P.~t 726~ PROCI.MIATION No. 81812014 " PRQCJ :\rH,)TIQN TO rROYlnE t'PS BfGISTB·\TION pF I IR6,\" I .\NQI!OI DING WHEREAS, it is desired to realize, the rights of Ethiopians 10 immovable property they build on Ihc land as provided under Article 40(7) of the Constitution of the Pederal Democratic Republic of Ethiopia. and their right to use land in urbans; WHEREAS, registration of urban land has become a fundament al institutional requis ite to generate reli able information for the country' s economy which will. be utilized for the required service, especially, to give security for the p('Issession right of citizens, and ther.eby accelerate economic, social and envi ronmental development o f cit ies; WHEREAS, it has become necessary to minimize disputes arised related to land and immovable property, establish transparent and ac~:ou lltnb lc worhillg system and making governmenl services efficient and enable Ihe possessor to enjoy lilt.: property he develops in accol1h.lIlce wi th law; WHEREAS, it has become necessary to put in place legal framework which is up-to-dale, efficient. compatible with market transaction th at facilit<ltc reg istration of rights, restrictions and responsibililies relating to land and immovable property and to enhance the contribu tion of land and immovable property to the development of free market economic system and to certi fy land and immovable property right to the possessor, who develops on Ihe land, and 10 ensure hi s possession securil Y; WHEREAS, it has become necessary 10 implement legal cadastre principles such as registration of possession, getting th e consent of the possessor durin g transaction , making registration of possession open to public, clearly iden ti fy ing the possession and the possessor through unique identificalion codes: NOW, TH EREFORE, in acco rdance with Article 55(2)(a) of the Constitution of the Federal Democratic Republi c of Ethiopia, it is hereby .'proclaimed,as foll ows: 'l .. Short Title PMU ONE GENERAL This Proclamation may be Landholding Registration 818/2014". Definitions cited as the "Urban Proclanlation No. Unless the contexl otherwise requires. in this Proclamation: II "urban center" means any locality having a mun icipal adm inislralion or designaled as an urban cent er by lega lly authorized body; 21 "urban land" means land located within the admini strati ve boundary of an urban cente r of any region; 31 " landhold ing" means a use righl on an urban land acquired in accordance with Ihe land lease law or an old urban land possession recognized by the lease law; " 41 "urban administration" means an organ establ ished by law or delegated by appropriale body 10 exercise the powers and fun cti ons of urban administration; 51 "legal cadastre" means an updated landh olding information system con lain in!,! a record of the rights, restr ict ions and responsibilities on a defined legal boundary for each landhold ings demarealed as parcel on map; 61 "syslematic landholding adjud icalion" means a process of ascertaining existing rights on landholdi ngs within a defined landholding adjudication neighborhood; 71 "sporadic landholding adjudication" means a process of ascertaining periodically existing holding right in a landholding adjudi cation neighborhood based on sequenti al order of the submission of the request by the holder; 81 "block partilion" means a plan block drawn up in linc whh roads and line features according to the standard prepared for block partition and conta ining one o r more holdings within the lower administrative unit of an urban center; 91 "unique parcel identi fr cation code" 1llcans the unique code or number by which a parcel located in an urban center is uniquely identifi ed; II "I)lI\,,.C "'!(I)-.... ~ IIC;J-" "'1/1')' O~,')~: h' /. 0'1 II "'I.Ii'l.Y: I' .e. ,I ;:/. I 01 "cadastre index map" means maps of block partitions prepared for landholding adjudication to be conducted in an wrban center or maps of a landholding adjudication neighborhood with serial name, and number according to the map naming standard; . I 1/ "parcel" means an area of land its boundary extent is clearly defined and demarcated on the ground and drawn upon a map with rights having a unique parcel identification code; 121 "landholding adjudication section" means a landholding adjudication area at a lower level of a urban administration comprising not more than five adjudicati on neighborhood with not more than one thousand parcels, recognized by the urban administration and to which a unique section code is assigned; 131 "landh olding adjudication neighborhood" means a landholding adjudication area having clearly identified boundary on the ground and on line map and containing consecutive number and identification name in which systematic adjudication activity is carried out; 141 "holding right certificate" means a document of title issued by the registering institulion confirming holding right that emanate from land use; 151 "cadastral survey" means a method o f . measuring landholding boundary on