P.O.Box 80001 18990 gA ፲፰ሺ፱፻፺ Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page የተቀናጀ እና ዘሊቂነት ያሇው የዯረቅ ቆሻሻ WHEREAS, to build an integrated አያያዝ እና አወጋገዴ ሥርዓት ሇመዘርጋት and sustainable solid waste management የኅብረተሰብ እና ባሇዴርሻ አካሊት ተሳትፎን and disposal system, it is essential to ማሳዯግ እና በዯረቅ ቆሻሻ አያያዝና አወጋገዴ enhance the involvement of the አገሌግልት የተሰማሩ ኢንተርፕራይዞች፣ community and stakeholders, ensure the ማህበራት፣ የግለ ዘርፍና ላልች ባሇዴርሻ አካሊት active participation and accountability of ተሳትፎ እና ኃሊፊነትን ብልም ዘርፉ enterprises, associations, the private የሚመራበትን ሥርዓት በህግ መወሰን sector, and others engaged in waste በማስፈሇጉ፤ management services, and establish a legally governed framework for the sector; በኢትዮጵያ ፌዯራሊዊ ዱሞክራሲያዊ ሪፐብሉክ NOW, THEREFORE, In accordance ሕገ መንግስት አንቀፅ ፶፭ (፩) መሰረት with Article 55 (1) of the Constitution of የሚከተሇው ታውጇሌ፡፡ the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows. ክፍሌ አንዴ PART ONE ጠቅሊሊ ዴንጋጌዎች GENERAL PROVISIONS ፩. አጭር ርዕስ 1. Short Title ይህ አዋጅ “የዯረቅ ቆሻሻ አያያዝና አወጋገዴ This Proclamation may be cited as አዋጅ ቁጥር ፩ሺ፫፻፹፫ /፪ሺ፲፯” ተብል "Solid Waste Management and Disposal ሉጠቀስ ይችሊሌ፡፡ Proclamation No.1383/ 2025". ፪. ትርጓሜ 2. Definition የቃለ አገባብ ላሊ ትርጉም የሚያሰጠው In this Proclamation unless the context ካሌሆነ በስተቀር በዚህ አዋጅ ውስጥ፡- otherwise requires: [

፩/ “ዯረቅ ቆሻሻ” ማሇት የማይፈሇግ ተብል 1/ “Solid Waste” means anything that የተጣሇ ማንኛውም ፈሳሽ ያሌሆነ ወይም is neither liquid nor gas and is ነፋሽ ያሌሆነ ቆሻሻ ነው፤ discarded as unwanted; ፲፰ሺ፱፻፺፩ 18991 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፪/ “የዯረቅ ቆሻሻ አያያዝና አወጋገዴ” ማሇት 2/ “Solid Waste Management and ዯረቅ ቆሻሻን ከምንጩ መቀነስ፣ በፈርጅ Disposal” means reducing, መሇየትና መሰብሰብ፣ ማጓጓዝ፣ ማከም፣ segregating and collecting, መሌሶ መጠቀም፣ መሌሶ ዑዯት ማዴረግ transporting, treating, reusing, እና አካባቢያዊ ተቀባይነት ባሇው መንገዴ recycling, and disposing solid waste ማስወገዴ ነው፤ from the source; ፫/ “የመንገዴ ፅዲት” ማሇት የተሸከርካሪ እና 3/ “Road Side Cleaning” means እግረኛ መንገዴን፣ የመንገዴ cleaning pedestrian roads and road አካፋይን፣ ተሸጋጋሪ ዴሌዴይን ፣ የጎርፍ divides, pedestrian overpass መዉረጃ ቦይን፣ የጉዴፍ ማጠራቀሚያዎች፣ drainages, litter bins, removing እና የመንገዴ ዲር ሌዩ ሌዩ ምሰሶዎችን illegal adverts on light posts; ማፅዲት ማሇት ነዉ፤ ፬/ “ጉዴፍ” ማሇት ዯረቅ ቆሻሻ ሆኖ በሰዎች 4/ “Litter” means any solid waste የሚመነጩ የሲጋራ ቁርጥራጭ፣ የሶፍት generated by humans which include ወረቀት፣ የትራንስፖርት ዯረሰኝ፣ cigarette butts, soft papers, transport የተንቀሳቃሽ ስሌክ ካርዴ፣ የፈጣን ምግቦች tickets, fast food packaging or other መጠቅሇያ ወይም የመሳሰለትን like materials; የሚያጠቃሌሌ ነው፤ ፭/ “መሌሶ መጠቀም” ማሇት ከዯረቅ ቆሻሻ 5/ “Reuse” means any operation by ውስጥ ጠቃሚ ዕቃዎችን በማውጣት which products or components that ሇተሰሩበት አሊማ በዴጋሚ ጥቅም ሊይ are not waste are used again for the የሚውለበት ማንኛውም አሰራር ነው፤ same purpose for which they were conceived; ፮/ “መሌሶ ዑዯት ማዴረግ” ማሇት ከዯረቅ 6/ “Recycle” means separating and ቆሻሻ ውስጥ ጠቃሚ ቁሶችን በመሇየትና reprocessing of valuable materials ወዯ ጥሬ እቃ በመቀየር ሇቀዴሞ from solid waste and turning them አገሌግልታቸው ወይም ሇላሊ አገሌግልት into raw materials for their previous ማዋሌ ነው፤ use or other use;

