BAHADUR, SERENDIB INVESTMENT PTE LTD, (Government Printer), Suva, Fiji – 2021 155/FGGS/21—269 Official Printer Since 2019 [LEGAL NOTICE NO. 95] AGRICULTURAL LANDLORD AND TENANT ACT 1966 Agricultural Landlord and Tenant (Exemption) (Amendment) Regulations 2021 IN exercise of the powers conferred on me by section 58 of the Agricultural Landlord and Tenant Act 1966, I hereby make these Regulations— Short title and commencement 1.—(1) These Regulations may be cited as the Agricultural Landlord and Tenant (Exemption) (Amendment) Regulations 2021. (2) These Regulations come into force on the date of publication in the Gazette. Regulation 5A inserted 2. The Agricultural Landlord and Tenant (Exemption) Regulations 1967 is amended after regulation 5 by inserting the following new regulation— “Exemption from a provision of section 9 of the Act 5A. Section 9(1)(e)(ii) of the Act shall not apply to any contract of tenancy of an agricultural holding subsisting at or after 29 December 1967 in relation to land where the Government or the iTaukei Land Trust Board is the landlord— (a) for the purposes of dealing with the contract of tenancy by way of mortgage, charge, pledge or caveat; or (b) if there is no breach of any lease condition or where such application to deal with the land is in accordance with any law.”.
