Box ባህር ዳር ሰኔ 24 ቀን 2003 ዓ.ም Bahir Dar 1 st , July 2011 16ኛ አመት ቁጥር 18 16 th Year No 18 16 th Year No 15 www.abyssinialaw.com ገ ጽ - 2 ዝክረ-ህግ ጋዜጣ ቁጥር 18 ሰኔ 24 ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 18 1 st Day of July 2011, P a g e -2 በአማራ ብሔራዊ ክልል የውሃ ሀብትን በአግባቡ የሚጠቀም የግብርና ልማትን ለማስፋት የመስኖ ልማት ሚና ከፍተኛ መሆኑን በመገንዘብ ይህንኑ ተግባራዊ ማድረግ በማስፈለጉ፣ WHEREAS, it has, cognizant of the fact that the role of irrigation development is immense to expand agricultural development capable of utilizing water resources in the Amhara National Region, it has been necessary to implement same; የቆጋ መስኖ ልማት ፕሮጀክት በከፍተኛ የመስኖ ልማት ደረጃ የሚፈረጅና በዘመናዊ የመስኖ ኤክስቴንሽን አሠራር ታግዞ በተደራጁ አርሶ አደሮች የሚተገበር በመሆኑ፣ WHEREAS, the Koga Irrigation Development Project is categorized in the higher level of irrigation development and is to be materialized by organized farmers with the support of modern irrigation extension schemes; የግድቡ ግንባታ ወጪው ከፍተኛ መሆኑን ከግንዛቤ ውስጥ ያስገባና የአካባቢውን አርሶ አደር ያሳተፈ የወጪ መጋራት ሥርዓትን በማመቻቸት በቀጣይ የፕሮጀክቱን ተግባራት ሙሉ በሙሉ ወደ ህብረተሰቡ የማሸጋገርና የማስተዳደር ምቹ ሁኔታዎችን ከወዲሁ መፍጠር በማስፈለጉ፣ WHEREAS, it has, from the very outset, been necessary to create a favorable condition to transfer the project to the community and thereby administer the overall activities by facilitating a cost sharing system that takes the immense expenditure of the dam in to consideration and involves the participation of farmers in the surrounding; በገበያ ላይ ተፈላጊ የሆኑና የተለያየ ኢኮኖሚያዊ ጠቀሜታ ያላቸውን ሰብሎች በዘመናዊ መንገድ በመስኖ እየታገዙ በአመት ከሁለት ጊዜ በላይ በማምረት ምርትና ምርታማነትን ለማሳደግ የሚያስችል አሰራር መፍጠር አስፈላጊ ሆኖ በመገኘቱ፣ WHEREAS, it has been found necessary to create a working mechanism enabling to improve the production and productivity by cultivating crops having various economical advantages with the demand in market more than twice a year through the assistance of modern irrigation; ለዚህም ያመች ዘንድ ፕሮጀክቱን በተገቢው ሁኔታ በማደራጀትና አወቃቀሩን በማሻሻል የተሰጠውን ኃላፊነት መወጣት የሚያስችል ጠንካራና ቀልጣፋ አስፈፃሚ ጽ/ቤት ማቋቋም አስፈላጊ ሆኖ በመገኘቱ፣ WHEREAS, it is henceforth necessary to establish a strong and speedy executive office capable of discharging the responsibilities granted to it by properly organizing the project and reforming its structure thereof; www.abyssinialaw.com ገ ጽ - 3 ዝክረ-ህግ ጋዜጣ ቁጥር 18 ሰኔ 24 ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 18 1 st Day of July 2011, P a g e -3 የአማራ ብሔራዊ ክልል መስተዳድር ምክር ቤት በተሻሻለው የክልሉ ህገ መንግስት አንቀጽ 58 ንዑስ አንቀጽ 7 እና በአስፈፃሚ አካላት እንደገና ማቋቋሚያና ሥልጣንና ተግባራት መወሰኛ አዋጅ ቁጥር 176/2003 ዓ.