፲፰ሺ፱፻፺፪ 18992 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፯/ “የቅብብልሽ ጣቢያ” ማሇት ወዯ ማስወገጃ 7/ “Transfer center” means a ቦታ ከመወሰደ በፊት ዯረቅ ቆሻሻን separate place for temporary በጊዜያዊነት ሇማከማቸት፣ በየፈርጁ storage, sorting, reuse and recycling ሇመሇየት፣ መሌሶ ሇመጠቀም እና መሌሶ of solid waste before it is taken to a ዑዯት ሇማዴረግ የተሇየ ቦታ ነው፤ disposal site; ፰/ “የማስወገጃ ቦታ” ማሇት ጥቅም የማይሰጥ 8/ “Disposal Site” means a place to የዯረቅ ቆሻሻ በሰዉ እና በአካባቢ ሊይ dispose any useless solid waste in a ጉዲት እንዲያስከትሌ የሚወገዴበት ቦታ manner that will not cause any harm ነዉ፤ to human and the environment; ፱/ “ፕሊስቲክ’’ ማሇት በዋናነት ከፔትሮኬሚካሌ 9/ “Plastic” means a soft and non- የተሰራ፣ ሇስሊሳ እና የማይበሰብስ degradable polymer-based material የፖሉመር ይዘት ያሇው ምርት ነው፤ made primarily from ‹ petrochemicals; ፲/ “የፕሊስቲክ ከረጢት’’ ማሇት አነስተኛ 10/ “ Plastic Bag” means a low- ጥግግት ያሇው፣ በቀሊለ በስብሶ ከአፈር density, non-biodegradable and a ጋር የማይዋሃዴ እና ላልች ምርቶችን plastic used to contain other ሇመያዝ የሚያገሇግሌ ፕሊስቲክ ነው፤ products; ፲፩/ “አንዴ ጊዜ ጥቅም ሊይ የሚውሌ 11/ “ Single-Use Plastic” means a ፕሊስቲክ’’ ማሇት መሌሶ ጥቅም ሊይ plastic product that is not reused or የማይውሌ ወይም መሌሶ ዑዯት recycled and used only once and is የማይዯረግ እና አንዴ ጊዜ ብቻ ጥቅም disposed of directly once used; ሊይ ውል ቀጥታ የሚወገዴ የፕሊስቲክ ምርት ነው፤ ፲፪/ “የማሸጊያ ፕሊስቲክ’’ ማሇት እቃዎችን 12/ “Plastic Packaging” means a ከብክሇት ሇመከሊከሌ ወይም ከላሊ ነገር plastic wrap or container used by ጋር እንዲይቀሊቀሌ ሇማዴረግ በእቃው the manufacturer of the product to አምራች ጥቅም ሊይ የሚውሌ ከፕሊስቲክ protect the product from የሚዘጋጅ መጠቅሇያ ወይም መያዣ contamination or to keep it from ነው፤ mixing with other materials; ፲፫/ “አምራች” ማሇት በራሱ የንግዴ ምሌክት 13/ “Producer” means a person who ምርት የሚያመርት ወይም ምርቱን ወዯ manufactures or imports a product አገር ውስጥ የሚያስገባ ሰው ነው፡፡ under his own trademark;

፲፰ሺ፱፻፺፫ 18993 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፲፬/ “የተራዘመ የአምራቾች ኃሊፊነት” ማሇት 14/ “Extended Producer Responsibilit” አምራቾች ሇሚያመርቱት ምርት እስከ means the responsibility of a ዴህረ-ሸማቾች የምርት የሕይወት ዑዯት producer for the product it ዯረጃ የሚራዘምበት ኃሊፊነት ነው፤ produces, extending to the post- consumer stage of the product life cycle; ፲፭/ “ክሌሌ” ማሇት በኢትዮጵያ ፌዳራሊዊ 15/ “Region” means any region ዱሞክራሲያዊ ሪፐብሉክ ሕገ-መንግሥት established according to Article 47 አንቀጽ ፵፯ መሰረት የተቋቋመ of the Constitution of the Federal ማንኛውም ክሌሌ ሲሆን የአዱስ አበባና Democratic Republic of Ethiopia የዴሬዲዋ ከተማ አስተዲዯሮችን and, includes the Addis Ababa and ይጨምራሌ፤ Dire Dawa City administrations; ፲፮/ “ከተማ” ማሇት ማዘጋጃ ቤት የተቋቋመበት 16/ “City” means a municipality that ወይም በህግ ሥሌጣን በተሰጠው አካሌ has been constituted or designated ከተማ ተብል የተሰየመ ከተማ ነው፤ as a city by a legally authorized body; ፲፯/ “የከተማ አስተዲዯር” ማሇት በከተሞች 17/ “City administration” means an ውስጥ አስተዲዯራዊ ወይም ማዘጋጃ independent administrative body ቤታዊ ወይም ላልች አገሌግልቶችን established to provide እንዱሰጥ የተቋቋመና ራሱን የቻሇ administrative or municipal አስተዲዯራዊ አካሌ ነው፤ administration services or other services; ፲፰/ “የገጠር ቀበላ” ማሇት በከተማ አስተዲዯር 18/ “Rural Kebele” mean a kebele ያሌታቀፉ ቀበላዎች ያጠቃሌሊሌ፤ that is not under city administration; ፲፱/ “ተቋም” ማሇት መንግስታዊና መንግስታዊ 19/ “Institution” means any ያሌሆኑ ተቋማትን ያጠቃሌሊሌ፤ governmental or non-governmental institution; ፳/ “ሰው” ማሇት የተፈጥሮ ወይም በህግ 20/ “Person” means any natural የሰውነት መብት የተሰጠው አካሌ ነው፤ person or juridical person; ፳፩/ “ባሇሥሌጣን” ማሇት የፌዯራሌ የአካባቢ 21/ “Authority” means the Federal ጥበቃ ባሇሥሌጣን ነው፤ Environmental Protection Authority;

፲፰ሺ፱፻፺፬ 18994 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፳፪/ በወንዴ ጾታ የተገሇጸው አነጋገር ሴትንም 22/ any expression in the masculine ያካትታሌ፡፡ gender includes the feminine. ፫. የተፈጻሚነት ወሰን 3. Scope of application ይህ አዋጅ በአዯገኛ ቆሻሻ አያያዝና አወጋገዴ This Proclamation shall apply to the አዋጅ ቁጥር ፩ሺ፺/፪ሺ፲ ሊይ በተሸፈኑ አዯገኛ management and disposal of solid ቆሻሻዎች እና ከኤላክትሪክና ኤላክትሮኒክ waste throughout the country, except ቆሻሻዎች በስተቀር በመሊ ሀገሪቱ በዯረቅ for hazardous wastes covered by ቆሻሻ አያያዝና አወጋገዴ ሊይ ተፈፃሚ Proclamation No. 1090/2018 and ይሆናሌ፡፡ electrical and electronic waste. ፬. መርሆዎች 4. Principles ማንኛውም የዯረቅ ቆሻሻ አያያዝና አወጋገዴ The following fundamental principles የሚከተለትን መሰረታዊ መርሆዎች መከተሌ shall guide all solid waste management ይኖርበታሌ፡- and disposal practices: ፩/ ቆሻሻን ከምንጩ መቀነስ፣ መሌሶ 1/ Reduction of waste generation from መጠቀም፣ መሌሶ ዑዯት ማዴረግ እና its source, reuse, recycle and በአግባቡ ማስወገዴ፤ disposal; ፪/ የህብረተሰብ ተሳትፎ ማሳዯግ፤ 2/ Public participation; ፫/ የበከሇን ማስከፈሌ። 3/ Polluter pay. ክፍሌ ሁሇት PART TWO ስሇዯረቅ ቆሻሻ አያያዝና አወጋገዴ SOLID WASTE MANAGEMENT AND DISPOSAL ፭. የተራዘመ የአምራቾች ኃሊፊነት 5. Extended Producers Responsibility ፩/ የፕሊስቲክ ምርት አምራቾች 1/ Plastic product producers shall have የሚከተለት ኃሊፊነቶች አለባቸው፡- the following responsibilities: ሀ) የፕሊስቲክ ምርት ሲያመርቱ a) Adopt production designs that በአካባቢ ሊይ አነስ ተኛ ተዕጽኖ have minimal environmental ያሊቸው የምርት ንዴፎችን impact of their plastic products; መከተሌ፤ ሇ) በአመራረት ሂዯት ሉከሰት የሚችሇውን b) Reduce plastic waste that may የፕሊስቲክ ምርት ቆሻሻ የመቀነስ፤ happen in the production process;

