PROHIBITION ON FISHING IN FISHERY MANAGEMENT TERRITORY OF THE REPUBLIC OF INDONESIA 714 (Regulation of the Minister of Marine and Fishery Number 4/PERMEN-KP/2015. dated January 6, 2015) BY GRACE OF GOD THE ALMIGHTY THE MINISTER OF MARINE AND FISHERY OF THE REPUBLIC OF INDONESIA Considering: a. that in order to protect breeding ground and spawning ground in Fishery Management Territory of the Re public of Indonesia 714, it is necessary to ban fishing; b. that having regards to letter a, it is necessary to stipulate a regulation of the Minister of Marine and Fishery regarding Prohibition on Fishing in Fishery Management Territory of the Republic of Indonesia 714; In view of: 1. Law Number 31 Year 2004 on Fishery (Statute Book of the Republic of Indonesia Year 2004 Number 118, Supplement to Statute Book of the Republic of Indonesia Number 4433), as already amended by Law Number 45 Year 2009 (Statute Book of the Republic of Indonesia Year 2009 Number 154, Supplement to Statute Book of the Republic of Indonesia Number 5073); 2. Presidential Regulation Number 47 Year 2009 on the Establishment and Organization of State Ministries as already amended by Presidential Regulation Number 13 Year 2014 (Statute Book of the Republic of Indonesia Year 2014 Number 25); 3. Presidential Regulation Number 24 Year 2010 on Status, Tasks and Functions of State Ministries as well as First-echelon Organizational Structures, Tasks and Functions of State Ministries as already amended the latest Presidential Regulation Number 135 Year 2014 (Statute Book of the Republic of Indonesia Year 2014 Number 273); 4. Presidential Regulation Number 165 Year 2014 on the Arrangement of Tasks and Functions of Work Cabi net (Statute Book of the Republic of Indonesia Year 2014 Number 339); 5. Regulation of the Minister of Marine and Fishery Number 18/PERMEN-KP/2014 on Fishery Management Territory of the Republic of Indonesia (State Gazette of the Republic of Indonesia Year 2014 Number 503); DECIDES: To stipulate: REGULATION OF THE MINISTER OF MARINE AND FISHERY REGARDING PROHIBITION ON FISHING IN FISH ERY MANAGEMENT TERRITORY OF THE REPUBLIC OF INDONESIA 714 Article 1 Referred to in this ministerial regulation as: 1. Fishing shall be an activity intended to obtain fish in waters, not in the state of breeding, by whatever in strument or method, including activity using ship to load, carry, save, cool, handle, process and/or preserve thereof. 2. Everybody shall be individual person or corporation. 3. Corporation shall be a group of organized individual persons and/or assets, either legal entity or non legal entity. 4. Fishing Licence hereinaafter abbreviated to SIPI shall be a written permit that every fishing ship has to have to conduct fishing, which constitutes an integral part of Fishery Business License. 44 Business News 8737/8-7 2015 Article 2 (1) Everybody shall be prohibited from conducting fishing in part of Fishery Management Territory of the Re public of Indonesia 714, which constitutes breeding ground and spawning ground. (2) The breeding ground and spawning ground as meant in paragraph (1) with the map and coordinate points ' shall be as contained in the attachment, which constitutes an integral part of this regulation. Article 3 SIPI with the fishing area as meant in dalam Article 2, which has been issued before the enforcement of this regulation shall continue to apply until expiring. Article 4 The regulation shall come into force as from the date of promugation.
