PUBLIC HEALTH ACT (AMENDMENT) [MO 3] DECREE, 1995 THE GAMlslA DECREE NO.42 [7th June, 1995] Short title section 12 of Cap.40:0J amended TBEARMED FORCES PROVISIONAL RULING COUNCIL hereby decrees as follows: 1. This Decree may be cited as the Public Health Act (Amendment) [NO.31 Decree, 1995 and shall be deemed to have come into force on the 27th daY of March, 1995. 2. The Public Health Act is hereby amended in section 12 by (a) deleting subsection ( 6 ) thereof and replacing it by the following: .. ( 6 ) Where any food is, after inspection by a Health Officer or after the determination of its wholesomeness, found to be unwholesome or unfit for human consumption, the Health Officer shall condemn it and, notwithstanding anything to the contrary contained in this Act, the Health Officer or any agent or servant of the State may order the food to be destroyed or disposed of as he may direct. n; and (b) inserting immediately after subsection (6) the following: "(6a) Notwithstanding section 18, no proceedings whatsoever shall be brought against a Health Officer or any agent or servant of the state for any action done or taken in accordance with this section."
