P.O.Box 80001 ÃNÇ êU Unit Price የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ፌደራል ነጋሪት ጋዜጣ FEDERAL NEGARIT GAZETTE OF THE FEDERAL DEMOCRATIC REPUBLIC OF ETHIOPIA በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ የሕዝብ ተወካዮች ምክር ቤት ጠባቂነት የወጣ ደንብ ቁጥር ፫፻፸፯ /፪ሺ፰ ዓ.ም “የጥራጥሬ ምርቶች ግብይት የሚኒስትሮች ምክር ቤት ደንብ…………………….…………………………….…ገጽ ፰ሺ፱፻፲፩ Regulation No.377/2016 Pulses Transaction Council of Ministers Regulation……………………..……..Page 8911 የሚኒስትሮች ምክር ቤት ደንብ ቁጥር ፫፻፸፯/፪ሺ፰ ስለጥራጥሬ ምርቶች ግብይት የወጣ የሚኒስትሮች ምክር ቤት ደንብ የሚኒስትሮች ምክር ቤት የኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ አስፈፃሚ አካላትን ሥልጣንና ተግባር ለመወሰን በወጣዉ አዋጅ ቁጥር ፱፻፲፮/፪ሺ፰ አንቀጽ ፭ እና በኢትዮጵያ ምርት ገበያ ማቋቋሚያ አዋጅ ቁጥር ፭፻፶/፲፱፻፺፱ (በአዋጅ ቁጥር ፮፻፷፭/፪ሺ፪ እንደተሻሻለ) አንቀጽ ፴፩(፪) መሠረት ይህንን ደንብ አዉጥቷል፡፡ ክፍል አንድ ጠቅላላ ፩. አጭር ርዕስ ይህ ደንብ “የጥራጥሬ ምርቶች ግብይት የሚኒስትሮች ምክር ቤት ደንብ ቁጥር ፫፻፸፯/፪ሺ፰” ተብሎ ሊጠቀስ ይችላል፡፡ ፪. ትርጉም በዚህ ደንብ ዉስጥ ፦ ፩/ “የጥራጥሬ ምርቶች” ማለት ከነጭ ቦሎቄ ውጭ ያሉ የተለያዩ የቦሎቄ ዝርያዎች፣ ማሾ፣ አኩሪ አተር፣ ምስር፣ ባቄላ፣ ሽምብራ፣ አተር፣ ጓያ፣ ግብጦ እና የመሳሰሉት ናቸው፤ ፪/ “የመጀመሪያ ደረጃ ግብይት ማዕከል” ማለት ለጥራጥሬ ምርቶች መገበያያነት እንዲሆን አግባብነት ባለዉ የክልል አካል የተከለለ ስፍራ ነዉ፤ Council of Ministers Regulation No. 377/2016 COUNCIL OF MINISTERS REGULATION TO PROVIDE FOR PULSES TRANSACTION This Regulation are issued by the Council of Ministers pursuant to Article 5 of the Definition of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation No. 916/2015 and Article 31(2) of the Ethiopian Commodity Exchange Proclamation No.550/2007 (as amended by Proclamation No. 665/2010). PART ONE GENERAL 1. Short Title This Regulation may be cited as the “Pulses Transaction Council of Ministers Regulation No.377 /2016”. 2. Definition In this Regulation: 1/ “pulses” means pea beans varieties other than white pea beans, mung beans, soya beans, lentils, fava beans, chick peas, field peas, grass peas, lupine beans and the like; 2/ “primary transaction centers” means places designated by an appropriate regional organ for pulses transaction; 22nd Year No.48 ADDIS ABABA 4th March, 2016 ሃያ ሁለተኛ ዓመት ቁጥር ፵፰ አዲስ አበባ የካቲት ፳፭ ቀን ፪ሺ፰ ዓ.ም https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8912 ፫/ “አገልግሎት ሰጪ” ማለት የጥራጥሬ ምርትን በማዘጋጀት፣ በማከማቸት ወይም በማጓጓዝ አገልግሎት ላይ የተሰማራ ማንኛውም ሰዉ ነዉ፤ ፬/ “የአቅርቦት ጥራጥሬ ምርት” ማለት በአቅራቢ፣ በአምራች ወይም በህብረት ስራ ማህበር አማካኝነት ከመጀመሪያ ደረጃ ግብይት ማዕከላት ተገዝቶ በቀጥታ ለኢትዮጵያ ምርት ገበያ የሚቀርብ ለኤክስፖርት ያልተዘጋጀ የጥራጥሬ ምርት ነው፤ ፭/ “አቅራቢ” ማለት ከመጀመሪያ ደረጃ ግብይት ማዕከላት የገዛዉን የጥራጥሬ ምርት ወደ ኢትዮጵያ ምርት ገበያ የሚያቀርብ ማንኛዉም ሰዉ ነዉ፤ ፮/ “ሸማቾች” ማለት የጥራጥሬ ምርቶችን በመግዛት ለፍጆታ የሚጠቀሙ ሲሆኑ በከፍተኛ መጠን በመግዛት ለፍጆታ የሚያውሉ የግል ድርጅቶችን፣ የሸማቾች ህብረት ሥራ ማህበራትን፣ የመከላከያ ተቋማትን፣ የትምህርት ተቋማትን እና ሌሎች ተመሳሳይ ተቋማትን ያካትታል፤ ፯/ “ላኪ” ማለት ከኢትዮጵያ ምርት ገበያ የገዛዉን የጥራጥሬ ምርት ለዉጭ ገበያ በሚመጥን ደረጃ አዘጋጅቶ የሚልክ ሰው ወይም በራሱ ማሳ ያመረተውን የጥራጥሬ ምርት ለዉጭ ገበያ በሚመጥን ደረጃ አዘጋጅቶ የሚልክ አነስተኛ አምራች፣ የገበሬዎች ህብረት ሥራ ማህበር ወይም የእርሻ ድርጅት ነዉ፤ ፰/ ”ጅምላ ነጋዴ” ማለት በአምራች አካባቢዎች ከሚገኙ የመጀመሪያ ደረጃ ግብይት ማዕከላት የጥራጥሬ ምርቶችን በመግዛት አምራች ባልሆኑ አካባቢዎች ላሉ የእህል ቸርቻሪ ነጋዴዎች የሚሸጥ ማንኛውም ሰው ነው፤ ፱/ “ቸርቻሪ ነጋዴ” ማለት የጥራጥሬ ምርትን ከመጀመሪያ ደረጃ ግብይት ማዕከል ገዝቶ በቀጥታ ለሸማቾች በመሸጥ ንግድ የተሰማራ ሰው ነው፤ ፲/ “አምራች” ማለት አነስተኛ አምራች ገበሬዎች፣ የገበሬዎች ህብረት ሥራ ማህበራትን፣ የእርሻ ድርጅቶችን፣ በኮንትራት የሚያስመርቱትን ጨምሮ ማንኛውም የጥራጥሬ ሰብሎችን የሚያመርት ሰው ነው፤ ፲፩/ “የግብይት ተዋናይ” ማለት የጥራጥሬ ምርቶች ሸማች፣ ሸማቾች ህብረት ሥራ ማህበር፤ ቸርቻሪ ነጋዴ፣ ጅምላ ነጋዴ፣ አቅራቢ፣ አቀናባሪ፣ ላኪ እና አገልግሎት ሰጪ ድርጅት ነው፤ ፲፪/ “አቀናባሪ” ማለት የማቀናበሪያ ኢንዱስትሪ ተጠቅሞ እሴት የተጨመረባቸውን የጥራጥሬ 3/ “service provider” means any person engaged in processing, warehousing or transporting pulses; 4/ ”supply pulses ” mean pulses that has not been processed for export but purchased from primary transaction centers by supplier, producer or cooperative society and directly delivered to the Ethiopia Commodity Exchange; 5/ “supplier” means any person who purchases pulses from primary transaction centers for delivery to the Ethiopia Commodity Exchange; 6/ “consumers” means persons who purchase pulses for consumption and includes private firms, consumer cooperative societies, defense institutions, educational institutions and other similar institutions who purchase large volume of pulses for consumption; 7/ “exporter” means a person who purchases pulses at the Ethiopia Commodity Exchange and processes and exports same in compliance with standard applicable to export, or small scale farmer, co-operative society, farm enterprise who collect pulses from own farm and processes and exports pulses in compliance with standard applicable to export; 8/ “wholesaler” means any person who purchases pulses from primary transaction centers of pulses producing areas and sales same to grain retailers situated in non-producing areas; 9/ “retailer” means any person engaged in purchasing of pulses from primary transaction centers and sales directly to consumers; 10/ “producer” means any person engaged in pulses production and including small scale farmers, co-operatives societies, farm enterprises and out growers; 11/ “transaction actor” means consumers, cooperative society, retailer, wholesaler, supplier, processor, exporter and service provider of pulses; 12/ “processor” means any person who produces value added pulse products by using processing industry and supply these products to the market; ፰ሺ፱፻፲፪ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8913 ምርቶች የኢንዱስትሪ ምርት በማምረት ለገበያ የሚያቀርብ ማንኛውም ሰው ነው ፲፫/ “አሳሳች ድርጊት” ማለት የጥራጥሬ ምርቶች ዋጋን፣ መጠንን፣ ጥራትን ወይም ዓይነትና ዝርያን እንዲሁም የነዚህን ማንኛውንም መረጃ በተመለከተ የግብይት ተዋንያንና የሚመለከታቸው አካላትን ሊያሳስት ወይም ሊያታልል የሚችል ወይም የሃገሪቱን የጥራጥሬ ምርቶች ተቀባይነት የሚቀንስ ተግባር ነው፤ ፲፬/ “ማዘጋጀት” ማለት የጥራጥሬ ምርቶችን አበጥሮና ከባዕድ ነገር አፅድቶ ለገበያ ለማቅረብ ማሰናዳት ነው፤ ፲፭/ “አግባብነት ያለው የክልል አካል”ማለት ንግድን ለመምራት ሥልጣን የተሰጠው የክልል አካል ነው፡፡ ፲፮/ “ክልል” ማለት በኢትዮጵያ ፌደራላዊ ዲሞክራሲያዊ ሪፐብሊክ ሕገ መንግሥት አንቀጽ ፵፯ የተመለከተው ማንኛውም ክልል ሲሆን የአዲስ አበባና የድሬድዋ ከተማ አስተዳደሮችን ይጨምራል፤ ፲፯/ “ሚኒስቴር” ወይም "ሚኒስትር" ማለት እንደቅደም ተከተሉ ተከተሉ የንግድ ሚኒስቴር ወይም ሚኒስትር ነው፤ ፲፰/ “አግባብ ያለው ሴክተር መሥሪያ ቤት" ማለት የጥራጥሬ ምርቶችን ለማዘጋጀት፣ ለማከማቸት፣ ለማጓጓዝ ወይም ለማቀናበር ወይም ለመሰል ተግባራት የብቃት ማረጋገጫ ለመስጠት በሕግ ሥልጣን የተሰጠው አካል ነው፤ ፲፱/ “ሰው” ማለት የተፈጥሮ ሰው ወይም በሕግ የሰውነት መብት የተሰጠው አካል ነው፤ ፳/ ማንኛውም በወንድ ጾታ የተገለጸው ሴትንም ይጨምራል፡፡ ፫. የተፈፃሚነት ወሰን ይህ ደንብ በጥራጥሬ ሰብሎች አምራቾች እና የግብይት ተዋንያን ላይ ተፈፃሚ ይሆናል፡፡ ክፍል ሁለት የጥራጥሬ ምርቶች ግብይት ፬. የመጀመሪያ ደረጃ ግብይት ማዕከላት ፩/ በመጀመሪያ ደረጃ የግብይት ማዕከላት የአቅርቦት ጥራጥሬ ምርት ግብይት ሻጭ በሆነ አምራች እና ገዢ በሆነ ሸማች ወይም ጅምላ ነጋዴ ወይም አቀናባሪ ወይም ቸርቻሪ ነጋዴ ወይም አቅራቢ መካከል ብቻ የሚከናወን ይሆናል፡፡ ፪/ አግባብነት ያለው የክልል አካል በጥራጥሬ ምርት ግብይት ጉዳይ በሕግ ሥልጣን ከተሠጣቸው ከሌሎች አካላትጋር በመመካከር በጥራጥሬ 13/ “manipulation” means any act that result or is likely to result in confusion or deception of market actors or the concerned body in relation to the price, quantity, quality or type of pulses and any information related to same and any act diminishing acceptability of the country’s pulses; 14/ “preparation” means making ready pulses for market after winnowing and making it clean from any foreign materials; 15/ “appropriate regional organ” means the regional organ vested with the power to lead trade activities; 16/ “region” means any regional state referred to in Article 47 of the Constitution of the Federal Democratic Republic of Ethiopia and includes the Addis Ababa and Dire Dawa City Administrations; 17/ “Ministry” or “Minister” means the Ministry or Minister of Trade, respectively; 18/ “appropriate sector office” an organ that is empowered to issue certificate of competence to prepare, store, transport, or process or to carry out other related activities in relation to pulses transaction; 19/ “person” means a natural or juridical person; 20/ any expression in the masculine gender includes the feminine. 3. Scope of Application This Regulation shall apply to producers and transaction actors of pulses. PART TWO PULSES TRANSACTIONS 4. Primary Transaction Centers 1/ Pulses transaction at primary transaction centers shall be effected only between pulses producers as a seller and consumer or wholesaler or processer or retailer or supplier of pulses as a buyer. 2/ The appropriate regional organ shall, in consultation with other relevant organs mandated for transaction pulses, determine the number and distribution of primary transaction centers in pulses producing areas. ፰ሺ፱፻፲፫ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8914 ምርቶች አምራች አካባቢ የሚከለሉትን የመጀመ ሪያ ደረጃ ግብይት ማዕከላት ብዛትና ሥርጭት ይወስናል፡፡ ፫/ አግባብነት ያለው የክልል አካል የመጀመሪያ ደረጃ የጥራጥሬ ምርቶች ግብይት ማዕከላትን ብዛትና ስርጭት ሲወስን የሚከተሉትን ከግምት ውስጥ ማስገባት ይኖርበታል ፦ ሀ) ለጥራጥሬ ምርቶች አምራቾችና አቅራቢዎች ያላቸውን ቀረቤታ፤ ለ) ተሽከርካሪን ለማስገባትና ለማስወጣት ያላቸውን አመቺነት፤ ሐ) የጥራጥሬ ምርቶች ግብይት አገልግሎት ለመስጠት ያላቸውን አመቺነት፤ እና መ) በትምህርት ቤቶች፣በጤና፣በእምነትተቋማት እና በሌሎች ማኅበራዊ አገልግሎት ሰጪ ተቋማት ላይ ተፅዕኖ በማይፈጥር ርቀት ላይ መገኘታቸውን፡፡ ፬/ የመጀመሪያ ደረጃ ግብይት ማዕከልን ለማስተዳደር ሥልጣን የተሰጠው አካል የግብይት ቦታው በጥራጥሬ ምርቶች ጥራት ላይ ተፅዕኖ ከሚያሳድሩ የአካባቢው ሁኔታዎች ነፃ እንዲሆን ከሌሎች የሚመለከታቸው አካላት ጋር በመተባ በር መስራት አለበት፡፡ ፭/ የመጀመሪያ ደረጃ የግብይት ማዕከላት