Regulation of the Minister of Public Works No. 48/PRT/1990: Regulation on the Management of Water and or Water Resources in the River Basins

TRANSLATION Regulation of Minister of Public Works No. 48/PRT/1990 on The Management of Water and or Water Resources in the River Basins The Minister of Public Works having considered : a. that, to implement Government Regulation {P.P} No. 22 year 1982 on Water Administration, article 4 particularly, Regulation of Minister of Public Works No. 39/PRT/1989 has been issued determining the classification of river basins in Indonesia into 90 River Basins; b. that, as a follow-up of the Minister of P.W. Regulation No. 39/PRT/1989, it is necessary to determine the agency/unit authorized to manage water and or water resources within the river basins as mentioned above, in accordance with the stipulations described in article 5 of Government Regulation {PP} No. 22 year 1982; c. that, to realize the abovementioned purposes it needs to be regulated and determined based on Regulation of the Minister of Public Works. Refer to Laws No. 5/1974 and No. 11/1974 and PP No. 22/1982 etc. etc. Chapter I D e fin i t ion s article 1 Chapter II The Authority of Management article 2 (1) The authority for the management of water/water resources in the river basins as stated in Annex I of this Ministerial Regulation is transfered to the Provincial Government concerned, as co-administration task. (2) The authority for the management of water and or water resources which is transfered to the Provincial Government as meant in para (1) of this article, covers some authorizations described in Article 3 of Law No. 11/1974 and in Article 12 of PP No. 1982, namely a/ to manage and develop the use of water and or water resources; b/ to formulate, legalize and or issue license based on planning and technical planning of the water management; c/ to regulate, legalize and or issue license on the purpose, the use and the provision of water and or water resources; d/ to regulate I legalize and or issue license on the exploitation of water and or water resources; e/ to determine and regulate the legal acts and legal regulations between persons and or legal entities in the field of water and or water resources; f/ to execute coordination of the water management; (3) The implementation of the management authority of water and or water resources, as meant in para (1) and (2) of this Article, is basically following the principles of co-administration task described in Law No. 5/1974 on Basic Principles of Governmental Affairs in the Regions, by participating (involving) the Provincial Government in the financing, as determined in Chapter VI I I of P. P. No.22/1982 on Water Management. (4) The Provincial Government concerned is responsible for the execution of water and or water resources management, as meant in para (1) and (2) of this Article, to the Minister of Public Works. Article 3 (1) The authority for the management of water and or water resources in the river basins as stated in Annex II of this Ministerial Regulation, rests with the Minister of Public Works with the authorization as described in Law No. 11 year 1974 and its implementation regulations. (2) The Director General of Water Resources Development (DGWRD)is to execute the management authority on water and or water resources, as meant in para (1) of this Article. Article 4 (1) The authority for the management of water and or water resources in the river basins as stated in Annex III of this Ministerial Regulation is transfered to certain Legal Entities mentioned in column 6 of the said Annex III. (2) The details of management authority of water and or water resources which is transfered to the Legal Entities as meant in para (1) of this Article, are to be prescribed in a Government Regulation (PP) of its establishmentX (3) The Legal Entities as meant in para (1) of this Article are responsible for the execution of water and or water resourGes management to the Minister of Public Works. CHAPTER III Executing Agency Article 5 The executing agency of water and or water resources management as meant in Articles 2 and 3 of this Ministerial Regulation, is regulated as follows : a/ the management of water and or water resources in the river basins which is transferred to the Provincial Government is carried out by DINAS to be arranged further by Head of the DINAS concerned with the approval of the Governor. b/ the management of water and or water resources in the river basins, which authority rests with the Minister of Public Works, is carried out by : 1. Project Executing Agency of the area/territory where the river basin is located. 2. Directorate of River of DGWRD, where there is no Project Executing Agency. x The establishment of Perum Jasa Tirta is based on PP No.5/1990. The establishment of Perum Jatiluhur is based on PP No.42/1990. CHAPTER IV Closing Article Article 6 (1) This Ministerial Regulation comes into effect as from the date of its promulgation. (2) Other matters which are not yet described in this Ministerial Regulation, will be determined by separate decree. (3) This Ministerial Regulation is to be distributed to all concerned for its implementation.
