gA ፲፯ሺ፮፻፳፭ Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 th January, 2025..page 17625 እነዚህን ዓላማዎች ተግባራዊ ለማድረግ WHEREAS, to be able to attain these የተቀናጀ ቋሚና ዘላቂነት ያለው የሀገር ውስጥ objectives, it is vital to establish a coordinated የፋይናንስ ምንጭ በመመደብና በማሰባሰብ and sustainable financing from domestic ሁሉም ክልሎች ፍትሃዊ በሆነ መንገድ sources and put in place mechanisms to ተጠቃሚ የሚሆኑበትን አሰራር መቀየስ allocate funds to all regions in equitable ways ተገቢና ለዚህም የአረንጓዴ አሻራ እና and for this to happen it is found necessary to የተጎሳቆለ መሬት ማገገሚያ ልዩ ፈንድ establish Green Legacy and Degraded ማቋቋም አስፈላጊ ሆኖ በመገኘቱ፤ Landscape Restoration Special Fund; በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ NOW, THEREFORE, in accordance with ሪፐብሊክ ሕገ- መንግሥት አንቀጽ ፶፭ ንዑስ Article 55 Sub-Article (l) of the Constitution of አንቀጽ (፩) መሠረት የሚከተለው ታውጇል፡፡ the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows. ክፍል አንድ PART ONE ጠቅላላ ድንጋጌዎች GENERAL PROVISIONS ፩. አጭር ርዕስ l. Short Title ይህ አዋጅ “የአረንጓዴ አሻራ እና የተጎሳቆለ This Proclamation may be cited as “The መሬት ማገገሚያ ልዩ ፈንድ ማቋቋሚያና Green Legacy and Degraded Landscape አስተዳደር አዋጅ ቁጥር ፩ሺ፫፻፷፩/፪ሺ፲፯” Restoration Special Fund Establishment and ተብሎ ሊጠቀስ ይችላል፡፡ Administration Proclamation No.1361/2024”. ፪. ትርጓሜ 2. Definitions የቃሉ አግባብ ሌላ ትርጉም የሚያሰጠው Unless the context requires otherwise, in this ካልሆነ በስተቀር በዚህ አዋጅ ውስጥ፦ Proclamation: ፩/ “ክልል” ማለት በኢትዮጵያ ፌደራላዊ 1/ “Region” means a region designated by ዲሞክራሲያዊ ሪፐብሊክ ሕገ- መንግሥት Article 47 of the Constitution of the አንቀጽ ፵፯ በተደነገገው መሰረት Federal Democratic Republic of Ethiopia ማንኛውም ክልል ሲሆን የአዲስ አበባና and for the purpose of this Proclamation, የድሬዳዋ ከተማ አስተዳደርን ይጨምራል፤ it also includes the Addis Ababa and Dire Dawa City Administrations; ፪/ “የሚመለከተው የስራ ክፍል” ማለት 2/ “Responsible Department” means the በገንዘብ ሚኒስቴር የተባበሩት United Nations Agencies, Climate መንግሥታት ተቋማት፣ ለአየር ንብረት Resilient Green Economy Facility and የማይበገር አረንጓዴ ኢኮኖሚ ፋሲሊቲ Regional Economic Cooperation እና የአህጉራዊ ኢኮኖሚ ትብብር የሥራ Department within the Ministry of ክፍል ነው፤ Finance;

፲፯ሺ፮፻፳፮ th gA Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 January, 2025..page 17626 ፫/ “አረንጓዴ አሻራ” ከ፪ሺ፲፩ ዓ.ም ጀምሮ 3/ “Green Legacy” means a program that በመካሄድ ላይ የሚገኝ ዘርፈ ብዙ ጠቀሜታ has been implemented since 2019 aiming ያላቸው ከአካባቢ ጋር ተስማሚ የሆኑ ቋሚ at planting ecologically friendly ዕጽዋትን በሕብረተሰብ ተሳትፎ የማልማት multipurpose perennial species through ፕሮግራም ነው፤ citizen mobilization; ፬/ “የተጎሳቆለ መሬት” ማለት የሥርዓተ-ምህዳር 4/ “Degraded Landscape” means land that አገልግሎቱ የቀነሰና ምርታማነቱን ያጣ its ecological services diminished and has በመሆኑ የማገገም ስራዎች ሊሰሩበት የሚገባ lost its productivity, and significantly and መሬት ነው፤ requires restoration; ፭/ “የተጎሳቆለ መሬት ማገገም” ማለት 5/ “Restoration of Degraded Landscape” የተጎሳቆለ መሬትን ለደን ልማት እና refers to the restoration of degraded ለጥምር ደን ግብርና እንዲውል ማድረግ landscape for afforestation and ነው፤ agroforestry purposes; ፮/ “ቀመር” ማለት በፌደራል መንግሥት 6/ “Formula” means the calculation used to ለክልሎች ከተመደበው የልዩ ፈንዱ በጀት determine the share of each region from ላይ የያንዳንዱን ክልል ድርሻ ለመወሰን the budget allocated to the regions from የሚያገለግል ስሌት ነው፤ the special fund; ፯/ “ተጓዳኝ በጀት” ማለት ክልሎች የልዩ 7/ “Matching budget” means a budget that ፈንዱን ዓላማ ለማሳካት ከክልላቸው ገቢ regions allocate every year from their በየዓመቱ በልዩ ፈንዱ ለሚደገፉ ፕሮጀክቶች regional revenue to projects, which are የሚመድቡት በጀት ነው፤ supported by the special fund to achieve the purpose of the special fund; ፰/ “ተጠቃሚ አካላት” ማለት በልዩ ፈንዱ 8/ “Accessing Entities” means Federal የሚደገፉ ፕሮጀክቶችን የሚተገብሩ የፌደራል government institutions and regions, that መንግሥት ተቋማት እና ክልሎች ሲሆኑ implement projects supported by the በዚህ አዋጅ አንቀጽ ፰ ንኡስ አንቀጽ (፪) special fund, and includes other entities መሠረት አብይ ኮሚቴው ለዚህ አላማ that meet the criteria set by the steering የሚያወጣውን መመዘኛ የሚያሟሉ ሌሎች committee for this purpose in accordance አካላትን ይጨምራል፤ with Article 8 Sub-Article (2) of this Proclamation; ፱/ “የልማት አጋሮች” ማለት ለልዩ ፈንዱ 9/ “Development Partners" means የፋይናንስ፣ የቴክኒክና የዓይነት ድጋፍ international institutions, governments, የሚሰጡ ዓለም አቀፍ ተቋማት፣ non-governmental organizations, and መንግሥታት፣ ግብረሰናይ ድርጅቶችና foundations that provide financial, ፋውንዴሽኖች ናቸው፡፡ technical, and in-kind support to the Special Fund.

፲፯ሺ፮፻፳፯ th gA Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 January, 2025..page 17627 ክፍል ሁለት PART TWO ስለልዩ ፈንዱ መቋቋም Establishment of the Special Fund ፫. መቋቋም 3. Establishment ፩/ የአረንጓዴ አሻራ እና የተጎሳቆለ መሬት 1/ The Green Legacy and Degraded ማገገሚያ ልዩ ፈንድ (ከዚህ በኋላ “ልዩ Landscape Restoration Special Fund ፈንዱ” እየተባለ የሚጠራ) በዚህ አዋጅ (herein after referred to as “the Special ተቋቁሟል፡፡ Fund”) is hereby established by this Proclamation. ፪/ ልዩ ፈንዱ ቋሚ የፋይናንስ ምንጭ ሆኖ 2/ The Special Fund shall serve as a ለዚህ አዋጅ አላማ ማስፈጸሚያ ይውላል፡፡ permanent source of finance to achieve the objectives of this Proclamation. ፬. የልዩ ፈንዱ አላማዎች 4. Objectives of the Special Fund ልዩ ፈንዱ የሚከተሉት ውስን ዓላማዎች The Special Fund shall have the following ይኖሩታል፦ specific objectives: ፩/ የተጎሳቆለ መሬት በተፈጥሮና በመልሶ 1/ Support the restoration of degraded ማልማት መርህ በመታገዝ እንዲያገግም landscape through assisted natural በማድረግ የደን ልማት እና የደን መልሶ regeneration and afforestation and ማልማትን መደገፍ፤ reforestation to develop and restore forests; ፪/ በአረንጓዴ አሻራ መርሃ ግብር እና በዜጎች 2/ Enhance the sustainability and ተሳትፎ የተተከሉ ችግኞች እና ያገገሙ productivity of planted seedlings and መሬቶች ውጤታማ እንዲሆኑና ዘለቄታ restored landscapes through citizens እንዲኖራቸው መደገፍ፤ mobilization and the Green Legacy initiative; ፫/ የደን ልማትና የደን ጥበቃ እንዲሁም 3/ Create employment opportunities and ተዛማጅ የሥርዓተ-ምህዳር አገልግሎቶችን sustainable livelihoods in particular for በማሻሻል ለዜጎች በተለይም ለወጣቶችና the youth and women through forestry ሴቶች ዘላቂነት ያለው የሥራና development, protection of forests የመተዳደሪያ ስራ ዕድል መፍጠር፤ improvment of ecological services; ፬/ ከአካባቢ ጋር ተስማሚ የሆኑ ቋሚ 4/ Develop riverbanks, areas around dams ዕጽዋትን መሰረት በማድረግ የወንዞች፣ and other water bodies through locally የግድቦችና ሌሎች የውሃ አካላት adaptable perennial plants; ዳርቻዎችን መልሶ ማልማት፤ ፭/ የከተማ ማስዋብና አረንጓዴ ልማት 5/ Support urban beautification and ሥራዎችን መደገፍ፤ greenery;