አደረጃጀት፣ አሠራር እና አስተዳደር ክልሎች በሚያወጡት ሕግ ይወሰናል፡፡ ፭. በኢትዮጵያ ምርት ገበያ የጥራጥሬ ምርቶች ግብይት ፩/ በኢትዮጵያ ምርት ገበያ የአቅርቦት የጥራጥሬ ምርቶች ግብይት ሻጭ በሆኑ አምራቾች ወይም አቅራቢዎች እና ገዥ በሆኑ ላኪዎች፣ አቀናባ ሪዎች፣ ጅምላ ነጋዴዎች፣ የሸማቾች ህብረት ሥራ ማህበራት መካከል በገበያው ሥርዓት መሠረት የሚከናወን ይሆናል፡፡ ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተደነገገው ቢኖርም፡ ሀ) የኢትዮጵያ ምርት ገበያ ከፍተኛ ጥራት ላለውና የተሻለ ገቢ ለሚያስገኝ የአቅርቦት የጥራጥሬ ምርት ልዩ የማስተናገጃ ሥርዓት ሊያመቻች ይችላል፤ ለ) ህገ ወጥ ድርጊት ተፈፅሞበት በሚኒስቴሩ ወይም አግባብ ባለው የክልል አካል የተያዘ የጥራጥሬ ምርት ወይም አንድ ላኪ ወደ ውጭ ሲልክ የተረፈና ከአንድ 3/ The appropriate regional organ shall take the following factors into account in determining the number and distribution of pulses primary transaction centers: a) proximity for pulses producers and suppliers; b) accessibility for motor vehicle transport; c) convenience for service provision in connection with pulses transactions; and d) distance that does not create inconvenience on schools, health, and religious institutions and other social service providing institutions. 4/ The organ in charge of administrating primary transaction centers shall cooperate with the appropriate organ to clean the trading places from environ mental effects that may affect the quality of pulses. 5/ The organization, operation and administration of primary transaction centers shall be governed by laws to be issued by regions. 5. Pulses Transactions at the Ethiopian Commodity Exchange 1/ The supply pulses transaction at the Ethiopia Commodity Exchange shall be effected only between producers or suppliers as a seller and pulses exporters, processors, wholesalers, consumer cooperatives as a buyer following the Exchange’s Rules. 2/ Notwithstanding the provision of sub article (1) of this Article: a) the Ethiopia Commodity Exchange may put in place special procedures for transaction involving high quality supply pulses that may fetch high income; b) pulses seized as illegal by the Ministry or the appropriate regional organ, or remains of pulses from export the volume of which is less than a 20 feet container may be introduced for re-trade at the Ethiopian Commodity Exchange. ፰ሺ፱፻፲፬ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8915 ባለ ፳ እግር ኮንቴይነር በታች የሆነ የጥራጥሬ ምርት በድጋሚ ወደ ኢትዮጵያ ምርት ገበያ ቀርቦ ሊሸጥ ይችላል፤ ክፍል ሦስት ስለብቃት ማረጋገጫ ምስክር ወረቀት እና ስለግብይት ተዋንያን ግዴታዎች ፮. ስለብቃት ማረጋገጫ የምስክር ወረቀት የብቃት ማረጋገጫ የምስክር ወረቀት መያዝ ያለባቸውን ግብይት ተዋንያን ዝርዝር እና የብቃት ማረጋገጫ የምስክር ወረቀት አሰጣጥ አግባብ ያለው ሴክተር መስሪያ ቤት በሚያወጣው መመሪያ የሚወሰን ይሆናል፡፡ ፯. በጥራጥሬ ምርቶች ግብይት የተሠማራ ሰው ግዴታዎች ማንኛውም በጥራጥሬ ምርቶች ግብይት ሥራ ላይ የተሠማራ ሰው ፦ ፩/ የጥራጥሬ ምርቶች ግብይትን በዚህ ደንብ አንቀጽ ፬ እና ፭ መሠረት በመጀመሪያ ደረጃ ግብይት ማዕከላት ወይም በኢትዮጵያ ምርት ገበያ ብቻ የማካሄድ፤ ፪/ አግባብ ያለው አካል ለሥራው አፈጻጸም የሚያወጣቸውን መመሪያዎች የማክበርና የመፈፀም፤ ፫/ ለግብይት ካዘጋጃቸው የጥራጥሬ ምርቶች ለጥራት ምርመራ አገልግሎት ናሙና እንዲሰጥ ሲጠየቅ ወካይ ናሙና በነፃ የማቅረብ፤ ፬/ የየዕለቱን የጥራጥሬ ምርቶች ግዥና ሽያጭ መጠን፣ ደረጃና የዋጋ ዝርዝር እና ለግብይት ሥርዓቱ ጠቃሚ የሆኑ ማንኛቸውንም መረጃዎች መዝግቦ የመያዝና በሚመለከተው የመንግሥት አካል ሲጠየቅ የማሳየት፣ እንዲሁም ድርጅቱን በአካል በመገኘት ለመጎብኘት ወይም ክምችቱን ለማወቅ ሲፈለግ የመተባበር፤ ፭/ አሳሳች የጥራጥሬ ምርቶች ግብይት እና ሕገወጥ ዝውውር ከመፈፀም የመቆጠብ፡፡ ፰. የአቅራቢ ግዴታዎች ማንኛዉም አቅራቢ ፦ ፩/ ከመጀመሪያ ደረጃ ግብይት ማዕከላት የገዛዉን PART THREE CERTIFICATE OF COMPETENCE AND OBLIGATION OF PULSES TRANSACTION ACTORS 6. Certificate of Competence The lists of transaction actors’ subject to obtain certificate of competence and issuance of certificate of competence shall be determined by directive to be issued by appropriate sector office. 7. Obligations of Person Involved in Pulses Transaction Any person involved in pulses transaction shall: 1/ effect pulses transaction only at primary transaction centers and the Ethiopia Commodity Exchange in accordance with Article 4 and 5 of this Regulation; 2/ comply with all directives issued by the appropriate body for the proper execution of transaction; 3/ submit without any payment a representative sample from pulses prepared for transaction when so requested for quality inspection purposes; 4/ maintain a register of details of the daily pulses transaction quantity, grade and price and disclose the same to the relevant Government organ on demand and cooperate when physical presence for site visit or inventorying is required; and 5/ abstain from deceptive transaction and illegal transportation of pulses. 