lA PROVISIONS AND PROCEDURES FOR TECHNICAL VERIFICATIONJ;SURVEILLANCE OF THE EXPORT OF CERTAIN PRODUCTS OF FORESTRY INDUSTRY BY SURVEYORS • (Regulation of the Director General of Foreign Trade No. 02/DAGLU/PER/2/2007 dated February 14, 2007) THE DIRECTOR GENERAL OF FOREIGN TRADE, Considering: a. that in the framework of implementing the provisions in Article 9 paragraph (7) of Regulation of the Minis ter of Trade No. 09/M-DAG/PER/2/2007 dated Feb ruary 14,2007 concerning Export Provisions of Fo restry Industry Products, it is necessary to regulate provisions and procedures for technical verification/ surveillance of the export of certain products of fo restry industry by surveyors; b. that based on the considerations as meant in letter a, it is necessary to stipulate a regulation of the DI rector General of Foreign Trade; In view of: 1. Presidential Regulation No. 10/2005 on Hrst-echelon Organizational Units andTasks of State Ministries as already amended several times and the latest by Presidential Regulation No. 63/2005; 2. Presidential Decree No. 34/M/200S on Appointment of First-Echelon Officials within the Ministry ofTrade; 3. Regulation of the Minister of Trade No. Ol/M-DAG/ PERl3/200S on the Organiziltion end Working Ar rangement of the Ministry of Trade as already amended byRegulation of the Minister pfTrade No. 30/M-DAG/PER/12/2005; 4. Regulation of the Minister of Trade No. 14/M-DAG/ PER/3/2006 dated March 29,2006 on Provisions and Procedures for the Issuance of Business License of Survey Service; s. Regu~ation of the Minister of Trade No. 09/M-DAG/ PER/2/2007 dated February 14,2007 on Provisions on the Export of Forestry Industry Products; DECIDES: To stipulate: THE REGULATION OF THE DIRECTOR GENERAL·OF FOREIGN TRADE ON PROVISIONS AND PROCEDURES Business News 7503/27-4-2007 FOR TECHNICAL VERIFICATION/SURVEILLANCE OFTHE EXPORT OF CERTAIN PRODUCTS·Of FORtSTRY INDUS TRY BY SURVEYORS Article 1 Referred to in this regulation as: 1. Certain forestry-industry products are the forestry industry products subsumed into tariff headings HS 4407, HS 4409, Ex HS4412 (especially forlaminated wood), HS 4415, HS 4418 and EX HS 9406 (espe cially for wooden pre-fabrlcated bUilding). 2. Surveyors are' business entities securiny Surveyor Service Business License (SIUJS) issued by the Mi nistry of Trade and stipulated by the Minister of Trade to undertake technical verification/sUlveillance of the export of certain forestry industry products. Article 2 Surveyors must apply technical verification/sur veillance to the export of the certain forestry industry products as meant in Article 1 point 1. Article 3 (l)Approved Exporters of Forestry Industry Products (ETPIK) planning to export the certain forestry-In dustry products are obliged to submit Application for Inspection of Exported Goods (PPBE) to. the sur veyors. (2)The submitted PPBE as meant in paragraph (1) uses the format mentioned in the attachment to this regu lation by enclosing: a. Copy of recognition to ETPIK (for the first sub mitted PPBE); b. COpy of Packing Ust (P/Ll; c. Copy of Invoice; and d. Copy of Ratiflcaticn of Endorsement from the Fo~ restry Industry Revitalization Board (BRIK). (3) PPBE . (3)PPBE as meant in paragraph (') is submitted in not later than 3 (three) days before the date of inspec tion of goods to the surveyors. Article 4 Activitiesexecuted by the surveyors in the frame work of the technical verification/surveillance of the cer tain forestry industry products are: . a. administrative verification, covering: 1. Legitimacy of document of ETPIK; 2. Legitimacy of Endorsement Ratification Document. b. Physical verification, covering: 1. Quantity, kind, brand and no. of package; 2. Quantity of goods; 3. Kind of timber; 4. The technical criteria as regulated in Attachment II to Regulation of the Minister of Trede No. 09/ M-DAGjPER/2j2007 on Provisions on the Export of Forestry Industry Products; 5. Conformance of Tariff Headings/HS Numbers; 6. Putting Identity of Surveyors on the package al ready inspected. 7. supervising.the loading into container, if the ship ment uses container; and 8. instalHng seal at container jf all goods in the con tainer are Inspected by the surveyor. Article 5 (1) Results of the technical verification/surveillance of the export of certain forestry industry products bV the surveyors arc mentioned in the form of: a. Surveyor report (LS) in the case of the inspected forestry-industry products being suitable to the provisions in force; or b. Inspection Report (LHP) in the case of the in spected forestry-indClstry products being not suit able to the provisions In force. (2)LS or LSP is sissued by surveyors in not later than one day after the date of the inspection and/or su pervision over the loading into container is completed. Article 6 ETPIK can raise objection in writing to the Di rector General of Foreign Trade in the case of surveyors not issuing LS/LHP in the period as meant in Article 5 paragraph (1). BusinessNews 7503/27-4-2007 2A Article 7 Every LSonly can be used as customs comple mentary document required for registration of one num ber of Export Declaration (PES) or Customs Declaration of Single Administrative Document (PP SAD) for Cus toms and Excise Service Offices already applying it. Article 8 Copy of PES or PP SAD must be conveyed by ETPIK to surveyors in not later than 2 (two) days after securing loading approval. Article 9 (l)Surveyors are obliged to report results of tec.hnic.al verification/surveillance of the export of certain for' estry industry products to the Director General of Foreign Trade, Ministry of Trade with a copy made available to the Director General of Agro and Chemi cal Industries, Ministry of Industry and Director Ge neral of Forestry Production Development, Ministry of Forestry in the form of hard copy and electronic data. (2)The report as meant in paragraph (1) must be con veyed by surveyors in not later than the 15th of the ensuing month. Article 10 Violation of the provision as meant in Article 9 is SUbjected to sanction in the form of revocation of right to receive service fee of verification executed in the not reported month. Article 11 With the enforcement of this regulation, Regu lation of the Director General of Foreign Trade No. 021 DAGLU/PER/3/2006 on Procedures for Technical Verifi cation/Surveillance of the Export of certain TImber Prod uds by Surveyors is revoked and declared null and void. The regulation comes into force two monthsas from the date of stipulation.
