'J", )J +-Ot,-.. f..,wl•ll. ~!flJ.A :: PROCLAMATI9N-No. 219 OF 1981 A PROCLAMATION TO PROVIDE FOR THE ESTABLISHMENT OF WATER SUPPLY AND SEWERAGE AUTHORITY " ETIDOPIA TIKDEM " \VHEREAS, it is necessary to provide for the supply of pure water and appropriate sewerage systems to the broad mas ses of Ethiopia; WHEREAS, the provision of water supply service and the establishment of sewerage. system in a planned and· coordinated manner necessitates the establishment at the national level of a government organization; NOW, THEREFORE, in accordance with Art. 5 (6) of the Redefinition of Powers and Responsibilities of the Provisional Military Administrative Council· and the Council of Ministers Proclamation No. 110/1977. it is hereby proclaimed as follows: 1. Keeping of Accounts The Authority shall keep accurate books of acc6~ts and such other financial documents. 12. Power to Issue Regulations The Commissioner may issue regulations for the better implementation of the provisions of this Proclamation. 13. Penalty Any person who violates the provisions of this Proclam ation and regulations issue.d hereunder shall be· punishable in accordance with the Penal Code. 14. DPII c;,:t- f, r.r 1}'} 01{11 ! \ nJ'r• {\f\(1)<'/c; 'i!l\ii. h.'1 A~fr':t- h.m:J>~ ·· ---· , -,- ,, P' ti.OJ"} h 1-f..-t-mfi<I• tP't 1 In this Proclamation : 1) "Commission" means the National Water Resources Commission; 2) "Commissioner" means the Commissioner of the National Water Resowces Commission; 3) "domestic 1;1se" means the use of water for drinking, cooking, sanitation, gardening plot, watering cattle or other domestic purposes; 4) "municipal use" means the use of water in urban centres other than for domestic purposes; 5) "person" means any natural or juridical person; 6) "restricted area" means an area delimited for the · acth>i.ties of the· Authority which however may be used by other persons upon permission of the Autho rity; 7) "prohibited area" means an area. defunited by the Authority the use of which is prohibited to persons other than the Authority; 8) · "sewage" means liquid effluents discharged from .domestic, industrial and other sources; 9) "sewer ...,;orJcs" means any construction or appliance used or constx'ucted for collecting, treating and dispos. ing of sewage; 10) "sewerage service" means.the colle.ction, treatmen,t an4 disposal of sewag~ 11) "water supply service" means the prqv!Sion of water supply for domestic or municipal uses; 12) "water works" means any construc,tion or appli~ce. used or consmicted for· utilizing water for domestic or municipal purposes. 3. Establishment 1) There is hereby established a Water Supply and Sewe rage Authority (hereinafter the "Authority") as an autonomous government organization having its own juridical personality. · 2) The Gommissioner shall be the supervising ·authority cy. the Authoricy". 4. Head Office The Authority. shall have its head office in Addis Ababa ail.d may establish branch offices elsewhere as necessary. 5. Objectives of the Authority The objectives of the Authority shall be to provide water supply and sewerage · services throughout Ethiopia. 6. Appointme!1t of a General Manager The Authority shall have ,a . General Manager to be ap pointed by the Government upon the recommendation of the Commissioner. 9. The General Manager 1) The General • Manager shall be the chief executive of the Authority and shall, in. accordance with the gene ral directives issued to hlm by the Commissioner, be responsible for ,the proper execution of the activities of the Authority. 2) The General Manager shall exercise . the powei:s and duties of the Authority referred to under Article 7 of this Proclamation. 3) Without limiting the generality referred tio under sub article 1 of this Article, the General Manager shall, in particular, carry out the following: a) e1p.ploy, promote, transfer, administer, dismiss personnel and fix their salaries and allowances in accordance with public service laws; b) prepare and submit to the Commissioner short and long term plans of ~e Authority; c) prepare and submit ,to• the Commissioner annual budget and work programme as well as activity and financial reports of the Authority pursuant to the Regulation and Coordination of Public Financial Operations Proclamation No. 163/ 1979; d) effect expenditure in acoordance with the approv ed budget and work programme of the Authority; e) select officials of the Authority who are account able to him and recommend them to ilie Com missioner for awointment; . , f) collect and compile data and statistics "pertaining to the activities of the Authority; ·g) represent the Authority in its relations with other persons. 4) The General Manager may delegate part of bis powers and duties to the ·employees of the Authorizy to the extent J:\ecessary for the efficient Jl!anagement of the activities of the Authority; provided however, that the person who acts on behalf of the General Manager in the absence of ·the latter shall be subject to the prior !pproviµ of the Commissioner. 10. ,Source of Budget The budget of the Authority shall be .drawn from the fol lowing sources; . a) government allocated budget; b) fees and charges to be collected by the Authority; and c) mnnP.v nht:iine<l f:-nm r.!hr ,. ~,.,nrr-1':l'.