ም. አንቀጽ 35 ድንጋጌዎች ሥር በተሰጠው ሥልጣን መሰረት ይህንን ደንብ አውጥቷል፡፡ NOW, THEREFORE, the Council of the Amhara National Regional Government, pursuant to the powers vested in it under the provisions of Art. 58 Sub-Art. /7/ of the Revised Regional Constitution and Art. 35 of the Executive Organs’ Re-establishment and Determination of their Powers and Duties Proclamation No 176/2010, hereby issues this regulation. 1. አጭር ርዕስ 1. Short Title ይህ ደንብ ‘‘የቆጋ መስኖ ልማት ፕሮጀክት ጽ/ቤት ማቋቋሚያ ክልል መስተዳድር ምክር ቤት ደንብ ቁጥር 84/ 2003 ዓ.ም’’ ተብሎ ሊጠቀስ ይችላል፡፡ This regulation may be cited as “the Koga Irrigation Development Project Office Establishment, Council of Regional Government Regulation No 84/2011”. 2. ትርጓሜ፣ 2. Definitions የቃሉ አገባብ ሌላ ትርጉም የሚያሰጠዉ ሆኖ ካልተገኘ በስተቀር በዚህ ደንብ ዉስጥ ፦ Unless the context requires otherwise, in this regulation: 1. “ተጠቃሚ” ማለት ኑሮው በግብርና ላይ የተመሠረተና የፕሮጀክት ጽ/ቤቱ በሚያቅፋቸው ቀበሌዎች ክልል የአገልግሎቱና የውጤቶቹ ተጠቃሚ የሆነ ማንኛውም አርሶ አደር ነው። 1. “Beneficiary” shall mean any farmer whose livelihood is based on agriculture, and who obtains benefits out of the services and results there from within the area limit of the kebeles embraced by the project office; 2. ‘‘የቆጋ መስኖ ልማት አካባቢ’’ ማለት በምእራብ ጎጃም ዞን በሜጫ ወረዳ የሚገኙትን ስምንት የቀበሌ አስተዳደሮች የሚያጠቃልለው ሥፍራ ነው። 2. “The Koga Irrigation Development Site” shall mean the area covering those eight kebele administrations located in Mecha Woreda of the West Godjam Zone; 3. ‘‘ቢሮ’’ ማለት የአማራ ብሄራዊ ክልላዊ መንግስት ግብርና ቢሮ ነው። 3. “Bureau” shall mean the Amhara National Regional State Agriculture Bureau. www.abyssinialaw.com ገ ጽ - 4 ዝክረ-ህግ ጋዜጣ ቁጥር 18 ሰኔ 24 ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 18 1 st Day of July 2011, P a g e -4 3. ስለ ቆጋ መስኖ ልማት ፕሮጀክት ጽ/ቤት መቋቋምና ተጠሪነት 3. Establishment and Accountability of the Koga Irrigation Development Project Office 1. በአማራ ብሔራዊ ክልል የቆጋ መስኖ ልማት ፕሮጀክት ጽ/ቤት ከዚህ በኋላ ‘‘ጽ/ቤቱ’’ እየተባለ የሚጠራ ራሱን የቻለና ሕጋዊ ሰውነት ያለው የክልሉ መንግሥት መስሪያ ቤት ሆኖ በዚህ ደንብ ተቋቁሟል። 1. There is here by established, the Amhara National Regional State Koga Irrigation Development Project Office, hereinafter referred to as “the Office” having become an office of the regional government with its own autonomy and legal personality, as per this regulation. 2. የጽ/ቤቱ ተጠሪነት ለቢሮው ይሆናል። 2. The office shall be accountable to the Bureau. 