፲፰ሺ፱፻፺፭ 18995 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ሐ) የፕሊስቲክ ምርቱ የአገሌግልት ዘመን c) Ensure that the plastic product is ሲያበቃ እንዱሰበሰብና ሇዲግም ጥቅም collected at the end of its term of ወይም መሌሶ ዑዯት ሊይ ሉውሌ service for reuse or recycling; የሚችሌበትን ሥርዓት የመፍጠር፤ መ) የፕሊስቲክ ምርቱ የአገሌግልት d) Cover the cost of collecting, ዘመኑ እንዲበቃ የሚሰበሰብበት፣ reusing and recycling their plastic መሌሶ ጥቅም ሊይ እና ዑዯት ሊይ products at the end of their term ሇመዋሌ የሚያስፍሇገውን ወጪ of service. የመሸፈን። ፩/ የምግብ፣ የመጠጥ፣ የንጽህና መጠበቂያና 2/ The manufacturer, importer, whole የመዋቢያ ምርቶችን በጠርሙስ ወይም seller and retailer of food, drink, በቆርቆሮ ጣሳ ወይም በፕሊስቲክ መያዣ hygiene protection and sanitary የሚያመርቱ፣ የሚያስመጡ፣ የሚያከፋፍለ products with glass containers, tin ሰዎች ጠርሙሱ ወይም የቆርቆሮ ጣሳው cans and plastic bottles shall ወይም የፕሊስቲክ መያዣው የአገሌግልት develop and implement a system ዘመኑ እንዲበቃ መሌሶ የሚወሰዴበትን that enables it to collect and recycle ወይም እንዱወሰዴ የሚያስዯርግበትንና on its own or through other persons, መሌሶ ዑዯት ወይም መሌሶ ጥቅም ሊይ used glass containers, tin cans and የሚውሌበትን ዘዳ የመዘርጋትና plastic bottles. የመተግበር ግዳታ አሇበት፡፡ ፮. ዯረቅ ቆሻሻ ስሇመሰብሰብ 6. Collection of solid waste ፩/ ከባሇሥሌጣኑ በሚሰጥ ፈቃዴ ሇጥሬ 1/ The importation of solid waste is ምርትነት ካሌሆነ በስተቀር ዯረቅ ቆሻሻን prohibited, except for raw materials ወዯ ሀገር ውስጥ ማስገባት የተከሇከሇ ነው። that have received approval from the authority. ፪/ ማንኛውም በዯረቅ ቆሻሻ አሰባሰብ ስራ 2/ Any person intending to engage in ሇመሰማራት የሚፈሌግ ሰው በቅዴሚያ the transportation of solid waste ከሚመሇከተው የከተማ አስተዲዯር የብቃት shall obtain a competency certificate ማረጋገጫ ማግኘት አሇበት፡፡ from the relevant city administration.

፲፰ሺ፱፻፺፮ 18996 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፫/ ማንኛውም ሰው ከመኖሪያ ቤቱ፣ 3/ Every individual shall be ከአገሌግልት መስጫ ወይም ማምረቻ responsible for segregating, ተቋሙ የሚመነጭን ዯረቅ ቆሻሻ በየፈርጁ temporarily storing, and transferring መሇየት፣ አመቺ በሆነ ቦታ በጊዜያዊነት solid waste from their households, ማከማቸትና ፈቃዴ ሇተሰጣቸው ቆሻሻ service establishments, or ሰብሳቢዎች ማስተሊሇፍ አሇበት፡፡ manufacturing facilities to authorized collectors. ፬/ በዚህ አንቀጽ ንዑስ አንቀጽ (፫) የተዯነገገው 4/ Notwithstanding with Sub-Article እንዯተጠበቀ ሆኖ ዯረቅ ቆሻሻ ሰብሳቢዎች (3) of this Article, individuals በማይኖሩበት አካባቢ የሚኖር ሰዉ ዯረቅ residing in areas without solid waste ቆሻሻን ጊዜያዊ ማከማቻ ቦታ የማዴረስ collection services shall be ኃሊፊነት አሇበት፡፡ responsible for transporting their solid waste to designated temporary storage sites. ፭/ ዯረቅ ቆሻሻ በከተማ አስተዲዯሮች በሚዘጋጁ 5/ Solid waste shall be temporarily የህዝብ የጋራ መገሌገያ የቆሻሻ stored in communal waste ማጠራቀሚያ ገንዲዎች በጊዜያዊነት containers provided by the city መከማቸ አሇበት፡፡ administration. ፮/ የከተማ አስተዲዯሮች የጉዴፍ ማጠራቀሚያ 6/ City administrations shall have the ወይም በገንዲ የተጠራቀመ ቆሻሻ responsibility for the timely removal በተቀመጠሇት ጊዜ የማንሳት ኃሊፊነት of solid waste from litter bins and አሇባቸው፡፡ containers. ፯/ ማንኛውም ሰው የሞቱ እንስሳትን ሇእነዚህ 7/ Each individual shall temporarily አይነት ቆሻሻዎች ተብል በተሇየ ቦታ store deceased animals in a በጊዜያዊነት ማስቀመጥ አሇበት። designated area specifically set aside for such materials. ፯. የዯረቅ ቆሻሻ ቅብብልሽ ጣቢያ 7. Solid waste transfer station ፩/ ማንኛውም የከተማ አስተዲዯር 1/ Each city administration shall set እንዯአስፈሊጊነቱ የዯረቅ ቆሻሻ up a solid waste transfer station as