8. Obligations of Suppliers Any supplier shall have the following obligations: 1/ sell the pulses purchased from primary transaction centers at the Ethiopia Commodity Exchange within the same harvest year; 2/ ensure that the pulse submitted to the Ethiopia Commodity Exchange conforms to quality standard; 3/ supply for sell pulses from a particular origin without mixing it with pulses of other origins; ፰ሺ፱፻፲፭ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8916 የጥራጥሬ ምርት በምርት ዘመኑ ለኢትዮጵያ ምርት ገበያ በማቅረብ የመሸጥ፣ ፪/ ለኢትዮጵያ ምርት ገበያ የሚያቀርበው የአቅርቦት የጥራጥሬ ምርት ጥራቱን የጠበቀ መሆኑን የማረጋገጥ፣ ፫/ የአንድን አካባቢ የጥራጥሬ ምርቶች ከሌላ አካባቢ የጥራጥሬ ምርቶች ጋር ሳያደባለቅ የመሸጥ፣ ፬/ ለጥራጥሬ ምርቶች ማከማቻነት ብቻ በተፈቀደ መጋዘን ውስጥ የማከማቸት፣ ፭/ የጥራጥሬ ምርቶችን የጥራት ደረጃውን በጠበቀ ከረጢት ውስጥ የማከማቸት እና ጥራቱን በማይቀንስ ወይም በማያበላሽ ሁኔታ የማጓጓዝ፣ ግዴታዎች አሉበት፡፡ ፱. የላኪ ግዴታዎች ማንኛውም ላኪ ፦ ፩/ ወደ ውጭ አገር የሚልካቸውን የጥራጥሬ ምርቶች በአገሪቱ የጥራት ደረጃ መሠረት ወይም በአገሪቱ የጥራት ደረጃ ያልወጣለት ከሆነ በገዥው የጥራት ደረጃ መሠረት የማዘጋጀት፣ ፪/ የሚያደርገውን የጥራጥሬ ምርቶች ሽያጭ ስምምነትና ትክክለኛ ዋጋ ውል ከፈፀመ ፳፬ ሰዓት ባልበለጠ ጊዜ ውስጥ በኢትየጵያ ብሔራዊ ባንክ የማስመዝገብ እንዲሁም ለሚኒስቴሩና ለሌሎች የሚመለከታቸው አካላት በ፲፭ ቀናት ውስጥ የማሳወቅ፣ ፫/ ከኢትዮጵያ ምርት ገበያ የገዛውን የአቅርቦት የጥራጥሬ ምርት አንድ የምርት ዘመን ባለቀ ሁለት ወር ጊዜ ውስጥ አጠናቆ ወደ ውጭ የመላክ፣ ፬/ አሳማኝ ምክንያት በመኖሩ በኢትዮጵያ ብሔራዊ ባንክ ተፈቅዶ ካልተራዘመ በስተቀር ከገዢ ጋር የገባውን ውል በውሉ ጊዜ ውስጥ የመፈፀም፣ ፭/ የጥራጥሬ ምርቶችን ከኢትዮጵያ ምርት ገበያ ብቻ የመግዛት፣ ፮/ ወደ ውጭ ሲልክ የተረፈና ከአንድ ባለ ፳ እግር ኮንቴይነር በታች የሆነ ካልሆነ በስተቀር ከኢትዮጵያ ምርት ገበያ የገዛውን የጥራጥሬ ምርት በድጋሚ ወደ ኢትዮጵያ ምርት ገበያ ያለማቅረብ፣ ግዴታዎች አሉበት፡፡ 4/ store pulses in the authorized warehouse; and 5/ store pulses in a standard quality bag and transport it in a manner that may not compromise or diminish quality of pulses. 9. Obligation of Exporters Any exporter shall have the following obligations: 1/ process export pulses in accordance with the country’s quality standard or; the quality standard of the buyer, if there is no quality standard of the country; 2/ Register with the National Bank of Ethiopia the contract and the correct sales price not later than 24 hours after the conclusion of a contract of sale of pulses and notify the same to the Ministry and other concerned authorities within 15 days; 3/ export all supply pulses purchased at the Ethiopia Commodity Exchange within two month after the end of harvest year; 4/ without prejudice to the extension of the contract permitted by the National Bank of Ethiopia upon showing sufficient reasons, perform the contract he concludes with the buyer on the due date; 5/ purchase pulses only at the Ethiopia Commodity Exchange; 6/ not supply for re-trade to the Ethiopia Commodity Exchange pulses purchased at the Exchange, unless it is a leftover from export and the volume of which is less than a 20 feet container. 10. Obligation of Wholesalers Any wholesaler shall have the following obligations: 1/ purchase pulses only from Ethiopia Commodity Exchange; 2/ sell within the same harvest year the pulses purchased from Ethiopia Commodity Exchange to retailers or cooperatives; 3/ sell the pulses purchased from Ethiopia Commodity Exchange without mixing it with pulses of other origins or foreign matters; ፰ሺ፱፻፲፮ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8917 ፲. የጅምላ ነጋዴ ግዴታዎች ማንኛዉም ጅምላ ነጋዴ ፦ ፩/ የጥራጥሬ ምርቶችን ከኢትዮጵያ ምርት ገበያ ብቻ የመግዛት፣ ፪/ ከኢትዮጵያ ምርት ገበያ የገዛዉን የጥራጥሬ ምርት በምርት ዘመኑ ለቸርቻሪ ነጋዴዎች ወይም ለሸማቾች ኅብረት ሥራ ማህበራት የመሸጥ፣ ፫/ ከኢትዮጵያ ምርት ገበያ የገዛዉን የጥራጥሬ ምርት ከሌላ አካባቢ የጥራጥሬ ምርት እና ባዕድ ነገሮች ጋር ሳያደባልቅ የመሸጥ፣ ፬/ ለጥራጥሬ ምርቶች ማከማቻነት በተፈቀደ መጋዘን ብቻ የጥራጥሬ ምርቶች የማከማቸት፣ ፭/ የጥራጥሬ ምርቶችን የጥራት ደረጃውን በጠበቀ ከረጢት የማከማቸት እና ጥራቱን በማይቀንስ ወይም በማያበላሽ ሁኔታ የማጓጓዝ፣ ግዴታዎች አሉበት፡፡ ፲፩. የአገልግሎት ሰጪ ግዴታዎች ማንኛውም አገልግሎት ሰጪ ፦ ፩/ አግባብያለው ሴክተር መስሪያ ቤት ለአገልግሎቱ አሰጣጥ የሚያወጣቸውን መመሪያዎች የማክበርና የመፈፀም፣ ፪/ የተከለከሉ ተግባራትንና አሳሳች የጥራጥሬ ምርቶች ግብይት እና ዝውውርን ከመፈፀም የመቆጠብ፣ ፫/ ከሚያዘጋጀውና ከሚያጓጉዘው የጥራጥሬ ምርት ለጥራት ምርመራ አገልግሎት ናሙና እንዲሰጥ ሲጠየቅ ወካይ ናሙና በነፃ የማቅረብ፣ ፬/ ወደ ውጭ አገር የሚላኩ የጥራጥሬ ምርቶችን በአገሪቱ የጥራት ደረጃ መሠረት ወይም በአገሪቱ የጥራት ደረጃ ያልወጣላቸው ከሆነ በገዥው ጥራት ደረጃ መሠረት የማዘጋጀት፣ ፭/ የጥራጥሬ ምርቶችን ምርት ከአምራች አካባቢ ወደ ኢትዮጵያ ምርት ገበያ ወይም ወደ ወደብ ሲያጓጉዝ በሚመለከተው አስፈጻሚ አካል በፕሎምፕ የማሳሸግና የተሰጠውን መሸኛ የመያዝ፣ ፮/ የጥራጥሬ ምርቶችን ከማስጫኑ በፊት አሽከርካሪው እና ተሽከርካሪውን በዚህ ደንብና ደንቡን ተከትለው በሚወጡ መመሪያዎች መሠረት መሠማራታቸውን የማረጋገጥ፣ ፯/ የጥራጥሬ ምርቶች ማዘጋጃና ማከማቻ ድርጅቱ እና የመገልገያ መሣሪያዎቹ ደረጃቸውን 4/ store pulses only in the warehouse authorized for pulses storage; and 5/ store pulses in a standard quality bag and transport it in a manner that may not compromise or diminish quality of pulses. 