Mae’n galluogi Gweinidogion Cymru i gyhoeddi manylion am leoliad mangreoedd lle bo’r fuches wedi colli neu adennill ei statws rhydd rhag twbercwlosis yn unol â Chyfarwyddeb y Cyngor 64/432/EEC ar broblemau iechyd anifeiliaid sy’n effeithio ar fasnach ryng-Gymunedol mewn anifeiliaid buchol ac anifeiliaid o deulu’r mochyn (OJ Rhif P 121, 29.7.1964, t 1977). Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Gorchymyn hwn. O ganlyniad, paratowyd Asesiad Effaith Rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Gorchymyn hwn. W E L S H S T A T U T O R Y I N S T R U M E N T S 2015 No. 1773 (W. 245) ANIMALS, WALES ANIMAL HEALTH The Tuberculosis (Wales) (Amendment) Order 2015 EXPLANATORY NOTE (This note is not part of the Order) This Order amends the Tuberculosis (Wales) Order 2010 (S.I. 2010/1379 (W. 122)). It enables the Welsh Ministers to publish location details of premises where the herd has lost or regained its tuberculosis-free status in accordance with Council Directive 64/432/EEC on animal health problems affecting intra-Community trade in bovine animals and swine (OJ No P 121, 29.7.1964, p 1977). The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, a Regulatory Impact Assessment has been prepared as to the likely costs and benefits of complying with this Order. W E L S H S T A T U T O R Y I N S T R U M E N T S 2015 No. 1773 (W. 245) ANIMALS, WALES ANIMAL HEALTH The Tuberculosis (Wales) (Amendment) Order 2015 Made 6 October 2015 Laid before the National Assembly for Wales 12 October 2015 Coming into force 2 November 2015 The Welsh Ministers make the following Order in exercise of the powers conferred by section 1 of the Animal Health Act 1981(1). Title, application and commencement 1.—(1) The title of this Order is the Tuberculosis (Wales) (Amendment) Order 2015. (2) This Order applies in relation to Wales. (3) This Order comes into force on 2 November 2015. Amendments to the Tuberculosis (Wales) Order 2010 2.—(1) The Tuberculosis (Wales) Order 2010(2) is amended as follows. (1) 1981 c. 22. Functions under the Act are exercisable by the Welsh Ministers (in relation to Wales) by virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672); the National Assembly for Wales (Transfer of Functions) Order 2004 (S.I. 2004/3044); and section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32). (2) S.I. 2010/1379 (W. 122). 3 (2) Yn erthygl 2 (dehongli) yn y man priodol yn ôl trefn yr wyddor mewnosoder— “ystyr “statws rhydd rhag twbercwlosis” (“tubercolosis-free status”) yw buches sy’n bodloni’r amodau a nodir yn Atodiad A.1, paragraffau 1 a 2 o Gyfarwyddeb y Cyngor 64/432/EEC(1) ar broblemau iechyd anifeiliaid sy’n effeithio ar fasnach ryng Gymunedol mewn anifeiliaid buchol ac anifeiliaid o deulu’r mochyn.” (3) Yn erthygl 12 (profi ar gyfer twbercwlosis) ym mharagraff (9) hepgorer y diffiniad o “colli ei statws rhydd rhag twbercwlosis”. (4) Yn erthygl 14 (cofnodion o brofion ar gyfer twbercwlosis) ar ôl paragraff (3) mewnosoder— “(4) Pan fo buches yn colli neu’n adennill ei statws rhydd rhag twbercwlosis caiff Gweinidogion Cymru gyhoeddi gwybodaeth am y fuches honno ar unrhyw ffurf y mae Gweinidogion Cymru yn barnu ei bod yn addas at ddibenion helpu personau eraill i ddiogelu rhag lledaeniad pellach twbercwlosis.” Y Dirprwy Weinidog Ffermio a Bwyd o dan awdurdod y Gweinidog Cyfoeth Naturiol, un o Weinidogion Cymru 6 Hydref 2015 (1) OJ Rhif P 121, 29.7.1964, t 1977. (2) In article 2 (interpretation) in the appropriate place in alphabetical order insert— ““tuberculosis-free status” (“statws rhydd rhag twbercwlosis”) means a bovine herd that satisfies the conditions laid down in Annex A.I, paragraphs 1 and 2 of Council Directive 64/432/EEC(1) on animal health problems affecting intra-Community trade in bovine animals and swine.” (3) In article 12 (tuberculosis testing) in paragraph (9) omit the definition of “loss of tuberculosis-free status”.
