vincial region as referred to in Article 5. (2) Technical guideline for SPM on Public Works and (2) Teh Regent/Mayor is responsible for implementing Space Layout of Provincial region and Regency/ SPM on Public Works and Space Layout in Regen Municipality region as referred to in Article 5 and 1 cy/Municipality area as referred to in Article 7. Business News 8616/10-17-2014 24 (3) The SPM on Public Works and Space Layout as referred to in point (1) and point (2) will be im plemented by the work unit in charge of Public Works and Space Layout in Provincial region and Regency/Municipality region. (4) If the Government of Regency/Municipality has no work unti yet to handle the duty and function for managing construction service, such Govern ment may appoint or assign work unit that is in charge of Public Works. will be implemented using facilities for capacity development in the form of general orientation, technical management, education and training, and/or other assistances based on the provisions in the statutory regulation. (4) Facilties for capacity development referred to in point (3) will be provided with due consideration of the capability of institution, personnel, and State finance as well as regional finance. Article 13 CHAPTER V MANAGEMENT AND SUPERVISION Article11 The Minister shall manage and supervise im plementation of technical matter of SPM on Public Works and Space Layout. Article 12 (1) The Minister shall manage the implementation of the technical matter of SPM on Public Works and Space Layout exercised by Provincial Govern (1) The Minister is responsible for technical supervi sion on the application of SPM on Public Works and Space Layout implemented by Provincial gov ernment. (2) The Governor as Government's representative in the region will supervise the technical application of SPM implemented by the Regency/Municipality government. CHAPTER VI ment MONITORING AND EVALUATION Article 14 (2) The Governor as Government's representative in the region shall manage the technical matter of the SPM on Public Works and Space Layout car ried out by the Regency/Municipality government (1) The Minister shall monitor and evaluate the appli cation and accomplishment of SPM performance on Public Works and Space Layout exercised by the Provincial Government and Regency/Munici pality government. (3) The technical management referred to in point (1) Business News 8616/10-17-2014 25 (2) The monitoring and evaluation referred to in point (1) will be exercised by: a. the Minister for Provincial government; and b. the Governor as Government's representative for Regency/Municipality government. (3) The monitoring and evaluation referred to in point (2) shall be exercised in accordance with the pro visions in the statutory regulation. CHAPTER VII REPORTING Article 15 (1) The Work Unit responsible for Public Works and Space Layout of Provincial Region will submit an nual technical report on the result of application and accomplishment of SPM performance on Pub lic Works and Space Layout to the Governor. (2) Based on the report referred to in point (1) the Governor shall submit annual technical report on the result of application and achievement of SPM performance on Public Works and Space Layout of Provincial Region to the Minister (?) and Minis ter of Home Affairs. on Public Works and Space Layout to the Regent/ Mayor. (2) Based on the report referred to in point (1) the Re gent/Mayor shall submit annual technical report on the result of application and accomplishment of SPM performance on Public Works and Space Layout to the Governor. (3) The Governor shall submit summary of annual technical report on the result of application and accomplishment of SPM performance on Public Works and Space Layout in Regency/Municipality areas within its region to the Minister of Home Affairs. Article 17 Format of annual technical report on the re sult of application and accomplishment of SPM per formance on Public Works and Space Layout as re ferred to in Article15 and Article16 shall be based on the provisions in the statutory regulation. CHAPTER VIII FINANCEMENT Article 19 (1) Payment for implementing SPM on Public Works and Space Layout in Provincial area and Regency/Munici pality areas will be charged to the respective Regional Revenue and Expenditure Budget. (2) Financement for accomplishment of SPM on Public Works and Space Layout as referred to in number (1) will be calculated based on the provisions as specified in Attachment III constituting inseparable part of this Regulation of the Minister. CHAPTER IX TRANSITIONAL PROVISION Article 20 Government Regency/Municipality that has programmed SPM on Public Works and Space Layout in the planning document based on Regulation of the Minister Public Works Number 14/PRT/M/2010, concerning Standard Minimum Service on Public Works and Space Layout survives in running the program according to the plan that has been decided up to Year 2014. CHAPTER X OTHER PROVISIONS Article 21 Provision on SPM on Public Works and Space Layout of Regency/Municipality regions as referred to in Article 6 up to Article 8 prevails mutatis mutandis for Jakarta Capital City of Special Province. Business News 8616/10-17-2014 27 CHAPTER XI CLOSING PROVISION Article 22 With the enforcement of this Regulation of the Minister ini, Regulation of the Minister Public Works Number 14/PRT/M/2010, concerning Standard Mini mum Service on Public Works and Space Layout is revoked and hereby declared null and void. Article 23 This Regulation of the Minister takes effect on the date it is enacted. For public cognizance, this Regulation of the Minister shall be announced by placing it in the State Gazette of the Republic of Indonesia.