11. Obligation of Service Providers Any service provider shall have the following obligations: 1/ comply with all directives to be issued by the appropriate sector office for the proper provision of service; 2/ abstain from any prohibited acts and deceptive transactions and transportation of pulses; 3/ submit without any payment a representative sample from the pulses he prepare or transport when so requested for quality inspection purpose; 4/ process export pulses in accordance with the country’s quality standard or; quality standard of the buyer, if there is no quality standard of the country; 5/ have sealed by the appropriate executive body and obtain a letter of release from such body, when transporting pulses from the production area to the Ethiopia Commodity Exchange or to the port; 6/ ensure before loading pulses for transportation that a vehicle and its driver comply with the provision of this Regulation and directives issued pursuant to this Regulation; 7/ keep approval document issued by appropriate body that his pulses processing and storage facility as well as equipment maintain the required standard.. 12. Obligation of Producer 1/ Any producer shall have the obligation to sale pulses produced from his own farm at a primary transaction centers or the Ethiopia Commodity Exchange. 2/ Notwithstanding sub-article (1) of this Article, any producer may, by himself or through a cooperative society in which he is a member, directly export or process and supply for market pulses produced from his own farm. ፰ሺ፱፻፲ ፯ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8918 የጠበቁ መሆናቸውን በሚመለከታቸው አካላት የተሰጠ ማረጋገጫ የመያዝ፣ ግዴታዎች አሉበት፡፡ ፲፪. የአምራች ግዴታዎች ፩/ ማንኛውም አምራች ከራሱ ማሳ ያመረተውን የጥራጥሬ ምርት በመጀመሪያ ደረጃ የጥራጥሬ ምርት ግብይት ማዕከላት ወይም በኢትዮጵያ ምርት ገበያ ብቻ የመሸጥ ግዴታ አለበት፡፡ ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) የተደነገገው ቢኖርም ማንኛውም አምራች ከራሱ ማሳ ያመረተውን የጥራጥሬ ምርት በግሉ ወይም አባል በሆነበት የህብረት ሥራ ማኅበር በኩል በቀጥታ ወደ ውጭ መላክ ወይም በማቀነባበር ለገበያ ማቅረብ ይችላል፡፡ ክፍል አራት የጥራጥሬ ምርቶች ግብይት ቁጥጥር ፲፫. የጥራጥሬ ምርቶች ደረጃ አሰጣጥና ስለማጓጓዝ ፩/ በአቅራቢ ወይም በአምራች ወደ ኢትዮጵያ ምርት ገበያ የሚጓጓዝ የጥራጥሬ ምርት ሲጫን አግባብነት ባለው የክልል አካል በተመደበ የግብይትና ጥራት ተቆጣጣሪ በጥራትና በዓይነቱ ላይ የመጀመሪያ ደረጃ ማጣሪያ ከተደረገ በኋላ ታሽጎ ወደ ኢትዮጵያ ምርት ገበያ መሸኘት አለበት፡፡ ፪/ የጥራጥሬ ምርት ኢትዮጵያ ምርት ገበያ ሲደርስ በወካይ ናሙና መሠረት አስፈላጊው ምርመራ ተደርጎለት በደረጃ መመደብ አለበት፡፡ ፫/ ለኤክስፖርት የተዘጋጀ የጥራጥሬ ምርት ተፈላጊውን የጥራት ደረጃ ስለማሟላቱ በሚኒስቴሩ ተረጋግጦ የምስክር ወረቀት እንዲያገኝ ከተደረገ በኋላ ታሽጎ ወደ ወደብ መሸኘት አለበት፡፡ ፲፬. የጥራጥሬ ምርቶች ግብይት ተቆጣጣሪዎችን ስለ መመደብ እንደ አግባቡ ሚኒስቴሩና አግባብ ያላቸው የክልል አካላት የጥራጥሬ ምርቶች ግብይት ተቆጣጣሪዎችን ይመድባሉ፡፡ ፲፭. የጥራጥሬ ምርቶች ግብይት ተቆጣጣሪ ሥልጣንና ተግባር በዚህ ደንብ አንቀጽ ፲፬ መሠረት የተመደበ ተቆጣጣሪ የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል ፦ ፩/ የዚህ ደንብ ድንጋጌዎችና ደንቡን ለማስፈጸም የወጡ መመሪያዎች መከበራቸውን ያረጋግጣል፤ PART FOUR PULSES TRANSACTIONS CONTROL 13. Grading and Transportation of Pulses 1/ The type and quality of pulses consigned to the Ethiopia Commodity Exchange by supplier or producer shall, be pre inspected and sealed by a transaction and quality inspector assigned by the appropriate regional organ. 2/ The pulses shall, upon arrival at the Ethiopia Commodity Exchange, be graded upon conducting appropriate test based on a representative sample. 3/ The grade of export pulses shall be certified by the Ministry and upon being sealed be transported to the port of shipment. 14. Assignment of Pulses Transaction Inspectors The Ministry and the appropriate regional organs shall, as may be appropriate, assign pulses transaction inspectors. 15. Powers and Duties of Pulses Transaction Inspectors An inspector assigned pursuant to Article 14 of this Regulation shall have the powers and duties to: 1/ ensure the implementation of the provisions of this Regulation and directives issued in accordance with this Regulation; 2/ supervise the transaction, storage, processing and transportation of pulses purchased at primary transaction center that they are carried out pursuant to this Regulation and directives issued for such purpose; 3/ seize, against issuance of a receipt, the illegally handled pulses or take sample of the pulses and seal the warehouse where the pulses are deposited, where he ascertains that the provisions of this Regulation or directives issued for the implementation of this Regulation are contravened; 4/ immediately report to the Ministry or the appropriate regional organ on the action he has taken pursuant to sub-article (3) of this Article; ፰ሺ፱፻፲፰ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8919 ፪/ በመጀመሪያ ደረጃ ግብይት ማዕከላት የሚካሄ ደው የጥራጥሬ ምርቶች ግብይት፣ አከመቻቸት፣ አዘገጃጀት እና አጓጓዝ በዚህ ደንብና በመመሪያ በተደነገገው አሠራርና ደረጃ መሠረት መሆኑን ይቆጣጠራል፤ ፫/ የዚህ ደንብ ድንጋጌዎች ወይም ይህንን ደንብ ለማስፈፀም የወጡ መመሪያዎች መጣሳቸውን ሲያረጋግጥ ሕገወጥ ድርጊት የተፈፀመበትን የጥራጥሬ ምርት ደረሰኝ ሰጥቶ ይይዛል ወይም ናሙና በነፃ ወስዶ የጥራጥሬ ምርቱ የተከማቸበትን መጋዘን ያሽጋል፤ ፬/ በዚህ አንቀጽ ንዑስ አንቀጽ (፫) መሠረት ስለተወሰደው እርምጃ ወዲያውኑ ለሚኒስቴሩ ወይም አግባብነት ላለው የክልል አካል ሪፖርት ያደርጋል፤ ፭/ በዚህ ደንብ አንቀጽ ፲፯ መሠረት መወሰድ ስላለባቸው ተከታታይ እርምጃዎች ከሚኒስቴሩ ወይም አግባብነት ካለው የክልሉ አካል የሚሰጠውን ትዕዛዝ በመከታተል ይፈፅማል፡፡ ፲፮. ሕገ ወጥ ድርጊቶችን ስለመጠቆም ፩/ ማንኛውም ሰው በጥራጥሬ ምርቶች ግብይት፣ አዘገጃጀት፣ ክምችት ወይም ማጓጓዝ ሂደት ላይ የዚህን ደንብ ድንጋጌዎች ወይም ደንቡን ለማስፈፀም የወጡ መመሪያዎችን በመተላለፍ ሕገ ወጥ ድርጊት መፈፀሙን ሲያውቅ በአካባቢው ለሚገኝ የጥራጥሬ ምርቶች ግብይትና ጥራት ተቆጣጣሪ ወይም ለሚኒስቴሩ ወይም አግባብነት ላለው የክልል አካል መጠቆም ይችላል፡፡ ፪/ በዚህ አንቀጽ ንዑስ አንቀጽ (፩) መሠረት ጥቆማ አቅርቦ ሕገ ወጥ ድርጊት የተፈፀመበትን የጥራጥሬ ምርት ያስያዘ ማንኛውም ሰው በዚህ ደንብ አንቀጽ ፲፯ (፬)(ለ) መሠረት የጠቋሚ አበል ይከፈለዋል፡፡ ፲፯. ስለተያዙ የጥራጥሬ ምርቶች እና ስለታሸጉ ማከማቻ መጋዘኖች ፩/ በዚህ ደንብ አንቀጽ ፲፭(፫) መሠረት የጥራጥሬ ምርት የተያዘበት ወይም የጥራጥሬ ምርቶች ማከማቻ መጋዘኑ የታሸገበት ማንኛውም ሰው በአምስት የሥራ ቀናት ውስጥ ተቃውሞውን ለሚኒስቴሩ ወይም አግባብነት ላለው የክልል አካል በጽሁፍ ማቅረብ ይችላል፡፡ 5/ follow up and implement instructions of the Ministry or the appropriate regional organ for taking subsequent actions in according with Article 17 of this Regulation. 16. Whistle Blowing 1/ Any person who is aware of an illegal act committed, in violation of the provisions of this Regulation or directives issued for the implementation of this Regulation, in the course of transaction, processing, storing or transporting pulses may inform the same to the nearest pulses quality and transaction inspector or to the Ministry or the appropriate regional organ. 2/ Any person who has submitted information in accordance with sub-article (1) of this Article that led to the seizure of pulses subject to the illegal act shall be entitled to the payment of whistle blower’s commission pursuant to Article 17(4)(b) of this Regulation. 17. Seized Pulses and Sealed Warehouses 1/ Any person whose pulses has been seized or his pulses warehouse had been sealed under Article 15(3) of this Regulation may submit his objection, in writing, to the Ministry or appropriate regional organ within five working days. 2/ The Ministry or the appropriate regional organ shall, within not exceeding one week, examine and give decision in writing on the objection. Where the decision of the Ministry or the appropriate regional organ: a) disapproves the actions of the inspector, the release of the seized pulses or the opening of the sealed pulses warehouse shall be immediately effected; b) approves the actions of the inspector, the pulses shall, after retaining sample, be sold to suppliers at primary transaction centers or to exporters at the Ethiopia Commodity Exchange where it is supply pulses, or to exporters at the Ethiopia Commodity Exchange where it is ፰ሺ፱፻፲፱ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8920 ፪/ ሚኒስቴሩ ወይም አግባብነት ያለው የክልሉ አካል ተቃውሞውን ከአንድ ሣምንት ባልበለጠ ጊዜ ውስጥ መርምሮ ውሳኔ በጽሁፍ ይሰጣል፡፡ የሚኒስቴሩ ወይም አግባብነት ያለው የክልል አካል ውሳኔ ፦ ሀ) የተቆጣጣሪውን እርምጃ የሚሽር ከሆነ ወዲያውኑ የተያዘው የጥራጥሬ ምርቱ ለአመልካቹ እንዲመለስ ወይም የተከማቸ በት መጋዘን እሽግ እንዲነሳ ይደረጋል፤ ወይም ለ) የተቆጣጣሪውን እርምጃ የሚያፀና ከሆነ የጥራጥሬ ምርቱን ናሙና በማስቀረት የአቅርቦት የጥራጥሬ ምርት ከሆነ በመጀመ ሪያ ደረጃ ግብይት ማዕከላት ለአቅራቢዎች ወይም በኢትዮጵያ ምርት ገበያ ለላኪዎች ወይም ለኤክስፖርት የተዘጋጀ የጥራጥሬ ምርት ከሆነ በኢትዮጵያ ምርት ገበያ ለላኪዎች እንዲሸጥ ተደርጎ ገንዘቡ በሚኒስቴሩ ወይም አግባብነት ባለው የክልል አካል በተከፈተ ዝግ የባንክ ሂሳብ ገቢ ይደረጋል፡፡ ፫/ በዚህ አንቀጽ ንዑስ አንቀጽ (፪)(ለ) የተመለከተ ውን ውሳኔ የሚቃወም የጥራጥሬ ምርቱ ባለቤት ውሳኔው በደረሰው በ፴ ቀናት ውስጥ አግባብ ላለው መጀመሪያ ደረጃ ፍርድ ቤት አቤቱታ ሊያቀርብ ይችላል፡፡ ፬/ በዚህ አንቀጽ ንዑስ አንቀጽ (፫) መሠረት አቤቱታ የቀረበለት ፍርድ ቤት ሚኒስቴሩ ወይም አግባብነት ያለው የክልል አካል የሰጠውን ውሳኔ ፦ ሀ) ከሻረው የጥራጥሬ ምርቱን ለመሸጥ የወጣው ወጪ ተቀናሽ ተደርጎ የሽያጩ ገንዘብ ለባለቤቱ ተመላሽ ይደረጋል፣ ወይም ለ) ካፀናው እና የጥራጥሬ ምርቱ ባለንብረት በፍትሐ ብሔር ሥነ-ሥርዓት ሕግ በተመለከተው የጊዜ ገደብ ውስጥ ለፍርድ ቤት ይግባኝ ካላቀረበ ከጥራጥሬ ምርቱ ሽያጭ ገንዘብ ውስጥ አስተዳደራዊ ወጪዎች ተቀንሰው ፵ መቶኛ ለጠቋሚው ወይም ያለጥቆማ የተያዘ ከሆነ ለያዘው የመንግሥት ፀጥታ ተቋም ይከፈላል፤ ቀሪው ፷ መቶኛ ለመንግስት ገቢ ይደረጋል፡፡ export pulses, and the proceeds of the sale shall be deposited in a blocked bank account opened in the name of the Ministry or the appropriate regional organ. 3/ The owner of pulses who objects the decision referred to in sub-article (2)(b) of this Article may lodge his pleading to appropriate first instant court within 30 days from the date of receipt of the decision. 