፲፯ሺ፮፻፳፰ th gA Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 January, 2025..page 17628 ፮/ ሀገራችን በዓለም አቀፍ ደረጃ የደን ዘርፍን 6/ Contribute to the realization of Ethiopia’s ማዕከል ባደረገ መልኩ ለማሳካት international forest sector- goals, ያቀደቻቸውን ግቦች፣ በተለይም የካርቦን especially the objective of lowering ልቀት ቅነሳ ግብ እንዲሳካ አስተዋጽኦ carbon emissions; ማድረግ፤ ፯/ ከልማት አጋሮች ለደን ልማትና ጥበቃ 7/ Mobilize additional resources from የሚገኝ ድጋፍ እንዲጨምር ማድረግ፤ development partners for forest development and conservation; ፰/ በልዩ ፈንዱ ከለማ ደን በዓለም አቀፍ 8/ Enable Ethiopia to benefit from an የካርቦን ግብይት ሀገራችን ተጠቃሚ international carbon financing mechanism እንድትሆን ማስቻል፤ from forests developed by the special fund; ፱/ ከአየር ንብረት ለውጥ ቅነሳ እና ሥርዓት 9/ Support climate change adaptation and ጋር ተዛማጅነት ያላቸውን ምርምሮችና mitigation related capacity building, ፈጠራዎች መደገፍና አቅም መገንባት፡፡ research and innovations. ፭. የልዩ ፈንዱ የፋይናንስ ምንጮች 5. Finance Sources of the Special Fund ልዩ ፈንዱ ከሚከተሉት የፋይናንስ ምንጮች The Fund shall be collected from the የተውጣጣ ይሆናል፦ following financing sources: ፩/ የፌደራል መንግሥት ከሚመድበው በጀት፤ 1/ Budgetary allocations by the Federal Government; ፪/ ከልማት አጋሮች፣ ከሲቪክ ማህበረሰብ እና 2/ Support from development partners, civil ከግል ዘርፍ ከሚገኝ ድጋፍ፡፡ society and the private sector. ፮. የፈንዱ ተሰብሳቢ ገንዘብ መጠንና ገንዘቡን ገቢ 6. Proportion and Depositing of the Special ስለማድረግ Fund ፩/ በዚህ አዋጅ አንቀጽ ፭ ንዑስ አንቀጽ (፩) 1/ The budget to be allocated to the special መሠረት ለልዩ ፈንዱ የሚመደበው ገንዘብ fund by the Federal Government as per የፌደራል መንግሥት በየዓመቱ ከሀገር Article 5 Sub-Article (1) of this ውስጥ ገቢ ምንጭ ከሚመድበው ዓመታዊ Proclamation shall be between 0.5 to 1.0 በጀት ውስጥ ከዜሮ ነጥብ አምስት እስከ percent of the annual budget allocated by ፩ በመቶ ያህል ይሆናል፡፡ የፌደራል the Federal Government from domestic መንግሥት ለልዩ ፈንዱ የሚመድበው revenue sources. ዓመታዊ በጀት የፌደራል መንግሥት allocation to the special fund shall be ዓመታዊ በጀት አካል ሆኖ በሕዝብ approved by the House of People's ተወካዮች ምክር ቤት ይጸድቃል፡፡ Representatives as part of the annual Federal Government budget. gA ፲፯ሺ፮፻፳፱ Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 th January, 2025..page 17629 ፪/ በዚህ አዋጅ አንቀጽ ፭ ንኡስ አንቀጽ (፩) 2/ The budget allocated to the special fund መሠረት ፌደራል መንግሥት ለልዩ ፈንዱ by the Federal Government as per Article ከሚመድበው በጀት የሚሰበሰበው ገንዘብ 5 Sub-Article (1) hereof shall be ለልዩ ፈንዱ በተከፈተው የባንክ ሂሳብ deposited every Three months into the በየሦስት ወሩ በገንዘብ ሚኒስቴር bank account opened to the special fund ተቀማጭ ይሆናል፡፡ by the Ministry of Finance. ፫/ በዚህ አዋጅ አንቀጽ ፭ ንዑስ አንቀጽ 3/ Support mobilized from development (፪) መሠረት ከልማት አጋሮች፣ ከሲቪክ partners, civil society and the private ማህበራት እና ከግሉ ዘርፍ ለልዩ ፈንዱ sector for the Special Fund as per Article የሚደረገው ድጋፍ የሚተዳደርበት አኳኋን 5 Sub-Article (2) shall be administered in የገንዘብ ሚኒስቴር በሚያወጣው accordance with the procedures and መመሪያና የአሰራር ሥርዓት ይወሰናል፡፡ guidelines to be issued by the Ministry of Finance. ፯. የልዩ ፈንዱ የሀብት ክፍፍልና አለቃቀቅ 7. Allocation and Release of Funds ፩/ በዚህ አዋጅ አንቀጽ ፭ ንዑስ አንቀጽ (፩) 1/ The annual budget allocated by the መሠረት የፌደራል መንግሥት ለልዩ Federal Government to the special fund ፈንዱ የሚመድበው ዓመታዊ በጀት pursuant to Article 5 Sub-Article (1) የገንዘብ ሚኒስቴር በሚያወጣው መስፈርት hereof shall be appropriated to the Federal መሠረት ለፌደራል መንግሥት እና Government and the Regions in ለክልሎች ይደለደላል፡፡ accordance with the criteria set by the Ministry of Finance. ፪/ የገንዘብ ሚኒስቴር በዚህ አንቀጽ ንዑስ 2/ The Ministry of Finance shall prepare and አንቀጽ (፩) መሠረት ለክልሎች submit to the House of Federation for ከሚደለደለው በጀት ላይ የእያንዳንዱን approval, the formula to be used to ክልል ድርሻ ለመወሰን የሚያገለግለውን determine the share of each Region from ቀመር አዘጋጅቶ እንዲጸድቅ ለፌደሬሽን the portion of the budget of the Special ምክር ቤት ያቀርባል፡፡ ሆኖም Fund appropriated to the Regions in ለመሸጋገሪያ የፌደሬሽን ምክር ቤት accordance with Sub-Article (1) hereof.