የቅብብልሽ ጣቢያ ማዘጋጀት አሇበት፡፡ deemed necessary. gA ፲፰ሺ፱፻፺፯ Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page 18997 ፪/ በከተማ ውስጥ የሚዘጋጅ ማንኛውም 2/ Each city administration shall have የቅብብልሽ ጣቢያ የአካባቢውን the responsibility to conduct public ህብረተሰብ በማሳተፍ እና የህብረተሰቡን consultation before establishing ፍሊጎት መነሻ ማዴረግ መዘጋጀት any solid waste transfer station. አሇበት፡፡ ፫/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሰረት 3/ The transfer station established የሚዘጋጅ የቅብብልሽ ጣቢያ በአካባቢ እና under Sub-article (1) of this Article ማህበረሰብ ሊይ ጉዲት የማያዯርስ shall be certified by the relevant ስሇመሆኑ በሚመሇከተው አካሌ ተረጋግጦ authority to confirm that it poses መዘጋጀት አሇበት፡፡ no harm to the environment and the community. ፰. ዯረቅ ቆሻሻን መሌሶ ስሇመጠቀም፣ መሌሶ 8. Reuse, recycle and disposal of solid ዑዯት ማዴረግ እና ማስወገዴ waste ፩/ ዯረቅ ቆሻሻን መሌሶ መጠቀም፣ መሌሶ 1/ The reuse, recycling, and disposal ዑዯት ማዴረግ እና ማስወገዴ of solid waste shall be carried out ኢኮኖሚያዊ፣ አካባቢያዊ፣ የጤና እና in a manner that delivers ማህበራዊ ጠቀሜታ ባሇው መንገዴ እና economic, environmental, health, ሇህብረተሰቡ ፍሊጎት ቅዴሚያ በመስጠት and social benefits, and aligns with መከናወን አሇበት። the needs and priorities of the community. ፪/ የዯረቅ ቆሻሻን መሌሶ መጠቀም፣ መሌሶ 2/ Any person intending to engage in ዑዯት እና ማስወገዴ ስራ ሊይ the reuse, recycling, or disposal of ሇመሰማራት የሚፈሌግ ማንኛውም ሰው solid waste shall obtain a ከባሇሥሌጣኑ ወይም ከክሌሌ የአካባቢ competence certificate from the ጥበቃ መስሪያ ቤት የብቃት ማረጋገጫ authority or the regional ማግኘት አሇበት፡፡ environmental protection office. ፱. የዯረቅ ቆሻሻ አወጋገዴ 9. Solid Waste Disposal ፩/ ማንኛውም ሰው ሇዚህ ተብል ከተዘጋጀ 1/ No person shall dispose of solid ቦታ ውጪ ዯረቅ ቆሻሻን ማስወገዴ waste outside the designated area. አይችሌም፡፡

፲፰ሺ፱፻፺፰ 18998 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፪/ ማንኛውም ሰው በከተማዎች አካባቢ 2/ No person shall dispose of solid በህዝብ ወይም በግሌ ይዞታ ሊይ ዯረቅ waste by burning it in public or ቆሻሻን በማቃጠሌ ማስወገዴ አይችሌም፡፡ private spaces in cities. ፫/ በዚህ አንቀፅ ንዑስ አንቀፅ (፪) የተዯነገገው 3/ Notwithstanding with Sub-Article ቢኖርም ዯረቅ ቆሻሻን ከሚመሇከተው (2) of this Article, solid waste may የከተማ አስተዲዯር ፈቃዴ ባገኘ be disposed of using an incinerator የማቃጠያ መሳሪያ ሇዚሁ በተፈቀዯ ስፍራ authorized by the relevant city እና ሁኔታ ማስወገዴ ይቻሊሌ፡፡ administration, at a location and under conditions approved for this purpose. ፬/ በዚህ አንቀጽ ስሇቆሻሻ አወጋገዴ 4/ The general provisions set forth in የተዯነገገዉ አጠቃሊይ ሁኔታ አግባብ this Article concerning waste ባሊቸው ህጎች ስሇዯረቅ ቆሻሻ አወጋገዴ disposal shall be without prejudice ሇላልች ተቋማት የተሰጠውን ተግባርና to the mandates, duties, and ሃሊፊነት የሚያስቀር አይሆንም፡፡ responsibilities conferred upon other institutions under applicable laws in relation to waste disposal. ክፍሌ ሶስት PART THREE የሌዩ ሌዩ ዯረቅ ቆሻሻዎች አያያዝና MANAGEMENT AND DISPOSAL አወጋገዴ OF DIFFERENT TYPES OF SOLID WASTES ፲. የመኖሪያ፣ የአገሌግልት መስጫ ወይም 10. Solid waste management and የማምረቻ ተቋማት የዯረቅ ቆሻሻ አያያዝ disposal by households, service institutions, or manufacturing entities. ፩/ ማንኛውም ሰው ከመኖሪያ ቤት ይዞታው 1/ Each person shall clean its ዴንበር አንስቶ እስከ ሀያ ሜትር ባሇው surroundings and prevent littering ርቀት ውስጥ ዯረቅ ቆሻሻን የማጽዲት within a radius of twenty meters ሃሊፊነት አሇበት፡፡ from its household.

፲፰ሺ፱፻፺፱ 18999 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፪/ ማንኛውም የአገሌግልት መስጫ ወይም 2/ Every service or commercial የንግዴ ተቋም ከይዞታው ዴንበር አንስቶ institution shall clean and its ቢያንስ እስከ ሀምሳ ሜትር ባሇው ርቀት surroundings from littering within a ውስጥ ዯረቅ ቆሻሻን የማጽዲት ሃሊፊነት radius of fifty meters from its አሇበት፡፡ premises. ፫/ ማንኛውም የአገሌግልት መስጫ ወይም 3/ Every service or commercial የንግዴ ተቋም በየቆሻሻ ፈርጁ ተሇይተው establishment shall provide waste ምሌክት የተዯረገባቸዉ የጉዴፍ bins labeled according to each waste ማጠራቀሚያዎች አመቺ በሆነ ቦታ category in a convenient location. ማስቀመጥ አሇበት፡፡ ፲፩. የግንባታና የፍርስራሽ ዯረቅ ቆሻሻ አያያዝና 11. Construction Debris and አወጋገዴ Demolition Wastes ፩/ የግንባታ ፈቃዴ የሚሰጠው የስራ 1/ Construction permits shall only be ተቋራጩ የግንባታ ፍርስራሽ ወይም granted when it is demonstrated that ተቆፍሮ የወጣ አፈር አካባቢያዊ the contractor can manage the ተቀባይነት ባሇው መንገዴ disposal of construction debris or እንዯሚያስወግዴ ሲረጋገጥ ብቻ ነው፡፡ excavated earth in an environmentally sound manner. ፪/ የዚህ አንቀጽ ንዑስ አንቀጽ (፩) 2/ Notwithstanding with Sub-Article እንዯተጠበቀ ሆኖ ማንኛውም የከተማ (1) of this Article, city መኖሪያ ቤት ወይም ላሊ ግንባታ administrations shall ensure that ከመጀመሩ በፊት የከተማ አስተዲዯር proper provisions for አካባቢያዊ ተቀባይነት ያሇው የዯረቅ environmentally sound solid waste ቆሻሻ አያያዝ በቂ ዝግጅት መኖሩን management are in place before ማረጋገጥ አሇበት፡፡ starting the construction of residential or other buildings. ፫/ የግንባታ ፍርስራሽ ወይም ተቆፍሮ የወጣ 3/ Any person intending engage in the አፈር በማስወገዴ ሥራ ሊይ ሇመሰማራት disposal of construction debris or የሚፈሌግ ማንኛውም ሰው ከባሇሥሌጣኑ demolition waste shall obtain a ወይም አግባብነት ካሇው የክሌሌ አካባቢ permit from the authority or regional ጥበቃ መስሪያ ቤት የብቃት ማረጋገጫ environmental protection office. ማግኘት አሇበት፡፡

