5A PESTICIDE MONITORING (Rpgutation of the Mini~erof Agrtrutture Number 42/Permentan/SR.140/5/2Q07 dated May 7 r 2007) BYTHEGRACE OFGOD ALMIGIfTY THE MINISTER OFAGRlCULlURE, Considering: a. that pestidde could give benefit to public but also could endanger for human health, conservation of resource of biological nature and life environment, therefore to avoid the effect of the mentioned pesti cide, distribution, keep and usageof pestidde shall be monitored; b. that pesticidemonitoring hasbeen regulated by De cree of the Ministerof AgricultureNumberSI7/Kpls/ TP.270/9/2002; c. that following changes in the organization of the Department of Agriculture, duty and function in the implementation of pesticide monitoring; d. that according on the mentioned above and to In crease usefulness andeffect in the execution of moni toring of pesticide, it is necessary to review Decree of the Minister of Agriculture Number 517/Kptsl TP.270/9/2002; Remembering: 1. Pesticide is all chemical substance and another sub stance also microorganism and virus which is used for: a. eliminate.•.•• a. eliminateor avoidplantdisease anddisease which damaged the plant, parts of plant or harvest of agriculture; b. eliminate grass; c. kill leaves andavoid the un wanted growth; d. regulate or sumulete the growth or plant or parts of plant excludefertilizer; e. eliminate or avoid of outsider plant disease at peta and Iiv=tock; f. eliminate or avoid of water plant disease; g. eliminate or avoid the animals and microorgan isms in household, building and in transportation tools; and or h. eliminate or avoid the animals.which cause the diS:Qa~ to humanor protected. animal by using at plants, land orwater. 2. CHAPTER 111 REQUIREMENT, PROC!:UUIU: OF SHOWiNG AND STOPPiNG OFSUPERVlSOR OF PEmaDE Article 6 (l)Monltoring or ~liLit.lt?: is conducted by Gupcrvlsor of Pestidde which consist on Supervisor of Pestldde at central, Supervisor of Pesticide at Province and Supervisor of pesticide at Sub-Di£trictfTow" 12lTo ..... (2)To be appointed as Supervisor of Pesticide as re ferred in sentence 1, shall have to fuffill the follow ings requirement: a. employee ofcivil state at environment of Fanning Institution, Industrial, Trading, Healthy, Supervi 50r of Medidlle: <lind rood (POM), Working em ployee and Transmigration, sea and Fish, Forest, Ufe Environment or another related Institute; b. at least having working period for 2 (two) years; c. havinq formal education or training and knowl edge at pesticide field which Isaccording with the duties of monitoring of pesticide; d. prioritized who is experienced handling the job which related withpesticide or having training cer tificate which is according with the duty 'Of moni toring of pesticide; and e. not afflliated or necessjty conflict with business at pestidde field. (3)Employee of Civil State Which is appointed as SUper visor of Pesticide but do not have certificate of train ing as referred at sentence 2 letter d shall be prlon tlzed to be suggested to follow the training which is related with monitoring of pestidde. Article 7 (l)SupelVisor of Pesticide as referred in Article 6 is ap pointed by Miniwar, Governor or Reaent/Maynr (2)Appolntment of SuperviSor of PesticIde as referred at sentence 1 is conducted as follows: a. Supervisor of Pesticide at central isappointed by Minister of Agricutture on suggestion of umt. of institution head of base of administration as re ferred in Article 6 sentence 2 letter a; b. Supervisor of pesticide at Province is appointed by Governor on suggestion of unit of institution head of base of administration as referred in Ar ticle 6 sentence 2 letter a at Province; c. Supervisor of Pesticide at Sub-District/Town is ap POinted by Regent/Mayo on suggestion or unn or institution head of base of administration as re ferred in Article 6 sentence 2 letter a at Sub-Dis b-ict{Town. Article 17 EaCh SUpervisorof PeStICIde In executing It:> duty shall be according with order letter from unit of institu tion head of base of administration. Article 18 (l)HoIder of registration number, producer, distributor and user of pesticide oblige to receive and give the explanation to Supervisor of Pesticide which executes Its duty. (2)HoIder of registration number, producer, distributor or user of pesticide who reject or obscure the execu tion of monitoring duty as referred at sentence 1, Business News 75B2-7583/11-7-20\l7 1111. supervisor of pesticide shall ask for help to police officer. (3)If supervisor of pestidde suspects or finds there is a criminal action at pesticide field,oblige to report to an authoriZed investigator according to regUlation and law. CHAPTER V REPORTING Article 19 Result of monitoring In according with object of monitortng as referred InArticle4 andduty of monitor ing as t'@ferred in Artide 11, is reported periodically by Supervisor of Pesticide or anytime to each of the unit of Instituti onhead of base of adminlstration. Article 20 Matter of report as referred in Artide 19, for: a. Sub-Di,trid:/Towli at least covers; amount, type and quality of pesticide which is distributed, effect of the usage of pestlcide at farmer level also another mat ters which is shown up at field; b. Province at least covers situation of the distribution of pesticide atsub-distrtct}town, effectof the usage of pesticide also another matters which is shown up at entire sub-districtjtown in one province; c. center at least covers production of pesticide, ex IJUrl ilflpott oractive meterjel and formulation of pes ticide, development of permit/registration number, result of evaluation of monltortng at area also the matters whICh IS shown UIJ dL enure ur IIIlJulloia area. Article 21 Mechanlsm of the submit of report is conducted as the followings: a. Supervisor of pestldde at Sub-D1striCtfTown SUbmits the report to unit of Institution head of base of ad ministration and to learn Head/commission of Moni tortng of Sub-Dlstriet/Town. Next ••• Next Team Head/Commission of Monitoring of Sub Oistrict{Tawn submits the report to Regent and to Team Head/COmmission of Monitoring of Province; b. Supervisor of Pesticide at Province submits the re port to unit of institution.head of baseof administra tion and to Team Head/Commission of Monitoringof Province. Next Team Head/Commission of Monitoring of SUb District{Townsubmits the report to Governorand to Headof Commission of Pestidde; 121\ CHAPTER VII FOLLOW UP ON MONITORING RESULT Article 25 (l)Follow up to the monitoring result at sub~district/ town shall be finished by Regent/lY1ayor, and if its negative effect isshownup betweensulH:listrictjtown in one province shall be finished by Governorand if its negativeeffect isshownup betweenprovinceshall be finished by Minister of Agriculture on suggestion and consideration from Commission of Pesticide. c. SUpervisor af Pesticide at Central submits the report to unn: of institution head of base of administration and to Head of commission of Pesticide. Next Head of Commission of Pestidde submits the report to Minister of I\gricu~ure. CHAPTER VI COORDINATION OF MONITORING Article 22 Exe<:utIoo ofmonltortng of pesticideisamducred as unity and coordinatedeither between related institu tion or betweencentral, provinceand sub-district/town. Article 23 (t)Coor<lination at central isoonduded by Commission of Pesticide ashasalready established by Decree of Minister of Agriculture. (3)Coordination at Sub-District{fown is conducted by Team/Commission of Monitoring which has already established with Decree ofRegent/Mayar. Article 24 Coordination of monitoring of pesticide as re ferred In Article 23 is conducted at preparing moment, execution and report. (3)Follow up of result of monitoling at central shall be finishedby Ministerof Agriculture onsuggestion and consideration of Commission of Pesticide.