Accessing Entities of the Special Fund ፩/ በልዩ ፈንዱ የሚደገፉ ፕሮጀክቶችን 1/ The Federal government institutions and የሚያስፈጽሙ የፌደራል መንግሥት the regions that implement projects አካላት እና ክልሎች ከልዩ ፈንዱ supported by the special fund shall በቀጥታ ተጠቃሚ ይሆናሉ፡፡ directly access from the special fund. ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) 2/ In addition to those mentioned in Article 8 ከተደነገገው በተጨማሪ አብይ ኮሚቴው Sub-Article (1) above, the Steering በሚያወጣቸው መመዘኛዎች መሠረት committee may set criteria to allow other ሌሎች አካላት ከልዩ ፈንዱ ተጠቃሚ entities to have direct access to the ሊሆኑ ይችላሉ፡፡ Special Fund. ፱. ስለ ልዩ ፈንዱ ሂሳብ 9. Account of the Special Fund ፩/ ተጠቃሚ አካላት በልዩ ፈንዱ ድጋፍ 1/ Accessing Entities shall keep an accurate የሚተገብሯቸውን ፕሮጀክቶች የሂሳብ and complete book of account of projects መዛግብትና ገንዘብ ነክ ሰነዶች implemented with financial support በተመለከተ ትክክለኛና የተሟላ የሂሳብ obtained from the Special Fund. መዛግብት መያዝ አለባቸው፡፡ ፪/ ተጠቃሚ አካላት የበጀት ዓመቱ 2/ Accessing entities shall prepare a በተጠናቀቀ በአንድ ወር ውስጥ financial statement showing the use of the ከፌደራል መንግሥት የተላለፈላቸውን money of the special fund transferred to የልዩ ፈንዱን ገንዘብ አጠቃቀም them by the Federal Government, within የሚያሳይ የሂሳብ ሪፖርት አዘጋጅተው One month of the end of the fiscal year

ለገንዘብ ሚኒስቴር ያቀርባሉ፡፡ and submit same to the Ministry of Finance. ፫/ የገንዘብ ሚኒስቴር በዚህ አንቀጽ ንዑስ 3/ The Ministry of Finance shall consolidate አንቀጽ (፪) መሠረት ከተጠቃሚ አካላት the financial statements it receives from የሚቀበለውን የሂሳብ ሪፖርት በማጠቃለል accessing entities as per Sub-Article (2) of የልዩ ፈንዱን ሂሳብ ዘግቶ የበጀት this Article, close the account of the ዓመቱ በተጠናቀቀ በሦስት ወራት ውስጥ special fund and submit the consolidated በፌደራል ዋና ኦዲተር ወይም የፌደራል financial statement of the fiscal year to the ዋና ኦዲተር በሚወክለው ኦዲተር Federal Auditor General or the auditor እንዲመረመር ያደርጋል፡፡ designated by it for examination within Three months of the end of the fiscal year. gA ፲፯ሺ፮፻፴፪ Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 th January, 2025..page 17632 ፬/ የገንዘብ ሚኒስቴር በዚህ አንቀጽ ንዑስ 4/ The Ministry of Finance, as per አንቀጽ (፫) መሰረት የፌደራል ዋና Sub-Article (3) of this Article, shall ኦዲተር ወይም የፌደራል ዋና ኦዲተር submit the result of the audit report to the የኦዲት ምርመራ አከናውኖ የኦዲት Steering Committee once the federal ውጤቱን እንዳሳወቀው የኦዲት ሪፖርቱን auditor general or the auditor designated ለአብይ ኮሚቴው ያቀርባል፡፡ by it informs the results of the audit. ክፍል ሦስት PART THREE ስለ ልዩ ፈንዱ አስተዳደር Administration of the Special Fund ፲. የልዩ ፈንዱ አስፈጻሚ አካላት 10. Executive Organs of the Special Fund የፈንዱ አስፈጻሚ አካላት የገንዘብ Executive Organs of the special Fund are ሚኒስቴር፣ የግብርና ሚኒስቴር፣ የፕላንና the Ministry of Finance, the Ministry of ልማት ሚኒስቴር፣ የኢትዮጵያ ደን ልማት Agriculture, the Ministry of Planing and እንዲሁም የክልሎች የገንዘብ ቢሮዎች Development, the Ethiopian Forest ናቸው፡፡ Development and Finance Bureaus’ of the Regions. ፲፩. አብይ ኮሚቴ 11. The Steering Committee ፩/ ልዩ ፈንዱ አጠቃቀሙና አተገባበሩን 1/ The Special Fund shall have a steering በበላይነት