፲፱ሺ 19000 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፬/ በጊዜያዊነት የግንባታና የፍርስራሽ ቆሻሻ 4/ Any individual authorized to እንዱያከማች የተፈቀዯሇት ሰው temporarily store construction debris የተከማቸበት ቦታ በተፈቀዯሇት ጊዜ and demolition waste shall restore ውስጥ ወዯ ቀዴሞው ሁኔታ መመሇስ the site to its original condition once አሇበት፡፡ the time limit expires. ፭/ ባሇሥሌጣኑ ወይም አግባብነት ያሇው 5/ The Authority or Regional የክሌሌ አካባቢ ጥበቃ መስሪያ ቤት Environmental Protection office ቆሻሻው የመነጨበት ቅጥር ግቢ ባሇቤት shall regulate the owner or occupant እና ግንባታውን የሚያካሂዯው ሰው ፡- of premises where building waste is generated, as well as the individual conducting activities that lead to the generation of such waste, ensuring that: ሀ) የግንባታ ፍርስራሽ ቆሻሻው a) The construction debris shall be እስከሚወገዴ ዴረስ በግንባታው ቅጥር kept on the premises where it ግቢ ውስጥ መቀመጡን፤ was generated until it is disposed of; ሇ) የግንባታና ፍርስራሽ ቆሻሻ ጊዜያዊ b) The temporary storage of the ክምችት የሰዎችን እንቅስቃሴ construction debris shall not የማይገታና ጉዲት የማያስከትሌ obstruct the movement of መሆኑን፤ people or cause any harm; ሐ) ከመነጨው የግንባታና ፍርስራሽ ቆሻሻ c) The construction debris shall be የሚጠቅመውን ከማይጠቅመው ሇይቶ segregated and stored በጊዜያዊነት መከማቸቱን፤ temporarily; መ) የመነጨው ቆሻሻ ሇማስወገዴ ፈቃዴ d) The waste shall be transferred to ሊሇው አካሌ ብቻ መተሊሇፉን፤ authorized bodies for disposal; ሠ) ከከተማ አስተዲዯሩ በሚሰጥ ትእዛዝ e) Any structure required to መሰረት እንዯአስፈሊጊነቱ የግንባታ contain the waste shall be ፍርስራሽ ቆሻሻን በአግባቡ ሇመያዝ provided in accordance with የሚያስችሌ ግንባታ መከናወኑን፤ instructions from the city ማረጋገጥ አሇበት፡፡ administration.

፲፱ሺ፩ 19001 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፲፪. ጠርሙስ፣ ጣሳ፣ የታሸገ ውኃ መያዣ ፕሊስቲክ 12. Bottles, cans, bottled water plastic ፩/ የከተማ አስተዲዯሮች ቆሻሻ ጠርሙስ፣ 1/ City administrations shall ensure የቆርቆሮ ጣሳ ወይም ፕሊስቲክ መያዣ that waste bottles, tin cans, and በጊዜያዊነት የሚከማችበት ቦታ plastic containers are temporarily መመዯቡንና ክምችቱም በየወቅቱ stored in a designated area and that መነሳቱን ማረጋገጥ አሇባቸው፡፡ they are collected and removed periodically. ፪/ መያዥ ጠርሙስ፣ የቆርቆሮ ጣሳ እና 2/ The design of glass containers, tin የፕሊስቲክ ንዴፎች የምርቶቹን መሌሶ The design of glass containers, tin መጠቀምና መሌሶ ዑዯት ማዴረግን ታሳቢ cans, and plastic bottles shall ያዯረገ መሆን አሇበት፡፡ consider the potential for reuse and recyclability of the products. ፲፫. ሇአንዴ ጊዜ ብቻ ጥቅም ሊይ የሚውሌ 13. ፲፱ሺ፪ 19002 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፬/ ባሇስሌጣኑ ወይም የክሌሌ የአካባቢ ጥበቃ 4/ The Authority or the Regional መስሪያ ቤት አንዴ ጊዜ ብቻ ጥቅም ሊይ environmental protection office የሚውሌ ፕሊስቲክን የሚመሇከቱ የዚህ shall regulate the enforcement of አዋጅ ዯንጋጌዎች አፈጻፀም ሊይ ቁጥጥር the provisions of this Proclamation ያዯርጋሌ፣ ጥሰት ሲኖር ተገቢው related to single-use plastic and የእርምት እርምጃ ይወስዲሌ። take appropriate corrective measures in the event of violations. ፲፬. ሇአንዴ ጊዜ ብቻ ጥቅም ሊይ የሚውሌ 14. ፲፱ሺ፬ 19004 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ክፍሌ አራት PART FOUR የዯረቅ ቆሻሻ ማስወገጃ መሳሪያዎች እና ቦታዎች SOLID WASTE DISPOSAL SITES AND MACHINERY ፲፮. የዯረቅ ቆሻሻ ማጓጓዣ ተሸከርካሪዎችና 16. Sanitary Landfill ፩/ እያንዲንደ የከተማ አስተዲዯር አግባብነት 1/ Every city administration shall, in ያሇው የአካባቢ ዯረጃ በመከተሌ የዯረቅ conformity with the relevant ቆሻሻ ማስወገጃ ቦታ እንዱገነባና environmental standard, ensure አገሌግልት እንዱሰጥ ማዴረግ አሇበት:: that sanitary landfill is constructed and properly used.

19005 gA ፲፱ሺ፭ Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፪/ ከከተማው አስተዲዯር ክሌሌ ውጭ 2/ Before the commencement of የሚገነባ የዯረቅ ቆሻሻ ማስወገጃ ቦታ construction of any sanitary የተቀባዩን የከተማ አስተዲዯር ወይም landfills outside the boundary of ከሚመሇከተው አካሌ ስምምነት ማግኘት a city administration, the city አሇበት፡፡ administration shall obtain consent from the relevant authority or from the recipient city administration. ፫/ ማንኛውም የዯረቅ ቆሻሻ ማስወገጃ ቦታ 3/ Any solid waste disposal site በሚመሇከተው አካሌ በተቀመጠው must be prepared according to መስፈርት መሰረት መዘጋጀት እና the criteria set by the relevant አስፈሊጊ መሰረተ ሌማቶችን ያሟሊ body and equipped with the መሆን አሇበት፡፡ necessary infrastructure. ፲፰. የዯረቅ ቆሻሻ ማስወገጃ ቦታ አስተዲዯር 18. Management of Sanitary Landfill ፩/ ማንም ሰው የዯረቅ ቆሻሻ ማስወገጃ ቦታን 1/ No person shall utilize a sanitary ከታሇመሇት አሊማ ውጭ መጠቀም landfill for any purpose other አይችሌም፡፡ than its primary function. ፪/ እያንዲንደ የከተማ አስተዲዯር የቆሻሻ 2/ Every city administration shall ማስወገጃ ቦታዎች በሰው ሀይሌና ensure that sanitary landfills is በግብዓት የተሟለ መሆናቸውን ማረጋገጥ furnished with adequate አሇበት፡፡ personnel and essential equipment necessary for its [ proper operation. ፫/ እያንዲንደ የከተማ አስተዲዯር በዯረቅ 3/ Every city administration shall ቆሻሻ ማስወገጃ ቦታዎች የሚወገዴ maintain systematic and periodic የቆሻሻ መጠንና አይነት መረጃ መያዝ records indicating the አሇበት፡፡ classification and volume of waste deposited at solid waste disposal facilities.