4/ Where the court to which a pleading is submitted pursuant to sub-article (3) of this Article: a) reverses the decision of the Ministry or the appropriate regional organ, the proceeds of the sale shall, after deducting the cost of sales, be paid to the owner of the pulses; or b) upholds the decision, and the owner fails to lodge appeal in a regular court within the time specified in the Civil Procedure Code, after deducting administrative expenses, 40% of the proceed shall be paid to the whistle blower as a commission or if there is no whistle blower to the government security organ seized the pulses and the remaining 60% shall be paid to Government. PART FIVE MISCELLANEOUS PROVISIONS 18. Prohibitions The following acts are prohibited: 1/ engaging in trading of pulses without having a certificate of competence and valid license; 2/ processing pulses, by any person engaged in the pulses trading business, using technical procedure other than those issued by the appropriate sector office; 3/ selling or buying, by any person engaged in the pulses trading business, pulses outside primary transaction centers or the Ethiopia Commodity Exchange; ፰ሺ፱፻፳ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8921 ክፍል አምስት ልዩ ልዩ ድንጋጌዎች ፲፰. የተከለከሉ ድርጊቶች የሚከተሉትን ድርጊቶች መፈፀም የተከለከለ ነው ፦ ፩/ የብቃት ማረጋገጫና የፀና የንግድ ፍቃድ ሳይኖረው የጥራጥሬ ምርቶችን መነገድ፤ ፪/ በጥራጥሬ ምርቶች ግብይት ላይ የተሰማራ ማንኛውም ሰው አግባብ ያለው ሴክተር መሥሪያ ቤት ካወጣው የቴክኒክ አሠራር ውጭ የጥራጥሬ ምርቶችን ማዘጋጀት፤ ፫/ በጥራጥሬ ምርቶች ግብይት ላይ የተሰማራ ማንኛውም ሰው ከመጀመሪያ ደረጃ የግብይት ማዕከል ወይም ከኢትዮጵያ ምርት ገበያ ውጭ የጥራጥሬ ምርቶችን መሸጥም ሆነ መግዛት፤ ፬/ የጥራጥሬ ምርቶችን በማንኛውም አቅራቢ ወይም ጅምላ ነጋዴ ወይም ላኪ ከአንድ የምርት ዘመን በላይ ወይም በማንኛውም ላኪ በዚህ ደንብ አንቀጽ ፱ (፫) ከተመለከተው የጊዜ ገደብ በላይ ማከማቸት፤ ፭/ በጥራጥሬ ምርቶች ግብይት ላይ የተሠማራ ማንኛውም ሰው የጥራጥሬ ምርቶችን እንዲያከ ማች ከተፈቀደለት መጋዘን ውጭ ማከማቸት፤ ፮/ በጥራጥሬ ምርቶች የማጓጓዝ ሥራ ላይ የተሠማራ ማንኛውም ሰው የጥራጥሬ ምርቶችን ንፅህና በጎደለው ሁኔታ ወይም ሕጋዊ የማጓጓዣ ፈቃድ በሌለው ተሸከርካሪ ማጓጓዝ፤ ፯/ በጥራጥሬ ምርቶች ግብይት ላይ የተሰማራ ወይም ከጥራጥሬ ምርቶች ግብይት ጋር በቀጥታም ይሁን በተዘዋዋሪ መንገድ ግንኙነት ባለው ሥራ ላይ የተሰማራ ማንኛውም ሰው ያለአግባብ ጥቅም ለማግኘት ሆነ ብሎ አሳሳች ድርጊት መፈፀም፤ ፰/ ይህንን ደንብ እና ደንቡን ተከትሎ የሚወጡ መመሪያዎችን ያለማክበር፤ ፱/ የሀገሪቱን የጥራጥሬ ምርቶች ግብይት የሚያጎድፍ ማንኛውንም ድርጊት መፈፀም፤ 4/ storing, by any supplier or wholesaler or exporter, pulses for more than one harvest year, or by any exporter for a period exceeding the time limit specified under Article 9 (3) of this Regulation; 5/ storing, by any person engaged in the pulses trading business, pulses outside the authorized warehouse; 6/ transporting, by any person engaged in the pulses transporting business, pulses in a manner that is below the standard of cleanliness or by a person that has no valid transportation permit; 7/ any person engaged in the pulses trading business or person directly or indirectly connected to the pulses trading business, engaging in any deliberate deception for inappropriate benefit; 8/ violating this Regulation and directives issued here under; 9/ engaging in any activity detrimental to trading of pulses; 10/ failing to perform a contract of pulses trading as agreed; 11/ failing to provide information requested by inspector or appropriate organ or providing fraudulent and misleading information. 19. Administrative Penalty Without prejudice to penalties provided for in other relevant law for violations not included in this penalty provisions: 1/ any supplier, wholesaler, retailer, exporter or processor who conducts pulses transaction outside the primary transaction centers or the Ethiopia Commodity Exchange shall, in addition to confiscation of his pulses, be punishable with a fine of Birr 10,000; 2/ any person, who stores pulses outside the authorized storage place or process outside the authorized processing industry shall, in addition to confiscation of the pulses, be punishable with a fine of Birr 7,000; ፰ሺ፱፻፳፩ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8922 ፲/ በገባው ውል መሠረት የጥራጥሬ ምርቶች ግብይት ያለመፈፀም፤ ፲፩/ በተቆጣጣሪ ወይም ጉዳዩ በሚመለከታቸው አካላት የሚጠየቀውን መረጃ ያለመስጠት ወይም የተጭበረበረና የተዛባ መረጃ መስጠት፡፡ ፲፱. አስተዳደራዊ ቅጣት በዚህ የቅጣት ድንጋጌ ውስጥ ያልተካተቱ ጥፋቶች አግባብነት ባላቸው ሌሎች ሕጎች የሚያስቀጡ መሆናቸው እንደተጠበቀ ሆኖ ፦ ፩/ የጥራጥሬ ምርቶች ግዢ ከመጀመሪያ ደረጃ የግብይት ማዕከላት ወይም ከኢትዮጵያ ምርት ገበያ ውጭ የፈፀመ ማንኛውም አቅራቢ፣ ጅምላ ነጋዴ፣ ቸርቻሪ ነጋዴ፣ ላኪ ወይም አቀናባሪ የጥራጥሬ ምርቱን ከመውረስ በተጨማሪ ብር ፲ ሺህ መቀጮ ይቀጣል፤ ፪/ የጥራጥሬ ምርቶችን ከተፈቀደላቸው የማከማቻ ቦታ ውጭ ያከማቸ ወይም ከተፈቀደ የማዘጋጃ ኢንዱስትሪ ውጭ ሲያዘጋጅ የተገኘ ማንኛውም ሰው የጥራጥሬ ምርቱን ከመውረስ በተጨማሪ ብር ፯ ሺህ መቀጮ ይቀጣል፤ ፫/ የጥራጥሬ ምርቶች