የሚቆጣጠር አብይ ኮሚቴ committee overseeing its use and ይኖረዋል፡፡ Implementation. ፪/ የአብይ ኮሚቴው አባላት በዚህ አዋጅ 2/ Members of the steering committee shall አንቀጽ ፲ የተዘረዘሩት የልዩ ፈንዱ be heads of executive organs of the አስፈጻሚ አካላት የበላይ ኃላፊዎች special fund specified in Article 10 of ይሆናሉ፡፡ this Proclamation. ፫/ የገንዘብ ሚኒስትርና የግብርና ሚኒስትር 3/ The Ministers of Finance and Agriculture እንደቅደም ተከተላቸው የአብይ ኮሚቴው shall, in order of their sequence be the ሰብሳቢና ምክትል ሰብሳቢ ይሆናሉ፡፡ chairperson and vice chairperson of the steering committee. ፬/ የሚመለከተው የሥራ ክፍል የፈንዱን 4/ The responsible Department shall carry አስተዳደራዊ ስራዎች ያከናውናል out the administrative functions of the እንዲሁም የአብይ ኮሚቴው ፀሐፊ fund and serve as the secretary of the በመሆን ያገለግላል፡፡ steering committee.

Powers and Duties of the Steering Committee ፩/ አብይ ኮሚቴው የልዩ ፈንዱን 1/ Oversees the use and implementation of አጠቃቀምና አተገባበር ይቆጣጠራል፤ the Special Fund; ፪/ የልዩ ፈንዱን የፕሮግራም ማዕቀፍ፣ 2/ Approves the program framework, እስትራቴጂና መመሪያዎች ያጸድቃል፤ strategy, and directives of the Special Fund; ፫/ በልዩ ፈንዱ የሚደገፉ ፕሮጀክቶችን 3/ Approves projects to be supported by the ያጸድቃል፤ Special Fund; ፬/ የልዩ ፈንዱን አጠቃላይ አፈጻጸም 4/ Reviews the overall performance of the ይገመግማል፤ Special Fund; ፭/ የልዩ ፈንዱን የኦዲት ሪፖርት ውጤት 5/ Reviews the results of the Audit Report ያዳምጣል፤ በሪፖርቱ መሰረት ተገቢው of the Special Fund and ensures that እርምጃ መወሰዱን ያረጋግጣል፤ recommendations of the Audit report are duly implemented; ፮/ መቋረጥና መሰረዝ በሚገባቸው ፕሮጀክቶች 6/ Decides on projects that shall be ላይ ይወስናል፤ discontinued or canceled; ፯/ መመዘኛዎችን በማውጣት ተጨማሪ 7/ Sets criteria to allow more entities to አካላት ከልዩ ፈንዱ ተጠቃሚ እንዲሆኑ acecess from the special fund. ያደርጋል፡፡ ፲፫∙ የአብይ ኮሚቴው ስብሰባዎች 13. Meetings of the Steering Committee ፩/ የአብይ ኮሚቴው ስብሰባ በዓመት አንድ 1/ The Steering Committee shall have One ጊዜ ይካሄዳል፣ ሆኖም አስፈላጊ ሆኖ regular meeting annually. However, በመገኘቱ በሰብሳቢው ሲጠራ extraordinary meetings of the Steering በማንኛውም ጊዜ አስቸኳይ ስብሰባ Committee may be held at any time ሊያደርግ ይችላል፡፡ when called by the Chairman. ፪/ በማንኛውም የአብይ ኮሚቴው ስብሰባ 2/ The quorum shall be constituted when ላይ ከግማሽ በላይ አባላት ከተገኙ more than half the members are present ምልዓተ ጉባዔ ይሆናል፡፡ at any Meeting. ፫/ የአብይ ኮሚቴው ውሳኔ የሚተላለፈው 3/ Decisions shall be made by a majority በስብሰባው ከተገኙት አባላት በአብላጫው vote of those present. In case of a tie, the ድምጽ ሲደገፍ ነው፡፡ ሆኖም ድምጽ chairman shall have a casting vote. እኩል በእኩል የተከፈለ እንደሆነ ሰብሳቢው ወሳኝ ድምጽ ይኖረዋል፡፡

Powers and Duties of the Ministry of Finance የገንዘብ ሚኒስቴር የሚከተሉትን ሥልጣንና The Ministry of Finance shall have the ተግባር ይኖሩቷል፦ following powers and duties to: ፩/ ልዩ ፈንዱን ያስተዳድራል፤ 1/ Administer the Special Fund; ፪/ በፌደራል መንግሥት ለልዩ ፈንዱ 2/ Recommend the amount of the budget በየዓመቱ የሚመደበውን በጀት መጠን allocated to the special fund each year ያቀርባል፣ የፌደራል መንግሥት ዓመታዊ and ensure its approval as part of the በጀት አካል ሆኖ እንዲጸድቅ ያደርጋል፤ annual federal government budget; ፫/ የፌደራል መንግሥት ለልዩ ፈንዱ 3/ Prepare the formula on the