the field using land surveying instrum ent or through photogrammetric means; 161 "surveyor with special permit" means a surveyor entrusted by the authorized body of an urban administration with the responsibility to carry out cadastral surveying; 171 "cadastral surveyor" means a person who is registered and issued a license as a surveying professional by the appropriate organ according to the professional compelency s tandards issued for this purpose; 181 "registrati on" means the process by which a landholding righl. restnctlOn, and responsibility is registered in the legal cadastre register; 191 "appropriate body" means the Federal Urban Real Property Registration and In fonn at ion Agency or an organ established or designated at regional level to supervise urban landholdi ng registration alld in form ation registering in stituti ons; tt Xlt~,~~;r; t.,.f../..A. " 201 211 "registering institution" means all organ established or designated by a region at appropriate level to undertake registration of urban land and immovable property information and is accountable to the appropriate body; "adjudication officer" means a person appointed by the government to verify landholding right during systematic adjudication in an adjudication section and in charge of organizing landholding information in the section; 221 "registration o fficer" means a person authorized by a region or by city administration to register landholding right, restriction and responsibilities and issue certificate of title in accordance with this Proclamation; 231 "cadastre base map" means a map prepared using ·Iand surveying or air photograph which shows administrative boundary, fence, road. boundary Jine of buiJding or house, river, Jake, land features, distribution of permanent survey points and similar objects: 241 " region" means any state referred to in Article 47(/) of the Constitution of the Federal Democratic Republic of Ethiopia and inc/udes the Addis Ababa and Dire Daw. city administrations; 251 "Ministry" means the Ministry of Urban Development, Housing and Construction; 261 "person" means any natural or juridical person; 271 any expression in the masculine gender includes the feminine. Prerequisites for l ,undhQldjng Ad iudiratioD In order to carry out adjudication of urban landholding right: 1/ Ihe adminislrati ve boundary of the urban center shall first be defined through line map; and 21 . the urban center plan wilh reference to administrative boundary shall be endorsed by the authori zed body as having a legally binding effect. PART TWO LEGAL CADASTRE Principle I I A cadastral base map, parcel map and cadastral index map which show features on the surface of the land shall be prepared on paper or paper and digital form on the basis of the national geodetic survey network. 21 A document specifying the right, restriction and responsibility of person having a land use right shall be prepared on paper or paper and digital form for each parcel. 31 Each parcel of land shall be assigned with a unique identifi cation code and this code shall interrelcite the components provided for under sub·article (I) and (2) of this Article. 41 Legal cadastre shall be established upon fulfillment of the requirements specified under sub·article (1), (2), and (3) of this Article are verified and registration is undertaken 10 accordance with Ihis Procl amation . 51 The legal cadastre, which shall be organized and kept in the reg istering insti tut ion. constitutes the primary evidcll ce for landholding certification purpose. ~. 11. ))/.\(I":y. t,1).'lil'l·C I" "I. III Landholding adjudication neighborhoods shall be specified sequentially through a public notice to be issued by a region or an urban administration. 11. Implementatjon of Landholding AdjudicatioQ System II Systematic landholding adjudication shall be implemented by government expense only for the purpose of establishing a legal cadastre system for the first time. 21 No systematic landholding adjudication may be performed out of the adjudication commune specified by a public notice to be issued by a region or urban administratj'on. 3/ The sporadic landholding adjudication shall be conducted by the application of interested party upon payment of service fee determined by the region. 12. Landholding Adjudication Neighborhood and Cadastre Index Map II In the implementation of s):>iL:lllatlc landholding adjudication. an index map of a landholding adjudication neighborhood designated by the urban administration . institution shall be prepared first. 21 Where the preparation of a map sheet 01' an adjudication neighborhood is ordered. it shall be prepared sequentially according to the national map design and cadastral index map standard. \3. The adjudication of landholdi ng right shall be suspended where it is proved that there is an injunction order of a legally authorized body issued before the publication of adjudication in the neighborhood is made public through public notice. The adjudication process may not be suspended where it is proved that the. injunction order referred to in sub-article (3) of this Article is issued after the landholding adjudication activity III the adjudication locality IS officially publicized through public notice. For the purposes of sub, article (I) and (4) of this Article. the respeclive region or urban administration shall determine the period in ' .. which the adjudication officer shall complete the work and leave out of an a~judication neighborhood. 