፲፱ሺ፮ 19006 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ክፍሌ አምስት PART FIVE የአስፈፃሚ ወይም ላልች ተቋማት POWERS AND DUTIES OF THE ተግባርና ኃሊፊነት EXECUTIVE OR RELATED INSTITUTIONS ፲፱. የከተማ አስተዲዯር ግዳታ 19. Obligations of City administration በዚህ አዋጅ ላልች ዴንጋጌዎች Without prejudice to the other የተመሇከተው እንዯተጠበቀ ሆኖ ማንኛውም provisions of this Proclamation, የከተማ አስተዲዯር፡- every city administration shall have the following obligations: ፩/ የዯረቅ ቆሻሻ አያያዝ መሰረተ ሌማቶች 1/ Expressly indicate the inclusion በከተማ ፕሊን በግሌፅ ማመሊከት፤ of solid waste management infrastructure within the urban development plan; ፪/ ዝቅተኛውን የአስተዲዯር እርከኑንና 2/ To ensure active participation the የአካባቢውን ማህበረሰብ መነሻ ባዯረገ of the lowest administrative አሳታፊ የአሰራር ዘዳ የዯረቅ ቆሻሻ units and their respective local አያያዝ ዕቅዴ አዘጋጅቶ የመተግበር፤ communities in the formulation and implementation of localized solid waste management plans; ፫/ የዯረቅ ቆሻሻ አያያዝና አወጋገዴ እና 3/ To plan and implement programs የአካባቢ መንከባከቢያ የግንዛቤ ማስፋፊያ related to solid waste መርሃ ግብር የማቀዴና የማከናወን፤ management, disposal, and public awareness on environmental protection and cleanliness; ፬/ ከዯረቅ ቆሻሻ አያያዝ ጉዴሇት ሉዯርስ 4/ To take appropriate preventive የሚችሌ ብክሇትን መከሊከሌ የሚያስችሌ measures against pollution ስራ መከናወኑን የማረጋገጥ፤ resulting from improper handling of solid waste;

፲፱ሺ፯ 19007 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፭/ የጉዴፍ ማስቀመጫዎችን በመንገዴ ዲር 5/ To install litter bins along እና ህዝብ በሚያዘወትርባቸዉ ቦታዎች roadsides and in public spaces, ማስቀመጥ፤ በየጊዜዉ መፅዲታቸዉን and to ensure their regular ማረጋገጥ፤ maintenance and emptying; ፮/ የመንገዴ ፅዲት ሥርዓት የመዘርጋት፤ 6/ To establish a system for street and roadside cleaning; ፯/ አካባቢን የሚያቆሽሹ የማስታወቂያ 7/ To regulate and control ሥራዎችን የመቆጣጠር፤ advertising activities that may contribute to environmental pollution; ፰/ የዯረቅ ቆሻሻ ማስወገጃ ቦታ ሊይ ወቅታዊ 8/ Conduct periodic environmental የአካባቢ ኦዱት በማከናወን ሪፖርቱን audit and submit the report the ሇባሇሥሌጣኑ ወይም ሇክሌሌ የአካባቢ authority and Regional ጥበቃ መስሪያ ቤቶች ማቅረብ፤ environmental protection office; ፱/ አግባብነት ያሊቸው ወጪ ቆጣቢ እና 9/ To ensure the adoption of cost- ሇአጠቃቀም ምቹ የሆኑ የዯረቅ ቆሻሻ effective, environmentally አያያዝን የሚያግዙ ቴክኖልጂዎች ሥራ sound, and user-friendly ሊይ መዋሊቸውን የማረጋገጥ ፤ technologies for solid waste management; ፲/ በከተማዉ ዉስጥ የሚገኙ የወንዝ 10/ To ensure that solid waste is not ዲርቻዎች፣ የገበያ ቦታ፣ የህዝብ disposed of in areas such as ማዘዉተሪያ ቦታዎች፣ አረንጓዳ riverbanks, market areas, public ስፍራዎች እና መሰሌ ቦታዎችን ማፅዲት open spaces, green areas, or እና ቆሻሻ እንዲይጣሌባቸዉ other environmentally sensitive የመቆጣጠር፤ locations, and to conduct regular monitoring thereof; ፲፩/ ዘሊቂነት ያሇው የቆሻሻ አያያዝ 11/ To develop and implement ተግባራትን ማከናወኛ ፋይናንስ ምንጭና a sustainable financing ሥርዓት መዘርጋት እና መኖሩን mechanism to support solid የማረጋገጥ፤ waste management initiatives;

፲፱ሺ፰ 19008 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፲፪/ በዯረቅ ቆሻሻ አያያዝና አወጋገዴ ሊይ 12/ To establish incentive schemes የግለን ዘርፍ ተሳትፎ የሚያሳዴግ that promote the private sector የማበረታቻ ሥርዓት የመዘርጋት፤ participation in solid waste management services; ፲፫/ ዓመታዊ የተቀናጀ የዯረቅ ቆሻሻ 13/ Compile and submit an annual አያያዝና አወጋገዴ ዘገባ ማዘጋጀት እና report on integrated solid waste ሇባሇሥሌጣኑ ወይም ሇክሌሌ የአካባቢ management and disposal ጥበቃ መስሪያ ቤት እና ሇከተማ እና activities to the competent መሰረተ ሌማት ሚኒስቴር ወይም authority or Regional ሇክሌሌ የከተማ እና መሰረተ ሌማት Environmental Protection መስሪያ ቤት የማቅረብ፤ Office, as well as to the Ministry of Urban Development and Infrastructure or the corresponding Regional Urban and Infrastructure Development Office; ፲፬/ ዯረቅ ቆሻሻን መሌሶ ሇመጠቀም፣ መሌሶ 14/ To promote and support ዑዯት በማዴረግ እና በማስወገዴ ስራ activities related to the reuse, ሊይ የሚሰማሩ ሰዎችን ሇማበረታታት recycling, and disposal of solid የሚያስችለ እርምጃዎችን የመዉሰዴ፤ waste. ግዳታ አሇበት፡፡ ፳. የገጠር ቀበላ አስተዲዯር ግዳታዎች 20. Obligations of Rural Kebele Administration ፩/ ማንኛውም የገጠር ቀበላ አስተዲዯር ፡- 1/ Every rural kebele administration shall have the following responsibilities: ሀ) በገጠር ቀበላዎች የሚመነጭ የዯረቅ a) To ensure that solid waste ቆሻሻ በአግባቡ መያዙንና መወገደን generated within its የማረጋገጥ፤ jurisdiction is properly managed, handled, and disposed of in an environmentally sound manner;