basis of ከሚመድበው በጀት ላይ የክልሎች ድርሻ which the budget allocated by the ለያንዳንዱ ክልል የሚከፋፈልበትን Federal Government to the special fund ቀመር አዘጋጅቶ ለፌደሬሽን ምክር ቤት is distributed to each region, submit the ያቀርባል፣ ሲጸድቅም በስራ ላይ ያውላል፤ formula to the House of Federation for approval and implement same upon approval; ፬/ የፌደራል መንግሥት ተጠቃሚ አካላትና 4/ Sets the criteria for determining the share ክልሎች የፌደራል መንግሥት ለልዩ of the Federal Government and the ፈንዱ ከሚመድበው በጀት ላይ Regions from the Special Fund and የሚያገኙትን ጥቅል ድርሻ የሚወሰንበትን prepares the budget accordingly; መስፈርት ያዘጋጃል፣ በመስፈርቱ መሰረት የበጀት ክፍፍሉን ያዘጋጃል፤ ፭/ በፌደሬሽን ምክር ቤት ቀመር መሰረት 5/ Informs each Region of its share የሚወሰነውን የእያንዳንዱን ክልል ድርሻ determined according to the formula of ለየክልሉ ያሳውቃል፤ the House of Federation; ፮/ ልዩ ፈንዱ ለአምስት ዓመት የሚመራበት 6/ Ensures preparation of the National ሀገራዊ የፕሮግራም ማዕቀፍ በየአምስት Program framework of the Special Fund ዓመቱ ተዘጋጅቶ ለአብይ ኮሚቴው every Five years and submitted to the እንዲቀርብ ያደርጋል፤ Steering committee;

gA ፲፯ሺ፮፻፴፭ Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 th January, 2025..page 17635 ፯/ የልዩ ፈንዱን አስተዳደር፣ 7/ Issues Directives concerning the special ፕሮግራም/ፕሮጀክት አስተዳደር፣ fund administration, program/project የፋይናንስ አስተዳደርና ቁጥጥርን management and financial በተመለከተ መመሪያ ያወጣል፣ የአሰራር administration, develops operational ስርዓት ይዘረጋል፣ ከነዚህም ጋር በተያያዘ systems and conducts capacity-building የአቅም ግንባታ ስራዎችን ያካሂዳል፤ in connection therewith; ፰/ በተጠቃሚ አካላት የተዘጋጁ የፕሮጀክት 8/ Recommends to the steering committee ጽንሰ ሀሳቦችና የፕሮጀክት ሰነዶች the approval of Project concepts and በሚመለከተው አካል ተገምግመው project proposals prepared by accessing ሲቀርቡ በአብይ ኮሚቴው እንዲጸድቁ entities after reviewed by relevant የውሳኔ ሀሳብ ያቀርባል፣ የግምገማ institution and announces the evaluation ውጤቱን ያሳውቃል፤ results; ፱/ ተጠቃሚ አካላት ለጸደቁ ፕሮጀክቶች 9/ Ensures accessing entities to submit their ዓመታዊ የሥራ ዕቅድና የጥሬ ገንዘብ annual plan and cash flow needs for ፍላጎት እንዲያዘጋጁ ያደርጋል፣ በጀት approved projects and effect budget ይለቃል፤ transfer as per the approved annual work plan; ፲/ በልዩ ፈንዱ የሚተገበሩ ፕሮጀክቶችን 10/ Monitors and evaluates the performance አፈጻጸም ይከታተላል፣ ይገመግማል፣ of projects financed by the Special Fund አጠቃላይ ሪፖርት ያዘጋጃል፤ and produces a consolidated report; ፲፩/ ከልማት አጋሮች፣ ከሲቪክ ማህበራት 11/ Mobilizes additional resources for the እና ከግል ዘርፍ ለልዩ ፈንዱ ድጋፍ Special Fund from development ያሰባስባል፤ partners, civil societies, and the private sector; ፲፪/ ከዓለም አቀፍ የካርቦን ንግድ ተጠቃሚ 12/ Facilitates the conditions and makes መሆን እንዲቻል በልዩ ፈንዱ የሚደገፉ agreements with the relevant parties for ፕሮጀክቶችን መሰረት በማድረግ projects supported by the special fund to ከሚመለከታቸው አካላት ጋር benefit from international carbon trade; ሁኔታዎችን ያመቻቻል፣ ስምምነት ይፈጽማል፤ ፲፫/ በዚህ አዋጅ አንቀጽ ፱ ንዑስ አንቀጽ 13/ Ensure the Special Fund to be audited (፫) መሠረት ልዩ ፈንዱን ኦዲት in accordance with Article 9 Sub-Article ያስደርጋል፤ (3) hereof; ፲፬/ የልዩ ፈንዱን አብይ ኮሚቴ 14/ Chair the special fund steering በሰብሳቢነት ይመራል፡፡ committee.