14. AdjudicatioQ of Landholding Right II Adjudication of landholding right in an adjudication neighborhood shall be done by verifying the consistency of the evidence presented by the person claiming to be the right holder with the evidence of the organ that perm itted the right. 21 Where there is inconsistency between the evidences mentioned under sub-article (I) of this Article. Where two or more persons are registered as co-holders of a right on a single landholding, the verifying officer shall, unless proved otherwise, presume that each of the joint holders have equal share on the land and verify the right accordingly. No adjudication of a landholding right may be undertaken with respect to any person 's landholding held beyond the legally possessed parcel size. The adjudication of a landholding boundary shall be based on the boundary measurement as agreed upon by the adjacent land holders or, in the absence of such agreement, based on the decision of the Landholding Adjudication Grievance Handling Tribunal established under Article 17( I) of thi s Proclamation. Landholding issues which have not been settled pursuant to sub-article (3) of this Article shall be registered and retained in the regi ster of landholding disputes. 15. Adjudication through rubljc Participatiog I I 21 31 41 51 Before carrying out adjudication · in any adjudication neighborhood, the adjudication officer shall notify the holders ofland in the ' selected neighborhood and make them aware of the process. The registering institution shall cause the participation of public representatives as observers in the adjudication process. An Adjudication Grievance Handling Tribunal shalf be established al each lower leve' of administration from among representatives of the administration and the community. The organization and working procedures of the grievance handling tribunal shalf be determined by regulation to be issued for Ihe implementation of this Proclamation. Any person concerned and interesled in the adjudication process shall have the right to participate therein; when so ordered, he shall give testimony, present written or any other document or infonnation relating to adjudication. Where necessary. an advisory commission may be establ ished within the regions at the levels of kebele, wereda, urban center or zone for ensuring the effectiveness of the adjudicati on process through coordinating and supporting the task. The powers and duties of the commission shall be detennined by regulalion to be issued to implemenl this Proclamation, 17. Grieyance Procedyre and l)ecjsjoQ Making I I There shall be Adjudication Grievance Hand'ing Tribuna' to decide on comp'aints submitted against adjudication decisions in the neighborhood. 21 Any person aggrieved by a decision of the registering institution on adjudication matters may appea' to the grievance handling tribun al within fifteen working days from the date of announcement of the completion of adjudication. Cadastral su rvey control points shall get protection in accordance with regulation to be issued for the implementation of this Proclamation . 24. Survey Plap and Suryey Record Every ground cadastral survey shall describe the plan of the parcel by indicating the boundary measurements. The survey plan shall be accompanied by a field note prepared at the same place and time the survey is carried out. 25. Cadastre Surveyor JI A cadastral surveyor or a surveyor with special permit shall submit the survey dala to the registering institution in accordance with the job order prescri bed by the registering instituti on. 2/ A surveyor shall be liable for any damage caused to a land holder or the institution that ordered the work as a result of field survey data collected by using surveying equipments not calibrated. tested or certified. 26. An applicalion for regislralion of a right on a landholding shall clearly indicate the righi, restriclion and · responsibility as 10 be provided by the regulation 10 be issued hereunder and shall be accompanied by supporting documents. Preparation and Keeping of Registers 11 A landholding adjudication register, register of landholding right. register of landholdings in respect of condominium, register of encumbrances. register of fanners rural landholdings incorporated into urban center boundary, other necessary registers shall be prepared for the purpose of effecling registration of landholding right. 