፲፱ሺ፱ 19009 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ሇ) የዯረቅ ቆሻሻ ዝውውርን የመቆጣጠር፤ b) To regulate the transportation ግዳታ አሇበት፡፡ of solid waste within its territorial bounds; ፪/ ሇከተማ አስተዲዯሮች በዚህ አዋጅ የተሰጡ 2/ Where applicable, all duties and ሀሊፊነቶች እንዯአስፈሊጊነቱ ሇገጠር ቀበላ responsibties conferred upon city አስተዲዯሮችም ይሰራለ:: administrations under this Proclamation shall likewise be deemed to apply to rural kebele administrations. ፳፩. በዯረቅ ቆሻሻ አያያዝና አወጋገዴ 21. Participation of the private sector የኢንተርፕራይዞች እና የግለ ዘርፍ ተሳትፎ and enterprises in the management and disposal of solid waste ፩/ በዯረቅ ቆሻሻ አያያዝና አወጋገዴ 1/ Private sector entities and የሚሰማሩ የኢንተርፕራይዞች እና enterprises seeking to engage in የግለ ዘርፍ ከባሇሥሌጣኑ ወይም solid waste management and አግባብነት ካሇው የክሌሌ አካባቢ ጥበቃ disposal activities shall first መስሪያ ቤት ፈቃዴ ማውጣትና obtain a certificate of ፍቃዲቸውን በየዓመቱ ማሳዯስ competence from the Authority አሇባቸው፡፡ or the appropriate Regional Environmental Protection Office, and shall thereafter renew such certificate on an annual basis. ፪/ የከተማና የገጠር አስተዲዯሮች እንዯ 2/ City and rural kebele አስፈሊጊነቱ የዯረቅ ቆሻሻ አያያዝና administrations may, where አወጋገዴ አገሌግልቶችን በጥቅሌ deemed appropriate, delegate all ወይም በተናጠሌ ሇግሌ ባሇሀብቶች፣ or part of their solid waste መንግስታዊ ሊሌሆኑ ዴርጅቶች ወይም management and disposal ኢንተርፕራይዞች ሉያስተሊሌፉ responsibilities to private ይችሊለ፡፡ investors, non-governmental organizations, or other qualified enterprises.

፲፱ሺ፲ 19010 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፫/ የከተማ አስተዲዯሮች በዯረቅ ቆሻሻ 3/ City administrations shall extend አያያዝ ሇሚሰማሩ ኢንተርፕራይዞችና the necessary support to private የግለ ተቋማት አስፈሊጊውን ዴጋፍ sector entities and enterprises ማዴረግ አሇባቸው፡፡ seeking to engage in solid waste management operations. ፳፪. የሙያ ዯኀንነት፣ጤንነትና የሥራ 22. Protection of Occupational Safety, አካባቢ Health, and Workplace environment ፩/ ማንኛውም በዯረቅ ቆሻሻ አያያዝና 1/ Any facility engaged in solid አወጋገዴ ሊይ የተሰ ማራ ተቋም waste management and disposal የሠራተኞችን ዯኅንነትና ጤንነት shall implement appropriate በሚገባ ሇመጠበቅ የሚያስፈሌጉ measures to ensure the adequate እርምጃዎችን መውሰዴ protection of the health and ይኖርበታሌ፡፡ safety of their workers. ፪/ በአሠሪና ሠራተኛ አዋጅ ወይም 2/ The occupational health and በላልች ህጎች ሊይ የተዯነገገው safety standards set forth under የሙያ ዯኀንነት፣ ጤንነትና የሥራ the Labor Proclamation and other አካባቢ መስፈርቶች በዯረቅ ቆሻሻ laws shall apply to all individuals አያያዝና አወጋገዴ ሊ ይ ሇተሰማሩ engaged in solid waste ሰዎችም ተግባራዊ ይሆናሌ፡፡ management and disposal activities. ክፍሌ ስዴስት PART SIX ሌዩ ሌዩ ዴንጋጌዎች MISCELLANEOUS PROVISIONS ፳፫. የዯረቅ ቆሻሻ አያያዝና አወጋገዴ 23. Solid Waste Management and አገሌግልት ክፍያ Disposal Service Charge ፩/ ማንኛውም ሰው ሇዯረቅ ቆሻሻ አያያዝና 1/ Every person shall have the አወጋገዴ አገሌግልት ክፍያ የመፈጸም obligation to pay the prescribed ግዳታ አሇበት፡፡ service fee for solid waste management and disposal service.

፲፱፲፩ 19011 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፪/ የዯረቅ ቆሻሻ አያያዝና አወጋገዴ 2/ The Council of Ministers may አገሌግልት ክፍያ በሚኒስትሮች ምክር issue Regulation governing the ቤት በሚወጣ ዯንብ ይወሰናሌ። determination and administration of fees related to solid waste management and disposal service. ፳፬. አስተዲዯራዊ እርምጃዎች 24. Administrative measures ባሇስሌጣኑ በአዱስ አበባ ከተማ አስተዲዯር The Authority shall issue directive እና ዴሬዲዋ ከተማ አስተዲዯር ሊይ ተፈጻሚ applicable to the Addis Ababa and the የሚሆን፣ የክሌሌ የአካባቢ ጥበቃ ባሇስሌጣን Dire Dawa City Administration, and በክሌሌ ዯረጃ ተፈጻሚ የሚሆን መመሪያ the Regional Environmental በማውጣት ይህን አዋጅ በመተሊሇፍ Protection Office shall issue directive በሚፈፀሙ የሚከተለት አስተዲዯራዊ applicable to the Region for the ጥፋቶች ሊይ የሚወሰዴ አስተዲዯራዊ purpose of prescribing administrative እርምጃን እንዯአካባቢ እና ነባራዊ ሁኔታው measures to be taken in response to እያዩ ይወስናለ፡- the commission of the following administrative offenses in violation of this Proclamation: ፩/ ከጉዴፍ መጣያ ቦታ ውጭ በመኪና 1/ Disposing of litter in driveways, መንገዴ፣ በእግረኛ መንገዴ፣ በፓርኮችና sidewalks, parks, or similar በመሳሰለ ቦታዎች ጉዴፎችን መጣሌ፤ public areas outside of designated waste receptacles; ፪/ ከባሇስሌጣኑ ወይም ከክሌሌ የአካባቢ 2/ Undertaking solid waste ጥበቃ መስሪያ ቤት ፍቃዴ ሳያገኝ management and disposal በዯረቅ ቆሻሻ አያያዝና አወጋገዴ ስራ activities without first obtaining ሊይ መሰማራት፤ the required license from the authority or the relevant regional environmental protection office; ፫/ በዚህ አዋጅ ከተቀመጠው አግባብ ውጭ 3/ Disposing of solid waste through የዯረቅ ቆሻሻን በማቃጠሌ ማስወገዴ፤ open burning, except in circumstances expressly permitted under this Proclamation;