Powers and Duties of the Ministry of Agriculture ፩/ የልዩ ፈንዱን አብይ ኮሚቴ በምክትል 1/ Serves as a vice chairman of the Steering ሰብሳቢነት ይመራል፤ Committee; ፪/ የልዩ ፈንዱን የቴክኒክ እስታንዳርድና 2/ Issues directives on technical standards አሰራር መመሪያ ያወጣል፣ ትግበራውን and implementation manuals for the ይከታተላል፣ የአቅም ግንባታ ሥራዎች Special Fund follow up its ይሰራል፤ implementation and conduct capacity building in connection herewith; ፫/ ልዩ ፈንዱ ለአምስት ዓመት 3/ Prepares the Five-year national program የሚመራበትን ሀገራዊ የፕሮግራም framework that guides the special fund ማዕቀፍ በየአምስት ዓመቱ ከኢትዮጵያ in conjunction with the Ethiopian ደን ልማት ጋር በመሆን Forestry Development and with the የሚመለከታቸውን በማሳተፍ ያዘጋጃል፤ participation of the relevant stakeholders; ፬/ በዚህ አዋጅ ለኢትዮጵያ የደን ልማት 4/ Follows up, oversees and renders support የተሰጡ ተግባራትንና ሀላፊነቶችን to the Ethiopian Forestry Development ይከታተላል፣ በበላይነት ይቆጣጠራል፣ in connection with the discharge of ድጋፍ ያደርጋል፡፡ functions and responsibilities assigned to it in this Proclamation. ፲፮. የፕላንና ልማት ሚኒስቴር ሥልጣንና ተግባር 16. Powers and Duties of the Ministry of Planning and Development ፩/ የልዩ ፈንዱን የፕሮግራም ማዕቀፍ ዕቅድ 1/ Appraise the Program framework plan of ይገመግማል፣ የግምገማውን ውጤት the Special Fund and notify the result; ያሳውቃል፤ ፪/ የልዩ ፈንዱን የፕሮግራም ማዕቀፍ 2/ Undertakes mid-term and terminal አፈጻጸም የመካከለኛና ማጠናቀቂያ evaluation on the implementation of the ግምገማ ያከናውናል፡፡ Program framework of the Special Fund. ፲፯. የኢትዮጵያ የደን ልማት ስልጣንና ተግባር 17. Powers and Duties of the Ethiopian Forestry Development ፩/ የልዩ ፈንዱ የፕሮጀክት ጽንሰ ሀሳብና 1/ Causes the submission of concept notes የፕሮጀክት ሰነድ እንዲቀርብ ያደርጋል፣ and project documents, reviews together ከሚመለከታቸው ተቋማት ጋር በመሆን with relevant inistitutions and submit its ይገመግማል፣ የውሳኔ ሀሳብ ለገንዘብ recommendations to the Ministry of ሚኒስቴር ያቀርባል፤ Finance;

gA ፲፯ሺ፮፻፴፯ Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 th January, 2025..page 17637 ፪/ በልዩ ፈንዱ ሊለሙ የሚችሉ ቦታዎች 2/ Prepares technical guidelines for site የሚለዩበትና የሚተከሉ የችግኝ ዝርያዎች selection and identification of species to የሚመረጡበትን አሰራር ያዘጋጃል፣ be planted by projects supported by the ክልሎችን ይደግፋል፤ Special Fund, and provide support to the Regions; ፫/ በልዩ ፈንዱ የሚተገበሩ ፕሮጀክቶች 3/ Gathers baseline data and put in place a ከዓለም አቀፍ የካርቦን ገበያ ተጠቃሚ Measurement, Reporting, and መሆን እንዲችሉ አስፈላጊውን የመነሻ Verification (MRV) system for projects እና የልኬት፣ የሪፖርት እና የማረጋገጥ financed by the Special Fund to benefit ሥራዎች እንዲጠናቀቁ ያደርጋል፤ from international carbon markets; ፬/ በልዩ ፈንዱ ድጋፍ የሚተገበሩ 4/ Prepares report on the socio-economic ፕሮጀክቶች ያስገኙትን ኢኮኖሚያዊና and ecological significance as well as on ማህበራዊ፣ የካርቦን ልቀት ቅነሳ እና carbon emission reduction contributions ሥርዓተ-ምህዳራዊ ጠቀሜታ ሪፖርት of projects financed by the Special ያዘጋጃል፤ Fund; ፭/ በዚህ አዋጅ የተሰጡትን ተግባራትና 5/ Conducts capacity building activities