21 The registers stipulated under sub-article (I) of this AI1icle shall be prepared by using paper or on paper and in digital form, 31 The registering institution shall take due care to safeguard the legal cadastre information register kept on paper or in digital form from informatioll security risk. 41 The registers stipulated under sub-article (I) of this Article shall be prepared in accordance with a national standard which shall enable to uniquely identify the holder of the right nationwide, 32. Paper and Digjtal Registration II The paper register and the digital register effected in accordance with Article 31 (2) of this Proclamation shall have equal prohatory value. 21 31 Where there is difference or doubt bdwcen the two registrations pursuant to sub-article (I) of this Article, the paper register shall prevail over the digital register. Any person whose certificate of landholding right is lost, damaged or become useless due to different reasons may be issued with a replacement certificate. upon payment of serv ice fee determined by the region . Sub-Leasiog Where a land holder sub-leases. as may be decided by the government, to a third party. part or all of his holding right in respect of the part or the whole of the duration of the lease period, this right, restriction and responsibility shall be registered and certificate shall be given to the person to whome the right is transferred by sub-lease, ' Encumbrance and Attachment 1/ The registering institution shall, upon request, give evidence of proof of registration of the mortgage contract or the attachment relating to landholding registered pursuant to Article 30(5) of this Proclamation, 2/ Any person who has acquired a right in accordance with sub-article (I) of this Article shall submit the documents based on which the transferee acquired the right to be registered while applying for registration. Notjce of Registration to the Landholder. 1/ If a person acquired landholding righl gels his right registered, he shall notify to the holder, within five working days through the registered address of the landholding, by a veri fled copy of the regi stration confirm iog that the documents entered in the register have been accepted. 21 Any person who has the duty to notify pursuanl to sub-article (I) of this Article shall be liable for the damage that may be caused to the landholder or third parties because of his failure to comply with his registration duty. 40. Liability of the Registering Institution /I The registering institution shall be li able for damage caused to third parties who acted in good faith relying on the proof of registrati on of right. restflctlon or responsibility on a registered landholding. 21 Nothing shall affect the right of the regi stering institution to make a claim against any person who benefited illegall y or against his own officers and employees at fault. 41. Prior Right II Where two or more persons have acquired from the same person a right subject to registration. the one whose right is first registered in the register of landholding shall have priority. 21 The right of the second person may not be registered in so far as it is in conflict to the right which has been first registered. 31 41 Nothing shall affect the rights of such second person agai nst the person from whom he has acquired the landholding right. Where the rights. restrictions. and responsibilities registered are equally old or the priority of one in relation to the other cannot be established, preference shall be given to that number of the registration which in the register comes before. 44. CQrrection and Cancellatjon of RegistratioQ I I Any enlry in a register pursuant to Ihis Proclam ation may be corrected based on Ihe . request of Ihe person who caused ils registration, by the judgment of a court or an appropriate organ or by the agreement of persons interested in ·the matter subject to correction. 21 Where the cancellation of registration is ordered by court or appropriate organ, the righls, restroctlons and responsibililies entered in the register shall be cancelled therefrom, 31 A registered right, restriction and responsibilities may be cancelled by Ihe decision of the regislering institution of its own motion only where the said right, restriction, and responsibility was created for a definite period and such period has lapsed, 4/ The grounds under which and the manner in which the registering institution may correct . or recti fy a registralion by its own motion shall be determined by regulation S/ Any correction and cancellation of a registered right, restriclion, and responsibilities shall be effective as of the date of the act. 46. Ignorance of D Registration 11 It shall be inadmissible for any person to claim based on the fact that he did not know of th'e registration of rights, restriction, and responsibility entered in the registers specified under Article 31(I} of this Proclamation and made open to the public. 21 Where the ignorance of regislratitln is resulted by the employee of the inslitution or regislering officer or official of Ihe institution •. they shall be liable for the damage resulted to the person referred to under sub-article (I) of this Article. 47.