gA ፲፱ሺ፲፪ Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page 19012 ፬/ በቆሻሻ ማሰባሰቢያ ማዕከሌ የተቀመጠ 4/ Damaging, destroying, relocating, የቆሻሻ መያዣን ማውዯም ወይም ጉዲት or causing loss to containers ማዴረስ፤ placed at solid waste collection centers; ፭/ ዯረቅ ቆሻሻን ከተሽከርካሪ፣ ከመኖሪያ 5/ Illegally placing, throwing, or ቤት ወይም ከማንኛውም ቅጥር ግቢ depositing solid waste from አውጥቶ ወዯ አሌተፈቀዯ ቦታ መወርወር፣ vehicles, residences, compounds, ማስቀመጥ ወይም ማከማቸት፤ or premises onto roads or other public spaces not authorized for such use; ፮/ በዯረቅ ቆሻሻ አያያዝ፣ አሰባሰብና አጓጓዝ 6/ Causing obstruction, interference, ሊይ እክሌ መፍጠር፤ or impairment in the handling, collection, or transportation of solid waste; ፯/ ሳያስፈቅዴ አካባቢን የሚያቆሽሽ 7/ Conducting advertising activities የማስታወቂያ ሥራ ማከናወን፤ that result in environmental pollution without prior authorization; ፰/ የሞቱ እንስሳትን ሇእነዚህ ተብሇው 8/ Depositing, placing, or storing ከተወሰኑ ቦታዎች ውጭ መጣሌ፤ dead animals outside areas designated for such purposes; ፱/ በዚህ አዋጅ አንቀፅ ፲፬ በሌዩ ሁኔታ 9/ Subject to the special conditions ከሚፈቀዴ ሇአንዴ ጊዜ ጥቅም ሊይ set forth in this Proclamation for የሚውሌ ፕሊስቲክ በሚቃረን ሁኔታ single-use plastics product: ሇአንዴ ጊዜ ጥቅም ሊይ የሚውሌ ፕሊስቲክ፡- ሀ) መጠቀም ወይ ሇመጠቀም ይዞ a) Using or intending to use መገኘት፤ single-use plastic products; ፲፱ሺ፲፫ 19013 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page

ሇ) ማምረት ወይም ወዯ ሃገር ውስጥ b) Manufacturing, importing, ማስገባት፣ ሇገበያ ማቅረብ ወይም marketing, selling, storing, መሸጥ፣ ሇንግዴ ዓሊማ ማከማቸት or possessing single-use ወይም ይዞ መገኘት፤ plastic products for commercial purposes. ፲/ ላልች በጥናት የሚሇዩ መሰሌ ጥፋቶች። 10/ Other related administrative. Violations. ፳፭. የወንጀሌ ተጠያቂነት 25. Criminal liability ፩/ ማንኛውም ሰው የፕሊስቲክ ከረጢት፡- 1/ Any individual who: ሀ) ከተጠቀመ ወይም ሇመጠቀም ይዞ a) Uses or intends to use a ከተገኘ ከሁሇት ሺህ plastic bag shall be subject to ብር በማያንስና ከአምስት ሺህ a fine of no less than ብር በማይበሌጥ የገንዘብ መቀጮ two thousand birr and no ይቀጣሌ፤ more than five thousand birr; ሇ) ካመረተ ወይም ወዯ ሀገር ውስጥ b) Manufactures, imports, ካስገባ፣ ሇገበያ ካቀረበ ወይም ከሸጠ፣ distributes, sells, stores, or ሇንግዴ አሊማ ካከማቸ ወይም ይዞ possesses plastic bags for ከተገኘ ከሀምሳ ሺህ ብር በማያንስና commercial purposes shall ከሁሇት መቶ ሺህ ብር በማይበሌጥ be subject to a fine of no less የገንዘብ መቀጮ እና ከአምስት than fifty thousand birr and አመት በማይበሌጥ ጽኑ እስራት no more than two hundred ይቀጣሌ፡፡ thousand birr, along with a term of rigorous imprisonment not exceeding five years. ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) 2/ Notwithstanding the provisions የተመሇከቱትን የወንጀሌ ዴርጊቶች of Sub-Article (1) of this የፈጸመዉ ህጋዊ ሰውነት ያሇዉ ዴርጅት Article, if the offence is በሚሆንበት ጊዜ የገንዘብ ቅጣቱ በንዑስ committed by an institution, አንቀጹ የተመሇከተዉን ሶስት እጥፍ the penalty to be imposed ይሆናሌ፡፡ shall be three times the amount prescribed therein.

፲፱ሺ፲፬ 19014 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page ፫/ በዚህ አንቀጽ የተመሇከተው የወንጀሌ 3/ The criminal penalties outlined in ተጠያቂነት በዚህ አዋጅ እና አዋጁን this Article do not preclude the ተከትል በሚወጣ መመሪያ መሰረት possibility of administrative ሉወሰደ የሚችለ አስተዲዯራዊ actions being taken in accordance እርምጃዎችን የሚያስቀር አይሆንም። with this Proclamation and the directives issued pursuant to it. ፳፮. ዯንብና መመሪያ የማውጣት ሥሌጣን 26. Power to Issue Regulations and Directives ፩/ የሚኒስትሮች ምክር ቤት ይህንን አዋጅ 1/ The council of Ministers may issue ተግባራዊ ሇማዴረግ የሚያስፈሌጉ regulations necessary for the ዯንቦችን ሉያወጣ ይችሊሌ፡፡ implementation of this Proclamation. ፪/ ባሇሥሌጣኑ ይህን አዋጅ እና በዚህ 2/ The authority may issue directives አዋጅ መሰረት የሚወጣውን ዯንብ for the implementation of this ሇማስፈፀም የሚያስፈሌጉ መመሪያዎችን Proclamation and the regulation ሉያወጣ ይችሊሌ፡፡ issued pursuant to this Proclamation. ፳፯. የተሻሩና ተፈፃሚነት የላሊቸው ሕጎች 27. Repeals ፩/ የዯረቅ ቆሻሻ አያያዝ አዋጅ ቁጥር 1/ Solid Waste Management ፭፻፲፫/፩ሺ፱ሺ፺፱ በዚህ አዋጅ ተሽሯሌ፡፡ Proclamation No. 513/2007 is hereby by repealed. ፪/ ይህንን አዋጅ የሚቃረን ማንኛውም 2/ No law, regulation, directive or አዋጅ፣ዯንብና መመሪያ ወይም ሌማዲዊ practice shall, in so far as it is አሰራር በዚህ አዋጅ የተዯነገጉትን ጉዲዮች inconsistent with this በተመሇከተ ተፈፃሚነት አይኖረውም፡፡ Proclamation, have effect on matters provided for in this Proclamation. ፲፱ሺ፲፭ 19015 gA Ød‰L ነU¶T Uz¤È qÜ_R ፶፰ ሐምላ ፳፬ ቀን ፪ሺ፲፯ ›.M Federal Negarit Gazette No. 58, 31st July, 2025. page