4. አላማዎች 4. Objectives ጽ/ቤቱ በዚህ ደንብ መሠረት የሚከተሉት ዓላማዎች ይኖሩታል፦ The office shall, pursuant to this regulation, have the following objectives: 1. የቆጋ መስኖ ልማት ፕሮጀክት አውታሩን በመንከባከብና አጠቃቀሙን ውጤታማ በማድረግ የተለያዩ ቴክኖሎጂዎችንና የምርት ማሳደጊያ ግብዓቶችን በመጠቀምና ምርታማነትን በማሳደግ በገበያ ላይ ተፈላጊ የሆኑ የተለያዩ ሰብሎችን በአመት ከሁለት ጊዜ በላይ በማምረት የተጠቃሚውን አርሶ አደር የነፍስ ወከፍ ገቢ ማሳደግ 1. To promote the per-capita or household income of the farmer benefitting there from by taking care of the Koga Irrigation Development Project infrastructure and making its utilization effective, by using various technologies as well as production-boosting inputs and thereby enhancing productivity as well as producing a variety of crops, more than twice a year, having demand on markets; 2. የመስኖ ልማት ግንባታው ተገቢው እንክብካቤና ጥገና እንዳይለየው መከታተልና ዘላቂነቱን በማረጋገጥ በቀጣይ ወደ ህብረተሰቡ ሙሉ በሙሉ የሚሸጋገርበትንና የሚተዳደርበትን ሁኔታ ማመቻቸት፣ 2. To follow–up the proper protection and maintenance of the irrigation development construction, ensure its sustainability, and thereby facilitate a condition whereby the project would entirely be transferred to and administered by the community; 5. መደበኛ አድራሻ 5. Principal Residence የጽ/ቤቱ መደበኛ አድራሻ በብሔራዊ ክልሉ ውስጥ በምእራብ ጎጃም ዞን በሜጫ ወረዳ በመራዊ ከተማ ይሆናል። The principal residence of the office shall be in the town of Merawi, Mecha Woreda, West Godjam Zone, within the National Regional state. www.abyssinialaw.com ገ ጽ - 5 ዝክረ-ህግ ጋዜጣ ቁጥር 18 ሰኔ 24 ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 18 1 st Day of July 2011, P a g e -5 6. የተፈፃሚነት ወሰን 6. Scope of Application 1. የPéjKT ጽ/ቤቱ yo‰ wsN bên¾nT böU GDB ከtsÆsb W¦ XNd¸l¥ b¸ጠbqW b8 qbl¤ãC oR b¸gßù 12 BlÖ÷C §Y YçÂL፡፡ 1. The operational scope of the project office shall mainly be in the 12 blocks found under the eight kebeles that are anticipated to be developed by the water accumulated in the Koga dam. 2. በመስኖ ልማቱ የስራ ክልል ውስጥ የሚሰሩ የእንስሳት ሀብትና የተፈጥሮ ሀብት ልማት ስራዎች መደበኛ የወረዳው ግብርና ልማት ጽ/ቤት ስራዎች ሆነው ይከናወናሉ፡፡ 2. Those livestock and natural resource development activities performed in the work area of the irrigation development shall continue being implemented as the normal duties of the Woreda Agriculture Development Office. 7. ድርጅታዊ መዋቅር 7. Organizational Structure ጽ/ቤቱ አስተባባሪ ኮሚቴ፣ አንድ ሥራ አስኪያጅ፣ ለሥራው አስፈላጊ የሆኑ ባለሙያዎችና ድጋፍ ሰጭ ሠራተኞች ይኖሩታል። The office shall have a steering committee, a manager, other professionals and support employees necessary for its duties. 8. ስለ አስተባባሪ ኮሚቴው አሰያየም፣ የስብሰባ ጊዜና የውሣኔ አሰጣጥ ሥነ ስርዓት 8. Designation, Meeting Time and Decision Making Procedure of the Steering Committee 1. ከ7 እስከ 11 የሚደርሱ አባላትን የያዘ የፕሮጀክቱ አስተስባባሪ ኮሚቴ ከዚህ በኋላ “ኮሚቴው” እየተባለ የሚጠራ በዚህ ደንብ ተቋቁሟል። 1. A project steering committee comprising members ranging from 7 through 11, hereinafter referred to as “the Committee”, is hereby established under this regulation. 