SECTION ONE GENERAL 1. Short Title This Regulation may be cited as the “Lead in Paint Control Council of Ministers Regulation No. 429/2018™. 2. Scope of Application i This Regulation shall apply to any pcrson who cngages manufacturing, importing, wholesaling, distributing and in exporting, retailing of paints and products that use lead in paint as an input. SECTION TWO CONCENTRATION OF LEAD IN PAINT 4. Concentration of Lead in Paint i 1/ The total concentration of leads in paint or any’ paint product that uses lead in paint aé an input shall not be abeve 90 parts per million.. 2/ Any person shall not manufacture, import, export, wholesale, distribute or retail paints . with a total lead concentration hlg,her than 90 parts per million. 3/ The Ministry in consultation with approhri'ne organs may review the concentration -of leads in paint or any paint product that uses lead in paint as an input and cause decision by the Standards Agency. 5. Labeling 1/ Any person who manufactures, imports, exports, wholesales, distributes or retails any Icad in paints or products that use lead in paint as an input shall label or cnsurc that the package of the lead in paint or the product has been labeled in - Amharic or in English language in a conspicuous manner about the total concentration of lead. 2/ It is prohibited to manufacture, import, export, wholesale, distribute or retail any lead in paints or products that use lcad in paint as an input without affixing a 1abel. 6Q ¢me£ o.f (lqum m ty Asmmu 1/ Any person who secks to engage in the manufacturing of lead in paint or produets that use lead in paint shall obtain a certificate of conformity assessment from the relevant government organ. SECTION THREE DISPOSAL OF LEAD IN PAINT AND SAFETY MEASURES 7.DISPOSAL OF LEAD IN PAINT 1/ Obsolete paints or products that use lead in paint as an input, or paint and products that use lead in paint as an input which are manufactured or imported after the entry in to force of this shall be - Regulation disposed in an environmentally sound manner. 2/ Principles and techniques of cenvironmentally sound management and disposal of hazardous wastes, as appropriate, shall also be applicable to the disposal of Icad in paint and products that usc lead in paint as an input. 8. Safety measures I/ Any person engaged in the management or production of paints or products that use lead in paint as an input shall take necessary and adequate mceasure to safeguard the health and safety of the workers. 2/ The occupational health and safety requirements provided under the Labor Proclamation shall be applicable to person engaged in the management or production of lead in paints or products that uses lead in paint as an input. 3/ Any person or owncr of building shall have obligation to causc examination of the concentration of lead in paint before demolition of building: and if the lcad concentration in the paints of the building is found above the standard provided n this Rcgulation, adequate safcty mcasure shall be taken or cnsure that adequate safety measures are put in place. MISCELLANEOUS PROVISIONS 9. Administrative Measures licensed produces, imports. wholesales, distributes or retails 1/ When any person lead in paint or product that uses lead in paint as an input which has concentration above the standard provided in this Regulation, competent authority may take the following administrative measures: a) Ban the domestic transaction; product from b) Suspend or cancel the business license of the licensee 2/ The competent authority shall notify to the relevant licensing body the measure taken under sub-article (1) of this Article 10.
