Decree of the Minister of Agriculture No. 941/Kpts/PL.810/10/97 to amend the Decree of the Minister of Agriculture No. 508/Kpts/PL.810/7/96 Re Supplies of Fishing Vessels and the Abolition of the System of Hiring Fishing Vessels with Foreign Flags

1 DECREE OF THE MINISTER OF AGRICULTURE NO. 941 /Kpts/PL.810/10/97: DATED OCTOBER 13, 1997 RE AMENDMENT OF THE DECREE OF THE MINISTER OF AGRICULTURE NO. 508/KPTS/PL.810/7/96 ON THE PROCUREMENT OF FISHING VESSELS AND THE ABOLITION OF THE SYSTEM OF LEASING OF FOREIGN FISHING VESSELS. THE MINISTER OF AGRICULTURE Considering: a. that by the Decree of the Minister of Agriculture No. 508/Kpts/PL.810/7/96, the procurement of fishing vessels and the abolition of the system of leasing of foreign fishing vessels have been stipulated; b. that with a view to ensuring the smooth procurement of fishing vessels particularly the procurement of foreign second-hand vessels from abroad, it is necessary to ease the maximum age requirement for importable vessels; c. that for the purpose as meant in letter b, it is deemed necessary to amend the Decree of the Minister of Agriculture No. 508/Kpts/PL.810/7/96. Government Regulation No.15/1980 Jo. No. 46/1993 on Fishery Business (State Gazette of 1990 No. 19, Supplement to State Gazette No. 3408 and State Gazette of 1993 No. 73, Supplement to State Gazette No. 3536); 5. Presidential Decree No. 44/1974 on the Organisational Structure of Ministries; 6. Presidential Decree No.15/1984 on the Organisational of Ministries jo. Presidential Decree No. 83/1993 on the Amendment of Presidential Decree No. 15/1984 on the Organisation of Ministries; 7. Presidential Decree No. 96/M of 1993 On Establishment of Vlth development Cabinet. 8. The Joint Decree of the Minister of Trade, the Minister of Communication and the Minister of Finance No. 885/Kpb/VII/1985, KM.139/HK.205/PHB-85 and No. 677/KMK.05/1985 as already amended and supplemented the latest by the Joint Decree of the Minister of Trade, the Minister of Communications and the Minister of Finance No. 297/Kpb/X/86, No. KM.146/HK.101 /PHB-86 and No. 836/KMK.01 /1986; 9. The Decree of the Minister of Agriculture No. 815/Kpts/IK.120/11/90 on the Licensing of Fishery Business; 10 The Decree of the Minister of Agriculture No. 957/Kpts/IK.120/12/96 on the Use of Foreign Fishing Vessel for Fishing by the Leasing System in the Indonesia Exclusive Economic Zone; 11. The Decree of the Minister of Agriculture No. 96/Kpts.OT.210/2/1994 on the Organisation and Operational Procedure of the Minister of Agriculture; 12. The Decree of the Minister of Agriculture No. 508/PL.810/7/96 on the Procurement of Fishing Vessels and the Abolition of the System of Leasing of Foreign Fishing Vessels. Taking into account: The Result of the meeting of the Team for Guidance and Control of fishing Vessel Procurement dated September 8, 1997. HAS DECIDED: To stipulate: THE: DECREE OF THE MINISTER OF AGRICULTURE CONCERNING AMENDMENT OF THE DECREE OF THE MINISTER OF AGRICULTURE NO. 508/KPTS/PL.810/7/96 ON THE PROCUREMENT OF FISHING VESSELS AND THE ABOLITION OF THE SYSTEM OF LEASING OF FOREIGN FISHING VESSELS. 2 Article I. 1. To amend the provision in Article 4 paragraph (3) so that it reads as follows: "Article 4. (3) The import of fishing vessels and or fish transport vessels as meant in paragraph (2) shall obtain prior approval of procurement of fishing vessels from the Minister of Agriculture. " 2. To amend the provision in Article 6 paragraph (1) so that it reads as follows: Article 6 (1) Fishing vessels and or fish transport vessels which can be imported shall have steel constructions and the maximum age for used vessels shall be 15 (fifteen) years" Article II.