2. የኮሚቴው ተጠሪነት ለቢሮው ይሆናል። 2. The committee shall be accountable to the Bureau. 3. የኮሚቴው ሰብሳቢና አባላቱ በቢሮ ኃላፊው የሚሰየሙ ይሆናሉ። የፕሮጀክቱ ሥራ አስኪያጅ የኮሚቴው ፀሐፊ ሆኖ ያገለግላል። 3. The chairperson and members of the committee shall be assigned by the Head of the Bureau; the manager of the project shall serve as the secretary of the committee. 4. ኮሚቴው በወር አንድ ጊዜ መደበኛ ስብሰባ ያደርጋል። ሆኖም እንደ አስፈላጊነቱ በማናቸውም ጊዜ አስቸኳይ ስብሰባ ሊያካሂድ ይችላል። 4. The committee shall convene its regular meeting once per a month. It may, however, hold an extra ordinary meeting at any time, as deemed necessary. www.abyssinialaw.com ገ ጽ - 6 ዝክረ-ህግ ጋዜጣ ቁጥር 18 ሰኔ 24 ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 18 1 st Day of July 2011, P a g e -6 5. ከግማሽ በላይ የሚሆኑት የኮሚቴዉ አባላት በስብሰባው ላይ የተገኙ እንደሆነ ምልዓተ ጉባዔ ይሆናል። 5. There shall be a quorum where more than half of the committee members are present at a meeting. 6. የኮሚቴው ውሣኔዎች በድምጽ ብልጫ ያልፋሉ። ሆኖም ድምጹ እኩል ለኩል የተከፈለ እንደሆነ ሰብሳቢው ወሳኝ ድምፅ ይኖረዋል። 6. Decisions of the committee shall pass by majority vote. In case of a tie, however, the chairperson shall have a casting vote. 7. የዚህ አንቀጽ ድንጋጌዎች እንደተጠበቁ ሆነው ኮሚቴው የራሱን ውስጣዊ የስብሰባ ሥነ-ሥርዓት መመሪያ ሊያወጣ ይችላል። 7. Without prejudice to the provisions of this Article hereof, the committee may issue its own internal directive governing meeting procedures. 9. ስለ ኮሚቴው ሥልጣንና ተግባር 9. Powers and Duties of the Committee ኮሚቴዉ በዚህ ደንብ መሰረት የሚከተሉት ስልጣንና ተግባራት ይኖሩታል፦ The committee shall, pursuant to this regulation, have the following powers and duties: 1 የጽ/ቤቱን መዋቅር አስጠንቶ በቢሮው በኩል ለክልሉ መስተዳድር ምክር ቤት እንዲቀርብና ውሣኔ እንዲያገኝ፣ ሲፈቀድም ተግባራዊ እንዲሆን ያደርጋል፣ 1. Have the structure of the office studied, submit same, through the Bureau, to the Council of the Regional Government for decision as well as cause its implementation up on approval thereof; 2 የጽ/ቤቱን የተለያዩ ባለሙያዎች ምደባ ያፀድቃል፤ 2. Approve the assignment of various professionals at the office; 3 በዚህ ደንብ መሠረት ተዘጋጅተው የሚቀርቡለትን ረቂቅ መመሪያዎች መርምሮ ያፀድቃል፤ 3. Examine and approve the draft directives prepared and submitted to it pursuant to this regulation; 4 የጽ/ቤቱን ዓመታዊ የሥራ ዕቅድና የማስፈፀሚያ በጀት ግምገማ ውጤቶች ለክልሉ መስተዳድር ምክር ቤት ያቀርባል፣ ያስወስናል፤ 4. Present the annual work plan and executionary budget evaluation results of the office to and have same decided upon the Council of the Regional Government; 5 ፕሮጀክቱ በታለመለት አግባብ ተግባራዊ ስለመደረጉ በየጊዜው ክትትል ያደርጋል፣ ይገመግማል፣ አፈፃፀሞቹን አስመልክቶ የሩብ ዓመትና ዓመታዊ ሪፖርቶችን ለክልሉ መስተዳድር ምክር