to ሀላፊነቶች ለመወጣት የሚያስችሉ discharge the functions and የአቅም ግንባታ ሥራዎችን ያከናውናል፡፡ responsibilities assigned to it in this Proclamation. ፲፰. ተጠቃሚ የፌደራል መንግሥት ተቋማት 18. Accessing Entities of the Federal Government በልዩ ፈንዱ ተጠቃሚ የሆኑ የፌደራል Accessing entities of the Federal መንግሥት ተቋማት የሚተገብሯቸውን Government shall prepare and submit ፕሮጀክቶች ፅንሰ ሀሳብና የፕሮጀክት ሰነድ concept notes and project proposals, አዘጋጅተው ያቀርባሉ፣ ሲፀድቅም implement the same upon approval, ይተገብራሉ፣ አፈጻጸሙን ይከታተላሉ፣ monitor its progress and submit report. ሪፖርት ያቀርባሉ፡፡ ፲፱. በልዩ ፈንዱ ለሚደገፉ ፕሮጀክቶች 19. Duties and Responsibilities of the የክልሎች ተግባርና ኃላፊነት Regions for Projects Supported by the Special Fund ክልሎች፦ The Regions shall: ፩/ ለልዩ ፈንዱ ተጓዳኝ በጀት በየዓመቱ 1/ Allocate annually the matching budget ይመድባሉ፤ for the Special Fund; ፪/ ለልዩ ፈንዱ የሚለሙ ቦታዎችን 2/ Select sites for the implementation of ይመርጣሉ፤ ያዘጋጃሉ፤ ህጋዊ የይዞታ projects financed by the Special Fund,

ማረጋገጫ ይሰጣሉ፤ prepare the same and issue land use certificate; gA ፲፯ሺ፮፻፴፰ Ød‰L ነU¶TUz¤È qÜ_R ፲፮ ጥር ፳፫ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No.16, 31 th January, 2025..page 17638 ፫/ በልዩ ፈንዱ በሚተገበሩ ፕሮጀክቶች 3/ Organize members of the communities, ተጠቃሚ የሚሆኑ ማህበረሰቦችን in particular women and youth, who will በተለይም ሴቶችና ወጣቶችን ያደራጃሉ፣ be beneficiaries of projects supported by ህጋዊ ዕውቅና ይሰጣሉ፤ the Special Fund and give legal recognition thereto; ፬/ በልዩ ፈንዱ የሚተገበሩ ፕሮጀክቶች ፅንሰ 4/ Prepare and submit concept notes and ሀሳብና የፕሮጀክት ሰነድ አዘጋጅተው project proposals to be implemented ያቀርባሉ፣ ሲጸድቅም ይተገብራሉ፣ using financial support from the Special አፈጻጸማቸውን ይከታተላሉ፣ ሪፖርት Fund, implement the projects upon ያቀርባሉ፡፡ approval, monitor their progress and submit reports on their implementation. ፳. የልዩ ፈንዱ አስተዳደር በጀት 20. Budget for Administering the Special Fund ልዩ ፈንዱን ለማስተዳደር የሚያስፈልገው The Budget for administering the special በጀት በየዓመቱ ከልዩ ፈንዱ የሚመደብ fund shall be allocated annually from the ይሆናል፡፡ special fund. ክፍል አራት PART FOUR ልዩ ልዩ ድንጋጌዎች Miscellaneous Provisions ፳፩. ተፈጻሚነት ስለማይኖራቸው ሕጎች 21. Inapplicable Laws ከዚህ አዋጅ ጋር የሚቃረን ማናቸውም No law and customary practice shall, in so ሕግ እና ልማዳዊ አሰራር በዚህ አዋጅ far as it is inconsistent with this በተሸፈኑ ጉዳዮች ላይ ተፈጻሚነት Proclamation, have force or effect in አይኖረውም፡፡ respect of matters provided for by this Proclamation. ፳፪. ደንብ እና መመሪያ የማውጣት ሥልጣን 22. Power to Issue Regulation and Directive ፩/ የሚኒስትሮች ምክር ቤት ይህን አዋጅ 1/ The Council of Ministers may issue ለማስፈጸም የሚያስችል ደንብ ሊያወጣ Regulations for the implementation of ይችላል፡፡ this Proclamation. ፪/ የገንዘብ ሚኒስቴር ይህን አዋጅ እና በዚህ 2/ The Ministry of Finance may issue አንቀጽ ንዑስ አንቀጽ (፩) መሠረት Directives for the implementation of this የወጡ ደንቦችን ለማስፈጸም የሚያስችል Proclamation and the Regulations issued መመሪያ ያወጣል፡፡ pursuant to Sub-Article (1) of this Article.