ጅምላ ንግድ ፍቃድ እና የማዘዋወሪያ ፍቃድ ሳይኖረው የጥራጥሬ ምርቶችን ከአንድ ወረዳ ወደ ሌላ ወረዳ ሲያጓጓዝ የተገኘ ማንኛውም ሰው የጥራጥሬ ምርቱን ከመውረስ በተጨማሪ ብር ፯ ሺህ መቀጮ ይቀጣል፤ ፬/ የጥራጥሬ ምርቶችን ፈቃድ የሌለው ሶስተኛ ወገን ወይም የውጭ ዜጋ ወደ ውጭ አገር መላክ እንዲችል በላኪነት ፈቃዱ ሽፋን የሰጠ ወይም ሁኔታዎችን ያመቻቸ ማንኛውም ላኪ ከጥራጥሬ ምርቱ መወረስ በተጨማሪ የመላኪያ ፍቃዱ ተሰርዞ ብር ፲ ሺህ መቀጮ ይቀጣል፤ ፭/ የመላክ ፈቃድ ሳይኖረው የጥራጥሬ ምርቶችን በመላክ ሥራ ላይ ተሰማርቶ የተገኘ ማንኛውም ሰው ከጥራጥሬ ምርቱ መወረስ በተጨማሪ ብር ፭ ሺህ መቀጮ ይቀጣል፤ ፮/ የጥራጥሬ ምርቶችን የጥራት ደረጃ በሚጎዳና በሚያበላሽ ሁኔታ ያከማቸ ወይም ያጓጓዘ ማንኛውም ሰው ብር ፭ ሺህ መቀጮ ይቀጣል፤ ፯/ የጥራጥሬ ምርቶች ግብይት ላይ ማንኛውንም 3/ any person who transports pulses from one woreda to another without a wholesale license and permit for transportation shall, in addition to confiscation of his pulses, be punishable with a fine of Birr 7,000; 4/ any holder of export license who provides cover and creates conducive environment for third parties having no export license or foreigners to export pulses shall, in addition to confiscation of his pulses and cancellation of export trade license, be punishable with a fine of Birr 10,000; 5/ any person who is engaged in exporting pulses without having valid export license shall in addition to confiscation of his pulses be punishable with a fine of Birr 5,000; 6/ any person, who stores or transports pulses in condition which damage the quality and standard shall be punishable with a fine of Birr 5,000; 7/ any person who performs misleading act on pulses transaction shall, in addition to confiscation of his pulses, be punishable with a fine of Birr 5,000; 8/ any person who violates other provisions of this Regulation or a directive issued for the implementation of this Regulation shall, in addition to confiscation of his pulses, be punishable with a fine of Birr 5,000. 20. Obligation to Cooperate 1/ Any person shall have the obligation to cooperate with the Ministry or with the appropriate regional organ in the implementation of this Regulation. 2/ Police shall provide the necessary assistance to a pulses quality and transaction inspector in seizing pulses subjected to illegal acts. 21. Power to Issue Directives The Ministry may issue directives necessary for the implementation of this Regulation. 22. Transitory provision Any pulses supplier, wholesaler, exporter, or service provider shall continue operating his business using his existing valid business license until he obtains a certificate of ፰ሺ፱፻፳፪ https://chilot.me gA Ød‰L ነU¶T Uz¤È qÜ R ፵፰ የካቲት ፳፭ qN ፪ሺ፰ ›.M Federal Negarit Gazette No. 48 4th March, 2016 ……....page 8923 አሳሳች ድርጊት የፈፀመ ሰው የጥራጥሬ ምርቱ ከመወረሱ በተጨማሪ ብር ፭ ሺህ መቀጮ ይቀጣል፤ ፰/ የዚህን ደንብ ሌሎች ድንጋጌዎች ወይም ደንቡን ለማስፈፀም የሚወጣን መመሪያ የጣሰ ማንኛውም ሰው የጥራጥሬ ምርቱ ከመወረሱ በተጨማሪ ብር ፭ ሺህ መቀጮ ይቀጣል፡፡ ፳. የመተባበር ግዴታ ፩/ ማንኛውም ሰው ይህንን ደንብ በማስፈፀም ረገድ ከሚኒስቴሩ ወይም አግባብነት ካለው የክልል አካል ጋር የመተባበር ግዴታ አለበት፡፡ ፪/ የጥራጥሬ ምርቶች ግብይትና ጥራት ተቆጣጣሪ ሕገ-ወጥ ድርጊት የተፈፀመበትን የጥራጥሬ ምርት ለመያዝ በሚያደርገው እንቅስቃሴ ፖሊስ አስፈላጊውን ድጋፍ ማድረግ አለበት፡፡ ፳፩. መመሪያ የማውጣት ሥልጣን ሚኒስቴሩ ይህንን ደንብ ለማስፈፀም የሚያስፈልጉ መመሪያዎችን ሊያወጣ ይችላል:: ፳፪. የመሸጋገሪያ ድንጋጌ ማንኛውም የጥራጥሬ ምርቶች አቅራቢ፣ ጅምላ ነጋዴ፣ ላኪ ወይም አገልግሎት ሰጪ ይህ ደንብ ከወጣበት ቀን ጀምሮ ባሉት ሁለት ወራት ከሚኒስቴሩ ወይም አግባብነት ካለው የክልል አካል የብቃት ማረጋገጫ የምስክር ወረቀት እስኪያገኝ ድረስ ባለው የፀና የንግድ ፈቃድ ሥራውን ማካሄድ ይችላል፡፡ ፳፫.ተፈፃሚነት ስለማይኖራቸው ደንቦችና መመሪያዎች የሰሊጥና ነጭ ቦሎቄ ግብይት የሚኒስትሮች ምክር ቤት ደንብ እንደተጠበቀ ሆኖ ይህንን ደንብ የሚቃረን ማንኛውም ደንብ ወይም መመሪያ ወይም የተለምዶ አሰራር በዚህ ደንብ በተመለከቱ ጉዳዮች ላይ ተፈፃሚነት አይኖረውም፡፡ ፳፬.ደንቡ የሚፀናበት ጊዜ ፩/ ይህ ደንብ በፌደራል ነጋሪት ጋዜጣ ታትሞ ከወጣበት ቀን ጀምሮ የፀና ይሆናል፡፡ ፪/ የዚህ አንቀጽ ንዑስ አንቀጽ (፩) ድንጋጌ ቢኖርም እያንዳንዱ የጥራጥሬ ምርት ግብይት በዚህ ደንብ ድንጋጌዎች መሠረት በኢትዮጵያ ምርት ገበያ ግብይት መካሄድ የሚጀምርበት ቀን በሚኒስቴሩ ይወሰናል፡፡ competence from the Ministry or the appropriate regional organ within two months from the effective date of this Regulation. 23. Inapplicable Regulations and Directives Without prejudice to the Sesame or White Pea Beans Council of Ministers Regulation, no regulation or directive or customary practice shall, in so far as they are inconsistent with this Regulation, be applicable with respect to matters provided for by this Regulation. 24. Effective Date 1/ This Regulation shall enter into force on the date of publication in the Federal Negarit Gazetee. 2/ Notwithstanding the provisions of sub article (1) of this Article, the date on which the pulses transaction begin to be conducted in Ethiopia Commodity Exchange in accordance with the provision of this Regulation shall be determined by the Ministry.