ቤት ያቀርባል፤ 5. Follow-up and periodically evaluate as to whether the project is implemented in conformity with its aims as well as submit quarterly and annual implementation reports to the Council of the Regional Government; www.abyssinialaw.com ገ ጽ - 7 ዝክረ-ህግ ጋዜጣ ቁጥር 18 ሰኔ 24 ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 18 1 st Day of July 2011, P a g e -7 6 የጽ/ቤቱን ዕቅድ ለማስፈፀም የሚረዱ የፖሊሲ ሃሳቦችን ያመነጫል፣ ለክልሉ መስተዳድር ምክር ቤት አቅርቦ ያስወስናል። 6. Initiate policy proposals that may help execute the plan of the office as well as submit same to the council of the Regional Government and get decisions thereof. 10. ስለጽ/ቤቱ ሥልጣንና ተግባር 10. Powers and Duties of the Office ጽ/ቤቱ በዚህ ደንብ መሠረት የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፦ The office shall, pursuant to this regulation, have the following powers and duties: 1. የፕሮጀክቱን ማኅበራዊና ኢኮኖሚያዊ መረጃዎች ያሰባስባል፣ ያደራጃል፣ ይተነትናል፣ 1. Gather, organize and analyze the socio-economic data pertaining to the project; 2. የመስኖ ልማቱን የ5 ዓመት ዕቅድ በመርሃ ግብርና በበጀት ሀሣብ አስደግፎ ያዘጋጃል፤ 2. Prepare the 5 year the irrigation development plan by supporting it with the program and budget proposals; 3. ከመስኖ አጠቃቀምና ከመኸር እርሻዎች ጋር በተገናዘበ አኳኋን የራሱን የአካባቢ አጠቃቀም ዕቅድ ያዘጋጃል፣ 3. Prepare its own local use plan in harmony with the irrigation utilization and autumn farms; 4. የዉሃውን የማልማት አቅም መሰረት በማድረግ በየአመቱ ሊለማ የሚችለዉን የመሬት መጠን ይወስናል፤ የአጠቃቀሙን የጊዜ ሠሌዳ ያወጣል፣ አፈፃፀሙን ይከታተላል። 4. Determine the amount of land to be developed per annum depending on the potential power of the water, formulate the utilization time table and follow-up its implementation thereof; 5. ከግድቡ ወደ ማሳ የሚለቀቀዉን ዉሃ በተለያዩ የቦይ ክፍሎች ይልካል፣ ይህንኑ መዝግቦ ይይዛል፣ 5. Release the water from the dam to the farm through the various canals and thereby keep records of same with it; 6. የዉሃ እጥረት ሲከሰት ከግድቡ መለቀቅ ያለበትን የዉሃ መጠን ይወስናል፣ 6. Determine the amount of water to be released where there appears shortage thereof; 7. የሰብሎችን ስብጥር የጊዜ ቀመር ያዘጋጃል፣ በሥራ ላይ እንዲውል ያደርጋል፣ 7. Prepare a time formula for crop diversification and cause same to be implemented; 8. አርሶ አደሩ የተሻሻሉ የአግሮኖሚ አሠራሮችን ሙሉ በሙሉ ተግባራዊ እንዲያደርግ በቅርብ ይከታተላል፣ይደግፋል፤ 8. closely follow-up and support the farmer to fully implement the improved agronomy working procedures; www.abyssinialaw.com ገ ጽ - 8 ዝክረ-ህግ ጋዜጣ ቁጥር 18 ሰኔ 24 ቀን 2003 ዓ.