WHEREAS, it is essential to xesettle, by employing ap­ propriate methods, those pel!ple who have no or insufllclent or overutilized land holdings 01'. are displaeed due to natural « man-made disast~rs, or are jobi- as well as those pc~ who \ead 1>0madic and similar patte.ms rl. life on such hinds which, for various reasons, are lying idle; WHEREAS, the organization of people so rese~ed along lines of socialist methods of productioo is an endeavour that promotes, the Jiving standards of the ~le and enhances the economic development of the oountry; WHEREAS, it is believed that the rehabilitation of people displaced due to natur-al and man-made disasters and the im­ plementation of settlement programmes are inter-related activities which, if carried. out in an integrated manner by an autonom­ ous organization, can yield maximum rewlts; WHEREAS, to achieve these objectives, it is 11eceBSary to establish an autonomous Government Office .!llld to define its powers and duties; 1lt !~ );:,t-1- ;JIJ.tlJ .,,. Short Title This Proclamation may be cited as the "Relief and Reha­ bilitation Commission Establishment Proclamation No, 173 /1979." 2 . Definitions In this Proclan1ation, unless the context otherwise requires: 1) "disaster" means any flood, drought, fire, whirlwind, earthquake or Wal" the consequences of which could not be covered· by the resources of the people of the area or the concerned Government Office and includes any other disaster which in the determination of the Commission warrants assistance by the Government; 2) "Government Office" means any organ, branch, or any central or local office of the State, any of its agencies, .public enterprise, or any other organization in which the State has 51 % or more financial interest but shall not include the courts; 3) "settlement'' means the act of e~tablisl,ing settlers in agricultural or other activities; 4) "settler" means any person who needs to be rehabi­ litated because of disaster or who has no or insuffi­ cient land holdings or who has no or insufficient job or whose land holdings have been earmarked for the purpose of implementing Government land utilizaition programmes or who leads nomadic or similar patterns of life and who is covered by the settlement pro­ gramme of the Commission; 5) "relief" means the supply of food, water, med.kine, clothing, shelter and similar basic necessities to disaste1-afle<:ted people until such people become self. supporting, are rehabilitated>'-or resettled; 6) "rehabilitation" means the preparation and implemen­ tation of programmes which will enable disaster­ affected people to be se1f-supporting and to protect themselves from possible futme disasters; 7) "person" means any natural or juridical persoo, 3, Repeal The Relief and Rehabilitation Commission Order No, 93/ 1974 and the Settlement Authority Establishment Procla­ mation No, 78/1976 are hereby repealed. 1K" !I~ ).,'.16:,. ;,lf.llJ· .,,. Establishment 1) There is hereby established a Relief and Rehabilitation Commission (her~inafter the "Commission") as an autonomous public authority. 2) The Commission shall be accountable to the Office of the Chairman of--t11e Counci of Ministers. 5 . Transfer of Rights· and Liabilities All the movable and immovable property, . assets and. lia­ bilities of the Relief and Rehabilitation Com~ission esta­ blished by Order No. 93/1974 and the Settlement Authority established by· Proclamation No. '78/1976 are hereby trans ferrcd to the Commission. 6. Head Office The Commission shall have its head office in Addis Ababa and may hav~ branch offices elsewher e in Ethiopia. 7. Purposes of the Commission The purposes of the Commission shall be: 1) in ease of disaster, ,to co-ordinate relief activities and distribute relief aid· to disaster-affected. people; 2) to find and implement ways to rehabilitate disaster­ affected people; 3) to take or cause to be taken the necessary measures to prevent possible disaster or minimize its conse­ quences; 4) to settle settlers in -settlement areas; to assist settlers to organize themselves and organize them in various coopers1tives. 8. Powers and 'Duties of the Commission The Commission shall have all the powers necessary for the attainment {)f its purpose6. These include: 1 ) to extend relief aid to, or rehabilitate, disaster-affected people; 2) in accordance with directives issued to it by the Go­ vernment, to request for and receive any form of assistance from domestic or foreign sources and for this purpose, to consult with the appropriate Govern­ ment institutions, ambassadors of friendly nations, the United Nations and other organizations and indivi­ duals; 3) to register and administer any form of assistance obtained from domestic and foreign sources; 4) in case of disaster, to conduct study regarding the n'ature, magpitude and extent of the disaster and make known same together. with the measures th,at should be taken in connection there with deterhtlne priorities for ass is lance; 5) 10 make known oofo.rehand and study the cause of disasters; to take or caus.e to be taken short 3,nd long term preventive measures against 'disasters; 1K' !Ji ~;,t,,1- ;,tt."I .,.. Meetings of the Council I) The Council shall meet at least once a ye-ar. It. shall · also meet at shorter inte.rviils where the Chaimls.n or two-thirds of the members so request. 2) There shall be quorum for the meetings of the Council when \he rnajority o! its members are present. 3) Decisions of the Council shall be given by majority vote; in case of a ti,e, the Chairman &hall have a · casting vote. 4) The Council may issue its own rules of procedure. 13 . The Commissioner and Deputy Coinmissioners 1) The Commissionet and Deputy Commissioners of the Commission shall be app0inted by the Gc,vernment. 2) The Commissic-ne.r shall be the chief executive officer of the Commission ood shall, subject to the general directions of foe Office of the Chairman of the Council of Ministers, be responsible for the proper operation of· the activities cf the Colill\li~sion. Without limiting the generality of the foregoing, the Commissioner shall:. (a) employ, promote, ·transfer, and dismiss personnel in acc'ordance with regulations the Commission issues in line with the principles embodied· in public ~ervice laws; (b) prepare an.d submit the annual budget and work programme of the Commission; ( c) prepare and submit to the Office of the Chairman of the Council of Ministers within four months after the end of the fiscal year, an annual finan­ cial and operational report of the Commission; (d) subject to the other provisions of this Procla­ mation, perform the ·powers and duties of the Commission vested in it hereunder; (e) effrct expenditures in accordance. with the ap­ proved annunl budget and work programme of the .Commission; (f) delegate all or part of his powers to the Jjeputy Commissioners or to other employees of the Commission to the extent necessary for the e,f­ fective performance of the activities of the Com­ n1ission. 15. Funa l) The budget of the Commission shall be drawn from the following sources: (a) proceeds received by the Oommission i,n the form of aid and donations; (b) proceeds from sales of property; ( c) Government subsidy. 2) The fund established under sub-article ( 1 ) of .this Article shall be lodged in the National Bank of Ethiopia, or in a bank designated by it, in a separate account in the name of the Commission and shall be expended to give effect to the purposes of the Cmmnission. 16. Books of Accounts and Fiscal Year 1) The Commission shall keep complete and accurate books of accounts. 2) The books of accounts and all financial affairs of the Commission ,hall be audite.d at least once a year by the Auditor-General or . by an auditor designated hy him. 3) The Commission shall prepare and submit to the Council of Ministers, within four months from .the . end of its fiscal year, an annual report on its activities. 4) The li~cal year of the Commission shall begin on the I st day of liam/e and end on the 30th day of Sene. 17.
