Order, 2014. 1. In Part II of Schedule 1 to the Animal Welfare (Requirements for Slaughter, Killing, Euthanasia Etc.) Order, 20l4b a Ordinance No. III of 2012 as amended by Order in Council No. XVI of 2015, Ordinance No. IX of 2016 and G.S.I. No. 32 of 2014. b G.S.I. No. 31 of 2014 as amended by Ordinance No. IX of 2016. 1 (a) in paragraph 5(1), omit the words ", Eurasian woodcock", and (b) in paragraph 6(2) (requirements in relation to the hunting, capture or killing of a cross-bred mallard duck or a greylag goose) (i) in item (a), omit the words "an air weapon or?, and (ii) in item (b), after the words "the requirements? insert the words "applying to killing by shooting with a shot gun". Amendment of the Animal Welfare (Designation and Control of Pest Animals) Order, 2014. 2. The Animal Welfare (Designation and Control of Pest Animals) Order, 20l4c is amended as follows (a) in article 3(1) (interpretation), after the definition of "air weapon" insert the following definition ""approved person" means a person who (a) is the holder of a qrialification that demonstrates that the holder has c G.S.I. No. 33 of 2014 as amended by Ordinance No. IX of 2016. 2 received training in the use of Larsen traps, or (b) has practical knowledge or experience in the use of Larsen traps, such that the person would be competent to use such a trap in accordance with the requirements of this Order and has demonstrated the same in writing to the satisfaction of the States Veterinary Officer, ," and (b) in paragraph 1(b) of Part I of Schedule 3 (control measures etc. for the control of carrion crows and magpies), after the words "approved pest controller" insert "or an approved person". Interpretation. 3. (1) In this Order, unless the context requires otherwise "enactment? includes a Law, an Ordinance and any subordinate legislation and includes any provision or portion of a Law, an Ordinance or any subordinate legislation, and "subordinate legislation" means any regulation, rule, order, rule of court, resolution, scheme, byelaw or other instrument made iu'ider any statutory, customary or inherent power and having legislative effect, but does not include an Ordinance. 3 (2) The Interpretation (Guernsey) Law, 1948a applies to the interpretation of this Order. (3) Any reference in this Order to an enactment is a reference thereto as from time to time amended, re-enacted (with or without modification), extended or applied. Citation and commencement. 4. This Order may be cited as the Animal Welfare (Amendment) Order, 2017 and shall come into force on the 30th April, 2017. Dated this l 5' day of April, 2017 /I . L. BREHAUT President of the States Committee for the Environment & Infrastructure For and on behalf of the Committee d Ordres ell Conseil Vol. XIII, p. 355. 4 EXPLANATORY NOTE (This note is not part of the Order) The Animal Welfare (Requirements for Slaughter, Killing, Euthanasia Etc.) Order, 2014 is amended to * omit the reference to a Eurasian woodcock in paragraph 5(1) of Part II of Schedule 1 (requirements applying to game animals) as it has been removed from the prescribed list of game animals to which the requirements for lawful killing apply; and remove killing of a wild cross-bred mallard duck or a greylag goose by shooting with an air rifle as a lawful method of killing. The result is that the only lawful method of killing such birds is shooting with a shot gun in accordance with the requirements of the Order. The Animal Welfare (Designation and Control of Pest Animals) Order, 2014 is amended so as to allow "approved persons", as defined in the Order to control carrion crows and magpies using a Larsen trap in accordance with the requirements of the Order. An approved person is one holding a qualification or having practical experience or knowledge such that they would be competent to use a Larsen trap and who has demonstrated this to the satisfaction of the States Veterinary Officer.