ም Zikre-Hig Gazette No, 18 1 st Day of July 2011, P a g e -8 9. የሰብል ልማት ተጠቃሚውን ማህበረሰብ ያሳተፈ ሆኖ የገበያ አዋጭነትንና የምርት ጥራትን መሠረት ያደረገ የሥራ ዕቅድ ያዘጋጃል፣ ለሚመለከታቸው ሁሉ ያቀርባል፣ 9. Prepare a work plan based on market feasibility and product quality having involved the participation of the community benefitting from the crop development and submit same to the concerned; 10. ተፈላጊውን የግብርና ግብዓት ፍላጐት ይለያል ጥያቄውን ለሚመለከተው አካል ያቀርባል፣ ይከታተላል፣ ምላሹ ለተጠቃሚዎች እንዲደርስ ያደርጋል፣ 10. Identify the needs for the necessary agricultural inputs, submit the request to the concerned body, follow-up and cause the response to be delivered for the beneficiaries; 11. የመስኖ ዉሃ ተጠቃሚዎችን በማህበር ያደራጃል፣ ያጠናክራል፣ የሥራ አፈጻጸማቸዉን ይከታተላል፣ 11. Organize the irrigation water users in cooperatives as well as strengthen and follow-up their implementation; 12. የመስኖ አዉታሮችን አጠቃቀም ይከታተላል፣ ወቅታዊ ጥገና እንዲካሄድላቸው ያደርጋል፣ 12. Follow-up the utilization of irrigation infrastructures and cause the carrying out of their timely repairs; 13. በፕሮጀክቱ አካባቢ የሚመረቱ ሰብሎች በዓይነት፣ በመጠንና የሚደርሱበትን ወቅት በመለየት ከገበያ ጋር በተያያዘ መረጃውን አደራጅቶ ለሚመለከታቸው ያሳውቃል፣ 13. Organize the data concerning those of crops produced in the project area by identifying their type, quantity and harvesting time in relation to market and thereby notify same to the concerned; 14. ለፕሮጀክቱ ሠራተኞችና ለአካባቢው አርሶ አደሮች በፍላጐት ላይ የተመሠረተ ሥልጠና ይሰጣል፣ እንዲሰጣቸው ያደርጋል፣ 14. Render training or cause same to be rendered for the project employees and farmers of the locality on the basis of their respective interest; 15. የመስኖ ልማቱንና የመስኖ አውታሮችን አያያዝና አጠቃቀም አስመልክቶ ለአካባቢው አርሶ አደሮች ተከታታይነት ያለው የግንዛቤ ማስጨበጫ መድረክ ያዘጋጃል፣ ያስተምራል፣ 15. Prepare a continuing awareness creation forum with regard to the handling and utilization of the irrigation development and irrigation infrastructures, and thereby teach farmers in the surrounding thereof; 16. በመስኖ ልማት የሚካሄዱ ተግባራትን በመከታተል ለተገልጋዮች አስፈላጊዉን የሙያ ድጋፍ ያደርጋል፣ 16. Avail professional support necessary for the clients by following-up those activities undertaken using the irrigation development; 17. አዳዲስ ቴክኖሎጅዎችንና አሰራሮችን ለማስተዋወቅ ይቻል ዘንድ የሠርቶ ማሳያ መርሃ ግብሮችን ያካሂዳል፣ እነዚህኑ በስፋት ወደ ልማቱ 17. Put forward commonly-agreed indicative solutions for administrative problems having to do with the implementation of the project in consultation with the concerned stakeholders; 19. ኘሮጀክቱ የተገነባበት ወጭ ከተጠቃሚዎችበወቅቱ ተመላሽ እንዲሆን ያደርጋል፡፡ 19. Cause the construction cost pertaining to the project reimbursed from the beneficiaries on time. 11. የሥራ አስኪያጁ ሥልጣንና ተግባር 11. Powers and Duties of the Manager የጽ/ቤቱ ሥራ አስኪያጅ ተጠሪነቱ ለኮሚቴውና ለቢሮው ሆኖ የሚከተሉት ሥልጣንና ተግባራት ይኖሩታል፣ The manager of the office shall, being accountable to the committee and the Bureau, have the following powers and duties: 1. የፕሮጀክቱን የልማት ሥራዎች በበላይነት ይመራል፣ ያስተባብራል፤ 1. Coordinate and administer the developmental activities of the project; 2. የጽ/ቤቱን ወቅታዊና ዓመታዊ የሥራ ዕቅዶች እያዘጋጀ ለኮሚቴውና ለቢሮው ያቀርባል፣ ያስፀድቃል፣ ዝርዝር የድርጊት መርሃ ግብሮችን ቀርጾ በሥራ ላይ እንዲውሉ ያደርጋል፣ 2. Prepare the periodic and annual work plans of the office, submit them to and have same approved by the committee and the Bureau as well as design specific action plans and cause same to be implemented thereof; 3. የጽ/ቤቱን ሠራተኞች ይቀጥራል፣ ያስተዳድራል፣ ያሰናብታል፤ 3. Hire, administer and dismiss employees of the office; 4. ለጽ/ቤቱ በተፈቀደው የሥራ ፕሮግራምና የማስፈፀሚያ በጀት መሠረት ገንዘብ ወጭ ያደርጋል፤ 4. Disburse money in accordance with the authorized work program and executionery budget of the office; 5. ከሦስተኛ ወገኖች ጋር በሚደረጉ ግንኙነቶች ጽ/ቤቱን ይወክላል፣ 5. Represent the office in all its dealings to be carried out with third parties; 6. የጽ/ቤቱን የሥራ እንቅስቃሴና የፋይናንስ አፈፃፀም አስመልክቶ ወቅታዊ ሪፖርቶችን እያዘጋጀ ለኮሚቴውና ለቢሮው ያቀርባል፤ 6. Prepare periodic reports regarding the activities and financial expenditures of the office and submit same to the committee and the bureau; 7. በዚህ ደንብ ከተሰጡት ሥልጣንና ተግባራት ውስጥ እንደአስፈላጊነቱ የተወሰነውን ለበታች ሠራተኞች 7. Discharge such other tasks in relation to those duties stated above and referred to him by the committee. 12. የቢሮው ልዩ ሥልጣንና ተግባር 12. Special Powers and Duties of the Bureau ቢሮው በብሔራዊ ክልላዊ መንግሥቱ አስፈፃሚ አካላት እንደገና ማቋቋሚያና ሥልጣንና ተግባራት መወሰኛ አዋጅ ቁጥር 176/2003 ዓ/ም አንቀጽ 14 እና በሌሎች ህጐች ሥር የተሰጠው ሥልጣን እንደተጠበቀ ሆኖ በዚህ ደንብ መሠረት የሚከተሉት ልዩ ስልጣንና ተግባራት ይኖሩታል፣ Without prejudice to the powers vested in it under Article 14 of the National Regional State Executive Organs’ Re-establishment and Determination of Powers and Duties Proclamation No 176/2010 and other laws, the Bureau shall, pursuant to this regulation, have the following special powers and duties: 1. የጽ/ቤቱን ሁለገብ እንቅስቃሴዎችና የፕሮጀክቱን አጠቃላይ ክንውን በበላይነት ይከታተላል፣ ይደግፋል፤ 1. Over see and support the multi-faceted activities of the office and the overall accomplishment of the project; 2. ከጽ/ቤቱ አቅም በላይ የሆኑ አስተዳደራዊና ቴክኒካዊ ችግሮችን ከሚመለከታቸው አካላት ጋር በመነጋገር እንዲፈቱ ያደርጋል፤ 2. Cause the resolution of those administrative and technical problems that are beyond the capacity of the office, in consultation with the concerned bodies; 3. የጽ/ቤቱን ዕቅዶች ገምግሞ ያፀድቃል፣ አፈፃፀማቸውን ይከታተላል፤ 3. Evaluate and approve the plans of the office as well as follow-up their implementation thereof; 4. ለጽ/ቤቱ የሚያስፈልገውን የሰው ኃይልና ቁሳቁስ ያሟላል፤ 4. Fulfill the man power and material requirements of the office; 5. የፕሮጀክቱን ሠራተኞች የአቅም ክፍተት በመለየት የአቅም ግንባታ ሥልጠናዎችን ይሰጣል፤ 5. Render capacity building trainings having identified the performance gap of the employees at the office; 6. በጽ/ቤቱ የሰው ኃይል አስተዳደር መመሪያ መሠረት የሠራተኞች መብትና ግዴታ መከበሩን ያረጋግጣል፤ 6. Personnel Administration የጽ/ቤቱ ሠራተኞች ቅጥርና አስተዳደር ከክልሉ ሲቪል ሰርቪስና ከአሰሪና ሠራተኛ ጉዳይ ሕጐች ጋር ተጣጥሞ በሚወጣና በኮሚቴው በሚፀድቅ መመሪያ መሠረት የሚከናወን ይሆናል፡፡ The recruitment and administration of employees of the office shall be carried out on the basis of a subsequent directive to be issued in conformity with the regional civil service and labor laws and approved by the committee. 14. የጽ/ቤቱ የበጀት ምንጭ 14. Budgetary Source of the Office የጽ/ቤቱ በጀት በክልሉ መንግሥት ከሚመደብና ከሌሎች ምንጮች የሚገኝ ይሆናል፡፡ The budget of the office shall be allocated from the Regional Government and secured from other sources. 15. የሂሣብ መዛግብት 15. Books of Account ጽ/ቤቱ የተሟሉ እና ትክክለኛ የሆኑ የሂሳብ መዛግብትንና ሰነዶችን ይይዛል፣ The office shall maintain complete and accurate books of accounts and documents. 16. ስለ ሂሣብ ምርመራ 16. Auditing የጽ/ቤቱ የሂሳብ መዛግብትና ገንዘብም ሆነ ንብረት ነክ ሰነዶች በክልሉ ዋና ኦዲተር መ/ቤት ወይም በውጪ ኦዲተሮች በየጊዜው ይመረመራሉ፡፡ The books of account and financial as well as property-related documents of the office shall be audited by the Office of the Auditor General of the Regional State or by external auditors on periodic basis. 17. ጽ/ቤቱ ስለሚፈርስበት ሁኔታ 17. Dissolution of the Office 1. የፕሮጀክቱ ዋና ተግባር ተጠናቆ የመስኖ ልማት አውታሮቹን ያካባቢው አርሶ አደር ሲረከብ ጽ/ቤቱ ይፈርሳል፤ 1. The office shall be dissolved upon completion of the principal operation of the project and the subsequent handover of the irrigation development infrastructures to the surrounding farmers. 2. በዚህ አንቀጽ ንዑስ አንቀጽ /1/ ሥር እንደተደነገገው ጽ/ቤቱ በሚፈርስበት ጊዜ መብቶቹና ግዴታዎቹ ወደ ቢሮው ይተላለፋሉ። 2. Inapplicable Laws ከዚህ ደንብ ጋር የሚቃረን ማናቸውም ሌላ ደንብ፣ መመሪያ ወይም ልማዳዊ አሠራር በዚህ ደንብ ውስጥ በሚሸፈኑ ጉዳዮች ላይ ተፈፃሚነት አይኖረውም። No other regulation, directive, or customary practice inconsistent with this regulation shall be applicable with respect to matters covered therein. 19. መመሪያ የማውጣት ሥልጣን 19. Power to Issue Directives ኮሚቴው ለዚህ ደንብ ድንጋጌዎች ሙሉ ተፈፃሚነት የሚያስፈልጉትን የተለያዩ መመሪያዎች ሊያወጣ ይችላል። The committee may issue various directives necessary for the full implementation of the provisions of this regulation. 20. ደንቡ ስለሚፀናበት ጊዜ 20. Effective Date ይህ ደንብ ለክልል መስተዳድር ምክር ቤት ቀርቦ ከፀደቀበት ከሰኔ 24 ቀን 2003 ዓ.ም ጀምሮ የፀና ይሆናል። This regulation shall come in to force as of July 1, 2011, on which date it has been approved by Council of the Regional Government. ባህር ዳር Done at Bahir Dar ሰኔ 24 ቀን 2003 ዓ.ም.
